individuals) located off Collette Lane for the purpose of clearing approximately 100 feet
of fenceline to allow creek channel to be cleared. Sites are located in Precinct 2.

22. Request by Road & Bridge Department to enter City of Bryan's property located off
Sandy Point Road for the purpose of improving site distance at its intersection with Rye
School Road extending northeast on Sandy Point Road approximately 186 feet. Site is

23. Request from GTE to place a 4 feet x 6 feet concrete slab with a communication cabinet
in the right-of-way of Bird Pond Road approximately 1.0 foot from the fenceline. Site is
located in Precinct 3.
24. Announcement of interest items and possible future agenda topics.
25. Call for citizen input and/or concerns.
26. Convene into Executive Session pursuant to 551.074 of the Texas Government Code to
discuss personnel matters relating to possible employment, evaluation and duties.

REGULAR MEETING
JUNE 13, 2000
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, June 13, 2000, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
The County Judge gave the invocation and led the pledge
of allegiance.
Under citizen input and/or concerns, Eric Todd
representing the Brazos Valley Community Action Agency (BVCAA)
updated the Court on the Texas Avenue Project better known as
the Community Health Clinic. He told the Court that the City
of College Station would not move forward with funding until
the County takes action on funding for the facility. The
County's inaction is causing the BVCA problems in completing
the project. He made an urgent plea for funding and asked
that a request from the BVCAA be placed on the agenda for a
decision on the funding issue. The County Judge asked what
support the BVCAA was receiving from the surrounding counties
and reminded Mr. Todd that the County can not spend money for
the construction of the facility. Commissioner Sims stated
that he was willing to support services provided by the BVCAA. .
Janice Ray also spoke on funding and asked for $150, 000.00 for
telephones and other equipment. She then invited the Court to
tour the facility.

The Court next heard a presentation by the Brazos
Heritage Society concerning a community historical
documentary.- Julie Schultz, representative of the society
presented documentary film maker, Greg Phelps to the Court. He
explain what they were trying to achieve with the film and
requested $50,000 to complete the project.
The Court next considered Budget Amendment #99/00-29.1
through 29.5, which would reallocate funds for the State Aid
Juvenile Grant and Sheriff's Office; set up a budget for the
Sheriff' Department Crime Fund and the District Attorney's
Coordinating Victims Services Grant and increase the budget
for Constable Precinct 2. On motion by Commissioner Cauley,
seconded by Commissioner Jones, the Court voted unanimously to
approve the budget amendment as submitted, a copy of which is
attached hereto.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to approve the
changes as submitted.
The Court next considered authorizing the Auditor's
office to process the recurring payment request for the
following:
a) PM Properties for real estate lease for
Narcotics Task Force $3,450.00 monthly.
On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to authorize the Auditor's
office to process the previously noted recurring payment.
• The court next considered the following Claims as
submitted by the County Treasurer for payment:

.On motion by Commissioner Sims, seconded by Commissioner
Jones, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered the Project Plan and the
Project Financial Plan for the City of Bryan's Tax Increment
Financing Zone #10, Traditions Golf Course Development.
Commissioner Jones asked the Court if they shouldn't wait
until the City of Bryan had passed their issue. Frank
Thurmond presented a written statement in opposition to the
project. Commissioner Sims moved to approve the Project Plan
and the Project Financial Plan for the City of Bryan's Tax
Increment Financing Zone #10, Traditions Golf Course
Development. Commissioner Cauley seconded the motion.
Commissioners Sims and Cauley and the County Judge voted
"Aye". Commissioner Jones voted "No". Commissioner Thornton
abstained.
The Court next considered the recommendations by the
Brazos County Community Healthcare Endowment Fund Review
Committee for distribution of tobacco funds. The Committee
made the following recommendations:
Recommended for funding of their proposed program:
American Lung Association $28,000
Family Medicine Center $45,000
Hospice Brazos Valley $72,000
Recommended for funding for educational materials
and/or supplies only:
Bluebonnet Girl Scout Council, Inc. $1,000
Health For All, Inc. $4,000
On motion by Commissioner Sims, seconded by Commissioner
Jones, the Court voted unanimously to accept the
recommendations of the Brazos County Community Healthcare
Endowment Fund Review Committee. Commissioner Sims thanked
Mr.' Bob Fleischer and Ms. Marcy Hosking of the Health

The next matter for consideration by the Court was a
request submitted by the Judge of County Court at Law I
seeking approval for out of state travel for the Court
Reporter. Ms. Blaha would be traveling to Orlando, Florida to
attend an Eclipse Software training courses August 10 through
the 13, 2000. On motion by Commissioner Jones, seconded by
Commissioner Thornton, the Court voted unanimously to grant
the request from the County Court at Law I Judge and approved
payment of out of state travel expense for Ms. Lorie Blaha.
The next matter before the Court was the authorization of
payment of an invoice from Patterson Architects for
architectural services, engineering services and reimbursable
items for the prototype of the Justice of the Peace buildings.
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to authorize payment of
the invoice in the amount of $11,464.23.
On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to adopt a resolution in
support of the creation of the Groundwater Conservation
District with a coordinating board created for Management Area
4 to provide local control and regional management of the
area's groundwater resources. Also, authorizing the County
Judge to retain professional services to represent the
county's interest and assist in creation of Groundwater ;
Conservation Districts with a coordinating board over
Management Area 4 of the Carrizo-Wilcox Aquifer.
The Court next considered approval of the railroad
crossing project at Sims Road in Precinct 4 and a commitment
for Brazos County to maintain signs in the future. The
project location is on Sims Road at the Union Pacific milepost
number 16.87. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the railroad crossing project.

