BRAZOS COUNTY COMMISSIONERS COURT
THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
JULY 18, 2000 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,

A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, July 18, 2000, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Cauley gave the invocation and led the
pledge of allegiance.
Under citizen input and/or concerns, Ronald A. Gordon of
6094 Steel Store Road in Precinct 4, complained of the
condition of the citizen's collection site that is across the
road from his property.
The Court next considered Budget Amendment #99/00-33.1
through 33.6, which would reallocate funds for Road & Bridge,
Jail Administration, and set up a budget for the Sheriff's
office and Community Support. On motion by Commissioner Sims,
seconded by Commissioner Thornton, the Court voted unanimously
to approve the budget amendment with the exception of
amendment 33.2, a copy of which is attached hereto.
The next matter for consideration was a request by the
Sheriff's office to reclassify the Assistant Crime Stoppers
position. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to approve the
request.

The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to approve the
changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
20008892 through 20009162
On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Claims as
submitted.
The next matter for consideration by the Court was the
Adoption of the Order Prohibiting Out Door Burning for Brazos
County. As of Sunday, the drought index was at 579. On
motion by Commissioner Jones, seconded by Commissioner Sims,
the Court voted unanimously adopt the outdoor burning ban.
The next matter before the Court was approval of a
Contractual Agreement between Brazos County and the Brazos
Valley Community Action Agency, Inc. (BVCCA). The BVCCA will
provide dental services to the County's indigent population,
including but not limited to dental care, laboratory and x-ray
services and physician services. The cost to Brazos County
will be $60,000.00 annually. The term of the contract will be
from July 15, 2000 to September 30, 2001. On motion by
Commissioner Cauley, seconded by Commissioner Sims, the Court
voted unanimously to enter into contractual agreement with the
Brazos valley Community Action Agency, Inc. A copy of the
contractual agreement is attached hereto.
The Court next considered the District Attorney's Office
policy regulating use of county-owned vehicles.

On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the District
Attorney's Office Policy regulating the use of County owned
vehicles. A copy is attached.
The next matter for consideration was a request by the
County Attorney to create a temporary position with funds from
an Investigator's position. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to authorize the creation of a temporary position.
The Court next considered Revision R-29 and R-30 to the
contract with W. M. Klunkert, Inc. for construction of the
Detention Center Addition. The revisions would make the
following changes:
R-29 - would add a GFI breaker to showers and add
$300.00 to the cost.
R-30 - would relocate door at Boiler 206 adding
$588.00to the cost.
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve Revisions R-29
and R-30 Construction Contract. A copy of each revision is
attached hereto.
The Court next considered Change Order No. 1 for the
Detention Center Construction Contract. The Change Order
would make the following change:
Add seven (7) day weather extension per revision R-

Add eleven (11) day weather extension per revision
R-11.
Commissioner Jones moved to approve. Commissioner Cauley
seconded the motion. Commissioners Jones, Thornton, Sims and
Cauley voted "Aye". The County Judge voted "No". The motion
carried. A Copy of the Change Order is attached hereto.

The court next considered changes to the County's
contribution to the retirement benefits for employees. On
motion by Commissioner Sims, seconded by Commissioner
Thornton, the Court voted unanimously to continue with the
present plan.
The next matter before the Court was approval of a
Contractual Agreement between Brazos County and Texas Voting
Systems, Inc. (TVS). TVS will conduct a Special Election to
be held on August 12, 2000. The cost to Brazos County will
be $2,035.00. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to enter into
contractual agreement with Texas Voting Systems, Inc. A copy
of the contractual agreement is attached hereto.
The next matter for consideration was a tax refund to
Long John Silvers Liquidating Trust. On motion by
Commissioner Jones, seconded by Commissioner Cauley, the Court
voted unanimously to refund to Long John Silver's Liquidating
Trust, $564.72 in county taxes for the years 1997 and 1998 on
three properties.
The next matter for consideration was the authorization
to use the County Judge's electronic signature for documents
submitted by Vertex Corporation to the Criminal Justice
Department concerning the federal alien inmate assistance
program. On motion by Commissioner Thornton, seconded by
Commissioner Cauley, the Court voted unanimously to authorize
the use of the County Judge's electronic signature for
documents submitted by Vertex Corporation to the Criminal
Justice Department.
The Court next considered modifying the Longevity Pay
Policy to exempt temporary employees from participation.

