To make arrangements, call (979) 361g4102. r ,ol • COMMISSIONERS' COURT REGULAR MEETING AUGUST 14, 2001 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, August 14, 2001, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; • Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Sims gave the invocation and led the pledge of allegiance. Under citizen input/and or concerns, Mell Pruitt, President of the African American National Heritage Society asked for financial help to build a black history museum for Brazos County. The Court next considered Budget Amendment #00/01-39.1 through 39.6, which would increase funds for the Jail Administration and reallocate funds for the County Clerk, Road • and Bridge, Non-Departmental, Juvenile Services and Jail Administration. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the changes as submitted. 91 914 Page Vol 40 Commissioners' Court meeting August 14, 2001 2 The Court next considered the following Claims as submitted by the County Treasurer for payment: 20021703 through 20021931 On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the Claims as submitted. The Court next considered entering into an Interlocal Agreement with the City of College Station for Emergency Medical Ambulance Service. College Station will provide Emergency Medical Ambulance Services to any person who requests it within the predetermined Automatic Aid Response District for which College Station is assigned responsibility in the Automatic Mutual Aid Agreement between College Station and Bryan. Cost to Brazos County will be $60,000 for fiscal year 2000-2001, $75,000 for fiscal year 2001-2002 and $100,000 for fiscal year 2002-2003. On motion by Commissioner Sims, seconded by Commissioner Thornton, the Court voted unanimously to enter into an Interlocal Agreement with the City of College Station. A copy of the Agreement is attached. The next matter before the Court was the adoption of an Order Creating Justice of the Peace Places Number 1 and 2 in New Justice Precinct 2. This is to become effective at the beginning of the day on January 1, 2002. On motion by Commissioner Sims, seconded by Commissioner Thornton, the Court voted unanimously to adopt the Order Creating Justice of the Peace Places Number 1 and 2 in New Justice Precinct 2. A copy is attached. The Court next considered approval of a lease agreement between Brazos County and S.N.S. Investments, LLC of Brazos County for rental of office space in the building located at 1904 North Earl Rudder Freeway, in Bryan, Texas, for the use of the Justice of the Peace for Precinct 3. Term of the lease Vol a4 Page 29 • r~ Commissioners' Court meeting August 14, 2001 3 is for the period of one year commencing on September 1, 2001 and ending on August 31, 2002. The County agrees to pay to S.N.S. Investments, LLC the amount of One Thousand Two Hundred dollars ($1,200.00) per month. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to enter into lease agreement between Brazos County and S.N.S. Investments, LLC for the period stated above. A copy of the Lease Agreement is attached. The next matter for consideration was a tax refund to the following: a. Samantha Miller and Perry Moore, Jr. - This is the correction of a clerical error in which the account should have been coded as the surviving spouse of an over-age 65 homesteader. Tax refund is in the amount of $1,040.10. b. Mary Sue McRae - This is the correction of a clerical error in which the account should have been coded as the surviving spouse of an over-age 65 homesteader. Tax refund is in the amount of $835.10. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to refund the parties involved, a portion of their city and county taxes for the years 1996 through 2000. • The next matter for consideration by the Court was a written request submitted by the Director of the Metropolitan Planning Office seeking approval for out of state travel for himself. Michael Parks would be traveling to Atlanta, Georgia to attend the 10°° Annual AMPO Conference during the week of September 19 through the 22, 2001. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to grant the request from the Director of the Metropolitan Planning Office and approved payment of out of state travel expense for Michael Parks. Computer and Monitor replacement, County Judge's office $967.00 b. Computer and Monitor replacement, 272"d District Court $1,174.00 C. Computer and Monitor replacement, County Court at Law ##2 $1,174.00 d. Replacement Monitors (10), Information Technology Department $3,710.00 Commissioner Cauley moved to approve. Commissioner Thornton seconded the motion. Commissioner Sims asked if there were funds available for this. Commissioners Jones, Thornton, Sims and the County Judge voted "No". Commissioner Cauley abstained. The motion failed. The next matter for consideration was a requisition from Major Capital Expenditure Funds, Printer Control Inventory, for a printer for the Road & Bridge Department. Commissioner Jones moved to approve. Commissioner Thornton seconded the motion. After some discussion, Commissioner Jones and Thornton withdrew their motion and second. