COMMISSIONERS' COURT
REGULAR MEETING
DECEMBER 12, 2000
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, December 12, 2000, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Sims gave the invocation and led the pledge
of allegiance.

There was no citizen input and/or concerns.
The Court next considered Budget Amendment #00/01-10.1
through 10.2 which would increase the budget of the Narcotics
Trafficking Task Force Grant and transfer funds from
Contingency to the Computer and Network Services Department.
On motion by Commissioner Sims, seconded by Commissioner
Thornton, the Court voted unanimously to approve the budget
amendment as submitted. A copy is attached.
The Court next considered a request by the District
Attorney to reclassify the group number for an Assistant
District Attorney position. This would reduce a current
position from a group 32, step 1 position to a group 27, step
1 position thus saving the County $1,300.00. On motion by
Commissioner Sims, seconded by Commissioner Thornton, the
Court voted unanimously to reclassify the group number for an
Assistant District Attorney position.

The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Thornton, seconded by
Commissioner Sims, the Court voted unanimously to approve the
changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Jones, seconded '~y Commissioner
Thornton, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered adopting a Resolution for the
creation of the office of Criminal District Attorney of Brazos
County and the abolishment of the offices of District' Attorney
of the 85 Ch Judicial District and the County Attorney of Brazos
County. Demetrios Basdekas commented on the proposed
combining of the County Attorney's office with that of the
District Attorney. Commissioner Sims moved to adopt the
Resolution. Commissioner Thornton seconded the motion.
Commissioner Sims and the County Judge voted "Aye".
Commissioners Jones, Thornton and Cauley voted "No". The
motion failed.
The Court next considered adopting a Resolution and
proposed legislation in reference to expanding the criminal
subject matter jurisdiction of the 85`h District Court and the
272nd District Court to include both felony and misdemeanor
jurisdiction. On motion by Commissioner Jones, seconded by
Commissioner Thornton, the Court voted unanimously to adopt a
resolution concerning the expansion of the criminal subject
matter jurisdiction of the 85`h District Court and the 272nd
District Court to include both felony and misdemeanor
jurisdiction.

The Court next considered adopting a Resolution and
proposed legislation in reference to the creation of
Magistrate positions for Brazos County. Commissioner Sims
moved to approve. Commissioner Jones seconded the motion.
Commissioners Jones, Thornton, Sims and the County Judge voted
"Aye". Commissioner Cauley voted "No". The motion carried.
The Court next considered adopting a Resolution and
proposed legislation in reference to the creation of a
Fifteenth Court of Appeals in Brazos County. On motion by
Commissioner Jones, seconded by Commissioner Sims, the Court
voted unanimously to adopt a resolution concerning the
creation of a Fifteenth Court of Appeals.
The next matter for consideration was the adoption of a
County Capital Expenditure and Minor Acquisition Policy. On
motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to adopt a County Capital
Expenditure and Minor Acquisition Policy. A copy is attached.
The Court next considered executing a Letter of
Acceptance for Local Benefit to participate in the Texas
Department of Public Safety's Safe & Sober Selective Traffic
Enforcement Program. This will enable the County to have
additional law enforcement to focus on speed, DWI and occupant
protection. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to authorize
the County Judge to execute a Letter of Acceptance for Local
Benefit to participate in the Texas Department of Public
Safety's Safe & Sober Selective Traffic Enforcement Program.
The next matter for consideration was Amendment Eight to
the Brazos County Employee Benefits Plan. On motion by
Commissioner Sims, seconded by Commissioner Cauley, the Court
voted unanimously to approve Amendment Eight. A copy is
attached.