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to exclude employees

The Court next considered approval of requisitions from
the Capital Projects Fund for the following purchases:

Cauley, the Court voted unanimously to approve the
requisitions to be paid from Capital Projects Fund.

seconded the motion. After some discussion, Commissioners

the Court voted unanimously to remove this from the agenda.

At 9:37 a.m. the County Judge announced the meeting
closed to the public so that the Court could meet in closed
Executive Session to discuss the purchase of real property
under Section 551.072 of the Texas Government Code.
At 10:21 a.m. the County Judge announced the meeting open
to the public and announced no action would be required.
Under citizen input and/or concerns, Tom Golson of the
Computer and Network Services Department voiced concern over
the audit to be conducted by the Comptroller's Office.
There being no further business to come before the Court,
the meeting was adjourned.

ORDER PROHIBITING OUTDOOR BURNING

WHEREAS, the Texas Legislature has granted to the Brazos County Commissioners Corut
the authority to restrict outdoor burning when necessary to protect health and safety pursuant to the
Local Government Code §240.906; and
WHEREAS, the Brazos County Commissioners Court hereby finds that circumstances
present in the unincorporated area of Brazos County create a public safety hazard that would be
exacerbated by outdoor burning;
NOW, THEREFORE, BE IT ORDERED that pursuant to the authority granted to the
Brazos County Commissioners Court by Local Government Code §240.906, the following order is
adopted:
(1) Outdoor burning is prohibited in all of the unincorporated area of Brazos County.
(2) This order is effective on the day it is adopted and for 90 days thereafter unless the
restrictions are terminated earlier based on a determination made by the Texas Forest
Service or this Court.
(3) This order does not prohibit outdoor burning activities related to public health and
safety that are authorized by the Texas Natural Resources Commission for:
(a)firefighter training; (b)public utility, natural gas pipeline or mining operations;
(c)harvesting of agricultural crops; or (d)diseased animal carcasses when burning is
the most effective means of controlling the spread of disease or the threat of disease.
(4) A person commits an offense if the person knowingly or intentionally violates the
prohibition established by this order.
(5) A violation of this order is a Class C misdemeanor, punishable by a fine not to
exceed $500.00.

! , CONTRACT
THIS CONTRACT IS ENTERED into by and between BRAZOS COUNTY, TEXAS, acting
by and through its duly elected County Commissioners Court (hereinafter "County'), and the
BRAZOS VALLEY COMMUNITY ACTION AGENCY, INC. (hereinafter "Provider'),
located at 504 East 270i Street, Bryan, Texas 77802.
RECITALS:
WHEREAS, the County is obligated to provide for the health and safety of its citizens;
and
WHEREAS, the County is responsible to a degree for the support of the County's poor,
and
WHEREAS, the residents of Brazos County are not served by a public hospital or
hospital district; and
WHEREAS, the County, pursuant to the Indigent Health Care and Treatment Act, Health
and Safety Code, § 61.001 et seq. (the "Act'), is authorized to provide certain Dental Services to
the County's indigent population, including but not limited to dental care, laboratory and x-ray
services and physician services; and
WHEREAS, the County, pursuant to the Act, has authority to contract with a private
facility for the provision of such services; and
WHEREAS, the Provider, has established a clinic to provide such services to the
County's indigent and poor residents; and
WHEREAS, the parties hereto believe that a Contract for services between them can be
mutually beneficial.
NOW THEREFORE KNOWN ALL MEN BY THESE PRESENTS that for and in
consideration of the mutual benefits herein described, the parties agree as follows:
TERM
This Contract shall commence on the 15'h day of July, 2000 and terminate on the 301e day
of September, 2001 (the "Contract Term').
This Contract may be canceled by either party hereto upon sixty (60) days written notice
as provided herein.

