COMMISSIONERS' COURT
REGULAR MEETING
MAY 29, 2001
•
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, May 29, 2001, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Reverend Jones gave the invocation and Commissioner Jones
led the pledge of allegiance.
There was no citizen input/and or concerns.

Because of time constraints, the County Judge deviated
from the agenda to consider item 26 announcement of interest
items and possible future agenda topics. He made the
following comments :
a) The State Legislature has adjourned. HB
1784 did pass. Both the Water District
and Water bill passed.
b) The Magistrate bill also passed.
c) HB 1925 was amended by Staples to
eliminate the county's ability to
restrict guns in buildings like the
courthouse.
d) Dick Forester has submitted his
resignation and will be taking a job in
Topeka, Kansas.
The County Judge read aloud a Proclamation designating
the month of June as "Relay for Life Month". The Court joins
with the local American Cancer Society in celebrating life and
urging all citizens to participate in the Relay events. On
motion by the County Judge, seconded by Commissioner Sims the

Court moved to proclaim the month of June 2001 as "Relay for
Life Month" throughout Brazos County. The County Judge then
presented the signed Proclamation to Ms Laura Ampol-Hall,
representing the local American Cancer Society.
The County Judge read aloud a Proclamation designating
Sunday, June 2, 2001 as "National Cancer Survivors Day in
Brazos County". The Court joins with the Oncology Nurses
Association and the Central Texas Cancer Center in the joyous
celebration of life. On motion by the County Judge, seconded
by Commissioners Jones, Thornton, Sims and Cauley, the Court
moved to proclaim Sunday, June 3, 2001 as "National Cancer
Survivors Day" throughout Brazos County. The County Judge
then presented the signed Proclamation to Ms Edwina Ramczyk,
representing the local Oncology Nurses Association and the
Central Texas Cancer Center.
The Court next considered a request by Justice of the
Peace, Precinct 3, for reclassification of a Clerk III
position. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the reclassification of a Clerk III position.
There were no budget amendments to consider.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
7submitted by the County Treasurer for payment:

On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Claims as
submitted.

The Court next considered a Proclamation honoring
Marijane (MJ) Deen for her exemplary service to the County. On
motion by the County Judge, seconded by Commissioners Jones,
Thornton, Sims and Cauley the Court moved to extend its best
wishes to Mrs. Deen. The County Judge will read the
Proclamation and present it to Mrs. Deen at the reception to
be held in her honor at 2:00 p.m. this afternoon.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to execute a Tax Resale Deed to Lakewood Estates for the
following property:
Track #3: Lot 11, Block 2, Lakewood Estates
Subdivision, Brazos County, Texas
The next matter for consideration by the Court was a
request submitted by the County Judge seeking approval for
out of state travel for himself. The Judge would be traveling
to Omaha, Nebraska to attend the "National Association of
Regional Councils Conference" during the week of June 1"
through the 6`h, 2001. On motion by Commissioner Jones,
seconded by Commissioner Cauley, the Court voted unanimously
to grant the request from the County Judge and approved
payment of out of state travel expense for him.
The next matter for consideration by the Court was a
written request submitted by the Ag Extension Agent seeking
,approval for out of state travel for himself. C. Jack Hunter
would be traveling to Albuquerque, New Mexico to attend the
"National Association of County Agricultural Agents Annual
Meeting" seminar during the week of August 5th through the
11`h, 2001. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to grant the
request from the Ag Extension Agent and approved payment of
out of state travel expense for C. Jack Hunter.

