Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3, Absent; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Thornton gave the invocation and led the pledge of allegiance. Under citizen input/and or concerns, 85`" District Court Judge, J.D. Langley, informed the Court that the House 401 Committee had approved HB 1432. The Senate has passed SB 1434 COMMISSIONERS' COURT REGULAR MEETING MAY 1, 2001 and placed it on the calendar for Friday. This bill creates the Magistrate's position. There is a question of there being enough time to have this bill passed before the legislative session ends. He went on to say that trial attorneys will not oppose this bill if it is amended to extend the appeal time from five days to ten if there is an objection to the Magistrate's report. Also, the house committee has passed out the proposal for redistricting. The Court next considered Budget Amendment #00/01-26.1 through 26.3, which would increase the budget for the Narcotics Trafficking Task Force, Community Support from Contingency, and reallocate funds for Ag. Extension and Certificate of Obligation Series 98. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the changes as submitted. The Court next considered authorizing the Auditor's office to process recurring payment requests for the following: a) BI Incorporated for Equipment Leasing Services $1,029.90 per month on motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to authorize the Auditors office to process all the previously noted recurring payments. The Court next considered the following Claims as submitted by the County Treasurer for payment: 20018269 through 20018511 i : -On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the Claims as submitted. The Court next considered a request from Constable Precinct 4, Duane Peters, to appoint Morrell Brent Munyon as Reserve Deputy Constable. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the request from Constable Peters to appoint Morrell Brent Munyon as an unpaid Reserve Deputy Constable subject to appointment being within the allotted number of deputies. The Court considered an Application and Agreement for Receipt of USDA-Donated Commodities for the Juvenile Service Department. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to make application and forward it to the Texas Department of Human Services. A copy is attached. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to authorize the County Judge to execute a Tax Resale Deed to the following individual: Richard B. Moore, Sr. - part of the Stephen F. Austin League No. 9, Abstract 62, City of Bryan, Brazos County, Texas, known as Lot 23, Block B, Starlight Addition. The Court next considered a request from the Sheriff's Office to expend additional Minor Acquisition Funds for the purchase of five chairs. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to expend $53.00 from the Minor Acquisitions Fund to order the correct chairs. The Court proceeded to consider the following blanket Purchase Order: Brazos Office Supp County Attorney $1,200 On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the Blanket Purchase Order as submitted. The next matter for consideration was approval for the Purchasing Agent to advertise Bid 2001-043, Construction of Radio Tower for Sheriff's Department. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to authorize the Purchasing Agent to advertise for bids for the construction of a radio tower. The Court next considered the granting of -a Release of Lis Pendens against a 0.297 of one acre tract of land owned by Sylvia Borland located on Straub Road in Precinct 1. The Court next considered acceptance of a Warranty Deed for right-of-way on Straub Road in Precinct 1. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to accept on behalf of Brazos County a Warranty Deed from Larren K. Elliott for the expansion and improvements to Straub Road. The Court next considered the request from Verizon to construct a road bore in the right-of-way of Grassbur Road. The site is located in Precinct 3. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the request by Verizon and authorized the installation. A copy of the request is attached hereto. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Jimmy Weedon on Dyess Road approximately 0.3 mile south of Elmo Weedon Road to stock pile -grade 4 rock for Dyess Road Improvements. On motion by Commissioner Cauley, seconded by Commissioner Jones, the Court voted unanimously to authorize the work. The Court next considered the request from Mitchell Gas Services L.P. to place a road bore in the right-of-way of Warren Ranch Road. The site is located in Precinct 3. Included with the request is company check #11741 in the amount of $500.00. The County Engineer stated that all appeared to be in order and recommended approval. The Court next considered the request from Verizon to construct approximately 855 feet of buried cable in the right- of-way of Rock Prairie Road approximately 150 feet of this cable will be inside the city limits of College Station. The site is located in Precinct 1. The County Engineer offered the following exception: 1. May be approved except for the western most 150 feet of cable that will be inside the city limits of College Station. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from Verizon subject to Verizion complying with the exception • noted by the County Engineer. A copy of the request is attached. The Court next considered approval of the Final Plat of Wickson Lake Estates Amending Plat in Precinct 3. Richard Vance, County Engineer, stated that he had reviewed the plat and all appeared to be in order. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the final plat of Wickson Lake Estates Amending Plat as submitted. The Court next considered approval of the minutes of the Commissioners, Court meetings held in November and December, 2000 on the following dates: Regular meetings November 7, 14 & 21 and December 5, 12 & 19; Special Meetings November 13 and December 19; Workshop held on November 21. -On motion by Commissioner Cauley, seconded by Commissioner Thornton, the 401 Court voted unanimously to approve the minutes as submitted. Vol 023 Page 7 1. i c ' Commissioners' Court meeting May 1, 2001 6 The Court acknowledged receipt of the County Treasurers Quarter Ending March 30, 2001 Investment Report. A copy is attached to and made a part of these minutes. Under announcement of interest items and possible future agenda topics the County Judge made the following comments: a) He has received a request to set up the office of Medical Examiner for Brazos County with several surrounding counties. b) He announced that the Veterans Officer, Bill Thompson had passed away a short time ago. c) He was concerned about the retention pond at the Detention Center on Sandy Point Road. Commissioners Jones would check into it. There was no citizen input and/or concerns. At 9:28 a.m. the County Judge announced the meeting closed to the public so that the Court could meet in Closed Executive Session to discuss the acquisition of real property as allowed under Section 551.072 of the Texas Government Code. At 9:37 a.m. the County Judge announced the meeting open to the public and that no action was required on the Executive Session. To the extent consistent with prudent industry practice. divide the contract work into the smallest reasonable lots. 2. Notify HUBs of the work the Contractor intends to subcontract. The notice shall be in writing. The notice shall include a description of the subcontracting opportunities and identify the location to review contract specifications. The nonce shall be provided to potential subcontractors prior to submission of the contractor bid. 3. The Contractor shall send such notice to at least five HUB firms in the GSC master bidders list and HUB directory that perform the type of work required. If the GSC master bidders list and HUB directory do not have at least five businesses, then the Contractor shall send the required nonce to HUBS on lists of minority and women owned businesses maintained by other government agencies or organizations. If the Contractor uses sources other than the GSC master bidders list and HUB directory, the selected HUB subcontractor must become certified by GSC in accordance with GSC procedures. 4. If a non-HUB subcontractor is selected through means other than competitive bidding, or a HUB bid is the lowest price responsive bidder to a competitive bid, but not selected. the Contractor will be required to document the selection procedures. 5. Maintain records documenting HUB compliance for audit purposes. Quarterly reports MAY BE required by the agency, and the contractor will be given sufficient notification if required to report.