SERVICE TO BE PERFORMED BY PROVIDER
Provider shall provide the following services through trained, salaried staff to dental
patients who qualify for such services pursuant to the guidelines currently implemented for
making such determination: interviews, lab work, physical exams, educational information and
medicine as needed (herein "Dental Services").
COUNTY'S MONETARY COMMITTMENT
County shall, on or before August 1, 2000, advance to Provider against the total cost to
provide Dental Services to Brazos County qualified residents during the Contract Term, the sum
of SIXTY THOUSAND AND N01100 DOLLARS ($60,000.00). Such advance shall be used as
a reserve against which Provider shall provide up to $60,000.00 in Dental Services to Brazos
County qualified residents. No additional monies may be billed to the County until
documentation is supplied to the County which demonstrates the Provider has furnished
$60,000.00 in Dental Services to Brazos County qualified residents.
RESPONSIBILITIES OF PROVIDER
Provider will be responsible for providing the following administrative services (herein
"Administrative Services') pursuant to this Contract:
1. Obtain all necessary application forms from potentially eligible individuals.
2. Obtain and compile information on each applicant with regard to residency and
financial qualifications.
3. Make a determination, based upon County approved standards, that the applicant
qualifies for Dental Services hereunder.
4. Maintain this Contract.
5. Maintain data files on clients and the Dental Services provided thereto.
6. Respond to all and any inquiries by the County regarding the Clinic and it's services.
7. Assist the County with information needed for audit purposes.
8. Provide the County with quarterly financial statements.
9. Provide the County with any and all certified audits of Provider and the management
letter prepared in connection therewith.
10. Provide financial statements evidencing how County funds are spent. Such statements
to be submitted to County one week subsequent to such expenditure.

using the Provider's Services and the percentage Brazos County residents comprise of
the total population using Provider's Services.
RESPONSIBILITY OF COUNTY

3. Approve standards for eligibility for Dental Services hereunder.
RECORD RETENTION
The Provider shall be responsible for record keeping on all Dental Services provided to
those individuals using its services and all financial records of the clinic. The Provider agrees to
maintain and make available for inspection by the County upon request consistent with personal
privacy and subject to the limitations of state law, any and all records the County determines, in
its sole discretion, to be necessary for the Court to justify its continued participation in
supporting the Provider with funding and to verify compliance with the terms of this Contract.
Such records shall be retained for a least four (4) years from the date the Dental Services was
provided. These records shall be made available for inspection and audit by the County if it so
desires.
DISCRIMINATION
The Provider shall not discriminate against any employee or applicant for employment
because of race, color, religion, sex, or national origin. The Provider shall take affumative
action to ensure that applicants who are employed are treated during employment, without regard
to their race, color, religion, sex, or national origin. Such action shall include, but not be limited
to, the following: employment, upgrading, demotion, or transfer, recruitment or recruitment
advertising; layoff' or termination; rate of pay or other forms of compensation; and selection for
training, including apprenticeship. The Provider agrees to post in conspicuous places, available
to employees and applicants for employment, notices setting for the provisions of this non-
discrimination clause.

INDEMNITY
The Provider agrees to indemnify the County for and hold it harmless from and against
all suits, claims, demands, liabilities or actions resulting or alleged to result from the breach,
violation or non-performance of the Dental and Administrative Services stated herein and for any
damage to any person resulting from any act or omission or negligence on the part of Provider.
INSURANCE
The parties hereto agree that the Provider is an independent contractor and not an agent
of the County and that Provider shall maintain at its own expense, adequate liability insurance to
insure against damages and liabilities which may prise due to the duties and obligations
contacted for herein.
COUNTY INVOLVEMENT
The County and Provider state that to the best of their knowledge, no officer, agent or
employee of the County who exercises any function or responsibility in connection with the
carrying out of this Contract or the service to which it relates, has personal interest, direct or
indirect, in this Contract.
GOVERNING LAW
This Contract shall be executed in and shall be governed by the laws of the State of
Texas.
NOTICES
All notices required to be given hereunder shall be deemed to be duly given by delivering
such notice or by mailing it, registered mail to the other party at the following addresses:

SEVERABILITY
In the event that any of the provisions or portions thereof, of this Contract, are held to be
unenforceable or invalid by any court of competent jurisdiction, the validity and enforceability of
the remaining provisions or portions thereof shall not be affected thereby.
ENTIRE AGREEEMENT
This Contract contains the entire understanding between the parties hereto concerning the
subject matter contained herein.. There are no representations, agreements, arrangements, or
understandings, oral or written, between or among the parties hereto, relating to the subject
matter of the Contract, which are not fully expressed herein.
ASSIGNABILITY
This Contract is not assignable by the Provider without the prior written consent of the

