A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, May 30, 2000, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4, Absent;
Mary Ann Ward, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Thornton gave the invocation and led the
pledge of allegiance.
There was no citizen input and/or concerns.
The Court heard a presentation by Pat Williams, Texas
Department of Transportation, concerning revisions to the Off-
System Bridge Replacement Program. Mr. Williams informed the
Court that the change was in the match. Counties can waive
the 10 percent match if the funds are to be used on another
county bridge that needs replacing.
The County Judge read aloud a Proclamation designating
June 4, 2000 as "National Cancer Survivors Day". On motion by
the County Judge, seconded by Commissioners Jones, Thornton
and Sims, the Court moved to proclaim June 4, 2000 as
"National Cancer Survivors Day" throughout Brazos County. The
County Judge then presented the signed Proclamation to Ms.
Edwina Ramzyck, representing the Central Texas Cancer Care
Clinic.
The Court next considered Budget Amendment #99/00-27.1,
which would reallocate funds for Sale to Intoxicated Persons
Grant.

On motion by Commissioner Sims, seconded by Commissioner
Jones, the Court voted unanimously to approve the budget
amendment as submitted, a copy of which is attached hereto.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Sims, seconded by
Commissioner Thornton, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered acceptance of the resignation
of Bill Riley and appointment of a new board member for the
Brazos Valley Groundwater Conservation District Board. On
motion by Commissioner Jones, seconded by Commissioner Sims,
the Court voted unanimously to accept the resignation of Bill
Riley and appoint John Woody to the Brazos Valley Groundwater
Conservation District Board of Directors.
The Court next considered a request from the County
Auditor seeking to utilize $10,000 from the County Records
Management and Preservation Fund. The funds will be used to
microfilm six years of grant accounting records. On motion by
Commissioner Thornton, seconded by Commissioner Jones, the
Court voted unanimously to approve the request.
The next matter for consideration was the authorization
of Revision R-28 (Electric Circuits for EDF, UPS and computer)
to the contract with W. M. Klunkert Construction Company for
the Brazos County Detention Center Addition. Revision R-28
will add $894.00 to the contract amount.

• On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to authorized Revision
R-28.
The next matter for consideration by the Court was a
request submitted by the Agricultural Extension Agent seeking
approval for out of state travel for himself. Eric Zimmerman
would be traveling to Winona County, Minnesota to chaperone
the Brazos County 4-H Exchange Club at an Exchange club
meeting during the week of July 10 through the 16, 2000. On
motion by Commissioner Sims, seconded by Commissioner
Thornton, the Court voted unanimously to grant the request
from the Extension Agent and approved payment of out of state
travel expense for Eric Zimmerman.
The court next considered a request from the County
• Attorney to hire a temporary employee to work from June 1,
2000 through August 11, 2000. The employee currently in this
position will be absent during this period. On motion by
Commissioner Jones, seconded by Commissioner Thornton, the
Court voted unanimously to approve the request.
The Court next considered entering into agreement with
the Brazos County Emergency Communications District 9-1-1 for
emergency communications services for the Narcotics Task
Force. On motion by Commissioner Thornton, seconded by
Commissioner Jones, the Court voted unanimously to enter into
agreement with the Brazos County Emergency Communications
District 9-1-1 and authorized the County Judge to execute the
Agreement on behalf of Brazos County. A copy of the Agreement
is attached.
• The Court next considered a request from Constable
Precinct 6, Phil Sikes, to appoint Rodney J. Merkley as unpaid
Reserve Deputy Constable.

On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the request
from Constable Sikes to appoint Rodney J. Merkley as unpaid
Reserve Deputy Constable subject to appointment being within
the allotted number of deputies.
The Court next considered establishing speed limits along
Old Reliance Road and Lakefront Road in Precinct 3. On motion
by Commissioner Sims, seconded by Commissioner Jones, the
Court voted unanimously to set the speed limit along Old
Reliance Road at 50 miles per hour and set the speed limit on
Lakefront Road at 30 miles per hour. Demetrios Basdekas,
concerned citizen, expressed gratitude.
The Court next considered approval of requisitions from
the Certificate of Obligation Funds for the following
purchases for the Sheriff's Office:
a) 5 Computers/monitors and associated
equipment $6,834.00
b) 10 MS Office Pro 2000 $2,750.00
c) 5 Lap Top Computers $11,955.00
On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve items "a" and
"b" as written but 3 lap top computers from item "c". All to
be paid from Certificate of Obligation Funds.
The next matter before the Court was approval of a
requisition for a partition replacement for the Brazos Center.
On motion by Commissioner Thornton, seconded by Commissioner
Sims, the Court voted unanimously to approve payment of the
requisition in the amount of $1,745.00.
The Court next considered approval of requisitions from
Certificate of Obligation Funds for the following purchases
for the Brazos County Detention Center:
a) Safety restraint chair $949.00
b) 2 Self contained breathing apparatus

