To make arrangements, call (979) 361-4102. , o23 5a ~.zxwr~^~.:ri'Z-- ' OFT",- y COMMISSIONERS' COURT REGULAR MEETING MAY 8, 2001 A regular meeting of the Commissioners' Court of Brazos • County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, May 8, 2001, with the following members of the Court present: Alvin W. Jones,.County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Sims gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns. The County Judge read aloud a Proclamation designating • the month of May 2001 as "Elder Abuse Prevention Month in Brazos County". The Court urges all citizens to work together to help reduce abuse and neglect of people who are elderly or have disabilities. On motion by the County Judge, seconded by Commissioners Jones, Thornton, Sims and Cauley, the Court moved to proclaim the month of May 2001 as "Elder Abuse Prevention month" throughout Brazos County. The County Judge then presented the signed Proclamation to Ms. Mandy Jenkins, representing the Texas Department of Protective and Regulatory Services. The Court next considered Budget Amendment #00/01-27.1 through 27.3, which would transfer funds to the Appellate Judicial Fund from Contingency, and reallocate funds for the County Attorney Comprehensive Underage Drinking Enforcement • Program Grant and the 85`n District Court. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court Vol 013 Page 6 Commissioners' Court meeting May 8, 2001 2 voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the changes as submitted. The Court next considered authorizing the Auditor's office to process the recurring payment request for the following: a) Cross Creek Manor, LLC for residential treatment services for Juvenile Offenders $3,490 per month. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to authorize the Auditor's office to process the previously noted recurring payment. The Court- next considered the following Claims as submitted by the County Treasurer for payment: 20018512 through 20018737 On motion by Commissioner Jones, seconded by Commissioner r Thornton, the Court voted unanimously to approve the Claims as submitted. The Court next considered approval of a Revision to Article III of the Bryan-College Station Economic Development Corporation Bylaws. On motion by Commissioner Cauley, seconded by Commissioner Jones, the Court voted unanimously to approve the revision to Article III of the Brya-College station Economic Development Corporation Bylaws. A copy is attached. The court next considered a request by the County Attorney for renewal of the contract with Database Technologies, Inc. There have been no changes to the current contract. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to Vol 623 Page 5cZ P' Rt i t r r X p i 1Ab Commissioners' Court meeting May 8, 2001 3 renew the contract with Database Technologies, Inc. for six (6) months. A copy is attached. On motion by Commissioner Cauley, seconded by 'Commissioner Sims, the Court voted unanimously to authorize the County Judge to execute a Tax Resale Deed to the following individual: Charlie Manley, Sr. and Lyvonne Manley - Lot 21, Block 1, James Addition, City of Bryan, Brazos County, Texas. The Court next considered a request from Constable Precinct 6, Phil Sikes, to appoint Mark Kalhofer as unpaid Reserve Deputy Constable. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from Constable Sikes to appoint Mark Kalhofer as unpaid Reserve Deputy Constable subject to appointment being within the allotted number of deputies. • The Court next considered authorizing payment of $333.00 in travel expenses for Walter Wilcox to attend the Texas Association RC&D Annual Conference in Wichita Falls, Texas, April 17-19, 2001. Commissioner Thornton pointed out a calculation error that would reduce the payment amount to $308.00. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize payment of $308.00 in travel expenses for Walter Wilcox. The Court next considered a request from the I.T. Department to expend Capital Improvement funds to purchase a modification to the Oasys J.P. software package. This expenditure was requested by the Auditors office. On motion • by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to authorize the expenditure of $405.00 from Capital improvement funds- to purchase a modification to the Oasys J.,P.;software package. The next matter before the Court was a requisition from Certification of Obligation funds for the purchase of a replacement copier for the County Judge's Office. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to authorize the expenditure of $2,971.00 from Certification of Obligation funds for the purchase of a replacement copier for the County Judge's Office. The Court next considered an amendment to the contract with NTS Communications long distance service for a one year extension. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to amend the contract with NTS Communications. A copy is attached. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Annetta Williams on Kuder Road in Precinct 4 to clear a 900 blind curve located on Kuder Road approximately 0.25 mile from its intersection with State highway 21 to create better site distance. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to authorize the work. The Court next considered approval of the Amending Plat of Lot 1 Precinct 3 Fire Department. Richard Vance, County Engineer, stated that he had reviewed the plat and all appeared to be in order. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to receive, approve and order filed as submitted the Treasurer's report for March 2001. A copy of which is attached to and made a part of these minutes. Under announcement of interest items and possible future agenda topics the County Judge made the following comments: a) The budget time line has been established. Worksheets will go out to the departments on May 23, 2001. b) A redistricting meting has been scheduled for May 16, 2001 at the Brazos Center. The county meeting will be from 1:00 p.m. to 3:00 p.m. The City of Bryan meeting will be from 4:00 p.m. until 6:00 p.m. and the Bryan ISD meeting will be from 7:00 p.m. until 9:00 p.m. c) There will be an Appraisal Board meeting on May 21, 2001 at 9:00 a.m. to discuss procedures for electing appraisal board members. The meeting will be held at the Appraisal Office. There was no citizen input and/or concerns. At 9:25 a.m. the County Judge announced the meeting closed to the public so that the Court could meet in Closed Executive Session to discuss personnel as allowed under Section §551.074 of the Texas Government Code and to discuss acquisition of real property as allowed under Section §551.072 of the Texas Government Code. At 10:09 a.m. the County Judge announced the meeting open to the public. On the matter of personnel, the County Judge stated interviews for the Executive Assistant and VA Officer positions will begin within the week. Then on motion by Commissioner Sims, seconded by Commissioners Jones, Thornton and Cauley, the Court voted Vol a3 Page 5S Commissioners' Court meeting May 8, 2001 6 unanimously to approve the final offer submitted to Delvin Barrett on April 2, 2001 for right-of-way for the widening of Democrat Road. APPOINTMENT AND QUALIFICATIONS OF DIRECTORS • • BACKGROUND - Article III of the B-CS EDC Bylaws covers "Appointment and Qualifications of Directors". Under this article, one of the three appointees representing the City of Bryan, City of College Station and Brazos County shall be an elected member of City Council or Commissioners' Court. The Article further articulates that at such time the appointed elected representative should cease to be an elected official, he/she will be required to resign the EDC Board position and the governmental entity affected will appoint a new representative from the entity to fill the vacant position. The article further states'no voting Director may serve more than one unexpired term, plus two consecutive three year terms as Director of the Corporation except as noted regarding the Immediate Past Chairman. CURRENTSTATUS At the time the revised Bylaws were drafted and adopted, it was not recognized that a narrow pool of potential Directors exists within the City Council and Commissioners Court, and restrictions on the length of term for these positions may pose an undue hardship for the City Councils and Commissioners Court. PROPOSAL Add such wording as to allow for the City Council and Commissioners Court appointees to remain on the Board for an additional term if so appointed by their governing entities. Such Directors will still be required to resign the EDC Board position at the time he/she would cease to be an elected official, as already stated in the Article.