The Court next considered the appointment of two
representatives to the Brazos County Bail Bond Board for the
year 2001. On motion by Commissioner Sims, seconded by
Commissioner Jones, the Court voted unanimously to appoint
Commissioner Thornton as the Cour4's representative and County
Court at Law I Judge, Randy Michel.
The next matter before the Court was the appointment of
members of the Brazos County Historical Commission. On motion
by Commissioner Sims, seconde3 by Commissioner Cauley, the
Court voted unanimously to the following individuals:

The Court next considered the following revisions to the
contract with W. M. Klunkert, Inc. for construction of the
Detention Center:

On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the three
revisions to the contract. A copy of each is attached.
On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to confirm the
cancellation of the Commissioners Court meeting of December
26, 2000.
The Court next considered acceptance of the Wellborn
Special Utility District cost estimate of $33,370.00 for

relocation' of approximately 4,200 feet of water line to {
accommodate the Straub Road widening project in Precinct 1.
• On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to accept the Wellborn
Special Utility District cost estimate of $33,370.00 for
relocation of water line on Straub Road.
The Court next considered the request from Wellborn
Special Utility District to construct water line installations
in the right-of-way of Gandy Road. The site is located in
Precinct 1. The County Engineer stated that all appeared to
be in order and recommended approval. On motion by
Commissioner Jones, seconded by Commissioner Cauley, the Court
voted unanimously to approve the request of Wellborn Special
Utility District and authorized the installation. A copy of
the request is attached hereto.
The Court next considered authorizing work outside of
• county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Charlotte Woods on
Zweifel Road in Precinct 2 to bury a dead horse. On motion by
Commissioner Thornton, seconded by Commissioner Cauley, the
Court voted unanimously to authorize the work.
The Court proceeded to consider the following blanket
Purchase Order:
Mansel's Wheel Constable Pct. 4 $1,000
On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Blanket
Purchase Order as submitted.
The Court next considered approval of a requisition from
the Road & Bridge Department to Wellborn Special Utility
District for relocation of a water line to accommodate the
'Straub Road widening project. On motion by Commissioner

Jones, seconded by Commissioner Thornton, the Court voted
unanimously to approve the requisition and authorized the
payment of $33,370.00 to Wellborn Special Utility District.
The Court next considered the renewal of Bid #2000-015,
Wireless Phone Service with Houston Cellular. On motion by
Commissioner Jones, seconded by Commissioner Thornton, the
Court voted unanimously to renew the contract for one
additional year. A copy of the packages is included.
The Court next considered awarding the following bid:
Bid No. 2001-014, Purchase and
Installation of Commercial Carpet
Pat Howard, Purchasing Agent, recommended
acceptance of the bid submitted by
Aggieland Carpet One. On motion by
Commissioner Jones, seconded by
Commissioner Thornton, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Aggieland Carpet One. A copy
of the bid tabulation is attached.
The next matter for consideration was approval for the
Purchasing Agent to advertise for the following bids:
a. Bid #2001-020 Hydrated Lime-Annual Contract
b. Bid #2001-021 Concrete-Annual Contract
c. Bid #2001-022 Materials Hauling-Annual Contract
d. Bid #2001-023 Herbicides& Surfactants-Annual
Contract
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the
Purchasing Agent to advertise for the previously noted bids.
Under announcement of interest items and possible future
agenda topics the County Judge made the following comment:
a) He commented on the possibility of the
weather turning bad.
At 10:25 a.m. the County Judge announced the meeting closed to
the public so that the Court could meet in Closed Executive
Session to discuss the purchase of real property as allowed
under Section 551.072 of the Texas Government Code.

At 11:02 a.m. the County Judge announced the meeting open

Executive Session.
There being no further business to come before the Court,

Based on the grantee's request, the Criminal Justice Division approves this grant adjustment. According to CJD
records, this adjustment is the first of four adjustments allowed during the grant year. Based on the
documentation submitted by Lee Freeman, received November 15, 2000, CJD approval is given for grantee to
transfer a total of $50,000 from Generated Program Income to create tine item "Commander", Schedule W
(Personnel), transfer $2,000 from line item 'Video Equipment' Schedule "D" (Equipment) to create line item
"Police Equipment' Schedule "F (Supplies & DOE). In addition, CJD approval given for grantee to asset share
$4,000 with the Brazos County Sheriff's Department and $592 with the College Station Police Department.
Grantee's new cash match ratio is 29.3319%. These changes will only affect Schedules "A (Personnel), "D"