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered the renewal of the contract
with McCreary, Veselka, Bragg and Allen for collection of
delinquent property taxes. The addendum is to renew the
contract for an additional one (1) year period. On motion by
Commissioner Sims, seconded by Commissioner Cauley, the Court
voted unanimously to renew the contract with McCreary,
Veselka, Bragg and Allen for collection of delinquent property
taxes. A copy is attached.
The Court next considered awarding the following Request
for Proposals:
RFP No. 2001-041, Mobile Computers, Radios and
Mounting System
Pat Howard, Purchasing Agent, recommended
acceptance of the RFP submitted by L&E
Mobile Computers. On motion by
Commissioner Sims, seconded by
Commissioner Cauley, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to L&E Mobile Computers. A copy
of the bid tabulation is attached.
The Court next considered awarding the following bid:
Bid No. 2001-042, Temporary Employment Services
Pat Howard, Purchasing Agent, recommended
acceptance of the bid submitted by Talent
` Tree as the Primary Vendor and Human
Resource Connection as the Secondary

Commissioner Sims, seconded by
Commissioner Thornton, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract as noted. A copy of the bid
tabulation is attached.

The Court next considered authorizing work outside of

county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Walter Wilcox on
Wilcox Lane to stock pile road material to be used for
improvements to county roads. On motion by Commissioner
Thornton, seconded by Commissioner Jones, the Court voted
unanimously to authorize the work.
The Court next considered the request from TXU Electric
& Gas to construct a road bore in the right-of-way of Greens
Prairie Road West to install a 2 inch natural gas main. to
service Turnberry Place Subdivision in Precinct 1. The County
Engineer stated that all appeared to be in order and
recommended approval. On motion by Commissioner Jones,
seconded by Commissioner Thornton, the Court voted unanimously
to approve the request from TXU Electric & Gas and authorized
the installation. A copy of the request is attached hereto.
The Court next considered approval of the Final Plat of
River Place Subdivision Phase Two in Precinct 1. Richard
Vance, County Engineer, stated that he had reviewed the plat
and all appeared to be in order. On motion by Commissioner
Jones, seconded by Commissioner Cauley, the Court voted
unanimously to approve the final plat of River Place
Subdivision Phase Two as submitted.
The Court next considered approval of the Final Plat of
Hunter's Creek Subdivision Lots 1-27, Block One, Lots 1-17,
Block Two in Precinct 3. Richard Vance, County Engineer,

stated that he had reviewed the plat and offered the following
comments:
1) Need volume and-page of Marcon's Subdivision.
2) Finish "Reference Monument" note.
3) Floodplain notes need full panel number.
4) ' Show cul-de-sac right-of-way at 100 feet.
5) Correct overlapping notations on Hunter's
Cove.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the final plat
of Hunter's Creek Subdivision Lots 1-27, Block One, Lots 1-17,
Block Two subject to the developer complying with the
exceptions noted by the County Engineer.
The Court next considered approval of the Final Plat of
Turnberry Place Subdivision in Precinct 1. Richard Vance,
County Engineer, stated that he had reviewed the plat and
offered the following comment:
6) Add notation for 100 feet diameter at cul-de-
sac.
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the final plat
of Turnberry Place Subdivision subject to the developer
complying with the exception noted by the County Engineer.
The Court next considered approval of the Re-Plat of Lot
1R, Block 1 of Withers Subdivision in Precinct 3. Richard
Nance, County Engineer, stated that he had reviewed the plat
and all appeared to be in order. On motion by Commissioner
Sims, seconded by Commissioner Cauley, the Court voted
unanimously to approve the re-plat of Lot 1R, Block 1 of
Withers Subdivision as submitted.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to receive, approve and
order filed as submitted the Treasurer's report for April