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the requisition but with funding to come from the Road & Bridge Contingency fund. The Court next considered authorizing the purchase and requisition for payment of a used school bus for the Juvenile Services Department. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to authorize the purchase and requisition in the amount of $2,250.00. Commissioner Cauley questioned the funds remaining in capital for vehicles. The Court proceeded to consider a requisition from the District Attorney's Minor Furniture funds for a chair. On motion by Commissioner Jones, seconded by Commissioner Cauley, Vol d4 Page 90 • Commissioners' Court meeting August 14, 2001 5 the Court voted unanimously to approve the requisition in the amount of $254.35. The Court proceeded to consider the following blanket Purchase Order: Lowe's Commissioners Court $1,300 On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the Blanket Purchase Order as submitted. The Court next considered awarding the annual elevator maintenance contract. Pat Howard, Purchasing Agent, recommended acceptance of the only quote received which was submitted by Kone, Inc. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to Kone, Inc. A copy of the tabulation sheet is attached. The Court next considered awarding the following bid: Bid No. 2001-049, Oil Changes Pat Howard, Purchasing Agent, recommended acceptance of the bid submitted by Aggieland Automotive. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to Aggieland Automotive. • The Court next considered the renewal agreement of the West Group CD-ROM Libraries. Pat Howard, Purchasing Agent, recommended reordering from West Group the current subscriptions used by the County and District Attorneys and the District Courts for the 2001-2002 fiscal year. The cost to Brazos County will be $12,150.00. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the Purchasing Agent and approved the renewal agreement of the West Group CD-ROM Libraries. Bid #2002-004, Asphalt, Oil & Emulsion Products, Annual Contract e. Bid #2002-005, Culverts, Various Types, Annual Contract On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the Purchasing Agent to advertise for the previously noted bids. The Court next considered the request from Verizon to construct buried cable installations in the right-of-way of Jack Manning Road beginning at its intersection with Edge School House Road for a distance of 3,306 feet. The site is located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from Verizon and authorized the installation. A copy of the request is attached hereto. The Court next considered an Agreement between the Wellborn Special Utility District and Brazos County on the terms and conditions of waterline installation(s) in the right of way of South Dowling Road in Precinct 1. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the Agreement. A copy is attached. The Court next considered the request from Bryan Texas Utilities to install a powerline/utility pole in the right-of- way of Dilly Shaw Tap Road. The site is located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. A copy of the request is attached hereto. The Court next considered approval of the Final Plat of Dilly Shaw Estates, 64.36 acres in Precinct 2. Richard Vance, County Engineer, stated that he had reviewed the plat and offered the following comments: 1) Change road name from Dilly Shaw Estates Court to Riata Court. • 2) Need to remove portion of lake from the road right- of-way. On motion by Commissioner Thornton, seconded by Commissioner Sims, the Court voted unanimously to approve the final plat of Dilly Shaw Estates, subject to the developer complying with the exceptions noted by the County Engineer The next matter for consideration was the establishment of a date and time for a public hearing regarding the proposed budget for Fiscal Year 2002. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to set 9:00 a.m. on Friday, August 24, 2001 as the date and time for the public hearing regarding the proposed budget for fiscal year 2002. The hearing will be held in the 361" • District Courtroom. The Court next considered a proposal to increase tax revenues. On motion by Commissioner Thornton, seconded by Commissioner Jones, the Court voted unanimously to increase tax revenues. The next matter for consideration was the establishment of a date and time for a public hearing regarding a tax increase. Under announcement of interest items and possible future agenda topics the County Judge made the following comments: a) Tonight, a redistricting meeting will be held with the Bryan City Council. b) According to the Emergency Management Coordinator, the drought index has gone from 548 to 575. c) The Juvenile Board has established a Juvenile Justice Alternative Education Program. There was no citizen input and/or concerns. The County Judge presented the proposed county budget for fiscal year 2002. He outlined salary increases which includes merit increases, and longevity pay, purchasing vehicles, the 1C tax increase and the reasons for it, At 9:58 a.m. the County Judge announced the meeting closed to the public so that the Court could meet in closed executive session to discuss the acquisition of real property for the Exposition Center as allowed under Section 