NOVEMBER 14, 2000 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE

A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, November 14, 2000, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3, Absent;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
The County Judge gave the invocation and led the pledge
of allegiance.
Under citizen input and/or concerns, Demetrios Basdekas
commented on his disappointment over the manner in which the
issue of the Expo Center was handled. He felt that it was
primarily done illegally behind closed doors and that the
results of the election were tainted. He reminded the Court
that the issue passed by less that % of 1 percent which to him
indicated some irregularities.
The Court considered the appointment of an Interim
Director for the Brazos Center. On motion by Commissioner
Thornton, seconded by Commissioner Sims, the Court voted
unanimously to appoint Janice McKean as Interim Director for
the Brazos Center.
The Court next considered Budget Amendment #00/01-7.1
which would transfer funds from Contingency to various
departments for electronic equipment purchases. On motion by
Commissioner Sims, seconded by Commissioner Thornton, the
,Court voted unanimously to approve the budget amendment as
submitted. A copy is attached.

The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Sims, seconded by
Commissioner Thornton, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
20013031 through 20013261
On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Claims as
submitted.
The Court proceeded to canvas the results of the General
Election held November 7, 2000. County Judge read aloud the
returns of the federal and state elections. On motion by
Commissioner Sims, seconded by Commissioner Jones, the Court
voted unanimously to accept the county-wide totals as
tabulated and ordered the results to be certified to the
Secretary of State and recorded in the Official Election
Records of Brazos County. County Judge read aloud the returns
on the county elections. On motion by Commissioner Sims,
seconded by Commissioner Thornton, the Court voted unanimously
to accept the county-wide totals as tabulated and ordered the
results to be certified to the Secretary of State and recorded
in the Official Election Records of Brazos County. A copy of
the election results as tabulated is attached hereto.
The next matter for consideration was rescinding the
renaming of Gandy Road, Sherwood Drive and Blue Ridge Drive as
acted upon on October 24, 2000. Commissioner Jones explained
the reasons for rescinding the renaming of the three roads.

On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to rescind the renaming
of Gandy Road, Sherwood Drive and Blue Ridge Drive in Precinct

The Court then considered the renaming of Gandy Road,
Sherwood Drive and Blue ridge Drive located in Precinct 1.
Ray Crow, Engineering Aide suggested renaming the entire road
as Rock Prairie Road West from FM 2154 to Hopes Creek Road.
Rene Frisbee and Jill Bennet spoke on behalf of leaving the
name of Blue Ridge Drive as it is. Commissioner Jones moved
to rename the three roads. Commissioner Thornton seconded the
motion. Commissioners Jones, Thornton and Sims voted "Aye".
The County Judge abstained. The motion carried to name 7andf
Road and Sherwood Drive from FM 2154 to Dowling Road, Rock
Prairie Road and from North Dowling Rod to Hopes Creek Road
leave it named Blue Ridge Drive.
The next matter before the Court was to consider adoption
of an Order authorizing Bruchez, Goss, Thornton, Meronoff &
Hawthorne, PC to begin condemnation proceedings for acquiring
road right-of-way for the Straub Road project concerning a
10.32 acre tract owned by Sylvia Borland. The site is located
in Precinct 1. On motion by Commissioner Jones, seconded by
Commissioner Thornton, the Court voted unanimously to adopt
the Order to begin condemnation proceedings A copy of the
order is attached hereto.
On motion by the County Judge, seconded by Commissioners
Jones, Thornton and Sims, the Court voted unanimously to adopt
a resolution honoring Judge John M. Delaney and to thank him
for his years of exemplary service.
The Court next considered authorizing the Auditor's
office to process recurring payment requests for the
following:
a) TA&MU Department of Psychology for
counseling services for Juvenile Inmates
$9,795.00
b) Brazos Valley Council of Government, for
indigent health care for $60,000

