To make arrangements, call (979) 361-4102. b COMMISSIONERS' COURT REGULAR MEETING JANUARY 16, 2001 • A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, January 16, 2001, with the following members of the Court present: Alvin W. Jones, County Judge; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3, Presiding; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Sims gave the invocation and led the pledge of all.egiance. • The first matter before the Court was the Oath of Office for Commissioner Tony Jones. The County Judge administered the Oath of Office. Commissioner Jones introduced his wife, mother-in-law and stepson to the Court. There was no citizen input/and or concerns. The Court next considered Budget Amendment #00/01-14.1 through 14.6, which would transfer funds from Contingency to the Department of Information Technology; set up a fund for Judicial Software, adjust the Reserve Fund Balance in the Special Forfeiture Fund, set up a budget for the Unclaimed Property Fund and Time Payment Fund and transfer funds from the Capital Improvement Fund to the Judicial Software Fund. ~J On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. . The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Sims, seconded by Vol AA Page d 6 9 I Commissioners' Court meeting January 16, 2001 2 Commissioner Cauley, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 20014723 through 20014999 On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the Claims as submitted. The Court next considered authorization for the performance of appraisals of real property. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize John Hamilton to perform appraisals of real property for Brazos County. The next matter before the Court was consideration of a Bank One Safekeeping Agreement and verification of items currently being held by the Treasurer for safekeeping for Brazos County. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to enter into a Safekeeping Agreement with Bank One. A copy of the Agreement is attached. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Dennis Rother on Vicks Lane in Precinct 3 in order to allow county trucks to turn around during road work. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to authorize the work. The Court next considered changes to the contract with W. M. Klunkert, Inc. for construction of the Detention Center Addition. The revisions would make the following changes: R-23 Security Camera modifications and add $150 to the cost. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve Revision R-23 and Change Order No. 2 for the Detention Center Contract. A copy of each is attached hereto. The Court next considered approval of a Walmart Credit Card and procedures for use. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve a WalMart Credit card and the procedures for use. A copy of the procedures is attached. The Court next considered a request from Constable Precinct 4, Duane Peters, to appoint Eric E. Dotson as an unpaid Reserve Deputy Constable. On motion by Commissioner Jones, seconded by Commissioner Sims, the Court voted unanimously to approve the request from Constable Peters to appoint Eric E. Dotson as unpaid Reserve Deputy Constable subject to appointment being within the allotted number of deputies. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to receive, approve and order filed as submitted the Treasurer's report for November 2000. A copy of which is attached to and made a part of these minutes. The Court next considered approval of the minutes of the Commissioners' Court meetings held in July, and August, 2000 on the following dates: July 11, 18, 25, August 1, 8, 15,22 and 29; Special meeting held on August 18 ani 2 Public Hearings held August 28. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve tie minutes as submitted. At 9:24 a.m. the County Judge announced the meeting closed to the public so that the Court could meet in Executive Session to discuss acquisition of real property as allowed under Section 551.072 Texas Government Code. At 10:30 a.m. the County Judge announced the meeting open to the public and announced there would be no action taken on the Executive Session. JUDICIAL BRANCH SUBTITLE D. JUDICIAL PERSONNEL AND OFFICIALS CHAPTER 51. CLERKS SUBCHAPTER K. TIME PAYMENT FEE Current through End of / 999 Reg Seas § 51.921. Time Payment Fee (a) in addition to other fees authorized or required by law, the clerk of each district court, statutory county court, county court, justice court, and municipal court shall collect a fee of 525 from a person who: (1) has been convicted of a felony or misdemeanor; and (2) pays any part of a fine, court costs, or restitution on or after the 31 st day after the date on which a judgment is entered assessing the fine, court costs, or restitution. (b) Court fees under this section shall becollected in the same manner as other fees, fines, or costs in the case. The officer collecting the fees shall keep separate records of the money collected under this section and shall deposit the money in the county or municipal treasury, as appropriate. (c) The custodian of the county or municipal treasury, as appropriate, shall keep a record of the amount of money on deposit collected under this section and shall send 50 percent of the fees collected under this section to the comptroller at least as frequently as monthly. The comptroller shall deposit the fees received to the credit of the general revenue fund. /(d) The custodian of the county or municipal treasury, as appropriate, shall deposit 10 percent of the fees collected under this section in the general fund of the county or municipality for the purpose of improving the efficiency of the administration of justice in the county or municipality. The county or municipality shall prioritize the needs of the judicial officer who collected the fees when making expenditures under this subsection. ((c') The custodian of the county or municipal treasury, as appropriate, shall deposit 40 percent of the fees collected under this section in the general revenue account of the county or municipality. The credit card would denote that a purchase order is required in order to use the credit card. The departments that use Wal-Mart regularly were very displeased when the found out they were not able to purchase there anymore. It is my understanding that Wal-mart no longer accepts purchase orders from Brazos County. The Jail Division is constantly searching for the most efficient means to obtain goods and services necessary for the operation of the county jail. Wal-mart has proven to be a excellent source for film, film processing, minor medical supplies, office supplies, and automotive maintenance items. Following Wal-mart's decision to stop accepting purchase orders, the jail has been forced to use other vendors. These vendors arc not usually competitive with Wal-mart's pricing. Brazos County will be well served by creating policy allowing the use of a credit card at Wal- mart. This policy should require the use of a blanket purchase order to encumber funds prior to charges being made to the card. This procedure should provide protection to Brazos County and enable various departments to use a quality vendor. This department used Wal-Mart frequently to make purchases of clothing and other items, and we are having a difficult time finding lower prices and/or desired quantities. • One example is sweat shirts and sweat pants that are purchased for the A.R.M.Y. Boot Camp Program. We can order this merchandise from other vendors, i.e., ICS, Bob Barker, but the prices are higher and the quality is lower. Another example is we occasionally have the need to purchase undergarments for indigent children going to placement. When we are purchasing for children going to placement, the merchandise is usually needed right away and in a small quantity. We would not have time to order from another vendor and cannot get a few pairs of underwear opposed to a dozen pair. Yet another example is when we hold our monthly parenting classes the staff psychologist purchases hard candy and drinks for this program. Ordering this type of merchandise from one of our food vendors is very expensive compared to Wal-Mart. I have listed just a few examples of problems posed by not having the Wal-Mart account. The only other 'local' vendor that is comparable would be Target, and their prices are somewhat higher on certain items.
