AUGUST 22, 2000
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, August 22, 2000, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3, Absent;
Carey Cauley,•Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Cauley gave the invocation and led the
pledge of allegiance.
There was no citizen input and/or concerns.
The Court next considered Budget Amendment #99/00-38.1
through 38.3, which would reallocate funds for the Computer
Network Services Department, and increase the budgets of the
Sheriff's Jail Administration and Court Support Costs. On
motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the budget
amendment as submitted. A copy is attached.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as

On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Claims as
submitted.
The next matter before the Court was the adoption of an
Order of Incorporation for the Town of Kurten. In an election
held August 12, 2000 the majority of the voters voting in the
election voted in favor of the incorporation of the community
to be known as the Town of Kurten. On motion by Commissioner
Thornton, seconded by Commissioner Cauley, the Court voted
unanimously to make the incorporation of the community as a
Type B General-Law Municipality, known as the Town of Kurten,
effective on August 22, 2000 being the date the Order was
entered into the minutes of the Brazos County Commissioners
Court and a certified copy of the order and plat of the
municipality be recorded in the Deed Records of Brazos County.
The Court next considered entering into agreement with
the Psychology Clinic in the Department of Psychology at Texas
A&M University for Clinical Psychology Services for Juvenile
inmates. On motion by Commissioner Jones, seconded by
Commissioner Cauley, the Court voted unanimously to enter into
agreement with the Psychology Clinic in the Department of
Psychology at Texas A&M University and authorized the County
Judge to execute the Agreement on behalf of Brazos County. A
copy of the Agreement is attached.
The Court next considered adoption of an Order for
Special Election for the election of Mayor, five Aldermen and
Marshall for the Town of Kurten. The voters within the area
of the Town of Kurten, voted on August 12, 2000 to
incorporate their community as a Type B General-Law
Municipality. Section 23.021 of Vernon's Local Government
Code, states that immediately after the municipality has
incorporated, the County Judge of the county in which the
municipality is located shall order an election for Mayor,
Aldermen and Marshall.'' On motion by Commissioner Thornton,

the City of Bryan Tax Increment Financing Zone No. 8. On
motion by the County Judge, seconded by Commissioner Cauley,
the Court voted unanimously to approve the revised Project and
Financial Plans for the said TIF No. 8, which calls for the

to order a Special Election for the election of Mayor, five
Aldermen and Marshall for the Town of Kurten to be conducted
on November 7,2000. A copy of the Order is attached.
The next matter before the Court was the adoption of an
Order for Relocation of Polling Place for Election Precinct
32. The ciurrent site located in Friends Congregational
Church located at 2200 Southwood Drive, College Station, Texas

is no longer available. The College Station Public Library,
located at 800 FM 2818, College Station, Texas, has agreed to
allow the polling place to be located in the library building.
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to adopt an Order for
Relocating Polling Place for Election Precinct 32 in the
College Station Public Library and send the submission to the
Assistant Attorney General, Civil Rights Division, Voting
Section, Department of Justice, Washington, D.C. for pre-
clearance. A copy of the Order is attached.
On motion by Commissioner Jones, seconded by Commissioner

Cauley, the Court voted unanimously to adopt a resolution in
support of the continuation and expansion through regional
councils of governments of the Texas Solid Waste Grants
Program and specifically requests that the Texas Legislature
appropriate the full one-half of fees collected to this
important program.

The court next considered an Amendment of Agreement for

funding of two additional projects. The first project costing
Eight Hundred Fifteen Thousand Dollars ($815,000.00) for the

improvement to be made to Pendelton Drive stretching from
Copperfield Drive to Highway 158 and the second, One Hundred
Thousand Dollars ($100,000.00) for the purchase of land
necessary to realign FM 60 where it intersects Highway 158.
The Court next considered two applications for tax refund
for Reliant Building Products:
1. 608 Carson Street $529.55
2. 615 Carson Street $16,273.44
The company has filed a voluntary petition for Chapter 11
relief in the United States Bankruptcy Court. On motion by
Commissioner Cauley, seconded by Commissioner Thornton, the
Court voted unanimously to refund $16,802.99 in county taxes
for 1999 to Reliant Building Products.
The Court next considered approval of four Hewlett
Packard Agreements for Support Services for Computer and
Network Services. On motion by Commissioner Cauley, seconded
by Commissioner Thornton, the Court voted unanimously to
approve the four agreements for support services. A copy of
each agreement is attached.
The Court next considered an Exemption from Competitive
Bidding Requirements of Local Government Code, Section
262.024(a)(4). This is for the purchase of Professional
Insurance Consulting Services from Gray & Company. On motion
by Commissioner Cauley, seconded by Commissioner Thornton, the
Court voted unanimously to approve the Exemption •of
Competitive Bidding Requirements and authorized the payment
for all professional services from the designated vendor for
the 1999-2004 fiscal year.