POLICY REGULATING COUNTY OWNED VEHICLES
' Pursuant to action taken by the Brazos County Commissioner's Court on Tuesday,
January 11', 2000, regarding the BRAZOS COUNTY POLICY REGULATING
USE OF COUNTY VEHICLES, the following are the policies adopted by the
Brazos County District Attorney's Office and approved by the Commissioner's
Court on Tuesday, 7K Ly 18 , 2000.
TAKE-HOME VEHICLE PROGRAM
For the purposes of these policies, a vehicle is any motor vehicle which is under
the direction and control of this Office and is not owned by an employee.
Participation in the Take-Home Vehicle Program requires the employee to abide
by applicable State of Texas and Federal law and the guidelines of these policies
and other Office procedures. Vehicles are issued at the discretion of the District
Attorney.
POLICY
• District Attorney's Office issued vehicles are considered a law enforcement tool.
Personal use or gain is not in keeping with this policy and is prohibited. It is
recognized and accepted that normal wear will occur during the working use of the
vehicle. It is recognized that operation of vehicles in the law enforcement setting
raises the possibility of accident, theft, criminal mischief, etc. This policy does
not hold the employee responsible for matters beyond his or her control.
Employee must comply with Internal Revenue Code Regulations. To comply,
each employee must file an annual EMPLOYEE FRINGE BENEFIT
CERTIFICATION FORM with the Brazos County Auditor's Office.
USE OF COUNTY-OWNED VEHICLES
Use of the vehicle is limited to commuting to and from work, normal on-duty
utilization, and office related events. De minimis use of the vehicle may include
personal errands while on duty or commuting, provided they do not take priority
over calls for service and do not diminish the image of the office or cause
additional cost to the County.
Brazos County vehicles assigned to the District Attorney's Office may not be used .
off-duty.

CARE AND MAINTENANCE
1. When not in use, all vehicles shall be provided reasonable security to
safeguard the vehicle and its contents.
2. Employees are responsible for maintaining the entire vehicle in a clean
condition and will ensure the vehicle receives preventative maintenance as
scheduled.
3. Any damage sustained to the issued vehicle shall be immediately reported
to the District Attorney, with a written report submitted to the District
Attorney by the next working day.
4. After review of an incident report involving damage to the vehicle, the
District Attorney or his designee will make a determination as to
responsibility. Should it be determined that the damage was caused by
neglect or misuse of the vehicle by the employee, the District Attorney or
his designee may require the employee to reimburse Brazos County for
expenses incurred as a result of neglect or misuse. Reimbursement may
include any and all expenses, including vehicle replacement.
PROHIBITED ACTIVITIES
The following activities, although not totally inclusive, are prohibited:
1. Employees experiencing any type of impairment or condition that may
adversely affect their safe performance of duty shall not operate a vehicle
and will notify their supervisor in writing; s
2. Employees will not drive vehicles to establishments which are primarily
engaged in the sale and/or on-premise consumption of alcoholic beverages,
to a business of questionable nature, or tgrother establishments specifically
prohibited by the District Attorney, unless within the scope of their official
business;
3. Employees shall not drive their vehicle improperly, unlawfully, or in a
reckless manner, and
4. Employees may not take a county vehicle outside the boundary of Brazos
County for anything other than Brazos County business, or to and from the
employee's residence.

The City of Bryan electrical inspector has required that we install a ground fault breaker for the
circuit serving Showers 11 I and 112. We disagree with his interpretation of the electrical code
but feel that it is not an item worth fighting.
The attached revision is forwarded to you for approval. It is the opinion of the Architect that the
amount is fair and equitable for the work proposed. It is recommended that the amount be funded
from the Contingency Allowance.

This contract made this the day of July 2000, by and between TEXAS VOTING SYSTEMS, INC., a
Texas Corporation, and the COUNTY OF BRAZOS, State of Texas.
WTTNESSETH:
Whereas, Texas Voting Systems, Inc. is the business of selling election services: and
Whereas, the BRAZ.OS COUNTY is desirous of employing the services of Texas Voting Systems, Inc. in
connection with the SPECIAL ELECTION to determine the incorporation of Kurten to be held on August 12, 2000
in Brazos County, Texas;
Now, Therefore, in consideration of the premises and mutual promises and obligations herein set forth, it is
agreed that:
TEXAS VOTING SYSTEMS, INC. will provide the following supplies:
(a) 500 numbered and printed Official Ballot Cards
(b) All required hinged ballot pages and punched masks. (One ballot group)
(c) 100 sample ballots
(d) Three (3) election sets to include the early voting canvassing board set and one central counting
set.
(e) All required seals for the voting equipment.
(f) Custom ballot layout for each voting precinct for checking correct ballot pages.
(g) Writs and Notice of Election.
(h) Precinct polling place supplies (pens - tape - extra stylus) as required.
(i) Early voting mail-out sets in English and Spanish.
(j) Polyurethane mail out backers as required.
(k) Early Voting mail-out official ballot labels as required.

