BRAZOS COUNTY COMMISSIONERS COURT
THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
MARCH 27, 2001 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.
1. Invocation - Commissioner Thornton.

3. Call for citizen input and/or concerns.
Consider and take action on agenda items 4 - 21:

in the District Clerk's office.
18. Renewal of underground storage tank insurance.

22. Acknowledge receipt of monthly reports from department heads and elected officials.
23. Announcement of interest items and possible future agenda topics.
24. Call for citizen input and/or concerns.
25. Convene into Executive Session pursuant to §551.072 of the Texas Government Code to
discuss the purchase of real property.
26. Consider and take action on Executive Session.
27. Adjourn.

A'regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, March 27, 2001, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
C,arey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Thornton gave the invocation and led the
pledge of allegiance.
Under citizen input/and or concerns Ernie Laney, Interim
Director of the Information Technology Department introduced
Bryan Brumfield the new Imaging Manager for the department.
The County Judge read aloud a Proclamation designating
the month of April "Sexual Assault Awareness Month". The
Court joins with the local Rape Crisis Center to promote
public understanding of sexual violence and victims of sexual
violence and the need for citizen involvement in efforts to
reduce sexual assault. On motion by the County Judge,
t seconded by Commissioners Jones, Thornton, Sims and Cauley,
the Court moved to proclaim the month of April as "Sexual
+ Assault Awareness Month" throughout Brazos County.

COMMISSIONERS' COURT
REGULAR MEETING
MARCH 27, 2001
The County Judge read aloud a Proclamation designating
the week of April 2 through 8, 2001 as "National Public Health
Week". This gives the public the opportunity to learn about
public health success stories such as elimination of polio,
reduction of lead in blood levels and decline in tooth decay.

by the County Judge, seconded by Commissioners Jones,
Thornton, Sims and Cauley, the Court moved to proclaim the
week of April 2 through 8, 2001 as "Health Awareness Week"
throughout Brazos County. The County Judge then presented the
signed Proclamation to Ken Bost and Marcie Hosking,
representing the local health department.
The Court next considered Budget Amendment #00/01-22.1,
which would transfer funds to various departments from
Contingency to allow for upgrades and replacement of computer
hardware and printers. On motion by Commissioner Cauley,
seconded by Commissioner Sims, the Court voted unanimously to
approve the budget amendment as submitted, a copy of which is
attached hereto.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Jones, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner, :Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered sending letters to the State
Senator and State Representatives concerning the terms of SB
748 relating to water districts. On motion by the County
Judge, seconded by Commissioner Sims, the Court voted
unanimously to forward the letter the State Senator and State
Representatives.
• The Court next considered sending letters to the State
Senator and State Representatives supporting H.J.R. 2,
allowing a Commissioners Court to declare the office of

Constable dormant if the office remained vacant for eight
consecutive years. Constables Phil Sikes, Donald Lampo, James
Marrow and Isaac Butler spoke out vehemently against sending
the letter to the State Senator and Representatives. The
County Judge and Commissioner Sims informed the Constables
that should this bill pass, it would require the vote of the
Commissioners Court along with a public vote on the issue. On
motion by the County Judge, seconded by Commissioner Sims, the
Court voted unanimously to send letters to the State Senator
and State Representatives supporting H.J.R. 2.
The next matter before the Court was the forwarding of
letters to the State Senator and Representatives opposing SB
578 which eliminates funding for delivery and coordination of
local 9-1-1 services by local governments and regional
planning councils. On motion by Commissioner Jones, seconded
by Commissioner•Cauley, the Court voted unanimously to forward
letters in opposition to SB 578.
The Court next considered sending letters to the State
Senator and Representatives supporting H.J.R. 29 allowing a
Commissioners Court to call an election to abolish the office
of Constable in the county. The County Judge moved to
approve. - Commissioner Sims seconded the motion.
Commissioners Sims and Thornton and the County Judge voted
"Aye". Commissioners Jones and Cauley voted "No". The motion

carried.
The next matter for consideration was an Agreement for
Emergency Medical Services between the County and the
following:
a. City of Bryan
b. City of College Station
On motion by the County Judge, seconded by Commissioner Sims,
the Court voted unanimously to remove this from the agenda.

