COMMISSIONERS' COURT
REGULAR MEETING
APRIL 17, 2001
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, April 17, 2001, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
The County Judge gave the invocation and led the pledge
of allegiance.
There was no citizen input/and or concerns.
The County Judge read aloud a Proclamation designating

the week of April 22 through 28, 2001 as "Infant Immunization
Week". The Court encourages businesses, government agencies,
community-based organizations and service groups to spread the
immunization message throughout the community. On motion by
the County Judge, seconded by Commissioners Jones, Thornton,
Sims and Cauley the Court moved to proclaim the week of April
22 through 28, 2001 as "Infant Immunization Week" throughout
Brazos County. The County Judge then presented the signed
Proclamation to Ms. Jennifer Schill representing the local
Health Department.
The County Judge read aloud a Proclamation designating
the week of April 22 through 28, 2001 as "County Government
Week". The Court encourages all its citizens to become more

aware of the history and be involved in the future of Brazos
County. On motion by the County Judge, seconded by
Commissioners Jones, Thornton, Sims and Cauley the Court moved

to proclaim the week of April 22 through 28, 2001 as "County
Government Week" throughout Brazos County. The County Judge
announced that on Monday, April 23, 2001, members of the Ag
d
Extension Service will be serving coffee and cake in the
commons areas of the courthouse.
The Court next considered Budget Amendment #00/01-24.1
through 24.3, which would increase funds for the TJPC
Challenge Grant, increase the budget for Records
Management /County Clerk's Records Management and reallocate
funds for Capital Improvement Fund. On motion by Commissioner
Cauley, seconded by Commissioner Sims, the Court voted
unanimously to approve the budget amendment as submitted, a
copy of which is attached hereto.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Jones, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
20017820 through 20017989
on motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Claims as
submitted.
The next matter for the Court's consideration was an
Intergovernmental Agreement between Brazos County and the City
of Kurten for Brazos County to maintain roadways. This is
authorized by the Interlocal Cooperation Act, V.T.C.A.
Government Code Chapter §791.011. Cost to the City of Kurten
will be $81.00 per trip to furnish a motor grader and $44.00
for additional motor grader work, $55.00 per hour for patching
potholes and $.20 per square yard for dust control. On motion
by Commissioner Sims, seconded by Commissioner Cauley, Jones

and Thornton, the Court voted unanimously to enter into an
Interlocal Agreement with the City of Rurten to maintain

Opersteny Lane, North Oakland Lane, and South Oakland Lane.
A copy of the Agreement is attached.
The Court next considered a Request for Waiver and
Resolution to the Texas Department of Transportation
concerning Local Match Fund Participation Requirement on
Federal Off -,System Bridge Program Projects. The waiver asks to
waive the usual 10 percent local match fund participation
requirement provided the local government performs improvement
work on other deficient bridge (s) equivalent to the 10 percent
match. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the Request for waiver and forward a Resolution to the Texas

Department of Transportation concerning Local Match Fund

Projects. A copy is attached.
The Court next established a date and time to conduct a
Public Hearing for an application for a revision of the plat
of Withers Subdivision, located in Precinct 3. On motion by
Commissioner Sims, seconded by Commissioner Thornton, the
Court voted unanimously to hold a Public Hearing on Tuesday,
May 22, 2001 at 10:00 a.m. in the Brazos County Courthouse,
300 East 26`n Street, Suite 115, Bryan, Texas.
The Court next considered authorizing the use of Brazos
County checks bearing the printed signature of the former
County Clerk, Mary Ann Ward. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to authorize the use of the checks.
The Court next considered the request from Verizon to
construct 1,492 feet of buried cable in the right-of-way of
Grassbur Road beginning approximately 1,780 feet west of Vicks
Lane. The site is located in Precinct 3. The County

