To make arrangements, call (979) 361-4102. 1 ~ i a, f ' f V I COMMISSIONERS' COURT REGULAR MEETING JULY 11, 2000 i A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, July 11, 2000, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2, Absent; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Sims gave the invocation and led the pledge of allegiance. Under citizen input and/or concerns the following voiced concern: 1. D. E. White complained about the way the citizens are using the Citizen's Collection facility at FM 2038. 2. Janie Moore, property owner where a dumpster is located asked for clarification on who is responsible for the collection sites. 3. Derik Matejka, Constable, Precinct 3 indicated that he would be working the site more closely in an attempt to catch people dumping their trash outside the dumpster. The Court next considered Budget Amendment #99/00-32.1 through 32.3, which would reallocate funds for Constable, Precinct 2, Tax Office and Agriculture Extension Office. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. ' ti Commissioners' Court meeting July 11, 2000 2 On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the changes as • submitted. The Court next considered authorizing the Auditor's office to process a recurring payment request for the following: a) Database Technologies, Inc. for County , Attorney's Office, $250.00 monthly. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to authorize the Auditor's office to process the previously noted recurring payment. The Court next considered the following Claims as submitted by the County Treasurer for payment: 20008508 through 20008891 On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as • submitted. The Court next considered a request by the Brazos Valley Community Action Agency for purchase of dental equipment. Commissioner Jones moved to fund $60,000.00 for the purchase of dental equipment. Commissioner Cauley seconded the motion. After some discussion Commissioners Jones and Cauley withdrew their motion and second. Then on motion by Commissioner Sims, seconded by Commissioner Jones the Court voted unanimously to enter into contract with the Brazos Valley Community Action Agency for dental services in the amount of $60,000 to run from July 15, 2000 through September 30, 2000. The next matter for consideration by the Court was authorization for Kerbow & Associates to submit a grant application on behalf of the County Health Department to fund a sewer infrastructure for West 28th Street. The grant is in the amount of $12,500 with matching funds to come from the City of Bryan. On motion by Commissioner Cauley, seconded by s Commissioner Sims, the Court voted unanimously to authorize Kerbow & Associates to submit a grant application on behalf of Commissioners' Court meeting July 11, 2000 . 3 the County Health Department to fund a sewer infrastructure for West 28th Street with the stipulation that the City of Bryan provide matching funds. The next matter before the Court was the collection of fees in conjunction with the vehicle registration fee. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to collect $10 for the Road & Bridge Fees and $1.50 for the Crossing Guard Program. The Court next considered Tax Resale Deeds and authorization for the County Judge to execute tax resale deeds 6 t F E r for the following property: On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to execute a Tax Resale Deed to the following individual: Robert Rivera - A 50 foot by 80 foot tract, more or less, out of the Stephen F. Austin League No. 10, Brazos County, Texas. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to execute a Tax Resale Deed to the following individual: Raynbo Development Company-Temple Brcwn Development Company - Lot 1 and % of Lot 2, Block 164, City of Bryan, Brazos County, Texas. The Court proceeded to consider the following blanket Purchase Order: ,R NAPA Auto Parts Road & Bridge $3,000 On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the Blanket Purchase Orders as submitted. L A' I Commissioners' Court meeting July 11, 2000 4 The Court next considered approval of requisitions from the Capital Projects Fund for the following purchase: a) one computer for Justice of the Peace, Precinct 2 and three computers for Justice of the Peace, Precinct 6 $5,546.00 On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the requisition to be paid from Capital Projects Fund. The Court next considered an Exemption from Competitive Bidding Requirements of Local Government Code, Section 262.024(a)(7)(D). This is for the purchase of election consulting services. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the Exemption of Competitive Bidding Requirements and authorized the payment for said costs for Special Elections . e The next matter before the Court was the renewal of a Contractual Agreement between Brazos County and The Eagle for municipal advertising. The advertising cost to Brazos County t will be $14.26 per inch for Monday through Saturday and $14.68 per inch on Sunday. The term of the contract will be twelve months beginning July 1, 2000. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court 1 voted unanimously to renew the contract with The Eagle. A r copy of the contractual agreement is attached hereto. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested 5l ¢ permission to enter the private property of James K. Ashlock 4 on Castenson Road in Precinct 2 to stock pile material for roadway improvements. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to authorize the work. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested :a hr permission to enter the private property of Ronald Weiman in Kurten, Texas located in Precinct 2 to obtain and haul donated fill material to be used for improvements to Brazos County roadways. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Jim Carroll on Peach Creek Road in Precinct 1 to blade and water Peach Creek Road and the entrance to the 0. D. Butler Memorial Forage field for dust control during an event scheduled for July 7, 2000. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The Court next con!..idered the request from GTE to construct three (3) 40 feet road bores and parallel cable installation in the rights-of-way of Cliff Road and Opersteny Road to provide service to Saddle Ridge Subdivision. The site is located in Precinct 3. The County Engineer offered the following recommendations: A. Rights of way along Cliff Road and Opersteny road are very narrow, cables must be placed on the back slope of ditches. B. All cables in Saddle Ridge Subdivision must be installed in designated 16 foot Public Utility Easements. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from GTE and authorized the installation subject to GTE complying with the stipulations noted by the County Engineer. A copy of the request is attached hereto. The Court next considered the request from GTE to construct a road bore and parallel cable installation in the right-of-way of North Dowling Road and Hopes Creek Road. The site is located in Precinct 1. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from GTE and authorized the installation. A copy of the request is attached hereto. The Court next considered approval of the Re-Plat of Lots 10 through 17, A Re-Plat of Reserve Tract, Big Cedar Estates in Precinct 3. Richard Vance, County Engineer, stated that he had reviewed the plat and all appeared to be in order. Commissioner Sims moved to approve the plat as submitted. The motion was seconded by Commissioner Cauley. Commissioners Sims Cauley and the County Judge voted "AYE". Commissioner Jones abstained. The motion carried. The Court next considered approval of the Final Plat of North Country Estates Phase One Subdivision in Precinct 2. Richard Vance, County Engineer, stated that he had reviewed the plat and offered the following comments: 1) Change 1116 feet utility easements" along FM 974 to 1120 feet utility easements". 2) Need more clarification of dimensions along pipeline easements. On motion by Commissioner Jones, seconded by Commissioner Sims, the court voted unanimously to approve the final plat of the North Country Estates Phase One Subdivision subject to the developer complying with the exceptions noted by the County • Engineer. The Court next considered approval of the Final Plat of River Place Phase I Subdivision in Precinct 1. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the final plat of River Place Phase One Subdivision subject to the developer complying with the exceptions noted by the County Engineer. The Court next considered approval of the minutes of the Commissioners' Court meetings held in February, 2000 on the following dates: 1, 8, 15, 22 and 29 and Public Hearings held on February 22, 2000 (two meetings). On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to approve the minutes as submitted. Scott Raisor with Cellular One will be in the Purchasing Department between 10:00 a.m. and 2:00 p.m. to reprogram cell phones. The Emergency Management Coordinator made the following comment: 1. The KBDI is at 478. It is time to consider implementing a Burn Ban. County Judge made the following comments: 1. He has a 41.page punch list for the detention center 2. The City of College Station has purchased the tract of land next to the TI property by the East Bypass. It will be used as a park and dedicated as a Veteran's Park. There was no citizen input and/or concerns.
