REGULAR MEETING
•
DECEMBER 5, 2000
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, December 5, 2000, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4, Absent;
Mary Ann Ward, County Clerk.

The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Thornton gave the invocation and led the
pledge of allegiance.
There was no citizen input and/or concerns.
The Court next considered Budget Amendment #00/01-9.1
through 9.2 which would reallocate funds for the County
Auditor and set up a budget for the Exposition Center Bond
Issue. On motion by Commissioner Sims, seconded by
Commissioner Thornton, the Court voted unanimously to approve
the budget amendment as submitted. A copy is attached.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Sims, seconded by
Commissioner Thornton, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as

On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Claims as
submitted.

The Court next considered authorizing the Auditor's
office to process recurring payment requests for the
following:
a) Brazos County Appraisal District 4 equal
payments of $55,654.25 for a total of
$222,617
b) Brazos Janitorial for cleaning services
10 equal payments of $175.00 for a total
of $1,750
On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to authorize the
Auditor's office to process all the previously noted recurring
payments.
The Court next considered approval of Minor Acquisitions
as follows:

On motion by Commissioner Sims, seconded by Commissioner
Thornton, the Court voted unanimously to approve the
prioritized lists submitted by the Sheriff.
The Court next considered approval of an amendment to the
County Travel and Reimbursement Policy and Procedures. On
motion by Commissioner Sims, seconded by Commissioner
Thornton, the Court voted unanimously to approve the amendment

on condition that the typographical errors be corrected. A
copy is attached.

The Court next considered authorizing Commissioner Jones
to negotiate for construction of a building for the Justice of
the Peace and Constable, Precinct 2. Commissioner Jones
summarized the project. Emily Staples, Precinct 1 VFD Fire
Chief, gave a rundown of the fire department's progress on the
project, She stated a need to proceed because of the increased
number and severity of wrecks occurring on State Highway 6
South. Commissioner Jones stated that he had contacted legal
counsel so as to stay within the law when bidding the work.
Commissioner Sims asked about the land. Commissioner Jones
replied that originally the county would enter into a ninety-
nine year lease with the owner having first right of refusal
should the county vacate the property. The land has since
been donated. On motion by the County Judge, seconded by
•
Commissioner Thornton, the Court voted unanimously to
authorize Commissioner Jones to negotiate for construction of
a building.
The Court next considered renewal of a lease agreement
between the Brazos Valley Art League and Brazos County for
rental of office space within the Brazos Center located at
3232 Briarcrest Drive, in Bryan, Texas. Term of the lease is
for the period of one year commencing on November 1, 2000 and
ending on October 31, 2001. The Art League agrees to pay
Brazos County Four Hundred Eighty dollars ($480.00) per month.
On motion by Commissioner Thornton, seconded by Commissioner

Sims, the Court voted unanimously to renew the lease agreement
between Brazos County and Brazos Valley Art League for the
period stated above. A copy of the lease agreement is
attached.
The Court next considered acceptance of the resignation
of Dr. J.T.L. McNew from the Brazos County Health Department

Board. On motion by Commissioner Sims, seconded by
Commissioner Jones and Thornton, the Court voted unanimously
to accept Dr. McNew's resignation.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Dean Allen on Long
Trussel Road to construct a channel to drain excess water from
roadway ditches. The site is in Precinct 3. On motion by
Commissioner Sims, seconded by Commissioner Jones, the Court
voted unanimously to authorize the work.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public.. The Road and Bridge Department requested
permission to enter the private property of Norman Ellison on
Jack Creek Road to install a 900 drop inlet for spillway of
lake under Jack Creek Road. The county will remove and
replace approximately 70 feet of fence to access the property.
The site is in Precinct 2. On motion by Commissioner
Thornton, seconded by Commissioner Jones, the Court voted
unanimously to authorize the work.
The Court proceeded to consider the following blanket
Purchase Order:

On motion by Commissioner Sims, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The next matter for consideration was approval for the
Purchasing Agent to advertise for the following bids:

On motion by Commissioner Sims, seconded by Commissioner
Jones, the Court voted unanimously to authorize the Purchasing
Agent to advertise for bids.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held in June 2000 on the
following dates: 6, 13, 20, 27; Joint Legislative meeting held
June 14, 2000 and Workshop held on June 20. On motion by
Commissioner Sims, seconded by Commissioner Thornton, the
Court voted unanimously to approve the minutes as submitted.
Under announcement of interest items and possible future

agenda topics the County Judge made the following comments:
a) He received a letter from the Texas
Department of Public Safety informing him
that the Safe & Sober Traffic Program has
funds for an additional law enforcement
officer.
b) A historical marker wil be placed on the
Courthouse lawn December 6, 2000. A
dedication ceremony will be held January
30, 2001.
c) The Texas Department of Transportation
has informed him that the Justice of the
Peace, Precinct 3 office on Highway 21
East will be demolished. The County has
90 to 180 days to locate another
building. He asked Commissioner Jones to
look into locating another building.
d) He received a letter from C. K. Rylander
in reference to Lateral Road funds.
There are approximately $24,000.00 to be
used for improvement/construction of
lateral roads.
e) The parking lot on 26`n Street will be
blocked off December 6, 2000 for the
funeral of Mark Hiatt.

f) The United Way Campaign fell way short of
the $9,000 goal. Juvenile Services had 26
contributors.
g) He received a letter from Austin in
reference to farm loans for disaster
(drought) relief.

h) He received a memo from the Auditor in
reference to personal use of County
phones for long distance calls.
i) He received a memo from the Purchasing
Agent in reference to WalMart Credit
Cards.
J) He visited with the Judge of the 85"'
District Court and asked him to prepare
resolutions on the four topics discussed
at the last workshop.
k) There will be no Commissioners Court
meeting December 26, 2000.
There was no citizen input and/or concerns.
There being no further business to come before the Court,
the meeting was adjourned.