1 am not an attorney, and I do not feel competent enough to offer detailed
comments on all of your proposals. As a private citizen, however, with work experience in a
quasi judicial federal regulatory agency, I would like to offer the following comments:
1. 1 believe that the concept of one defendant, one prosecutor, one judge, and one defense
attorney is judicially sound and fiscally respx)nsible.
2. There is considerable merit in Judge Delaney's suggestion that the offices of the County
Attorney and District Attorney may remain separate, but have all felony/misdemeanor
cases assigned to the District Attorney's Office, leaving the misdemeanor-only cases to
the County Attorney's Office, along with its other functions.
3. The duties of the County Attorney's Office should include those of legal counsel to
County Commissioner's Court and other county departments. The practice of the County
Commissioners' Court of retaining a private law firm to obtain legal advice is open to
conflict of interest problems, or the appearance thereof, which is not in the public interest.
If upgrading the expertise of the County Attorney's staff is necessary to effectively
perform this function, then it should be done. j

1. CAPITAL EXPENDITURES
A capital expenditure must be $1,000.00 or more with a life expectancy of
three or more years.
The funds for the purchase of all capital expenditures for all departments
are placed in the county's "General Capital Improvement Fund."
• All departments are required to follow the county's purchasing policy when
acquiring capital assets.
• Capital asset purchases are approved during the budget process. Each item to
be purchased-is identified with a maximum dollar value to be expended.
• At the time of purchase, if the item corresponds to the approved budget
(quantity to be purchased, description and budgeted amount), it is not necessary
for the purchase order to be processed/approved by the Commissioners Court.
• If the request for purchase deviates from the approved budget - by exceeding
the approved dollar amount, is not the specific item approved, or is a different
quantity - the requisition MUST be submitted to Commissioners Court for
approval.
• During the fiscal year, should the need arise to purchase items that were not
itemized and approved in the budget, all requests MUST go through
Commissioners Court for approval before the purchase can be made.
• Departments that are not supported by county funds are not required to submit
their capital expenditure purchases to Commissioners Court (i.e., Adult
Probation, Health Department, Metropolitan Planning Organization and
Juvenile Justice Department). These departments are still required to submit
the proper quotes and/or bids to insure compliance with state statutes, county
purchasing policies and established county accounting procedures.

II MINOR CAPITAL ACQUISITIONS

A minor capital acquisition has a value less than $1,000.00.
A minor capital asset is an item that i$ less than $1,000.00 in value and is accounted for
as an operating expense for which an elected official and/or department head will be
held accountable. These items will appear in the department's fixed asset ledger with
no value.

• The department will be responsible for notifying the County Judge and the
County Auditor of this situation.
• The County Auditor, at the request of the County Judge, will prepare a budget
amendment to transfer funds from the Capital Expenditure Fund to the
department's operating account.
• Once the budget amendment has been approved by Commissioners Court,
Purchasing may proceed with the acquisition.

CONTINUATION COVERAGE
A. Eligibility for Coverage under COBRA
If a Participant's coverage under this Plan terminates because of a "Qualifying
Event", and the Participant was covered under the Plan on the day before the
Qualifying Event, the Plan will offer the Participant the opportunity to continue
coverage as a "Qualified Beneficiary" in compliance with the Consolidated
Omnibus Budget Reconciliation Act of 1986, as amended (COBRA).
A *Qualified Beneficiary" is an Employee, Spouse and/or Dependent Child who
was covered under this Plan on the day before a Qualifying Event, and who loses
coverage as a result of the Qualifying Event. A Child who is born to the covered
Employee, or who is placed for adoption with the covered Employee, during a
period of COBRA continuation coverage is also a Qualified Beneficiary.