unanimously to approve the payment of the requisition to IKON
Office Solutions in the amount of $995.00.
The Court next considered approval of a requisition from
Computer Replacement Fund in the amount of $3,144.00 for the
purchase of a computer for the Purchasing Department. On

Thornton, the Court voted unanimously to approve the
requisition to be paid from Computer Replacement Fund.
The Court next considered approval of requisitions from
the Capital Projects Fund for the following purchase:
a) Laptop Computer for District Clerk

On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the
requisition to be paid from Capital Projects Fund.
The next matter before the Court was approval of a
requisition to Kesco Supply, Inc. in the amount of $20,816.00
for the jail expansion. On motion by Commissioner Cauley,
seconded by Commissioner Thornton, the Court voted unanimously
to approve the requisition.
The next matter for consideration was Amendment Number 7
to the Brazos County Employee Co-Pay and Deductible Insurance
Plan to authorize payment of charges for professional fees
charged by a specialist to interpret x-ray and/or lab tests.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve Amendment
Number 7 to the Brazos County Employee Co-Pay and Deductible
Insurance Plan. A copy is attached.
The next matter for consideration was the payment of
professional fees to Austin Pathology and Brazos Valley
Pathology for laboratory services performed. On motion by
Commissioner Jones, seconded by Commissioner Thornton, the
Court voted unanimously to include coverage for the
professional fees.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of the J. H. Nash
Estate on Chick Lane in Precinct 4 to clear out all underbrush

and all tree limbs up to a height of 6 feet for a distance of
100 feet in either direction from the curve for better sight
distance. 'On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to
authorize the work.
The Court next considered the request from Verizon to
construct a road bore and place approximately 3,800 feet of
parallel cable in the rights-of-way of Opersteny Road and Old
Reliance Road. The site is located in Precinct 3. The County
Engineer stated that all appeared to be in order and
recommended approval. On motion by Commissioner Cauley,
seconded by Commissioner Thornton, the Court voted unanimously
to approve the request of Verizon and authorized the
installation. A copy of the request is attached hereto.
The Court next considered acceptance of the Brazos
Utility Service cost estimate of $10,000.00 for relocation of
a sewer line at Cain Road, Abbate Road and I&GN Railroad
right-of-way to accommodate the I&GN extension project in
Precinct 1. On motion by Commissioner Jones; seconded by
Commissioner Thornton, the Court voted unanimously to accept
the Brazos Utility Service cost estimate of $10,000.00 for
relocation of a sewer line at Cain Road, Abbate Road and I&GN
Railroad right-of-way.
The Court next considered approval of the Final Plat of
Rock Bottom Ranch Subdivision in Precinct 1. Richard Vance,
County Engineer, stated that he had reviewed the plat and all
appeared to be in order. On motion by Commissioner Jones,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the final plat of the Rock Bottom Ranch Subdivision
as submitted.

Under announcement of interest items and possible future
agenda topics the County Judge made the following comments:
a) He announced that a Workshop would be
held jointly with the Bryan and College
Station Fire Department head to discuss
EMS Services.
b) The KBDI is 740.
c) He announced that John Hachmann,
Purchasing Agent had resigned effective
August 25, 2000. The Judge will act as
interim Purchasing Agent until the
position is filled.
d) He, Ruth McLeod and M.J. Deen will be
traveling to Austin this evening to
receive the "Best Practice Award" for the
Justice of the Peace computer program
that the county developed.
There was no citizen input and/or concerns.
There being no further business to come before the Court,
the meeting was adjourned.