551.072 of the Texas Government Code. At 10:42 a.m. the County Judge announced the meeting open to the public and that no action would be taken on the Executive Session. There being no further business to come before the Court, the meeting was adjourned. Jones Judge, Brazos County 300 E. 260' Street Bryan, TX 77803 Dear Judge Jones: Enclosed is the Interlocal Agreement executed between the City of College Station and Brazos County pertaining to the delivery of Emergency Medical Services to unincorporated areas of Brazos County. During its August 23, 2001 meeting the College Station City Council approved the Interlocal Agreement for the current fiscal year and fiscal year 2001 - 2002. The City Council did not approve the Interlocal Agreement for fiscal year 2002 - 2003. College Station City Council cited the following stipulations pertaining to year three of the agreement. 1. We feel it would be fair and equitable for Brazos County to share in any potential liability the City of College Station may incur while providing Emergency Medical Services to unincorporated areas of Brazos County. The Interlocal Agreement as written does not clearly identify Brazos County sharing in any potential liability. 2. The second item discussed by Council was "fair share funding." The core issue is the county's willingness to come to the table and pay their fair share of the cost of service. Residents of College Station should not be required to subsidize the cost of Emergency Medical Services to residents living within the unincorporated areas of Brazos County. Early in the negotiations process the Fire Chiefs of both College Station and Bryan provided documentation of the county call volume in relation to city calls. On average the county counts for ten percent of our EMS call volume. It appears our request is fair and equitable for Brazos County to participate at a funding level equal to a minimum of ten percent of the city's EMS operating budget. This current year the fire department EMS budget is $1,655,000. In fiscal year 2001 - 2002 the EMS budget is projected to be $1,755,000. As clearly indicated the county offer falls well short of the ten percent we are requesting. Home of Texas A&M University 04~~ • It is our hope we can continue negotiations over the next twelve months that provide for fair share funding and a resolution to liability issues. The City of College Station has enjoyed working with and providing services for Brazos County. The City of College Station is prepared to continue services to the unincorporated areas of Brazos County upon successful conclusion of the negotiation process. However, in the event further negotiations are not successful the City of College Station will have to review its options regarding future delivery of Emergency Medical Services to unincorporated areas of Brazos County. It is our intent to work in partnership with Brazos County while insuring a fair and equitable agreement that provides Emergency Medical Services at a reasonable cost to all parties involved. I am prepared to discuss the above mentioned items with you at any time. I would like to recommend we meet early in January 2002 to insure we can include any modifications to the agreement in our 2002 - 2003 budgets. College Station shall provide Emergency Medical Ambulance Services to any person who requests it within the predetermined Automatic Aid Response District for which College Station is assigned responsibility in the Automatic Mutual Aid Agreement between College Station and Bryan. (See Exhibit "A", an attached map of the Automatic Mutual Aid Response Districts.) 2. All requests for services under this Agreement shall be through the 9-1-1 Emergency Communications District, which dispatches police and fire units for College Station and County. 3. College Station reserves the right to refuse to answer any call pursuant to this Agreement if the Fire Chief or his or her designee reasonably determines that the he" safety, or welfare of College Station citizens would be endangered by dispatching personnel or equipment outside of its corporate limits. 4. College Station will maintain emergency medical equipment and licensed personnel in compliance with Subchapter C of Chapter 773 Health & Safety Code and the regulations promulgated by the Texas Department of Health and adhere to the standards set forth therein. The parties shall use their best efforts to replace the respective provisions or provisions of this Agreement with legal terms and conditions approximating the original intent of the parties. No Amendment to this Agreement shall be effective and binding unless and until it is reduced to writing and signed by the authorized representatives of all parties. lb. This Agreement has been made under and shall be governed by the laws of the State of Texas. This Agreement and all matters related thereto shall be performed in Brazos County, Texas. The venue of any lawsuits arising out of this Agreement shall be in Brazos County, Texas. 