COMMISSIONERS' COURT REGULAR MEETING MARCH 6, 2001 • C7 • A regular called meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, March 6, 2001, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. The County Judge gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns. The Court next considered Budget Amendment #00/01-20.1 through 20.2, which would transfer funds to Court Support Costs from Contingency, and reallocate funds for the Information Technology Department. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the changes as submitted. It f 1 2 On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the Claims as submitted. The County Judge read aloud a Proclamation designating the week of March 4 through 10, 2001 as "Severe Weather Awareness Week". The Court urges everyone in this community to learn and to participate in sever weather preparedness activities available through the Brazos County Office of Emergency Management. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court moved to proclaim the week of March 4 through 10, 2001 as "Severe Weather Awareness Week" throughout Brazos County. The County Judge then presented the signed Proclamation to Mrs. DeMerle Giordano, Director of the Brazos County Office of Emergency Management. The Court next considered approval of the First Amendment to Agreement for Development and Tax Abatement in reinvestment zone Number 13 for Commercial Tax Abatement for Betco Inc. This was necessary because of an error involving the insertion of an incorrect date. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the First Amendment to Agreement for Development and Tax Abatement for Betco, Inc. The next matter before the Court was the appointment of an individual to serve as a representative of Brazos County on the Brazos County Health Board. On motion by Commissioner Sims, seconded by Commissioner Thornton, the Court voted unanimously to appoint Garth Morgan M.D. to serve as a representative to Brazos County on the Brazos County Health Board. The Court next considered authorizing an increase in the amount of Community Healthcare Endo-wrment Fund money to be distributed. The Court next considered creating Justice of the Peace precinct lines equal to Commissioners precinct lines, thereby establishing four Justice of the Peace precincts. Commissioner Sims stated that it was appropriate to look at reducing the Justice of the Peace Precincts but he does not feel the need to eliminate a Justice of the Peace. The following people made comment: Demetrios Basdekas - voiced support for realigning JP Precincts. Greg Rodriguez - was concerned about redistricting and the need for a minority precinct. Roy Flores - expressed interest in the financial savings involved in reducing the precincts. James Marrow - stated the need to maintain five justice of the Peace Precincts for the benefit of the local citizens. Commissioner Sims moved to remove the item from the agenda and to bring it back for consideration after redistricting. Commissioner Jones seconded the motion and it carried unanimously. The Court next considered negotiating with the College Station Independent School District for the purchase of the property located at 100 Anderson in College Station. Commissioner Jones informed the Court that he now has an appraisal of the property and asked if the Court was interested in pursuing this matter. Commissioner Jones then moved to authorize two Commissioners to negotiate with the College Station Independent School District for the purchase of the property located at 100 Anderson. Commissioner Cauley. seconded the motion. After some discussion, the County Judged offered an amendment to the motion and second. Commissioners Jones and Cauley amended their motion and second. The motion carried unanimously. f• «l: The next matter for consideration was approval for the Purchasing Agent to advertise for Requests for Proposal for the construction of a Justice of the Peace, Precinct 3 office. On motion by Commissioner Jones, seconded by Commissioner Sims, the Court voted unanimously to authorize the Purchasing Agent to advertise for proposals to construct the Justice of the Peace office. The Court next considered finalizing a contract with Jim Carol for the purchase of a building to be used as the Justice of the Peace, Precinct 2, office. Commissioner Sims stated that he felt the county should look for a location closer into town after redistricting has been completed. On motion by Commissioner Jones, seconded by Commissioner Sims, the Court voted unanimously to remove this item from the agenda. The next matter for consideration by the Court was a request submitted by George Boyett, Justice of the Peace, Precinct 6 seeking approval for out of state travel for himself. Judge Boyett would be traveling to Reno, Nevada to attend a "Search and Seizure" seminar at the National Judicial College during the week of March 11 through 18, 2001 and attend the National Judicial Leadership Conference at the National Judicial College during the week of March 18 through March 23, 2001. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to grant the request from the Justice of the Peace and approved payment of out of state travel expense for Judge Boyett. The Court next considered a request by Justice of the Peace, Precinct 2 to upgrade a part-time position to a full- time position. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to adopt a resolution authorizing the County Clerk to extend credit for fees paid by private person or entities who regularly and routinely file numerous documents and obtain copies of official records. Billing for the fees shall be monthly. A copy of the Resolution is attached. The next matter for consideration by the Court was a request submitted by the Interim Director of the Department of Information Technology for out of state travel for Linda Jeske and Ana Sifuentes so that the may attend the programing class "Introduction to System V in Nashville Tennessee on April 9 through 13, 2001. On motion by Commissioner Cauley, seconded • • by Commissioner Sims, the Court voted unanimously to grant the request from the Interim Director and approved payment of out of state travel expense for Ms. Jeske and Mrs. Sifuentes. The Court next considered a request by the County Auditor I to utilize Minor Acquisition-Furniture funds for the purchase of a chair. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve payment of the requisition in the amount of $1,753.00. The next matter for approval was the Official Bond for the County Clerk. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to approve the Official Bond for Karen McQueen, County Clerk. The Court next considered approval of an application to the Texas Department of Health for Pro Rata Tobacco Settlement proceeds. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the application in the amount of $2,473,568.00 and forward it to the Texas Department of Health. A copy of the application is attached. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of David Price on Weedon Loop in Precinct 3 to remove a portion of a pond dam to allow water to drain from the Weedon Loop ditch and roadway. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The Court next considered the request from Verizon to construct a road bore and approximately 5332 feet of parallel cable installation to relocate to the new right-of-way of South Dowling Road. On motion by Commissioner Jones, seconded by Commissioner Thornton, the -Court voted unanimously to approve the request from Verizon and authorized the installation. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to receive, approve and order filed as submitted the Treasurer's report for January 2001. A copy of which is attached to and made a part of these minutes. Under announcement of interest items and possible future agenda topics the County Judge made the following comments: a) He received a call from State Senator Steve Ogden and Representative Fred Brown in reference to two of three bills the Court asked to be introduced in the legislature. They introduced a bill allowing misdemeanor cases to be heard in the 85th and 272nd District Courts along with hiring a Magistrate. Establishing a 15`h Court of Appeals was not introduced... H i~ E r R i b) There is a report being issued from the f~ • Auditor's office stating that it appears all departments are within their budgeted r dollars. One is a map as the Commissioners lines currently exist, a letter relating to redistricting guidelines and a fax disagreeing with census information. 8 Commissioner Cauley made the following comments: a) Getting relatively close to contracting with the Software group. Will be in a workshop March 21-" or 27tH. to discuss the contract b) Need to move files from District Clerk's office. c) Need to find a location for the Information Technology Department d) Need to discuss a tower in order to reach those areas in the county that the Sheriff's office does not have radio contact with. E~ r Y y At 9:45 a.m. the County Judge announced the meeting closed to the public so that the Court could meet in closed executive session to discuss personnel as allowed under Section 551.074 of the Texas Government Code. At 11:11 a.m. the County Judge announced the meeting open to the public. The Court considered information presented by the County Auditor relating to undocumented time for which an employee of Justice of the Peace, Precinct 3 was compensated for while on sick leave. The report showed the total number of undocumented hours to be 228. The employee had also been granted 240 hours from the County Sick Leave Pool. On motion by Commissioner Sims, seconded by the County Judge, the Court voted unanimously to request that the County Auditor calculate the number of Sick Leave Pool hours used and then deduct the balance from unauthorized hours for which the employee was paid. The County Judge instructed the County Auditor to notify him of the amount of the reimbursement due to the County. There was no citizen input and/or concerns. The Agreement Regarding Disposition of Settlement Proceeds states that these expenditures shall be calculated as follows for pro rata distributions made in 2000 and subsequent years: "Ilse total annual unreimbursed health care expenditures for a county not wholly located within a hospital district are defined as all unreimbtused amounts, including urueimbursed jail health care, expended by such county for health care services to the general public during that year plus 15% of the total. The total may include unreimbursed health care expenditures for juveniles held under court commitment at county expense. Indirect costs must be excluded from the calculation. (1) determine the total expenditures based on itemized health care expenses for prisoners over the entire year, subtracting any reimbursement received fiom entities outside your political subdivision to cover health care expenses for individual prisoners; or (2) determine the total expenditures based on itemized health care expenses for the entire year and apply the following formula: Total Prisoner Health Care X Unreimbursed Jail Population = Unreimbursed Health Care Expenses Total Jail Population Attach a worksheet indicating which of the above methods you used to calculate unreimbursed jail health care expenditures, as well as the base numbers for your calculation. In identifying expenses and reimbursements, the County followed a cash basis of accounting for the period January 1, 2000 through and including December 31, 2000. The County has developed documentation to support the expenditures requested for reimbursement under Category C., Additional Unreimbursed Personal Health Care Services Provided To The General Public.