There was no citizen input and/or concerns.
At 9:35 a.m. the County Judge announced the meeting
closed to the public so that the Court could meet in Closed
Executive Session to discuss the acquisition of real property
as allowed under Section 551.072 of the Texas Government Code.
At 9:38 a.m. the County Judge announced the meeting open
to the public and announced that the Court would recess and
reconvene on Wednesday, May 30, at 11:00 a.m.
Commissioner Cauley asked if we had a contract yet with
The Software Group. He said chat we had a contract with the
consultants on peripherals and also that we needed to have a
workshop to discuss it. *Commissioner Sims informed the Court
that Jason Muesse had been the recipient of the County Judges
and Commissioners Association Past Presidents scholarship in
the amount of $5,000.00.
Judge Langley informed the Court that the bill concerning
Court Appointed Attorneys will have some impact here. If an
inmate is indigent, he has to have a Court Appointed Attorney
within 72 hours of being jailed. The bill concerning racial
profiling requires the county to have video equipment in
vehicles running at all times. Funding for this may be a
,problem. There are some grant funds available but not enough
to cover the expense of $5,000 per vehicle. The County Judge
asked Judge Langley about HB 1925 whereupon Judge Langley
replied that he would know more about that by this afternoon.
The County Judge recessed the Commissioners Court meeting
•
until Wednesday, May 30, 2001.
The County Judge reconvened the Commissioners Court
meeting of May 29, 2001 at 11:00 a.m. on May 30, 2001. At
11:07 a.m. the County Judge announced the meeting closed to

the public so that the Court could meet in Closed Executive
• Session to discuss the acquisition of real property as allowed

the meeting was adjourned.

ADDENDUM NUMBER ONE
TO THE CONTRACT FOR
COLLECTION OF DELINQUENT PROPERTY TAXES
THIS CONTRACT ADDENDUM is made and entered into by and between THE COUNTY OF
BRAZOS, TEXAS (The County), acting herein by and through its governing body, and
MCCREARY, VESELKA, BRAGG AND ALLEN, P.C. (The Firm), 5929 Balcones Drive, P. O.
Box 26990, Austin, Texas 78755, pursuant to the provisions of the contract dated June 27, 2000,
between these parties. ,
This contract addendum is executed to renew said contract for an additional one (1) year period
beginning July 1. 2001 and ending June 30, 2002, upon the same terms and conditions as the original
contract.
This contract is executed on behalf of The County by the County Judge who is authorized to execute
this instrument by order heretofore passed and duly recorded in the minutes of the Brazos County
Commissioners Court.

1) No work will be permitted between front slope and/or back slope.
2) All installation(s) shall be constructed in designated utility easements. if aonlicable. If no utility
easement exists, the Installation(s) shall be 1) within 3-5' of and parallel to the right-of-way line
and/or 2) in the case of a road bore, perpendicular to the right-of-way line.
3) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right-of-way.
4) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test
shall be conducted by an independent Geotechnical testing firm; copies of all test results shall be
furnished to the office of the Brazos County Engineer.
5) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of Transportation,
and all other State and Federal laws governing utility construction.

REQUEST FOR PROPOSED INSTALLATION IN COUNTY RIGHT-OF-WAY
TO THE COMMISSIONERS' COURT OF BRAZOS COUNTY, TEXAS

Formal notice is hereby given that (applicant) Txu Elec. & Gas proposes ~yj/
place a (type)2" Gas Linwithin the right-of-Way of (road) Greens Prairie RJIA44
Brazos County, Texas as follows:
•
The location or description of the proposed installation is more fully shown by
copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning of
construction in order that he, or his designated inspector, may inspect the
actual installation.
2. * All damage to the roadways and rights-of-way will be repaired to their
original condition to the satisfaction of the County Engineer.
3. Brazos County reserves the right to require Applicant to relocate or lower
any such line at no cost to Brazos County, should same become
necessary due to widening or lowering, or other alteration of the roadway
or right-of-way.
4. Brazos County will in no way be responsible for any damage which might
occur to any existing utility lines in the right-of-way.

5. The line will be constructed and maintained on the County right-of-way in.
accordance with the Utility Accommodation Policy which was adopted by the
Texas Department of Transportation on May 29, 1989.
6. The line or lines will be constructed no less than twenty-four inches (24") lower
than the lowest part of the drainage or bar ditch and the drainage is to be
considered at least two feet (2') below the center of the roadway.
7. All sites will be barricaded during the construction period.
Construction of this line will begin on or after the lAtiiay of June , 2021 .