TEXAS VOTING SYSTEMS, INC. will provide the following services:
(a) Assemble six (6) voting devices, and check each unit. I
(b) Deliver the voting devices to the Brazos County Voting precincts before the election and return the i
voting devices to the Brazos County Warehouse after the election.
(c) Provide complete ballot layout and design.
(d) Conduct one (1) class for election judges and clerks of election procedures.
(e) Conduct one (1) class for all central counting personnel if required.
(f) Assist with Early Voting as required.
(g) Assist with assembling all supplies for use in the individual precincts.
(h) Assist in the preparation of the computer test deck and holding of the Official Test of the vote count
computer.
(i) Assistance on election day, as required, to include the central counting station.

(k) Provide repair crews for the voting device repair in the individual precincts on election day.

The COUNTY OF BRAZOS, State of Texas, will be responsible for, and hereby assumes the following duties
and obligations in regard to the BRAZOS COUNTY SPECIAL ELECTION to be held on August 12, 2000:
(a) Payment of all invoices, Election Judges, Alternate Judges, and Clerks of Election, to include the central
counting station.
(c) Furnish Texas Voting Systems, Inc. a complete list of all issues to be conducted in the above mentioned
election.
(d) All reports, expense accounts, canvass of the election, conduct of the election at the individual polling
places, and any other statutory requirements as required by the Texas Election Code and/or the Federal
Voting Rights Act.

The consideration to be paid by the BRAZOS COUNTY to TEXAS VOTING SYSTEMS, INC. for the
services and supplies to be rendered by said corporation in the BRAZOS COUNTY SPECIAL ELECTION to be held
on August 12, 2000 is TWO THOUSAND THIRTY FIVE DOLLARS AND NO CENTS (52,035.00)
IN WITNESS WHEREOF, the parties have hereunto set their hands, this day of July, 2000.

PERSONNEL POLICY AND PROCEDURES
LONGEVITY PAY

All County employees, to include elected officials and to exclude employees classified as
temporary, shall be paid longevity pay. Longevity pay for purposes of this policy is considered
benefit nay. and is in addition to the regular salary approved by the Commissioners Court, and set
by the employing official and/or department head. Longevity pay is related solely to length of an
employee, s service to the County. Longevity pay will be paid based on the completion of five-year
incremental periods of employment. The incremental periods will begin with five years and end
with thirty-five years. Longevity pay shall begin with the first full two-week pay period after the
passing of the anniversary date. For pay purposes, longevity pay will be distributed to the employee
with each bi-weekly payroll check (26 times per year). Longevity pay will be paid based on the
following schedule:

$20.00 per month,
$240.00 per year,
$9.23 per pay period
• 10 Years
$40.00 per month,
$480.00 per year,
$18.46 per pay period
• 15 Years
$60.00 per month,
$720.00 per year,
$27.69 per pay period
• 20 Years

Each employee who has earned longevity benefit pay will be notified by the Personnel
Department prior to the benefit pay being included in their bi-weekly pay check. In addition, if there
is to be a change in existing longevity benefit pay, the employee will be notified before the benefit
pay change takes place. Such increases will commence with the first full pay period beginning after
the employee's anniversary date. The Personnel Department shall make the notification in writing
to the employee.
In the event that an employee leaves the employment of the County during a fiscal year,
longevity pay for the bi-weekly period will be distributed in their last pay check. For purposes of
this policy, longevity pay will be considered earned as of the first day of the pay period and therefore
there will not be a need for a pro-rated calculation.
It is the responsibility of the Commissioners Court to provide budget appropriations for
longevity for each department, independent of other line item provisions.
The foregoing policy change amends the Brazos County Personnel Policy dated 1989.
