BRAZOS COUNTY COMMISSIONERS COURT
THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
SEPTEMBER 12, 2000 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.
1. Invocation - Commissioner Thornton.
2. Pledge of Allegiance - Commissioner Thornton.
3. Call for citizen input and/or concerns.
Consider and take action on agenda items 4 - 14:
4. Budget Amendment 99/00-41.
5. Personnel Changes of Status.

7. Resolution levying a tax rate for the tax year 2000.

COMMISSIONERS' COURT
REGULAR MEETING
SEPTEMBER 12, 2000
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, September 12, 2000, with the following
members of the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3, Absent;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Thornton gave the invocation and led the
pledge of allegiance.
Under citizen input and/or concerns, Demetrios Basdekas
made the following comments:
1. Expressed concern over the county budget
suggesting a more equitable distribution of
resources for the departments and employees.
2. Construction of the Expo Center gives the
impression that money is being syphoned off the
departments to fund it.
The Court next considered Budget Amendment #99/00-41.1
through 41.8 which would reallocate funds for Juvenile
Services, County Court at Law #2, Treasurer, Sheriff and
Constable, Precinct 5; increase the budget of the Grant Fund
Sale to Intoxicated Person, Building Maintenance and Jail
Administration. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the budget amendment as submitted. A copy is attached.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests.

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the changes as
submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
20011000 through 20011174
On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Claims as
submitted.
All members being present, the Court proceeded to set the
tax rate for the year 2000. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
adopt a Resolution to set the ad valorem taxes against all
property in Brazos County, Texas according to the following
schedule:
Maintenance & Operating funds $.3736
Sinking Fund $.0364
TOTAL TAX RATE FOR 2000 $.4100 per $100
valuation
on motion by Commissioner Thornton, seconded by
Commissioner Cauley, the Court voted unanimously to adopt a
resolution authorizing the County Judge to make application
to the Texas Department of Transportation, for grant funds for
the Comprehensive Underage Drinking Enforcement Program. This
program is to deter licensed establishments and their
employees from selling alcoholic beverages to underage persons
and educate students, parents and retailers on the dangers of
underage consumption of alcoholic beverages and to authorize
the County Judge to accept such grant funds should they be
tendered.
The court next considered approval of revisions to the
contract with W. M. Klunkert, Inc. for the detention center
addition as follows:

Waiting, $1,159.00
c. R-36 Sprinkler system re-work at drainage flume,

d. R-37 Relocate valves from Cell 159 to Chase 158,
$884.00
Commissioner Sims questioned R-37, asking why the valve had
been placed in the cell in the first place. He was told that
it had been over looked. Commissioner Jones moved to approve
the revisions. Commissioner Cauley seconded the motion.
Commissioners Jones, Cauley and the County Judge voted "Aye".
Commissioners Sims and Thornton voted "No". The motion
carried.
The Court next considered a Maintenance Agreement with
IKON Office Solutions for the Purchasing Department's copier.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Maintenance
Agreement with IKON Office Solutions and authorized the County
Judge to execute the Agreement on behalf of Brazos County. A
copy of the Agreement is attached.
The Court next considered approval of a requisition from
the Capital Funds, Computer Replacement for the following
purchase:
a) A Computer for the Computer & Network
Services Department's training room,
$1,385.00
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the requisition
to be paid from Capital Funds, Computer Replacement.
The Court next considered approval of a requisition from
the Capital Funds, Printer Replacement for the following
purchase:
a) Printer replacement for the Sheriff's
Office $5,285.00
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the requisition
to be paid from Capital Fund, Printer Replacement.

