COMMISSIONERS' COURT REGULAR MEETING • FEBRUARY 6, 2001 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, February 6, 2001, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3, Absent; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Jones gave the invocation and led the pledge is The Court first considered a request by Justice of the Peace, Precinct 3, for a temporary part-time clerk position. This is necessary due to the illness of one of the clerks in the office. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to approve the request for a temporary part-time clerk. The Court next considered Budget Amendment #00/01-17.1 through 17.3, which would transfer funds to Justice of Peace, Precinct 6, Jail Administration, Juvenile Services, District Attorney, Justice of Peace Precinct 2, Road and Bridge and Justice of Peace, Precinct 3 from Contingency, and reallocate funds for the District Clerk. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted • unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. of allegiance. Vol a a. Page Lf o-7 Commissioners' Court meeting February 6, 2001 2 The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Thornton, seconded by Commissioner Jones, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 20015489 through 20015730 On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to adopt a resolution in support of establishing a cemetery, the Texas Aggie Field of Honor, dedicated to the interment of members of the Texas A&M community. The Court next considered a recommended reorganization of the Information Technology Department. Commissioner Cauley called the Court's attention to the organizational chart items A & B. He then moved to institute item "A" at this time and then to institute item "B" upon the retirement of Mrs. Deen. Commissioner Thornton seconded the motion. The County Judge asked if salaries were involved in the reorganization whereupon Commissioner Cauley replied that they were but he would return to Court at a later date to ask for those increases. The County Judge offered an amendment removing the salary recommendations until they can be studied further. Commissioner Jones seconded the amendment. Commissioners Jones, Thornton and the County Judge voted "Aye". Commissioner Cauley voted "No". The Court voted unanimously to reorganize the department. I: J Vol aa. Page Lf o 8 • • • 0 Commissioners' Court meeting February 6, 2001 3 The next matter for consideration was approval of the Corrected Order authorizing Bruchez Goss, Thornton, Meronoff & Hawthorne, PC to begin condemnation proceedings for acquiring right-of-way for the Straub Road project concerning 0.068 acres out of a 6.00 acre tract in the Samuel Davidson League, owned by Mitchell C. Smith and Cheryl A. Smith. The site is located in Precinct 1. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the Corrected Order. The Court next considered a request by the Brazos Center to reallocate Minor Acquisition Funds to acquire two chainsaws and three blowers. On motion by Commissioner Thornton, seconded by Commissioner Jones, the Court voted unanimously to approve the reallocation of Minor Acquisition Funds. The Court proceeded to consider the following blanket Purchase Order: P/M Lube Center Sheriff $2,000 On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the Blanket Purchase Order as submitted. The Court next considered the renewal of a software support contract with Informix Software for the Information Technology Department. Commissioner Cauley moved to approve. Commissioner Jones seconded the motion. Commissioner Thornton stated that he felt the contract needed an option to renew included in it. Commissioners Cauley and Jones withdrew their motion and second. Then on motion by Commissioner Cauley, seconded by Commissioner Jones the Court voted unanimously to table the contract pending presentation of a new contract. The Court next considered the request from Verizon to donstruct a road bore in the right-of-way of Luza Lane approximately 0.5 mile northeast of State Highway 21 West. The site is located in Precinct 4. The County Engineer stated .Vol A a Page q-09 . Commissioners' Court meeting February 6, 2001 4 all appeared to be in order and recommended approval. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the request Verizon and authorized the installation. A copy of the request is attached hereto. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to receive, approve and order filed as submitted the Treasurer's report for December 2000 and the Quarter Ending December 31, 2000 Treasurer's Report. A copy of which is attached to and made a part of these minutes. The Court next considered approval of the minutes of the Commissioners' Court meetings held in August and September, 2000 on the following dates: 5, 12, 19, Public Hearing held on August 30, Workshop held on September 5, 2000 and a Special Meeting held September 5, 2000. They are here to attend the V. G. Young conference. c) There will be a workshop Tuesday, February 13, 2000 at 10:00 a.m. There was no citizen input and/or concerns. That in the event the authorized official offer described in Section 2 is refused by the owner of the said property designated for the right-of-way, the County of Brazos, Texas is hereby authorized and directed to institute and prosecute to conclusion proceedings in eminent domain against the owner of said property and against all r~ 9.90%.