A "Qualifying Event" for a Participant is any of the following which results in a
loss of coverage for that Participant-
1) Termination of the Employee's employment for reasons other than gross
misconduct;
2) Reduction in the Employee's working hours to the extent that the Employee
is no longer eligible to participate in the Plan;
3) The Employee's death;
4) Divorce or legal separation of the Employee from the Employee's Spouse;
5) The Employee becomes entitled to Medicare benefits under Title XVIII of
the Social Security Act;
6) A Dependent Child no longer satisfies the Plan's definition of "Dependent
Child";
7) A proceeding in bankruptcy under Title 1 I of the United States Code with
respect to the Employer from whose employment a covered employee
retired at any time.

If any of the events listed in 1) through 7) immediately above results in an increase
in contribution which a Participant must pay to remain covered under the Plan, that
increase in contribution will also be considered a Qualifying Event and a loss of
coverage.
Coverage under COBRA will be identical to coverage offered under the Plan to
similarly-situated Employees, as such coverage under the Plan may change from
time to time. Each Qualified Beneficiary under COBRA shall have all the rights of
an Employee under the Plan, including the right to enroll dependents, if such right
is given to Employees; however, other than a child born to the Employee or placed
for adoption with the Employee during a period of COBRA continuation coverage,
any such dependent so enrolled, who was not covered under the Plan on the day
prior to the initial Qualifying Event, although eligible for coverage under COBRA,
shall not have the status of Qualified Beneficiary.
B. Initial Notification of a Qualifying Event
If the Qualifying Event is a divorce or legal separation, or a Dependent Child no
longer satisfying the Plan's definition of "Dependent Child", the Qualified
Beneficiary eligible for COBRA as a result of such Qualifying Event must notify
the Plan Administrator of the Qualifying Event, in writing, within sixty (60) days
of (a) the Qualifying Event, or (b) the date on which coverage is lost as a result of
the Qualifying Event, whichever is later. If the Plan Administrator is not so

notified, the Qualified Beneficiary may not enroll in COBRA. In the event of a
divorce or legal separation, notice sent to the Plan Administrator by any one of the
Participants for whom the divorce or legal separation constitutes a Qualifying
Event will be considered notice sent on behalf of all such Participants.
For all other Qualifying Events, the Employer will notify the Plan Administrator of
a Qualified Beneficiary's Qualifying Event within thirty (30) days of such event.
The Plan Administrator will then notify all Qualified Beneficiaries, in writing, of
their rights to continue coverage under COBRA, within fourteen (14) days
following the thirty-day period specified above in this paragraph.
C. Electing COBRA
If a Qualified Beneficiary wishes to enroll in COBRA, he must so notify the Plan
Administrator, in writing, within (60) days of the date the Plan Administrator mails
written notification of the right to continue coverage, except that if loss of
coverage occurs after the date of the Qualifying Event, the sixty (60) days shall be
counted from the date coverage is lost. An election is considered to be made on the
date it is mailed to the Plan Administrator.
Each Qualified Beneficiary may make his own independent election to receive or
not receive COBRA coverage. If an Employee or a Spouse of an Employee, which
such person is a Qualified Beneficiary, elects COBRA and does not specify his
election is self-only, the election will be deemed to include election of COBRA for
all Qualified Beneficiaries with respect to that Qualifying Event. An election on
behalf of a minor child may be made by the child's parent or legal guardian An
election on behalf of a Qualified Beneficiary who is incapacitated or deceased may
be made by the legal representative or the estate of the Qualified Beneficiary, as
determined under applicable state law, or by the spouse of the Qualified
Beneficiary.
If notice of election is not sent to the Plan Administrator within the period
specified in the paragraph immediately above, the Qualified Beneficiary may not
enroll in COBRA.
A Participant who waives his right to COBRA during the initial 60-day period
discussed in the first paragraph of this Section may, at any time during such 60-day
period, revoke his waiver and enroll in COBRA; however, coverage under
COBRA will be effective as of the date the revocation of the waiver is sent to the
Plan Administrator, and will not be made retroactive to the date coverage would
have been in effect had the waiver not been made.
The right to revoke a waiver expires at the end of the initial 60-day period
discussed above in this Section.

