Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2, Absent; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Cauley gave the invocation and the County Judge led the pledge of allegiance. There was no citizen input and/or concerns. The first matter before the Court was a presentation by i t V .j l c ~l i Y f C Tiffany Drake representing the Brazos Valley Sports Foundation. Ms. Drake presented an overview of the Brazos Valley Sports Foundation, enumerating the goals, activities and explained future objectives. The Court next considered Budget Amendment #99/00-31.1 through 31.2, which would reallocate funds for the Capital Improvements Fund and transfer funds from Contingency to Non Departmental. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action , Requests. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the changes as submitted. Vol ao Page a t -y- Commissioners' Court meeting June 27, 2000 2 The Court next considered the following Claims as submitted by the County Treasurer for payment: 20008303 through 20008507 On motion by Commissioner Jones, seconded by Commissioner f f Sims, the Court voted unanimously to approve the Claims as submitted. The Court next considered conducting contract negotiations with The Software Group concerning a global information technology network for Brazos County. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to enter into contract negotiations with The Software Group. The next matter for consideration was the Extension and Amendment to the Contract for the Collection of Delinquent Property Taxes with McCreary, Veselka, Bragg and Allen, P.C. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the Extesion and Amendment to the Contract for the Collection of Delinquent Property Taxes with McCreary, Veselka, Bragg and Allen, P.C. A copy is attached. The Court next considered awarding the following Request for Proposal: RFP No. 2000-032, Representation of Indigent Juveniles John Hachmann, Purchasing Agent, recommended acceptance of the proposal submitted by Lane Thibodeaux, Patrick Gendron and Patricia Bonilla-Harrison. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to Lane Thibodeaux, Patrick Gendron and Patricia Bonilla-Harrison. Commissioners' Court meeting June 27, 2000 i • • J~J rr J t 3 The Court next considered renewal of the County's General Liability, Law Enforcement Liability, Elected Officials Errors and Omissions, Automobile and Property Insurance. Bill Jeanes, County Risk Manager, recommended that General Liability coverage, Law Enforcement, Elected Officials Errors and Omissions and auto coverage be with the Insurance Network of Texas at a cost of $214,450 annually; renew Property Damage coverage with Arthur J. Gallagher & Company at a cost of $47,328.00 annually. On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to accept the previously noted recommendations of the Risk Manager for liability insurance coverage. The Court next considered approval of an Interlocal Cooperation Contract with the Brazos County Community Supervision and Corrections Department for professional services provided by the Brazos County Sheriff's Office. The sheriff's office will provide a jail officer in each of the jails to be responsible for assisting offenders with forms and conferences with Community Supervision officers. Contract period is for two years. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to enter into an Interlocal Cooperation Contract with the Brazos County Community Supervision and Corrections Department for professional services provided by the Brazos County Sheriff's Office. A copy is attached. The Court next considered a request by the Sheriff's office for payment of an invoice from Auto Pros. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to authorize payment of the invoice in the amount of $546.85. Vol A0 Page a►3 } k t E i Commissioners' Court meeting June 27, 2000 4 The Court next considered a request by the Sheriff's Office to accept a cash donation for the purchase of body armor vests. This is a donation in the amount of $5,034 from Invest, a non-profit organization that helps agencies defray the cost of body armor. The gift is a 50/50 cash match with the rest being funded by a federal grant. There are no County funds required. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to approve acceptance of the cash donation from Invest. The next matter for consideration was a requisition from the Revenue Fund for a replacement fax machine for the Purchasing Department. On motion by Commissioner Jones, seconded by Commissioner Sims, the Court voted unanimously to authorize payment of the requisition in the amount of $830.00. The Court proceeded to consider the following Blanket Purchase Orders: Capitol Bearing Road & Bridge $3,000 Roly Poly Jury Services $ 500 Cain's Coffee Jail $ 600 Lilly Dairy Jail $2,800 Butterkrust Bread Jail $1,300 Ben E. The Court next considered a request from Wickson Creek Special Utility District for a road bore in the right-of-way of Dick Elliott Road. The first being approximately 0.3 mile from its intersection with FM 974 and the second being approximately 528 feet from its intersection with FM 974. These are for water line installation. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Jones, seconded by Commissioner Sims, the Court voted unanimously to approve the request from Wickson Creek Special Utility District and authorized the two installations. A copy of the request is attached hereto. The Court next considered the request from Wickson Creek Special Utility District to construct a road bore in the right-of-way of Hensarling Lane approximately 800 feet from its intersection with Elmo Weedon Road. The Court next considered the request from GTE to construct two road bores in the right-of-way of Old Reliance Road beginning at its intersection with Wallis Road and extending for a distance of 1,760 feet along the south right- of-way of Old Relliance Road to the public utility easement of Austin's Estates Subdivision. The site is located in Precinct 3. The County Engineer stated that he had reviewed to request and made the following recommendation: a. GTE work site diagram shows the Public Utility Easement of Austin's Estates to be 16 feet; the Public Utility Easement is 20 feet. Upon entering the 20 feet of Austin's Estates, GTE will be in the City Limits of Bryan. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to approve the request from GTE subject to the correction on the Public Utility Easement and authorized the installation. The Court is looking into funding a dental service for the Health Center. The County Judge made the following comments: a) He has an agenda item to adopt a Resolution to approve additional fees for vehicle registration. These are Road and Bridge fees and School Crossing Guards. Susan Gandy made the following comment: a) Budget prints will be distributed by Thursday and department hearings will begin on July 5. Mike Parks, MPO made the following comment: a) He invited all to attend the Public Meeting of the Rail Road Study. (The Firm), 5929 Balcones Drive, P.O. Box 26990, Austin, " Texas, 78755. I. The County agrees to employ and does hereby employ The Firm to enforce by suit or otherwise the collection of all delinquent taxes, penalty and interest owing to The County. a Current year taxes which become delinquent within the period of this contract shall become subject to the terms of the contract upon the following conditions: A. Taxes on real estate that become delinquent during the term of this contract, that are not delinquent for any prior years, become subject to the terms of this contract on July 1" of the year in which they become delinquent. Taxes on personal property shall ' become subject to this contract thirty (30) days after delinquency as defined by the Texas Property Tax Code. B. Taxes that become delinquent during the term of this contract. on property that is delinquent for prior years and is the subject of a suit to collect the prior years delinquent taxes, shall become subject to its term$ on the first day of delinquency as 4 defined by the Texas Property Tax Code. U. The County agrees to furnish all necessary delinquent tax information to The Firm on all property within the boundaries of The County. The County shall provide The Firm a computer tape of all delinquent taxes each quarter of the year. The County hereby authorizes The Firm to determine the name, identity and location of necessary parties and to procure necessary legal descriptions of property and hereby assigns to The Firm the right to recover the costs of obtaining such information. III. The Firm agrees to mail the tax notices required by Section 33.07 of the Texas Property Tax Code at no charge provided that The County furnishes the current year delinquent tax information on computer tape to The Firm on or before the lOm day of May of each year. ' t. IV. The County shall provide Office Space in the County Tax Office to accommodate two (2) employees of The Firm and system access for The Firm's two (2) computer terminals and a printer. V. The Firm is to advise The County of errors, double assessments or other discrepancies coming under observation during the progress of the work. VI. The Firm is to intervene on behalf of The County in all suits for ad valorem taxes hereafter filed by any other taxing unit on property located within its boundaries. VII. The Firm agrees to make written delinquent tax collection progress reports to The County quarterly or upon request. VIII. A collection goal of sixty-five percent (65%) of the balance of the current taxes due on July 1•' to be collected by the following June 301h is established for the City of College Station. A collection goal of sixty-five percent (65 of the balance of the current taxes due on July 1" to be collected by the following June 30'° is established for the College Station Independent School District. A collection goal of fifty-two percent (52 of the balance of the current taxes due on July 1" to be collected by the following June 301h is established for the City of Bryan and a collection goal of fifty-five percent (55%) of the balance of the current taxes due on July 1" to be collected by the following June 301" is established for Brazos County. In addition to these goals, a goal for total delinquent collection for each of the four taxing jurisdictions is established. For each of the jurisdictions the goal is that percentage calculated by averaging the percentage of collections for each of the years which ended June 30, 1998, 1999 and 2000. The Firm shall escrow ten percent (5% for each set of goals) of the fees payable to The Firm in an interest bearing account. When it is determined whether or not the units goals have been met, the escrow account shall be distributed as follows: If a unit goal is met or exceeded, the amount of principle and interest in escrow for that unit is paid to The Firm. If the goal is not met or exceeded, said principle amount plus one half of the interest accrued on that amount is paid to that unit and the balance of the interest is paid to The Firm. IX. r The County agrees to pay The Firm, for services rendered, fifteen percent (15%) of all delinquent taxes, penalty and interest collected by The County for itself and all the taxing units for which it collects except for the Bryan Independent School District, for years covered by Vo Li0_--JA7P-4 &.