17. Failure of any party at any time, to enforce a provision of this Agreement, shall not constitute a waiver of that provision, nor in any way affect the validity of this Agreement or the right of any party thereafter to enforce each and every provision hereof. No term of this Agreement shall be deemed waived or breach excused unless the waiver shall be in writing and • signed by the party(ies) claimed to have waived. Furthermore, any consent to or waiver of a breach will not constitute consent to or waiver of or excuse of any other different or subsequent breach. 18. It is understood and agreed that this Agreement may be executed in a number of identical counterparts, each of which shall be deemed an original for all purposes. and WHEREAS, the abolition of the current justice precincts and the creation of new justice precincts by Order No. T will create vacancies of office in all the justice of the peace and constable positions in each of the new justice precincts; and WHEREAS, incumbent justices of the peace and constables are entitled under Texas Constitution Article V, Section 18(c), as amended, to serve out the remainder of the terms of office to which they have been previously elected notwithstanding that the precinct from which they were elected has been abolished; and that such remaining terms of office are to be served in the new justice precincts in which the said incumbent justices of the peace will then reside; and WHEREAS, a commissioners court has the authority under Texas Constitution Article V, Section 18(c) to create multiple justice of the peace positions in a justice precinct; and WHEREAS, the Commissioners Court of Brazos County has authority and discretion under Texas Constitution Article V, Sections 18(c) and 28, and Texas Local Government Code Sections 87.041(a) & (c) (Vernon 1999), to appoint properly qualified persons of its choice to the vacancies in the offices of justices of the peace and constables created by the Court's Order No. H~ and WHEREAS, under Texas Constitution Article V, Section 18(c) the persons appointed to fill such vacant offices shall serve a term of office until the person elected at the next general election shall take office; and • WHEREAS, the Texas Constitution Article XVI, Section 65, was amended by the voters of the State of Texas in 1999, and no longer expressly requires that the terms of office of multiple justice of the peace positions in a single justice precinct be staggered in time as to each other, requiring the initial term of office of one of such a pair of positions be only two (2) years' duration; Provided however, should the cost of repairing or restoring any buildings or improvements so • damaged or destroyed exceed twenty-five percent (25%) of the replacement cost of all buildings and improvements now located on the leased premises, or if more than fifty percent (50%) of the total floor space of the leased premises be rendered unfit for Lessee's occupancy, this lease may be terminated by either party by ten (10) days written notice. If less than fifty percent (50%) of the total C floor space ofleased premises shall be uninhabitable and repair and restoration can be accomplished within ninety (90) days, Lessor may, at his option, either repair and restore the damaged buildings and improvements or cancel this lease and return any unearned rent previously paid by Lessee under this lease. CONDITION OF PREMISES Lessee stipulates that the leased premises, as well as all buildings and improvements located thereon, are at the date of this lease in good order, repair and a safe and clean condition. UTELITIES All charges for electricity, water and other utility services shall be paid by Lessor. IMPROVEMENTS A] I alterations, changes and improvements built, constructed or placed in the leased premises by Lessee, other than movable personal property, shall, unless otherwise provided by written agreement between Lessor and Lessee, be the property of Lessor and remain in the leased premises at the expiration or sooner termination of this lease. Lessee, at the termination of this lease, shall not be required to restore the improvements to their original condition. Nothing contained in this paragraph, however, shall authorize Lessee to make or place any such alteration, change or improvements on the leased premises without having first obtained the written consent of Lessor. ASSIGNMENT AND SUBLETTING Lessee shall not assign this lease nor sublet the leased premises or any interest therein without first obtaining the written consent of Lessor, which consent shall not be unreasonably withheld. A consent by Lessor to one assignment or subletting shall not be deemed to be a consent to any subsequent assignment or subletting. An assignment or subletting without the written consent of Lessor, shall be void and shall, at the option of the Lessor, terminate the lease. LESSEE'S RIGHT TO PERFORM In the event Lessor violates or fails to perform any provisions or agreements of the lease to be performed or complies with by Lessor, and such violation or failure continues for fifteen (15) • days after written notice thereof to Lessor, Lessee may, in addition to all remedies available to it, be entitled to perform on behalf of Lessor and deduct all such payments from the rent. DEFAULT BY LESSEE Should Lessee be in default for a period of more than ten (10) days in the payment of any rent payable under this lease or in the performance of any other provision of