D. Payment for COBRA
•
The cost to a Qualified Beneficiary for COBRA coverage shall be 102% of the
Employer's cost, or 150% of the Employer's cost during an 11-month extension for
disability (as explained below), for such coverage.
A Qualified Beneficiary's first payment for COBRA is due forty-five (45) days
after the date of his election. All subsequent payments are due within thirty (30)
days of the first day of coverage such payment represents, or within the period of
time allowed under the Plan for covered Employees, whichever is later. Payment is
considered to be made on the date on which it is sent to the Plan.
Failure to pay any contributions due within the timeframes specified in this Section
will result in cancellation of COBRA coverage, such cancellation to be effective as
of the end of the last day for which coverage has been paid. COBRA does not
require that the Qualified Beneficiary be notified in the event cancellation of
COBRA coverage has occurred.
E. Length of COBRA Coverage
(1) For Covered Employees, Spouses and Dependent Children

If the Qualifying Event is an Employee's termination of employment for
reasons other than gross misconduct, or reduction in hours worked to the
extent that the Employee is no longer eligible for coverage under the Plan,
COBRA may be continued for up to eighteen (18) months for all
Participants who become Qualified Beneficiaries as a result of such event.
If a Qualified Beneficiary is disabled on the day of either Qualifying Event
discussed in the paragraph immediately above, or becomes disabled during
the first sixty (60) days of COBRA coverage, COBRA coverage for all
Qualified Beneficiaries in the disabled Qualified Beneficiary's family may
be continued for an additional eleven (11) months beyond the original
eighteen (18) months, regardless of whether or not the disabled individual
himself elects the 11-month extension. As used herein, "disabled" means
the Qualified Beneficiary has been determined under Title 2 or Title 16 of
the Social Security Act to be disabled. The "first sixty (60) days of COBRA
coverage" is counted from the date of the Qualifying Event or the date
coverage would actually be lost, whichever is later.
For the 11 -month extension to apply, the Qualified Beneficiary must notify
the Plan Administrator, in writing, of the determination of disability, such
notification to be within the initial 18-month period of COBRA, and not
more than sixty (60) days after the date on which the determination was
made by the Social Security Administration. If the disabled Qualified
Beneficiary is later determined by the Social Security Administration to no

longer be disabled, he must so notify the Plan Administrator, in writing,
within thirty (30) days of such re-determination. If the re-determination
occurs during the initial eighteen (18) months of COBRA, coverage may
continue until the end of the eighteen (18) months. If the re-determination
occurs during the 11-month extension, coverage will cease for all Qualified
Beneficiaries as of the month that begins more than thirty (30) days after
the date of the re-determination.
If a Qualified Beneficiary first becomes disabled more than sixty (60) days
after COBRA has begun, or fails to notify the Plan Administrator as
explained above within the 18-month period, the 11-month extension does
not apply.
(2) For Spouses and Dependent Children
If the Qualifying Event is other than the two specified in (1) directly above,
COBRA coverage may be continued for up to thirty-six (36) months for
any Spouse or Dependent Child(ren) who become Qualified Beneficiaries
as a result of such Qualifying Event.
(3) Multiple Qualifying Events
I€a second Qualifying Event occurs during COBRA coverage, in no event
will coverage under COBRA be extended beyond a maximum of thirty-six
(36) months from the date of the initial Qualifying Event. Termination of
employment following the Qualifying Event of reduction in hours is not a
second Qualifying Event.
F. Early Termination of COBRA Coverage
COBRA coverage shall terminate earlier than the 18-, 29- and 36- month time
periods given in this Section if any of the following occur:
(1) The Employer ceases to offer any group health plan (including successor
plans) to any employee (COBRA will terminate on the day such coverage
ceases); or
(2) The first day for which timely payment is not made to the plan with respect
to the Qualified Beneficiary (COBRA will terminate on the last day of the
period for which contributions have been made); or
(3) The Qualified Beneficiary becomes entitled to Medicare, provided such
entitlement first occurs after the date of the election (COBRA will
terminate on the date of entitlement); or