ORDER OF INCORPORATION FOR THE
TOWN OF KURTEN
WHEREAS, on the 201 day of June, 2000, a Special Election was ordered to be held on
August 12, 2000 to determine whether or not the community known as Kurten would be
incorporated as a Type B General-Law Municipality pursuant to Chapter 7 of the Local Government
Code; and
WHEREAS, the incorporation election was duly held on August 12, 2000; and
WHEREAS, at said incorporation election &9 _voters voted in favor ofthe incorporation
of the community to be known as the Town of Kurten, and .S voters voted against the
incorporation of the community to be known as the Town of Kurten; and
WHEREAS, a majority of the voters voting at said Special Election held on August 12, 2000
voted in favor of the incorporation of the community to be known as the Town of Kurten.
NOW, THEREFORE, IT IS ACCORDINGLY ORDERED THAT the community,
contained within the territory described as "Exhibit A" attached hereto is hereby incorporated as a
Type B General-Law Municipality under Chapter 7, Local Government Code, to be known by the
name of the Town of Kurten.
IT IS FURTHER ORDERED THAT the incorporation of the community as a Type B
General-Law Municipality, known as the Town of Kurten, is effective on August 22, 2000, the date
this order is entered into the minutes of the Brazos County Commissioners Court.
IT IS FURTHER ORDERED THAT a certified copy of this order and a plat of the
municipality known as the Town of Kurten shall be recorded in the Deed Records of Brazos County,
Texas.

Clinical Psychology Services Agreement between
Brazos County Department of Juvenile Services
and the Psychology Clinic in the
Department of Psychology at Texas A&M University
I. Purpose of Agreement
This contract outlines an agreement between the Brazos County Department of Juvenile Services
(henceforth referred to as Juvenile Services) and the clinical psychology program in the
Department of Psychology at Texas A&M University (henceforth referred to as TAMU) regarding a
clinical assistantship program between the two institutions.
The purpose of this agreement Is to provide the terms whereby (a) students enrolled in the
Doctoral Clinical Psychology Program shall receive on-site educational experiences from Juvenile
Services, and (b) Juvenile Services shall receive clinical psychology services provided by students
enrolled in the Doctoral Clinical Psychology Program.
II. Respective Responsibilities
A. TAMU agrees to:
1. Provide a masters-level graduate student in clinical psychology to Juvenile Services for 10
hours/week for 50 weeks during a 12-month period (500 hours per year).
2. Provide one hour per week of doctoral-level supervision for this graduate student.
3. Bill Juvenile Services monthly for services provided.
B. The student agrees to:
1. Provide clinical psychology services to Juvenile Services for 10 hours/week. Scheduling of these
10 hours is to be negotiated on an individual basis between the student and Juvenile Services.
2. Include within the 10 hours/week the following on-site activities:
Direct clinical services, staff meetings and consultations, and all administrative responsibilities
including preparation of written reports and maintenance of clinical records.
3. Comply with policies established by Juvenile Services regarding code of ethics, confidentiality,
and other issues relevant to provision of clinical services in a multidisciplinary setting. The student
will supply appropriate certification of credentials and complete agreements regarding
confidentiality and other professional issues as required by Juvenile Services of its staff and
consultants.
C. Juvenile Services agrees to:
1. Submit a check payable to Texas A&M University 10 days following receipt of the bill for
services.
2. Provide case-try-case consultation to the student on an as-needed basis by Juvenile Services
staff.
3. Provide written evaluation of the student to the director of clinical psychology training at TAMU
at the end of the term of this agreement.
4. Identify two weeks during the 12-month period, in consultation with the student, during which
no clinical services will be provided by the graduate student.

D. TAMU and Juvenile Services both agree to:
1. Selection of the graduate student for this clinical assistantship by the Director of Qinical
Psychology Training at TAMU in consultation with program faculty and with appropriate Juvenile
Services administrative personnel.
2. Mutual evaluation of the graduate student throughout the term of this agreement. In the event
that difficulties arise with any component of the assistantship program, the following steps will be
undertaken:
a. Ether Juvenile Services or TAMU may initiate a joint meeting with representatives from
both institutions, including the student assigned to the assistantship, to identify relevant
issues and plan appropriate interventions to remediate these difficulties.
b. In the event that appropriate interventions cannot be identified or upon implementation
and modification prove unsuccessful, reasonable efforts will be made to continue the
student's clinical assistantship at Juvenile Services through the last month of the current
academic semester.
c. Should continuation of the assistantship or a given student through the end of the
current academic semester not prove possible, this agreement may be cancelled upon 30
days written notice by either Juvenile Services or TAMU.
III. Professional Liability
1. Professional liability insurance provided to graduate students in clinical psychology through the
Department of Psychology will cover their clinical assistantship responsibilities at Juvenile Services.
IV. Cost of Agreement
1. This agreement constitutes a fixed-cost contract
2. Juvenile Services agrees to purchase these services for the sum of $11,754.00 to be paid In 12
monthly installments of $979.50. This sum is equivalent to $23.51 per service hour.
V. Term of Agreement
1. The term of this agreement shall be for a period of 12 months beginning September 1, 2000
and ending August 31, 2001.
2. This agreement may be renewed if mutually agreed upon by both parties.