this lease and such default continues for thirty (30) days after written notice, Lessor may terminate this lease and regain possession of the leased premises in the manner provided by the laws of the State of Texas in effect at the date of such default. HOLD OVER At the expiration of this lease, should Lessee hold over for any reason whatsoever, it is hereby agreed that, in the absence of a written agreement to the contrary, such tenancy shall be from month to month only under the same conditions and at the same monthly rental as provided herein. • SUBORDINATION OF LEASE This lease and Lessee's leasehold interest under this lease are and shall be subject, subordinate, and inferior to any lien or encumbrance now on the leased premises by Lessor. RIGHT OF INSPECTION Lessor and his agents have the right at all reasonable times during the terms of this lease to enter the leased premises for the purpose of inspecting them and all buildings and improvements thereon, provided, however, that the right of inspection shall not exceed to any record, the disclosure of which is prohibited by law. Co ssio r ny Jones County Engineer Precinct 1 0001-075 Approved E6 Denied ❑ by Commissioners' Court Date: ~ - - nt Alvin W. ones, Coun Judge • '#®L,2 is COUNTY OF BRAZOS STATE OF TEXAS WATER UNE RIGHT OF WAY AGREEMENT SOUTH DOWLING ROAD WHEREAS, Wellborn Special Utility District, successor to Wellborn Water Supply Corporation heretofore acquired a water line easement upon private property for the construction of its water distribution line along but inside the private property fence line marking the Westerly right of way line of South Dowling Road, Brazos County, Texas, and WHEREAS, at a later date In time, the County widened the right of way of South Dowling Road and the relocation of the fence line included the water line easement and water pipeline within the road right of way, as aRered; and WHEREAS, Wellborn Special Utility District is entitled to rely upon its private easement and therefore to be reimbursed for any cost required for relocating its water line and to require its line be placed within a new private easement inside the fence of the adjoining owner, and WHEREAS, County of Brazos is desirous of not acquiring additional private property for relocating such line, instead to relocate such fine as required for a current road improvement project all within the current road right of way, In consideration for Wellborn Special Utility District's agreement and consent to leave the water line, as re-located, within the current road right of way and reducing the cost to the County of acquiring a new private easement by eminent domain or otherwise, the County of Brazos hereby expressly agrees as follows: 1. At any such time in the future that ri becomes necessary that the water line left inside the road right of way be removed to provide for other county improvements or meet any requirements imposed by law or ordinance, the County of Brazos will assume the full cost of relocating such line, labor and material , for the distance of three thousand five hundred (3,500) feet and acquire private property easements for such line at whatever cost may be required by use of negotiated purchase or eminent domain. 2 Wellborn Special Utility District, or its successors in interest, are hereby acknowledged to be the owners of said current line and a legally enforceable easement within which it is constructed and may not be required to remove the line or relocate it without full and complete reimbursement for such cost. 3 At any such time in the future that Wellborn Special Utility District chooses to change or upgrade the water line left inside the road right of way and if the County of Brazos is successful in securing a private easement for Wellborn Specaal Utility District at that time, Wellborn Special Utility District will assume the cost to move the water line Into private easement. The Brazos County Investment portfolio earned a weighted average yield of 5.489% for the quarter ending 06/29/01. Total interest deposited during the quarter was $363,196.57. The weighted average maturity of the invested funds was 37.62 days-for the total portfolio. This average included the one-day to two-day availability of the funds that were invested with TexPool. (Note: On July 10, 2000, Brazos County purchased a callable coupon note with the maturity date of July 10, 2002 callable at par on July 10, 2001. Although, the Federal Reserve maycall the note in on July of 2001, for the purpose of this report, all calculations of weighted average maturity and yield are based on the actual maturity date of July 2002.) At quarter end, Brazos County had an investment cost of $30,001,505.05 that carried a book value of $30,160,961.04. Merrill Lynch of Houston and the June 2001 TexPool Newsletter provided the 06/29/2001 total market value of $30,192,767.56. The Brazos County Investment portfolio had an unrealized gain of $31,806.53 for the quarter end. As interest rates continue to be reduced by the Federal Reserve (six times since January 2001), the County's investment yield will continue to fall. Higher yielding investments that are beginning to mature will have to be reinvested at much lower interest rates.