On motion by Commissioner Sims, seconded by Commissioner
Thornton, the Court voted unanimously to authorize the
Auditor's office to process all the previously noted recurring
payments.
The next matter for consideration was a tax refund to
Windrush-REO, L.P and GSSW-REO Landmark Limited Partnership.
In a Court settlement it was agreed that the appraised value
for 1999 on property #28344 be lowered to $3,180,000.00 and
the appraised value for 1999 on property #28345 be lowered to
$2,120,000.00. On motion by Commissioner Sims, seconded by
Commissioner Thornton, the Court voted unanimously to refund
$600.02 in county taxes for 1999 on property #28344 and to
refund $421.37 in county taxes for 1999 on property #28345 to
Windrush-REO, L.P and GSSW-REO Landmark Limited Partnership.
The Court. next considered approving a corrected Tax
Resale Deed and authorization for the County Judge to execute
the corrected Tax Resale Deed for Lot 9, Block "B" Munnerlyn
Village Addition, to Gladis X. Colon Ramirez and Mirna C.
Rodriguez. On motion by Commissioner Sims, seconded by
Commissioner Thornton, the Court voted unanimously to approve
a corrected Tax Resale Deed and authorized the County Judge to
execute the corrected Tax Resale Deed.
The next matter for consideration by the Court was
authorization for Texas A&M University Department of
Entomology to conduct fire ant control research on properties
owned by Brazos County. On motion by the County Judge,
seconded by Commissioner Sims, the Court voted unanimously to
remove this from the agenda.
On motion by Commissioner Sims, seconded by Commissioner
Thornton, the Court proceeded to set the holidays to be
observed by Brazos County for 2001:

One (1) Floating Holiday
The Court next considered a request by the County Auditor
to accept donated property. Twenty (20) tires were seized and
forfeited to the interest and possession of Brazos County. On
motion by Commissioner Sims, seconded by Commissioner
Thornton, the Court voted unanimously to accept the 20 tires
with the estimated value of $1,133.22.
The next matter before the Court was approval of a
Contractual Agreement between Brazos County and the Bryan/
College Station Eagle for classified line ads. The cost to

Brazos County will be .87 cents per line. The term of the
contract will be from November 1, 2000 until October 31, 2001.
On motion by Commissioner Sims, seconded by Commissioner
Thornton, the Court voted unanimously to enter into
contractual agreement with the Bryan/College Station Eagle.
A copy of the contractual agreement is attached hereto.
The next matter for consideration was approval for the
Purchasing Agent to advertise for the following bids:
Bid 2001-016, Cold Mix Limestone-Annual Contract
Bid 2001-017, Fencing Supplies-Annual Contract
Bid 2001-018, Fence Building-Annual Contract
Bid 2001-019, Motor Grader Blades-Annual Contract
On motion by Commissioner Sims, seconded by Commissioner
Jones, the Court voted unanimously to authorize the Purchasing
Agent to advertise for bids.

The Court next considered approval of requisitions from
the Capital Expenditure Fund for the following purchases:
a) Backup Software of Imaging Server for
Computer & Network Services Dept. $832.00
b) E-mail Server for County, $4,538.00

On motion by Commissioner Sims seconded by Commissioner
Thornton, the Court voted unanimously to approve the
requisitions to be paid from Capital Expenditures Fund.
The Court next considered the request from Wellborn
Special Utility District to a road bore for water line
installation in the right-of-way of Bird Pond Road
approximately 1.0 mile from its intersection with SH 30. The
site is located in Precinct 3. The County Engineer stated
that all appeared to be in order and recommended approval. On
motion by Commissioner Sims, seconded by Commissioner Jones,
the Court voted unanimously to approve the request of Wellborn
Special Utility District and authorized the installation. A
copy of the request is attached hereto.
On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to receive, approve and
order filed as submitted the Treasurer's reports for September
2000 and the Quarter Ending September 30, 2000. A copy of
which is attached to and made a part of these minutes.
Under announcement of interest items and possible future
agenda topics the County Judge made the following comments:
a) He announced that he was pleased to have
Janice McKean serve as Interim Director
of the Brazos Center.
b) There is the possibility of having a
Workshop next Tuesday, November 21, 2000
at 2:00 p.m. to discuss the option of
combining the County and District
Attorneys' offices.
The County Clerk thanked the County Judge, County
Engineer, the Chief Deputy, the Executive Assistant and the
Elections Clerk for making the election process run smoothly
and honestly.
There was no citizen input and/or concerns.
There being no further business to come before the Court,
the meeting was adjourned.