Engineer stated that all appeared to be in order and
recommended approval. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the request by Verizon and authorized the
installation. A copy of the request is attached hereto.
The Court next considered approval of the Final Plat of
Estates at River Run Phase Three, Block One, Lots 1-5 in
Precinct 1. Richard Vance, County Engineer, stated that he
had reviewed the plat and all appeared to be in order. On
motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the final
plat of Estates at River Run Phase Three, Block One, Lots 1-5
as submitted.
The next matter for consideration was approval for the
Purchasing Agent to advertise Bid 2001-042 Temporary
Employment Services. On motion by Commissioner Jones,
seconded by Commissioner Thornton, the Court voted unanimously
to authorize the Purchasing Agent to advertise for bids for
employment services.
The Court proceeded to consider the following blanket
Purchase Orders:

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered approving a requisition from
Capital Funds, Printer Control Inventory, for a Burster for
the Information Technology Department. On motion by
Commissioner Cauley, seconded by Commissioner Jones, the Court
voted unanimously to remove this item from the agenda. Those
needing to have printouts burst may take them to the
Treasurers office.

The Court next considered approval of a requisition from
Capital Funds, Computer Inventory for ten (10)Deskpro
Workstations for the Information Technology Department. On
-motion by Commissioner Cauley, seconded by Commissioner Sims,
the Court voted unanimously to approve the requisition from
Capital Funds, Computer Inventory for ten (10) Deskpro
Workstations in the amount of $16,966.00.
The next matter for the Court's consideration was
approval of a requisition from the Information Technology
Department's Computer Contracts Budget for software licenses.
On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve payment of the
requisition in the amount of $8,160.48.
Under announcement of interest items and possible future

agenda topics Commissioner Sims made the following comments:
a) He provided the members of the Court with
a list of proposed legislation. He
stated that there were several that
needed support to get through the
legislature. He specifically wanted
support for H.B. 3049 which would impose
restrictions and guidelines on Tax
Assessor-Collector motor vehicle
inventory tax interest fund.
The County Judge made the following comments:
a) He will be attending a CUC meeting April
18. It is an Inter-government meeting.
There was no citizen input and/or concerns.
At 9:36 a.m. the County Judge announced the meeting
closed to the public so that the Court could meet in Closed
Executive Session to discuss the purchase of real property as
allowed under Section 5551.072 Texas Government Code.
At 10:10 a.m. the County Judge announced the meeting open

to the public. He announced the Executive session recessed
until 3:00 p.m. The County Judge also announced the
Commissioners Court meeting would be recessed until 3:00 p.m.

The County Judge reconvened the Commissioners Court
meeting at 3:00 p.m. and announced that the Court would
revisit item 18 on the agenda which was to buy ten (10)
computers without monitors for the IT Department. The
question was raised as to how training would be conducted if
the monitors were' to be used with the new computerp_
Commissioner Cauley responded that new monitors would be
purchased after procedures were in place and if and when it
was determined to purchase from QSIV vendors. The County
Judge asked why two (2) of the printers were more expensive.
Ernie Laney, Interim Director of the IT department replied
that those two (2) had CD burners thus making them more
expensive. On motion by the County Judge, seconded by
Commissioner Thornton, the Court voted unanimously to rescind
the action taken during the morning session that approved the
purchase of 18,computers from the Capital Funds budget. On
motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to purchase 10 computers for the
IT department and to use Certificate of Obligation funds for
the purchase. He further moved that a budget amendment be
prepared, if necessary, to make the funds available.
Ruth McLeod advised the Court that the Bickerstaff
attorneys would be ready to present a plan sometime in early
May or they could do it while making the initial assessment to
the City of Bryan on May 181"
At 3:37 p.m. the County Judge then closed the
Commissioners Court meeting to the public so the Court could
meet in Closed Executive Session to continue discussing the
purchase of real property as allowed under Section §551.072
Texas Government Code. At 3:50 p.m. the County Judge opened
the meeting and announced that no action would be taken on the
Executive Session and that the court members will continue

negotiation on the purchase of real estate property.
The County Judge announced that he had a call from a
reporter at the Eagle. She is doing a story on the Chilifest
in Burleson County. The Sheriff Ia department of Burleson
County has indicated that the activity is too intense for
their department and is suggesting that it be moved to the
race tract in Brazos County. He told the Eagle that he is
taking no position on the issue at this time.
Susan Gandy announced there would be a Public Hearing on
the Septic Tank On Site inspection order on Tuesday, April 27,
2001 at 10:00 a.m.
There being no further business to come before the Court,
the meeting was adjourned.