On motion by Commissioner Sims seconded by Commissioner
Thornton, the Court voted unanimously to approve the
requisitions to be paid from Certificate of Obligation Funds.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Derik Matejka on
Collette Lane to remove a fallen tree from the right-of-way.
On motion by Commissioner Thornton, seconded by Commissioner
Jones, the Court voted unanimously to authorize the work.
The Court next considered the request from Wickson Creek
Special Utility District to construct a road bore in the
right-of-way of Wheelock Hall Road in Precinct 2 approximately
0.2 mile from its intersection with FM974. The County
Engineer stated that all appeared to be in order and
recommended approval. On motion by Commissioner Thornton,
seconded by Commissioner Jones, the Court voted unanimously to
approve the request of Wickson Creek Special Utility District
and authorized the installation. A copy of the request is
attached hereto.
The Court next considered approval of the Preliminary
Plat of Great Oaks Subdivision in Precinct 1. Richard Vance,
County Engineer, stated that he had reviewed the plat and
offered the following comment:
1) He has reservations about some lots being too
small; this will need to be addressed before the
final plat is submitted.
On motion by Commissioner Jones, seconded by Commissioner
Sims, the Court voted unanimously to approve the preliminary
plat of the Great Oaks Subdivision subject to the developer
•
complying with the exception noted by the County Engineer.

The Court next considered approva o e iAs a o
Falcon Crest Subdivision in Precinct 3. Richard Vance, County
Engineer, stated that he had reviewed the plat and all
appeared to be in order. On motion by Commissioner Sims,
seconded by Commissioner Thornton, the Court voted unanimously
to approve the final plat of Falcon Subdivision as submitted.
The Court voted to approve and order filed as submitted
the Treasurer's Report for April 2000. A copy of which is
attached to and made a part of these minutes.
Under announcement of interest items and possible future
agenda topics the County Judge made the following comments:
a) There is a dangerous intersection at the
corner of Sandy Point Road and Rye School
Road. He suggested having the Road and
Bridge department contact the land owner
about better site projection.
Commissioner Sims asked about the status of the proposed
Just'ice of the Peace office at the south end of the county.
There was no citizen input and/or concerns.
There being no further business to come before the Court,
the meeting was adjourned.

On this the 30`" day of May 2000 at a regular meeting of the
Commissioners' Court, the following members were present:

THAT WHEREAS, on May 30, 2000 the Court heard and approved a
budget amendment for the 1999-2000 budget year for Brazos County,
Texas.

meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 9,
1999 the following amendment(s) to the original are hereby
authorized, as described on the attached page(s).

ITEM: Request from Wickson Creek Special Utility District to construct a road bore in
the right of way of Wheelock Hall Road approximately 0.2 mile from its intersection with
FM 974. Site is located in Precinct 2.
SOURCE OF FUNDS: N/A
PRESENTATION:
A) No work will be permitted between front slope and/or back slope.
B) The line shall be installed 1) within 3-5' of and parallel to the right-of-way line and/or 2) in the
case of a road bore, perpendicular to the right-of-way line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right-of-way.
D) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test
shall be conducted by an independent Geotechnical testing firm; copies of all test results shall
be furnished to the office of the Brazos County Engineer.
E) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of Transportation,
and all other State and Federal laws governing utility construction.

In Brazos County, Texas as follows:
The location or description of the proposed installation is more fully shown by 3
copies of the drawings attached to this notice.
i understand and agree that:
1. The County Engineer must by notified 72 hours prior to the beginning of
construction in order that he or his designated inspector may inspect the
actual Installation.
2. That all damage to the roadways and rights-of-way will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate or
lower any such line at no cost to Brazos County, should same become
necessary due to widening or lowering, or other alteration of the
roadway or right-of-way.
4. That Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the County right-of-way in
accordance with the Utility Accommodation Policy which was adopted by the
Texas Department of Transportation on May 29, 1989.
6. That the line or lines will be constructed no less than twenty-four inches (241
lower than the lowest part of the drainage or bar ditch and the drainage is to
be considered at least two feet (2') below the center of the roadway.
7. That all sites will be barricaded during the construction period.