-:2 =9- F. ■ . .his contract. The penalty imposed pursuant to Section 33.07 of the Property Tax Code is not subject to this contractual fee. The County shall pay fees due The Firm monthly by check. X. The Firm agrees to include with its tax lien foreclosures, for the Cities of Bryan and College Station, any other city liens which are assessed against the same properties. An additional title research fee of twenty-five dollars ($25.00) shall be charged against these properties to be collected as court costs and paid to The Firm. XI. The Firm agrees to pay in the month of July all the taxes, penalties and interest on those accounts on which the total due is one dollar ($1.00) or less. XII. Y, l . I~ The Firm shall and does hereby agree to indemnify and hold harmless The County, its officers and employees, from any and all damages, loss, or liability of any kind whatsoever, by reason of injury to property or third persons occasioned by any error, omission or negligent act of The Firm, its officers, agents, employees, invitees, and other persons for whom it is legally liable, with regard to the performance of this Contract, and The Firm will, at its cost and expense, defend and protect The County against any and all such claims and demands. XIII. This contract is drawn to cover a period beginning July 1, 2000, and ending June 30, 2001, with the option to renew for an additional one (1) year period and each party shall have the right to terminate this contract by giving at least thirty (30) days written notice of such intention; provided however, that The Firm shall have an additional six (6) months to reduce to judgment and sale all tax collection lawsuits filed and collect all bankruptcy claims filed prior to the date last mentioned and shall have the exclusive right to compensation of fees earned due to these suits during this six (6) month period. In consideration of the terms and compensation herein stated, The Firm hereby accepts said employment and undertakes the performance of this contract as above written. ` XIV. The Firm fully incorporates into this contract all terms and conditions presented to The County in its "Proposal for the Collection of Delinquent Property Taxes" on June 5, 1998. r XV. This contract is executed on behalf of The County by the presiding officer of its governing body who is authorized to execute this instrument by order heretofore passed and duly recorded in its minutes. R,_~ _ ~ .r. ~ M 1 r r r INTERLOCAL COOPERATION CONTRACT WHEREAS, the Brazos County Sheriff's Department (hereinafter "Performing Party') is a validly organized and constituted Sheriffs Department as established in accordance with Article 5, Section 23 of the State Constitution; WHEREAS, the Brazos County Community Supervision and Corrections Department (hereinafter "Department') is properly established in accordance with Chapter 76, Government Code; WHEREAS, Chapter 140, Local Government Code, permits the Department, as a "specialized local entity," to enter into contractual arrangements; WHEREAS, Chapter 791, Government Code, authorizes local governments to increase their efficiency and effectiveness by contracting with one another and with agencies of the State; THEREFORE, this Interlocal Cooperation Contract (hereinafter "contract") for professional services is made and entered into by and between the Performing Party and the Department. ARTICLE I SPECIFICATIONS r 1.1 Terms and Conditions. A. The Performing Party shall, in accordance with the terms of this contract, provide all the necessary personnel, equipment, materials, supplies, facilities, and services (except as may be furnished by the Department as specified in writing in this contract) and do all things necessary for, or incidental to, the provision of the services listed as follows: 1. The Performing Party will provide a jail officer in each of the jails a maximum of two days per week, three hours per day. These officers will be responsible for moving offenders from their cells to the video conference system area, positioning and operating the equipment, witnessing the offender signing documents, communicating with the community supervision officer, returning the offenders to their cells, and sending signed documents through inter-office mail. The Performing Party will designate one or multiple contact persons who will receive a weekly or daily faxed list of offenders who need to be seen. The contact person will monitor forms, and will notify the Department contact person when forms are running low. 2. The Department will provide a contact person or persons who will fax a list or otherwise communicate with the Performing Party contact person(s) about offenders needing to be seen. VOL, a ° X66. ~ ti r~ 3. For services specified in Paragraph 1, the Department will pay the Performing Party $12.00 per hour. These wages will be limited to 12 hours weekly, unless in an emergency situation, when both parties may agree to a temporary increase in hours. Payment will be made within 30 days following receipt of an itemized invoice that lists inmates served and date and time of service. 