The next matter for consideration by the Court was a
request submitted by the Agricultural Extension Agent seeking
approval for out of state travel for herself. Ms. Rebekah See
would be traveling to Winona County, Minnesota to chaperon the
Brazos County 4-H Exchange Club during the week of July 10
through the 16, 2000. On motion by Commissioner Cauley,
seconded by Commissioner Thornton, the Court voted unanimously
to grant the request from the Extension Agent and approved
payment of out of state travel expense for Ms. Rebekah See.
The Court next considered cancellation of the
Commissioner Court meeting during the week of July 3-7, 2000.
On motion by the County Judge, seconded by Commissioner
Thornton, the Court voted unanimously to cancel the scheduled
Commissioners Court meeting on July 4, 2000.
The Court proceeded to consider the following blanket
Purchase Order:
Align Guys Sheriff's Office $1,000
On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Blanket
Purchase Order as submitted.
The Court next considered awarding the following bid:
Bid No. 2000-041, Uniform Rental
John Hachmann, Purchasing Agent, ;
recommended acceptance of the bid
submitted by G&K Services on Section I,
Items A through D; Best Uniform on
Section I, Items E through I - Section
II, Items A through D; G&K Services on
Section III, Items A through C and G&K
Services on Coveralls. On motion by
Commissioner Thornton, seconded by
Commissioner Cauley, the Court voted
unanimously to accept the recommendations
of the Purchasing Agent and award the
contracts as noted. A copy of the bid
tabulation is attached.

The next matter for consideration was approval for the
Purchasing Agent to advertise Bid 2000-045, Jail Commissary
for the Sheriff's Office and Bid 2000-046, Urinalysis Services
for the Community Supervision Office. On motion by
Commissioner Cauley, seconded by Commissioner Sims, the Court
voted unanimously to delete Bid 2000-045, Jail Commissary and
authorize the Purchasing Agent to advertise for bids for
Urinalysis Services.
The Court next considered acceptance of a Warranty Deed
for right-of-way on Edge School House Road in Precinct 2. On
motion by Commissioner Thornton, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to accept on behalf of Brazos County a Warranty Deed
from Richard W. Towry and wife Billie J. Towry for the
expansion and improvements to Edge School House Road.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of the following
individuals:
a) James T. Opersteny on Collette Lane in Precinct
2 to clear approximately 100 feet of fence line at
the bridge to allow the creek channel to be
cleared. A temporary fence will be constructed
around the area and replaced with a new fence on
completion of bridge work.
b) Michael South on Collette Lane in Precinct 2 to
clear approximately 100 feet of fence line at the
bridge to allow the creek channel to be cleared. A
temporary fence will be constructed around the area
and replaced with a new fence on completion of
bridge work.
On motion by Commissioner Thornton, seconded by Commissioner
• Jones, the Court voted unanimously to authorize both requests
for work.

b) He talked with Rick Ravey and it appears
the contractor has exceeded the time
limit for completion of the expansion to
the Jail. The $500.00 per day liquidated
damages are now in force. Should the ! -
Court wish to issue a variance and waive
the penalty, if so, consideration of it t.tt'
needs to be placed on the Commissioners
Court agenda.

Wallace concerning travel expenses and
reimbursement and outlining procedures.

The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of the City of Bryan
on Sandy Point Road in Precinct 4 to improve site distance by
hand clearing and removing trees and brush in the fence line
beginning at its intersection with Rye School Road extending
northeast on Sandy Point Road approximately 186 feet. On
motion by Commissioner Cauley, seconded by Commissioner Sims,
the Court voted unanimously to authorize the work.
The Court next considered the request from GTE to a 4 x
6 concrete slab with communication cabinet (mounted on top)
in the right-of-way of Bird Pond Road approximately 1.0 foot
from the fence line and adjacent to an existing hand hole and
X-conn cabinet. The site is located in Precinct 3. The
County Engineer stated that all appeared to be in order and
recommended approval. Commissioner Sims questioned the
installation of a concrete slab and the County's liability if
any. On motion by Commissioner Sims, seconded by Commissioner
Jones, the Court voted unanimously to approve the request of
GTE and authorized the installation. A copy of the request is
attached hereto.
Under announcement of interest items and possible future
agenda topics the County Judge made the following comments:
a) He showed the Court post cards designed
by local children to promote the area. r

d) He received a memo from Demerle Wehmeyer,
Emergency Management Coordinator asking
the Court to ban fireworks. This must be
done by June 15. The County cannot meet
the deadline.
e) TAC is in the process of updating the
salary survey.
f) He informed the Court of a Supreme Court
case that allows counties to dictate when
an employee takes comp time. He will
circulate a copy.
g) He received a memo from TCDRS. If the
County wishes to make any changes to the
County's Retirement Plan, it must be done
soon.
h) He received a communication from the
Brazos Valley Council of Governments
concerning the water issue and when
reports are required.
i) He received a fax from Don Lee indicating
that the fee being collected for County
Judges' salaries may be unconstitutional.
j) He visited with Bobby Kurten who wishes
to incorporate an area into the Town of
Kurten. A petition in favor of the
incorporation of Kurten will be on the
agenda for the meeting of June 20, 2000.
c) There will be a workshop on computer
software next Tuesday in room 108.
Commissioner Sims made the following comment:
a) He was contacted about the use of the law
library books in reference to veteran's
benefits.

At 11:05 the County Judge closed the Commissioners Court

meeting to the public so that the Court could meet in
Executive Session pursuant to Section 551.074 of the Texas
Government Code to discuss personnel matters relating to
possible employment evaluation and duties. He asked Don
Gilman with ASCI to attend the meeting.
At 12 noon, the County Judge opened the meeting to the
public and announced that no action would be taken on the
Executive Session.