(4) The Qualified Beneficiary becomes covered under another group health
plan, in any capacity, even if that other coverage is of lesser value,
provided such coverage first becomes effective after the date COBRA
continuation has been elected, and provided the plan does not limit
coverage for Pre-Existing Conditions which apply to the Qualified
Beneficiary, or has such limits but such limits do not apply to the Qualified
Beneficiary because of Creditable Coverage (COBRA will terminate on the
date coverage under the other plan becomes effective).
In addition, COBRA coverage for a Qualified Beneficiary may be terminated at
any time for cause, to the degree coverage for a similarly-situated Employee's
coverage under the Plan may be terminated for cause.
If an individual who is not a Qualified Beneficiary is receiving COBRA coverage
solely because of his relationship to a Qualified Beneficiary, that individual's
coverage under COBRA will cease at the same time as the Qualified Beneficiary's
coverage ceases. Such loss of COBRA coverage shall not constitute a Qualifying
Event.
G. Interpretation
This Article reflects the latest interpretations of the IRS rulings; however, if the
IRS ruling or interpretation should change, this Plan will automatically be
amended to reflect any such change under the COBRA legislation.
ARTICLE VI9 (SECTION B) CO-PAY PLAN, ELIGIBLE MEDICAL EXPENSES in
reference to Organ Transplants is hereby restated in its entirety to include language regarding the
Special Transplant Program.
NON-EXPERIMENTAL HUMAN-TO-HUMAN ORGAN TRANSPLANTS
(REFER TO THE SECTION BELOW ENTITLED "SPECIAL TRANSPLANT
PROGRAM" THAT IS AVAILABLE TO COVERED PERSONS WHO
PARTICIPATE IN THIS PLAN)
The medical expenses incurred in acquiring the organ(s) to be used in any and all covered
transplants received by a Covered Person include charges for:
1. Tests for crossmatch donor, suitability and other such screening tests related to the
donation of the organ(s), whether used or not; and
2. Hospital, surgical, storage and transportation costs incurred that are related to the
donation of the organ(s), whether used or not.

When only the transplant recipient is a Covered Person, the benefits of this plan will be
provided for the donor to the extent that benefits to the donor are not provided under any
other form of coverage. In no such case under this plan will any payment of a "personal
service" fee be made to any donor, but only the necessary hospital and Physicians' medical
care and services expense with respect to the donation will be considered for benefits.
When only the donor is a Covered Person, the donor will receive benefits for care and
service necessary to the extent such benefits are not provided for the donor under any
coverage available to the recipient for the organ or tissue transplant procedure. Benefits
will not be provided to any recipient who is not a Covered Person.
When the transplant recipient and the donor are both Covered Persons, benefits will be
provided for each in accordance with his respective eligible expenses.
.SPECIAL, TR,4N.SPI.ANT PROGRAM
In addition to the standard transplant benefit, the following benefits may be available
when a Covered Person participates in the Special Transplant Program. This Special
Transplant Program is an enhancement to the standard transplant benefit and participation
in the program is voluntary.
ADDITIONAL. COVERED BENEFITS PROVIDED UNDER THE SPECIAL
TRANSPLANT PROGRAM
I . Access to transplant Centers of Excellence across the United States, as well
as out-patient peripheral stem cell facilities.
2. Reimbursement for travel and lodging expenses incurred during entire
transplant (immediately before and after the transplant) up to a $5,000
maximum for the Covered Person and companion. Travel and lodging
discounts are also available through select airlines and hotels.
3. Waiver of Covered Person's deductible and out-0f--pocket expenses, up to a
$1,500 maximum.
4. Services of a Transplant Facilitator, who will coordinate the cost savings.
The benefits above are only available when a Covered Person fully participates in
the Special Transplant Program and meets all of the following requirements:
1. Pre-notnftcatton of the upcoming transplant must be given by the Covered
Person, their physician, or Third-Party Administrator as soon as the
Covered Person is identified as a potential transplant candidate. Pre-
notification must be made to 1-888-40RGANS (or call the pre-certification
number on the back of the medical identification card). and
z All transplant services must be rendered at a transplant Center of