The Court next considered Tax Resale Deeds and
authorization for the County Judge to execute Tax Resale Deeds
for the following property: "
a. Lot 18, Block 2, Henderson #2 Addition, City of
Bryan, to Frankie Mae Morris. On motion by
Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to authorize
the County Judge to execute a Tax Resale Deed to
Frankie Mae Morris.
b. Lot 9, Block 4, Rainbow Acres Subdivision to C.
W. Henry. On motion by Commissioner Sims, seconded
by Commissioner Cauley, the Court voted unanimously
to authorize the County Judge to execute a Tax
Resale Deed C. W. Henry.
C. Lot 2, Block 3, Timbercreek at Steephollow
Subdivision to Gus Schultz and Laren Schultz. On
motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to
authorize the County Judge to execute a Tax Resale
Deed to Gus Schultz and Laren Schultz.
The next matter for consideration was a request by the
District Attorney for additional funding for the salary
budget. In a letter to the Court, the District Attorney
explained that there would be no increase to the salary budget
because of vacancies. On motion by Commissioner Thornton,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the request.
The Court considered another request from the District
Attorney. This is for the establishment of a budget line item
for mediation under court support costs, to be funded
available Title IV-B funds. The Texas Department of
Protective and Regulatory Services will reimburse the County
for a percentage of salaries and allowable expenses. On
motion by Commissioner Sims, seconded by Commissioner
Thornton, the Court voted unanimously to establish a budget
line item for mediation.
The next matter for consideration was the authorization
to make partial payment to Newman Printing for Digital
Archiving Services in the District Clerks Office.' On motion

by Commissioner Cauley, seconded by Commissioner Thornton, the
Court voted unanimously to authorize the payment of $34,245.45
with the condition that partial payment does not mean
acceptance of the final product.
The Court next considered renewal of underground storage
tank insurance. This insurance coverage is required by the
Texas Natural Resources Conservation Commission. On motion by
Commissioner Jones, seconded by Commissioner Thornton, the
Court voted unanimously to renew the underground storage tank
insurance and authorize the payment of $1,312.00.
The Court proceeded to consider the following blanket

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously. to approve the Blanket
Purchase Orders as submitted.
The next matter for consideration was approval for the
Purchasing Agent to advertise Bid 2001-040 Poly Jute Annual
Contract. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to authorize
the Purchasing Agent to advertise for bids for poly jute.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held in October 2000 on the
following dates: 3, 10, 17, 24 and 31; Workshop held on
October 31 and Public Hearing held October 16. On motion by
Commissioner Cauley seconded by Commissioner Sims, the Court
voted unanimously to approve the minutes as submitted.

The Court acknowledged receipt of the Extension Service
Reports for February 2001 and acknowledged receipt of reports
from the following County and Precinct Offices showing
revenues collected and remitted to the County Treasurer:

A copy of the Officials' reports can be viewed in the County
Auditor's office.
Under announcement of interest items and possible future
agenda topics the County Judge made the following comments:
a) He received a letter from personnel in
reference to payment of insurance
premiums for county retirees. A workshop
will be held to discuss this issue.
b) He will be at the CUC meeting in Austin
on Wednesday and stay over to attend the
House redistricting hearing.
c) He received an urgent letter from Jim
Allison referring to the tobacco
settlement money. The County has already
submitted their request for a draw and
received the funds.
d) Next week, the Court will make an
appointment to the Child Welfare Board
e) There will be a hearing in Austin on HB
3106 that asks for a $.05 increase in the
fuel tax.

At 9:57 a.m. the County Judge announced the meeting
closed to the public so that the Court could met in Closed
Executive Session to discuss the purchase of real property as
allowed under Section §551.072 Texas Government Code.
At 10:20 a.m. the County Judge announced the meeting open
to the public. On motion by Commissioner Thornton, seconded
by the County Judge, the Court voted unanimously to authorize
Commissioner Sims and the County Judge to negotiate for the
purchase of property.
There being no further business to come before the Court,
the meeting was adjourned.
