A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, January 23, 2001, with the following members
of the Court present:
Alvin W. Jones, County Judge;
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3, Presiding;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Cauley gave the invocation and led the

pledge of allegiance.
There was no citizen input/and or concerns.
The Court next considered a request by the District
Attorney for the creation of a temporary, part-time position.
The position will be funded out of the District Attorney's
Crime Fund. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to approve the
request from the District Attorney.
The Court next considered Budget Amendment #00/01-15.1
through 15.3, which would transfer funds to Constable,
Precinct 3 and 85`n District Court, from Contingency, and
reallocated funds for the District Attorney Crime Fund. On

motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.

The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests.

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the changes as
submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Claims as
submitted.
The next matter before the Court was approval of a
Resolution regarding Dr. J.T.L. McNew. On motion by
Commissioner Sims, seconded by Commissioner Cauley, the Court
voted unanimously to adopt a resolution extending the Court's
appreciation to Doctor J. T. L. McNew for his faithful service
to the Brazos County Board of Health.
The Court next considered approval of a Resolution
regarding Bryan Police Chief Lee Freeman. On motion by
Commissioner Sims, seconded by Commissioner Cauley, the Court
voted unanimously to adopt a resolution honoring Chief Lee
Freeman and to thank him for his years of exemplary service to
the citizens of Brazos County.
The next matter for the Court's consideration was a
request by the Community Supervision and Corrections
Department for a budget increase. In a memo to the Court, the
Director of the department asked that $3,600 be added to the
budget for copier maintenance services and that the $262.70
erroneously deducted from the 2000/2001 budget equipment line
item be added back for typewriter repairs. On motion by
Commissioner Thornton, seconded by Commissioner Sims, the
Court voted unanimously to restore the $262.70 erroneously
deducted from the 2000/2001 budget equipment line item and
increase the budget by $3,600 for copier maintenance.

The Court next considered awarding the following bids:

Pat Howard, Purchasing Agent, recommended
acceptance of the bid submitted by R B
Everett. On motion by Commissioner
Cauley, seconded by Commissioner Sims,
the Court voted unanimously to remove
this from the agenda.
b. Bid No. 2001-026, 6-8 Yard Dump Trucks
Pat Howard, Purchasing Agent, recommended
acceptance of the bid submitted by
Hogan's Trucks. On motion by
Commissioner Sims, seconded by
Commissioner Cauley, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Hogan's Trucks. A copy of
the bid tabulation is attached.
c. Bid No. 2001-027, Sand Trucks
Pat Howard, Purchasing Agent, recommended
acceptance of the bid submitted by
Hogan's Trucks. On motion by
Commissioner Sims, seconded by
Commissioner Cauley, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Hogan's Trucks. A copy of

acceptance of the bid submitted by
Mustang Tractor as a guaranteed re-
purchase price. On motion by
Commissioner Sims, seconded by
Commissioner Cauley, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Mustang Tractor. A copy of
the bid tabulation is attached.
e. Bid No. 2001-029, 4 x 4 Backhoe Loader
Pat Howard, Purchasing Agent, recommended
acceptance of the bid submitted by
Mustang Tractor. On motion by
Commissioner Sims, seconded by
Commissioner Cauley, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Mustang Tractor. A copy of

f. Bid No. 2001-030, 84" Single Smooth Drum Vibratory
Self-Propelled Roller
Pat Howard, Purchasing Agent, recommended
acceptance of the bid submitted by
Mustang Tractor as a guaranteed re-

Commissioner Cauley, seconded by
Commissioner Sims, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Mustang Tractor. A copy of

g. Bid No. 2001-031, Two-lane Roadway Bridge, White
Switch Road over Big Creek
Pat Howard, Purchasing Agent, recommended
acceptance of the bid submitted by BLS
Construction. On motion by Commissioner
Sims, seconded by Commissioner Cauley,
the Court voted unanimously to accept the
recommendation of the Purchasing Agent
and award the contract to BLS
Construction. A copy of the bid
tabulation is attached.
The Court next considered extension of the contract with
Swico Auctions for auctioneering services. This is the third
continuation and extension of the contract. The period will
be for one year ending on March 10, 2002. On motion by
Commissioner Sims, seconded by Commissioner Cauley, the Court
voted unanimously to to extend the contract with Swico
Auctions. A copy of the extension is attached.

The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Rose Livingston on
Warren Ranch Road in Precinct 3 to allow county trucks to turn
around during road work. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to authorize the work.

The Court next considered approval of the Amending Plat
of Lots 17-6R and 17-7R, Block 7, a Re-subdivision of Lots 17-
1, 17-2, 17-3, 17-4, Block 7, Rainbow Acres, 2"" Installment
in Precinct 3. Richard Vance, County Engineer, stated that he
had reviewed the plat and that it was amended to clear up
survey errors. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the amended plat of Lots 17-6R and 17-7R, Block 7, a Re-
subdivision of Lots 17-1, 17-2, 17-3, 17-4, Block 7, Rainbow
Acres, 2nd Installment as submitted.
The Court next considered approval of the Final Plat of
Precinct 3 Fire Department in Precinct 3. Richard Vance,
County Engineer, stated that he had reviewed the plat and all
appeared to be in order. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the final plat of the Precinct 3 Fire Department as
submitted.
The Court next heard a presentation by Shelbourn Veselka,
representing McCreary, Veselka, Bragg & Allen, on quarterly
delinquent tax collection figures.
Under announcement of interest items and possible future
agenda topics Commissioner Jones made the following comment:

land for the Justice of the Peace,
Precinct 6 office is located.

b) He informed the court that the Precinct 1
Volunteer Fire Department was proceeding
with their plans to construct a fire
station.
Commissioner Sims made the following comment:
a) He and Commissioner Thornton have met
with the two Fire Chiefs and will have an
inter-local contract prepared between the
cities of Bryan and college Sation and
Brazos County for EMS Services to county
residents.
The County Judge made the following comments:
a) There is a way to collect fees and fines
via the Web. We will need a presentation
on this process.
b) The agenda for next week's Commissioners
Court meeting will contain two letters to
the legislature. One is in reference to
HJR 22 relating to government liability
and the other relates to authorizing
counties to adopt more stringent
standards for on-site sewage disposal
systems
c) The Brazos Valley Historical Commission
dedication of a historical marker will be
held at 10:00 a.m. on Tuesday, January
30, 2001.
The County Auditor introduced Kevin McMahon a new
assistant Auditor.
There was no citizen input and/or concerns.
There being no further business to come before the Court,
the meeting was adjourned.

reasonably included in the original budget adopted September 5,

As per our contract dated March 10, 1998 and agreed change dated March 18, 1999, we
are hereby offering to continue and extend this contract for the third extension period of
one year till March 10, 2002.
We are prepared to perform the same high standard of service for the next year for all
joint auctions held for the County as was provided in the past. We are now offering the
sale of items over our Internet web site at a fee of 5% of the gross with no advertising
costs, of which you have already taken advantage of this service.
We need to start looking for a suitable date as our spring calendar fills up fast. We have
April 21 and May 23 already spoken for.
Please have the County Judge sign in the space provided and return one copy for our
files.