4. The Performing Party agrees to furnish to the Department and/or Texas Department of Criminal Justice - Community Justice Assistance Division (TDCJ-CJAD) such information as may be requested which relates to the services described in this contract. The Performing Party shall permit the Department and TDCJ-CJAD to audit/inspect records and reports, review services, and/or evaluate the performance of these services at any time. The Performing Party shall provide reasonable access to all the records, books, reports and other necessary data and information needed to accomplish reviews of program activities, services and expenditures. 5. It is understood that the employees of the Department or individuals acting as agents of the Department are not authorized to receive any type of personal payment, reimbursement, compensation, commission, gratuity or gift for services provided under this contract. The Performing Party warrants that no employee or agent of the Department has been retained to solicit or secure this contract and that the Performing Party has not paid or agreed to pay any employee of the Department any fee, commission, percentage, brokerage fee, gift or any other consideration, contingent upon the making of this contract or as an inducement ` for entering into this contract. The unauthorized offering or receipt of such payments may result in the immediate termination of this contract. 6. The Performing Party agrees to comply with all applicable standards and guidelines, including those contained in the Contract Administration Manual, promulgated by the Texas Department of Criminal Justice-Community Justice Assistance Division. 7. The venue of this contract is Brazos County, Texas, and this contract shall be governed by and in accordance with the laws of the State of Texas. 8. The Brazos County Sheriff's Office (BCSO) may provide off duty deputies in uniform and in Brazos County Sheriffs Department marked vehicles to escort community supervision officers on field visits to homes, work places, and other community sites in Brazos County. 9. BCSO will offer these off duty hours to its deputies, schedule the deputies, 4nd have them available as scheduled at the BCSO to meet with the designated community supervision officer for a specified time period of not less than two hours and generally not more than four hours, but potentially up to eight hours a day. i 10. BCSO deputies will act as escorts for community supervision officers (CSO's), driving the CSO's to specific sites in Brazos County as designated by the CSO. In the event a CSO determines probable cause exists for the BCSO deputy to enter the residence, building, or other facility, the CSO will notify the officer of the nature of the probable cause, such as drugs or paraphernalia in plain sight, a domestic quarrel in progress, an illegal weapon in plain sight, or assault of the CSO, and the BCSO deputy will effect an arrest as he or she deems necessary. 12. CSO's have no power of arrest, and so may also request a BCSO deputy to verify whether there are outstanding warrants on an offender, such as a warrant for violation of the conditions of community supervision, and may request the BCSO deputy to arrest an offender after the proper procedure for verification of a warrant has occurred. 13. Deputies will be available for work at the direction of the CSO or administration of the Community Supervision and Corrections Department (CSCD), but it is understood that if the deputies witness a crime, arrive upon the scene of an accident, or another emergency occurs, they may have to resolve that situation prior to resuming duties with the CSO. 14. BCSO deputies will conduct these duties within the policies and procedures of the Brazos County Sheriffs Office and Brazos County, and will be cognizant of their safety and that of the CSO at all times. s t 15. BCSO deputies will have available a form to document hours and mileage, and will complete the form in full at the end of the shift, will sign the form, have the CSO sign, and will return a copy of the signed form to the appropriate BCSO personnel. The CSO will return the original form to the CSCD's Administrative Assistant or Fiscal Officer for processing. B. All deputies of the Performing Party shall have and maintain all required licenses, certifications, and other qualifications. 1.2 Compensation. The Department agrees to make payments to the Performing Party for the delivery of the services described in Article I, Paragraph 1.1, 1. above. i A. The department shall pay the sum of $12.00 per hour for video conferencing services per offender upon submission of an itemized invoice on the standardized billing fprm. B. Invoices for video conferencing services shall be presented to the Department by the 20'" day of the month following the end of the month in which services were performed; C. The department shall pay the sum of $20.00 per hour for deputy escort services and $.31 per mile driven in BCSO vehicles upon submission of an itemized invoice on the Department's standardized billing form. The deputies will be paid within 20 days of receipt of invoice under this contract, barring circumstances beyond the control of the CSCD, such as unavailability of the Fiscal Officer, Director, or Judge to sign requisitions 3 _ a33 VO~a-6 r or checks, computer failure, or similar circumstances. Mileage will be paid within one month of the end of the previous month's forms turned in by BCSO deputies. Invoices for deputy escort services shall be presented to the Department by the CSO riding with the deputy no later than the next working day after services are performed. E. The total amount of payments to the Performing Party during the fiscal year generally will not exceed a total of $40,000, $10,000 of which is for direct offender services, and the remainder for professional services. F. The Performing Party and the Department agree that these payments fairly compensate the Performing Party for the services or functions performed under the contract. This contract is subject to the availability of funds as appropriated by the legislature and made available by the Community Justice Assistance Division of the Texas Department of Criminal Justice. If such funds become reduced or unavailable, this contract shall be subject to immediate modification, reduction or termination. 