INTERGOVERNMENTAL AGREEMENT

This Agreement, made and entered into this /?'4 day of 2001, by and
between BRAZOS COUNTY, TEXAS, hereinafter referred to a "BRAZOS COUNTY". and the
CITY OF KURTEN, herein after referred to a "KURTEN".
WHEREAS, Government Code §791.011 et seq., Interlocal Cooperative Act provides
that agreements to provide services between governmental units are permitted; and
WHEREAS, both parties have the authority to maintain roadways; and
WHEREAS, BRAZOS COUNTY has the necessary equipment and personnel to provide
such maintenance; and
' WHEREAS, it is more efficient and economical for BRAZOS COUNTY to provide such
services; and
WHEREAS, the parties wish to enter into an arrangement for the maintenance of
roadways that is economical and fair to both parties.
NOW THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that for an in
consideration of the mutual covenants herein set forth, the parties agree as follows:
1. Upon the request of the Mayor of KURTEN, BRAZOS COUNTY will blade,
with its graders, Opcrsten Lane. North Oakland Lane, and South Oakland Lane.

a 2. The timing of maintenance work to be done will be at the discretion of BRAZOS
COUNTY. Generally this will be at a time the graders are next in the vicinity of
Kurten.
3. This agreement does not include culvert installations, additional gravel, mowing
right-of-way, clearing right-of-way and maintaining culverts and channels.
4. KURTEN will reimburse BRAZOS COUNTY for the expenses incurred in
furnishing said grader services at a rate of EIGHTY-ONE DOLLARS ($81.00)
per trip.
5. KURTEN will reimburse BRAZOS COUNTY at a rate of FORTY-FOUR
DOLLARS ($44.00) per hour for additional motor grader work such as spreading
gravel or pulling ditches should this service be required by KURTEN.
6. KURTEN will reimburse BRAZOS COUNTY at the rate of FIFTY-FIVE
DOLLARS (555.00) per hour for patching of potholes with a minimum time of
one hour.

7. KURTEN will reimburse BRAZOS COUNTY at a rate of TWENTY CENTS
($0.20) per square yard for dust control should this service be required by
KURTEN.
8. The parties agree that the rates stated herein fairly compensate BRAZOS
COUNTY for the services to be provided.
9. BRAZOS COUNTY will submit a bill to KURTEN each month that work is
performed and KURTEN shall pay said bill within fifteen (15) days of the date on
which the bill is submitted.
10. KURTEN agrees to request only those services described herein that it can pay
for out of currently available fund and to make payments out of such funds.
11. This Agreement may be amended at any time with the approval of both parties.
12. This Agreement amends all prior Interlocal Agreements. This Agreement shall be
in full force and effect until one (1) year from the anniversary date hereof.
Thereafter, such contract shall be automatically renewed, subject to termination
by either party on 30 days written notice. KURTEN agrees to not to continue this
contract if it has not, on an annual basis, budgeted funds sufficient to pay the costs
stated herein.

SUBJECT: Request for Waiver of Local Match Fund
Participation Requirement on Federal
Off-System Bridge Program Projects
Dear Mr. Traweek:
Under the provisions of Texas Administrative Code, Title 43, Section 15.55(d), Brazos County
requests waiver of the local match fund participation requirement on the federal off-system bridge
program projects shown on the attached sheet and referred to as the "participation-waived" projects.
In return for waiver of this participation, it is proposed that our governing body perform, or cause
to be performed, an equivalent dollar amount of structural improvement work on other deficient
bridge(s) or deficient mainlane cross-drainage structure(s), referred to as "equivalent-match
project(s)", within the jurisdiction of our governing body.
A copy of the appropriate required resolution adopted by our governing body is attached.