NO. 00/01 - 9.1 through 9.2
On this the 5th day of December 2000 at a regular meeting of
the Commissioners' Court, the following members were present:
Alvin W. Jones, County Judge, Presiding
Tony Jones, Commissioner, Precinct 1;
Wm. S. Thornton, Commissioner, Precinct 2;
Randy Sims, Commissioner, Precinct 3;
Carey Cauley, Commissioner, Precinct 4;
Mary Ann Ward, County Clerk.
The following proceedings were held:
THAT WHEREAS, on December 5, 2000 the Court heard and approved
a budget amendment for the 2000-2001 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 9,
1999 the following amendment(s) to the original are hereby
authorized, as described on the attached page(s).
ADOPTED AND APPROVED this the 5th day of December 2000.

Procedure:
No. 3. Amended to read:
County will not reimburse an employee for more than $25.00 pe day for meals. Meal reimbursement
to an employee who is not away from their duty station overnight will be considered a benefit and
the amount will be reflected on the employee's W-2 form at the end of the year. Meal
reimbursement will of be provided to an employee who is less than 'e" i6aR seventy five 75
miles away from their duty station unless the employee is away overnight.
The County will reimburse the traveling County employee for actual cost of lodging expenses
incurred, not to exceed $75.00 base rate (without taxes) while traveling on official County business.

COUNTY OF BRAZOS
LEASE AGREEMENT
This agreement is made between BRAZOS COUNTY, TEXAS, hereinafter called Lessor, and BRAZOS
VALLEY ART LEAGUE, hereinafter called Lessee is as follows:
Lessor, the Owner of the Brazos Center, a multi-use building and the adjacent grounds has agreed and
does hereby agree, to lease and demise unto Lessee, a portion of the Brazos Center, hereinafter described,
upon the following terms and conditions.
1. Lessee shall be exclusively entitled to the space allocated to it by the Director of
the Center for a term beginning November 1, 2000 and ending October 31, 2001.
The space allocated to Lessee as described in Attachment "A" hereto, which
have been signed by the Director of the Center. (Room 106 and Closet)
A. Lessee shall have access to this space during those hours in which the Brazos
Center is open for normal business. Lessee will not have a key to the exterior
door of the facility.
B. Lessee shall use the leased premises solely for the use and purposes for which
it is let, that being the conduct of the Brazos Valley An League meetings,
classes, exhibits and workshops.
C. Lessee shall provide the Director of the Center with a monthly schedule of
activities by the 15th of the preceding month. Lessor is responsible for
verifying that the Center is scheduled to be open prior too scheduling
activities.
2. A. In consideration therefore, Lessee agrees to pay the Lessor on the first
working day of each calendar month during the term hereof, in advance, the
sum of $480 representing the agreed monthly rental for use of such space
as herein set forth.
B. In addition, Lessee has permission to use Concourse and Assembly III for
three an shows per year. The term for each not being longer than seven

C. Lessor will make staff and chairs available to set the room three times per
month, auditorium style for up to 40 persons, at the request of Lessee.
Lessee will request this service at least 30 days in advance for each set-up.
3.
Lessee agrees to arrange and hang work of local artists on a continual basis in
Showcase III. Artist's works chosen too be spotlighted are the sole responsibility
of Lessee. At least six artists per year will be featured. The Brazos Center has
the right to deny exhibition of any work that the director deems to be of
questionable appropriateness.
4.
Lessor shall furnish all utilities, including gas, water and electricity. Excluding
telephone service.
5.
Lessee will pay the regular User fees for space used by it, other than space
allocated to it under this agreement.
6.
Lessor does not provide and will not
provide furnishings, custodial care, or
maintenance of the space allocated to Lessee under this agreement. Lessor will
replace light bulbs, only.
7.
Lessee shall take good care of the space allocated to it, reasonable wear and tear
only excepted, and shall surrender the premises at the termination of this
agreement.
8.
Lessee agrees that no improvements to or alterations to the space shall be made
without the consent of Lessor in writing.

Risk of loss of all property owned by Lessee shall remain with Lessee, it being
understood that Lessor will maintain no insurance on such property. Any
insurance desired by Lessee on Lessee's property shall be purchased by Lessee at
its expense.
10.
Lessor shall not be Gable to Lessee or the Lessee's employees for any damage to
person or property ceased by the negligent act of Lessor Its agent, set : vents, of
employees or due to the act of any other tenant In the building, or due to any
defect or went of repair In any part of the building of which the a9ocated space
forms a part.

Lessee agrees to hold Lessor harmless from any and e0 claims, damages,
expenses, Including ettomey's fees, growing out of or adsing from any negrgent
act on the part of Lessee, its agent servants of employees.
12. No sign shall be placed at, on, or about the premises by Lessee except with the
approval of the Center Director in writing. One sign, no larger than 18" X 24 can
be placed on each door. Design and materials to be approved in advance by
center director.
13. This agreement can be terminated by either party upon written notice of intent
delivered by U.S. mail, return receipt requested. The termination notice must
allow the lessee 45 days from the date of the notice to vacate the premises,
likewise, the lessee will give the lessor 45 days notice of intent to vacate; or the
lessee shall pay the lessor a prorated amount of rent not to exceed $720.00
(seven hundred twenty dollars.)
IN TESTIMONY WHEREOF, the parties to this agreement have hereunto set their hands in duplicate,
the day and year written below.