ORDER FOR SPECIAL ELECTION
WHEREAS on the, 14th day of June 2000, a Petition and Application for the
Incorporation of the Town of Kurten was filed with the County Judge of Brazos County, Texas,
praying that this Judge order an election to be held within the boundaries of that certain tract or
parcel of land within the County and described on Exhibit "A" attached hereto and incorporated
herein by this reference of the purpose of enabling the voters thereof, to determine whether they
desire to incorporate their community as a Type B General-Law Municipality to be know as the
"Town of Kurten"; and
WHEREAS on the2&b day of June, 2000, such Petition and Application was heard and
an order was adopted by the County Judge and Commissioners Court of Brazos County, Texas,
calling for a Special Election to be held on August 12, 2000 for the purpose of enabling the
voters thereof, to determine whether they desire to incorporate their community as a Type B
General-Law Municipality; and
WHEREAS on the_= day of August. 2000, a Special Election was held and the
proposed Incorporation of the Town of Kurten passed by a vote of 80 for and _5 against;
and
WHEREAS Section 23.021 of Vernon's Local Government Code, states that
immediately after the municipality has incorporated, the County Judge of the County in which
the municipality is located shall order an election for a mayor, five aldermen and a marshall; and
WHEREAS the next uniform election date is November 7,2000: and
WHEREAS the Judge finds that a Special Election should be granted for the purpose of
enabling the voters to elect a mayor, five aldermen and a marshall.
NOW THEREFORE IT IS ACCORDINGLY ORDERED THAT on November 7,
2000, such date being not less that forty-five (45) days from the date hereof, a Special Election
be held at:

Congregational Church located at 2200 Southwood Drive, College Station, Texas; and
WHEREAS, the Commissioners Court of Brazos County has been notified that the Friends
Congregational Church located at 2200 Southwood Drive, College Station, Texas will no longer be
suitable for the conduction of elections; and
WHEREAS, the College Station Public Library has agreed to allow the polling place for
Election Precinct 32 to be located in the College Station Public Library building located at 800 F.M.

1. REQUIREMENTS:
A) No work will be permitted between front slope and/or back slope.
B) All installation(s) shall be constructed in designated utility easements, If applicable. If no utility
easement exists, the installation(s) shall be 1) within 3-5' of and parallel to the right-of-way line
and/or 2) In the case of a road bore, perpendicular to the right-of-way line.
C) If clearing of brush, trees and other obstruction is necessary, It shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right-of-way.
D) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test
shall be conducted by an independent Geotechnical testing firm; copies of all test results shall be
furnished to the office of the Brazos County Engineer.
E) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of Transportation,
and all other State and Federal laws governing utility construction.

ATTENTION COUNTY JUDGE:
Formal notice is hereby given that VERIZON SOUTHWEST, INC. will
construct a communication line within the right-of-way of a County Road in
Brazos County, Texas as follows:
Verizon Southwest, Inc. will be placing approximately 3800 feet of
buried telephone cable along the northeast side of Opersteny Road
at a minimum depth of 30". This cable will be placed 3 feet in the
county right-of-way. This job will also required a bore under Old
Reliance Road at the intersection of Opersteny Road and Old
Reliance Road.
The location and description of this line and associated appurtenances is
more fully shown by two (2) copies of drawings attached to this notice. The line
will be constructed and maintained on the County Road right-of-way in
accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly
understood that the tender of this notice by the Verizon Southwest Incorporated
does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, aythority, permission, privilege or
right now granted by law or may be granted in the future and any provision or
provisions so construed shall be null and void.
