THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
APRIL 24, 2001 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.

REGULAR MEETING
APRIL 24, 2001
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, April 24, 2001, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The County Judge opened the meeting and turned it over to
Commissioner Sims, siting a case of laryngitis.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Jones gave the invocation and led the pledge

of allegiance.
Under citizen input/and or concerns, the County Judge
read a resolution and presented a plaque to outgoing Bryan
City Manager, Mike Condiff. Commissioner Sims thanked him and
his wife for their service to the community and wished them
well. Mr. Condiff thanked the Court for its cooperation
during his tenure and indicated that the future looked bright
thanks to their leadership.
The Court next heard a presentation by representatives
of United Way. Mrs. Kay Parker and Mr. Tommy Swigert

presented the Court with a plaque for having reached the 67t
Judges Challenge. Brazos County enrolled 2,951 children in
the Children's Healthcare Insurance Partnership. This number
is 68.9% of the total number of uninsured children in this
county.
The Court next considered Budget Amendment #00/01-25.1
through 25.3, which would transfer funds from Contingency to

various departments for the purchase of replacement equipment
and Equipment Replacement /Maintenance, and reallocate funds
for Court Support Costs. On motion by Commissioner Cauley,
seconded by Commissioner Jones, the Court voted unanimously to
approve the budget amendment as submitted, a copy of which is
attached hereto.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to approve
the changes as submitted. ,
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
20017990 through 20018268
On motion by Commissioner Cauley, seconded by Commissioner
Jones, the Coutt voted unanimously to approve the Claims as
submitted.
The next matter before the Court was the appointment of
a member to the Bryan-College Station Economic Development
Board. On motion by Commissioner Sims, seconded by
Commissioner Thornton, the Court voted unanimously to
reappoint Commissioner Tony Jones to a second three-year term.
The next matter for consideration was to set the retiree
monthly premiums for group medical/dental insurance.
Commissioner Sims moved to approve the two categories of
monthly premiums. Commissioner Cauley seconded the motion.
After considerable discussion Commissioners Sims and Cauley
withdrew their motion and second. Then on motion by
Commi4ssioner Sims, seconded by the County Judge, the Court
voted unanimously to have one premium rate for the retirees'
whether they be age 65 years or younger. The group
medical/dental insurance premium of $80.00 would be for the

retiree and $129.00 for the group medical/dental insurance
premium for the retiree and spouse.
On motion by the County Judge, seconded by Commissioner
Cauley, the Court voted unanimously to adopt a resolution
honoring Ed Dobbins for his twenty-five years of dedicated
service to Brazos County and wished him the best of health and
happiness for many years to come. Mr. Dobbins will retire•on
April 30,2001.
The Court proceeded to consider the following blanket
Purchase Orders:

On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered the extension of the contract
for Ben Sanford and Associates. This extension is for $100.00
per hour, not to exceed five (5) hours and does not exceed the
25% as allowed in Section §362.031 of Vernon's Statutes Texas
Government Code. The counseling and assistance is for
renewing the Long Distance Services Contract with NTS
Communications, Inc. On motion by Commissioner Jones,
seconded by Commissioner Cauley, the Court voted unanimously
to extend the contract with Ben Sanford and Associates.

The Court next considered awarding the following bid:
Bid No. 2001-040, Poly-Jute, Annual Contract
Pat Howard, Purchasing Agent, recommended
acceptance of the bid submitted by
Contech Construction. On motion by
Commissioner Cauley, seconded by
Commissioner Jones, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Contech Construction. A copy
of the bid tabulation is attached.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Mary Ann Stein on
Luza Lane in Precinct 4 to construct a drainage channel in a
pasture to allow water to drain from the county roadway. On
motion by Commissioner Cauley, seconded by Commissioner Jones,
the Court voted unanimously to authorize the work.
The Court acknowledged receipt of the Extension Service
Reports for March 2001 and acknowledged receipt of reports
from the following County and Precinct Offices showing
revenues collected and remitted to the County Treasurer:

Under announcement of interest items and possible future
agenda topics the County Judge made the following comments:
a) Action in the State Legislature has
struck Brazos County from reporting to
the 1" and the 14`" Courts of Appeals.

b) A presentation will be made to Ed Dobbins
on Friday at 1:00 p.m.

c) He received a letter from the Department
of Health indicating that Brazos County
will receive $129,153.28 from the tobacco
settlement funds.
d) He received a letter from the Department
of Commerce in reference to participation
in the After Action Program.
Commissioner Sims made the following comment:
a) The House committee on redistricting has
completed a plan and it is available on
the web.
There was no citizen input and/or concerns.
The next matter before the Court was the Order Adopting
Rules of Brazos County, Texas for On Site Sewage Disposal. On
motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to remove this item from the
agenda.

At 9:35 a.m. the County Judge announced the meeting
closed to the public so that the Court could meet in Closed
Executive Session to discuss the acquisition of real property
as allowed under Section 5551.072 of the Texas Government
Code.
At 9:56 a.m. the County Judge announced the meeting open
to the public and that no action would be taken on the
Executive Session.
J. D. Langley, Judge, 85`h District Court informed the
Court that he had testified before the Legislature on the
subject of a Magistrate. He said he had picked up opposition
from trial lawyers against the measure.
There being no further business to come before the Court, '
the meeting was adjourned.

The Purchasing Department is requesting an extension of a Contrad and requisition for Ben
Sanford and Associates. This contract extension is for $100.00 an hour, not to exceed (5) fire
hours. This amount does not exceed the 25% increase as allowed in 262.031 of Vernon's Law.
This counsel and assistance is for the renewing of the Long Distance Services Contract with NTS
Communications, Inc.