ARTICLE X, CLAIMS, CO-PAY AND DEDUCTIBLE PLANS, section C is hereby amended
to allow terminated Employees 90 days rather than 30 days from date of termination to file a
claim. Such section is hereby restated-
C. In order to be considered eligible for payment, written proof of claim must be submitted to
the Plan Supervisor within 90 days after the loss or as soon as reasonably possible. In any
event, claims will not be accepted more than one year and 90 days following the date of
the loss, except in the case of legal incapacity. When an Employee's coverage terminates
for any reason, written proof of claim must be given to the Employer within 90 days of the
date of termination of coverage, provided that the Plan remains in force. However, upon
termination of the Plan, final claims must be received within 30 days of termination.
Claims will be paid within a reasonable period of time following receipt of written proof,
from available benefit fund deposits made by the Employer.
ARTICLE XX, HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT
(HIPAA) COMPLIANCE is hereby restated to read as follows:

HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT (HIPAA)
COMPLIANCE
"HIPAA" shall mean the Health Insurance Portability and Accountability Act of 1996, as
presently enacted and as it may be amended from time to time, together with its related rules and
regulations. References to any section of HIPAA shall include any successor provisions.
The Plan Sponsor of a non-federal governmental plan may elect to be exempt from any or all of
the requirements identified below:
(1) Limitations on pre-existing condition exclusion periods;
(2) Special enrollment periods for individuals (and dependents) losing other coverage;
(3) Prohibitions against discriminating against individual participants and beneficiaries based
on health status,
(4) Standards relating to benefits for mothers and newborns;
(5) Parity in the application of certain limits to mental health benefits.
As a non-federal governmental plan, this Plan has elected to be exempt from the following
sections of the Health Insurance Portability and Accountability Act for plan year January 1, 2001
ending December 31, 2001.

REQUIREMENTS:
A) No work will be permuted between front slope and/or back slope.
B) All installations shall be constructed in designated utility easements, if applicable. If no utility
easement exists, the installation(s) shall be 1) within 3-5' of and parallel to the right-of-way line
and/or 2) in the case of a road bore, perpendicular to the right-of-way line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county nght-of-way.
D) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698: test
shall be conducted by an independent Geotechnical testing firm: copies of all test results shall
be furnished to the office of the Brazos County Engineer.
E) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of Transportation,
and all other State and Federal laws governing utility construction.

The location or description of the proposed installation is more fully shown by 3
copies of the drawings attached to this notice.
I understand and agree that:
The County Engineer must be notified 72 hours prior to the beginning of
construction in order that he, or his designated inspector, may inspect the
actual installation.
2. All damage to the roadways and rights-of-way will be repaired to their
original condition to the satisfaction of the County Engineer.
3. Brazos County reserves the right to require Applicant to relocate or lower
any such line at no cost to Brazos County, should same become
necessary due to widening or lowering, or other alteration of the roadway
or right-of-way.
4. Brazos County will in no way be responsible for any damage which might
occur to any existing utility lines in the right-of-way.
5. The line will be constructed and maintained on the County right-of-way in
accordance with the Utility Accommodation Policy which was adopted by the
Texas Department of Transportation on May 29, 1989.
6. The line or lines will be constructed no less than twenty-four inches (24") lower
than the lowest part of the drainage or bar ditch and the drainage is to be
considered at least two feet (2') below the center of the roadway.