The Court next considered approval of a requisition for
a computer and speakers for County Court at Law #2 utilizing
departmental computer hardware funds. On motion by
Commissioner Cauley, seconded by Commissioner Thornton, the
Court voted unanimously to approve the requisition in the
amount of $1,385.00.
The Court next considered the request from Verizon
Southwest to construct approximately 636 feet of buried cable-
installations in the right-of-way of Peach Creek Cut-Off Road;
656 feet of buried cable shall be placed in the 16 ft. utility
easements along Pipeline Road. The site is located in
Precinct 1. The County Engineer stated that all appeared to
be in order and recommended approval. On motion by
Commissioner Jones, seconded by Commissioner Thornton, the
Court voted unanimously to approve the request of Verizon
Southwest and authorized the installation. A copy of the
request is attached hereto.
The Court acknowledge receipt of Orders determining
compensation of the County auditor, Assistant County Auditors
and Court Reporters.
Under announcement of interest items and possible future
agenda topics the County Judge made the following comments:
a) He informed the Court that the Auditor
had supplied him with a list of comp time
that is currently on the books for county
employees. He is asking departments to
ask employees to take comp time in lieu
of payment.
b) He received the Financial Report from the
Auditor and there was nothing significant
in it.
There was no citizen input and/or concerns.
There being no further business to come before the Court,
the meeting was adjourned.

On this the 12'h day of September 2000 at a regular meeting of
the Commissioners' Court, the following members were present:
Alvin W. Jones, County Judge, Presiding
Tony Jones, Commissioner, Precinct 1;
Wm. S. Thornton, Commissioner, Precinct 2;

The following proceedings were held:
THAT WHEREAS, on September 12, 2000 the Court heard and
approved a budget amendment for the 1999-2000 budget year for
Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 9,
1999 the following amendment(s) to the original are hereby
authorized, as described on the attached page(s).

WHEREAS, the Commissioners Court is responsible for the levy or adoption of a tax rate
for Brazos County;
NOW, THEREFORE, BE IT RESOLVED that the Commissioners Court of Brazos
County, Texas does hereby levy or adopt the tax rate on $100 valuation for the County of Brazos for
tax year 2000 as follows:
$ .3736 for the purpose of maintenance and operation
5.0364 for the payment of principal and interest on debt of this county
S.4100 Total Tax Rate.
BE IT FURTHER RESOLVED that the tax assessor-collector is hereby authorized to
assess and collect the taxes of Brazos County in accordance with the above set rate.

ITEM: Reouest from Verizon Southwest to construct aDDroximately 636 ft. of

buried cable shall be placed in the 16 ft. utility easements along Pipeline Road. Site is
located in Precinct 1.
SOURCE OF FUNDS: N/A
1. REQUIREMENTS:
A) No work will be permitted between front slope and/or back slope
B) All installation(s) shall be constructed in designated utility easements, if applicable. If no utility
easement exists, the installation(s) shall be 1) within 3-5' of and parallel to the nght-of-way line
and/or 2) in the case of a road bore, perpendicular to the right-of-way line.
C) If clearing of brush, trees and other obstruction is necessary. it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc from county right-of-way.
D) Duch line shall be compacted to 90% standard density ASTM•Test Method No. D-698; test
shall be conducted by an independent Geotechnical testing firm: copies of all test results shall be
furnished to the office of the Brazos County Engineer.
E) Construction shall be in strict conformance to the latest Texas Manual of uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of Transportation,
and all other State and Federal laws governing utility construction.

ATTENTION COUNTY JUDGE:
Formal notice is hereby given that VERIZON COMMUNICATIONS will
construct a communication line within the right-of-way of a County Road in
Brazos County, Texas as follows: ,

Approximately 636 feet of-buried cable will be placed in the south
R.O.W. of PeachLreed Road near the intersection with north bound
feeder of Hwy 6. Also on same job approximately 656 feet of cable
is to be placed on Pipeline Road starting at the intersection with Peach
Creek Road. All cable is to be placed approximately 3 feet in R.O.W. F-
The location and description of this line and associated appurtenances is
more fully shown by two (2) copies of drawings attached to this notice. The line ~r a
will be constructed and maintained on the County Road right-of-way in
accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly
understood that the tender of this notice by the Verizon Southwest Incorporated
does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or
right now granted by law or may be granted in the future and any provision or
provisions so construed shall be null and void.
Construction of this line will begin on or after August 2000.

On August 3, 2000, after a public hearing in accordance with the Texas Local
Government Code, Section 152.905, the undersigned Judges of the 85`x, 272"° and 361" District
Courts determined the compensation to be paid to the County Auditor and Assistant County
Auditors as set forth in this order.

Brazos County should provide merit pay allowances for the operating departments of Brazos
County, neither event have effect on this order of the District Judges, and neither event should be
allowed to alter this order.