reasonably included in the original budget adopted September 9,
1999 the following amendment(s) to the original are hereby

maintenance, expansion. widening. repair. extension and reconstruction of Straub Road
thereon and located in Brazos County, Texas.
BE. IT ORDERED BY THE COUNTY COMMISSIONERS COURT OF
THE COUNTY OF BRAZOS, TEXAS:
Section 1. That the findings and recitals in the preamble of this Order are hereby
found and determined to be true and correct and are hereby approved and adopted.
Section 2. That the official offer by Brazos County, Texas, for 0.297 acres
necessary for the road right-of-%%ay to the land described in Exhibit "A" attached hereto,
in the amount of $1.782.00 represents the right-of-way's fair market value based upon an
appraisal by an independent fee appraiser, and is hereby confirmed and the County staff
and its authorized agents and representatives are hereby authorized and directed to offer
the owner the amount of $1,782 00 for the necessary property.
Section 3. That in the event the authorized official offer described in Section 2 is
refused by the owner of the said property designated for the right-of-way, the County of
Brazos, Texas is hereby authorized and directed to institute and prosecute to conclusion
proceedings in eminent domain against the owner of" said property and against all

the SAMUEL DAVIDSON LEAGUE, Abstract No 13, and being out of that certain Called 10.32
acre tract of land conveyed from Joan Borland to Sylvia Borland by deed recorded in Volume
3579, Page 34 of the Official Records of Brazos County, Texas (O R B.C.T.). said 0.297 of one
acre (12,952 square feet) tract of land being more particularly described by metes and bounds as
follows:
BEGINNING at a point in an existing fence line for the northeast comer at the northeast comer of
the remainder of said Borland called 10 32 acre tract of land, as occupied, same being a point in
the existing southerly nght-of-way line, as occupied, of a county road commonly known as Straub
Road, same also being the occupied northwest corner of the Leota J Smith remainder of a called
34 61 acre tract of land as described in a deed recorded in Volume 1441, Page 169 (O R.B.C.T.);

ITEM: Request from Wellborn Special Utilily District to construct a road bore for water
line installation in the right of way of Bind Pond Road approximately 1.0 mile from its
intersection with SH 30. Site is located in Precinct 3.
SOURCE OF FUNDS: N/A
1. PRESENTATION:
A) No work will be permitted between front slope and/or back slope.
B) All installations shall be constructed in designated utility easements, if applicable. If no utility
easement exists, the installation(s) shall be 1) within 3-5' of and parallel to the right-of-way line
and/or 2) in the case of a road bore, perpendicular to the right-of-way line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right-of-way.
D) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test
shall be conducted by an independent Geotechnical testing firm; copies of all test results shall
be fumished to the office of the Brazos County Engineer.
E) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of Transportation,
and all other State and Federal laws governing utility construction.

construction in order that he, or his designated inspector, may inspect the
actual installation.

All damage to the roadways and rights-of-way will be repaired to their
original condition to the satisfaction of the County Engineer.

Brazos County reserves the right to require Applicant to relocate or lower
any such line at no cost to Brazos County, should same become
necessary due to widening or lowering, or other alteration of the roadway
or right-of-way.
4.
Brazos County will in no way be responsible for any damage which might

occur to any existing utility lines in the right-of-way.
5.
The line will be constructed and maintained on the County right-of-way in
accordance with the Utility Accommodation Policy which was adopted by the
Texas Department of Transportation on May 29, 1989.
6.
The line or lines will be constructed no less than twenty-four Inches (24•) lower
than the lowest part of the drainage or bar ditch and the drainage is to be
considered at least two feet (2') below the center of the roadway.
7.
All sites will be barricaded during the construction period.
Construction of this line will begin on or after the;=day of r . 20_0