13 Contract Period. This contract is for a period of 2 years beginning on September 1, 2000, and ending on August 31, 2002. It may be renewed annually or terminated as hereinafter provided. ARTICLE II GENERAL CONDITIONS k ' r` 4E c f l 'j. 2.1 Duties and Obligations. The Performing Party shall: A. Provide the services outlined in Article I, Paragraph 1.1, in compliance with applicable federal and state laws, including all constitutional, legal, and court-ordered requirements. B. Comply with applicable standards established by the Texas Commission on Jail Standards. f C. Comply with the HIV standards at Exhibit A, which are incorporated into this contract by reference. D. Furnish such quarterly financial and program data as may reasonably be requested by the Department. E. Permit the Department, or Department's designee, to inspect, review, and audit its records ' and reports to review services and evaluate performance. G. Permit the Department, or Department's designee, to conduct site visits at times mutually agreed upon between the parties. 2.2 Confidentiality. When applicable, records of identity, diagnosis, prognosis, or treatment of any Defendant through this contract shall be confidential and may be disclosed only in accordance with applicable laws. A. Absent specific statutory authority to the contrary, no confidential information may be released without the Defendant's written consent as documented by a signed release form that complies with the requirements of the applicable laws and regulations. B. All records prepared in conjunction with this contract or maintained on defendants shall be the property of the Department. All records (electronic or paper) pertinent to this contract shall be retained by the Providing Party for a period of five years with the following qualifications: if any audit, litigation or claim is initiated before the expiration of the five- year period, the records shall be retained until the audit, litigation or claim has been resolved. The Providing Party shall request disposition instructions from the department at the end of the retention period. C. The Performing Party shall promptly notify the Department in writing if any legal process requires disclosure of a Defendant's record and shall obtain written acknowledgment of the Department's representative. ARTICLE III MODIFICATION, RENEWAL, CANCELLATION, DEFAULT, AND TERMINATION 3.1 Modification. This contract may be modified at any time with the mutual consent of the Director of the Department and of the Sheriff of Brazos County. Any such modification must be documented in writing. 3.2 Renewal. This contract may be renewed in one-year increments by the mutual consent of the Director of the Department and of the Sheriff of Brazos County. Any such renewal must be documented in writing.. , . S X35 i tr ' k t 3.3 Cancellation. Payments must be made from current revenues available to the Department. This contract is subject to ! cancellation, without penalty, either in whole or in part, if funds are not appropriated by the Texas Legislature. 3.4 Termination of Convenience. 4 1 Either party may terminate this contract for any reason, without cause, and at any time, by furnishing to r the other party thirty (30) days prior written notice. Upon termination, the Department shall only be ' obligated to compensate the Performing Party for services performed and payments earned hereunder up to the date of the termination. The Performing Party shall be obligated to provide services until the date of the termination. Neither party shall be entitled to any other compensation based on this contract. I 3.5 Default, Cure Notice, Termination for Cause. i A. Default by the Performing Party. I 1 1. A material failure to keep, observe, perform, meet or comply with any term or provision of this contract by the Performing Party shall constitute an event of default. 2. Upon the occurrence of an event of default by the Performing Party, the Department shall notify the Performing Party of such event of default by registered United States Mail, return receipt requested. 3. Upon receipt of a notice of an event of default, the Performing Party shall have thirty (30) days to cure the default. 4. If the Performing Party fails to cure the default, the Department may suspend payments, terminate the contract for cause, and pursue any remedy it may have at law or in equity. B. Default by the Department. t 1. A failure by the Department to pay the Performing Party within thirty (30) days after such t payment is due, provided such failure to pay is not the result of the Comptroller of the State of Texas withholding payments to the Department, shall constitute an event of default. • 2. Upon the occurrence of an event of default by the Department, the sole remedy of the Performing Party is to tcrminate the contract. Upon such termination, the Performing n Party shall be entitled to receive payment from the Department for all services satisfactorily furnished up to and including the date of termination.