RESOLUTION
WHEREAS, the federal off-system bridge program is administered by the Texas Department of
Transportation (the State) to replace or rehabilitate structurally deficient and functionally obsolete
(collectively referred to as deficient) bridges located on public roads and streets off the designated
state highway system; and
WHEREAS, Brazos County, hereinafter referred to as the Local Government, owns bridges located
and identified as shown on Page 4 of this Resolution; and
WHEREAS, projects to remedy these bridges are included in the currently approved program of
projects as authorized by Texas Transportation Commission Minute Order Number 108310 dated
September 28, 2000; and
WHEREAS, the usual fund participation ratio for projects on such programs is 80 percent federal,
10 percent state and 10 percent Local Government; and
WHEREAS, Texas Administrative Code, Title 43, Section 15.55(d) (43 TAC Section 15.55(d))
provides that under specified conditions the 10 percent Local Government match fund participation
requirement may be waived with agreement by the Local Government to perform, or cause to be
performed, an equivalent dollar amount of structural improvement work on other deficient bridges
or deficient mainlane cross-drainage structures within its jurisdiction, such a project of structural
improvement work being referred to as an "equivalent-match project"; and
WHEREAS, the estimated local match fund participation requirement on the approved federal off-
system bridge projects is $162,616, hereinafter referred to as the "participation-waived" projects,
such participation requirement the Local Government proposes be waived and in return perform or
cause to be performed equivalent-match project structural improvement work.

the following equivalent-match project(s) in return for waiver of the local match fund participation

BE IT FURTHER RESOLVED that in receiving this waiver, the Local Government acknowledges
its obligation to conform with all conditions of 43 TAC Section 15.55(d); such conditions that
include but are not restricted to the following:
I. The Local Government must be currently in compliance with load posting and closure
regulations as defined in National Bridge Inspection Standards under US Code of Federal
Regulations, Title 23, Section 650.303.
2. The equivalent-match project work increases the load capacity of the existing bridge or other
mainlane corns-drainage structure, or upgrades the structure to its original load capacity with
a minimum upgrade to safely carry school bus loading if located on a school bus route.
3. In performing, or causing to be performed, the equivalent-match project(s), the Local
Government assumes all responsibilities for engineering and construction, and complying with
all applicable state and federal environmental regulations and permitting requirements for the
structures being improved.

4. The work on the proposed equivalent-match project(s) has not begun and will not begin until
the local match fund participation waiver approval process has been completed.
5. The Local Government will be allowed three years after the contract award of the participation-
waived project to complete the structural improvement work on the equivalent-match
project(s).
6. Should this waiver request be approved, an appropriate written agreement or amendment to
a previously executed agreement will be executed between the State and the Local
Government.

WHEREAS,
As of March 1, 2001, Karen McQueen was appointed to serve the
remainder of Mary Ann Ward's term as Brazos County Clerk, and
WHEREAS,
Mary Ann Ward's name is printed on the existing supply of Brazos
County Payroll and Accounts Payable checks, and
WHEREAS,
It would be in the best fiscal interest of Brazos County to use the
balance of said checks rather than to destroy same;
THEREFORE,
Commissioners Court acknowledges and approves the continued
issuance of these checks declaring Mary Ann Ward's signature on
these checks to be synonymous with that of Karen McQueen.

of Grassbur Road beginning approximately 1.780 feet west of Vicks Lane Site is
located in Precinct 3.
SOURCE OF FUNDS: N/A
REQUIREMENTS:
1) No work will be permitted between front slope and/or back slope.
2) All installation(s) shall be constructed In designated utility easements, if applicable. If no utility
easement exists, the installation(s) shall be 1) within 3-5' of and parallel to the right-of-way line
and/or 2) in the case of a road bore, perpendicular to the right-of-way line.
3) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc from county nght-of-way.
4) Duch line shall be compacted to 90% standard density ASTM-Test Method No. D-698: test
shall be conducted by an independent Geotechrncal testing firm: copies of all test results shall be
furnished to the office of the Brazos County Engineer.
5) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Highway . published by the Texas Department of Transportation,
and all other State and Federal laws governing utility construction.
