COMMISSIONERS' COURT REGULAR MEETING JUNE 20, 2000 k ~S r f i r A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, June 20, 2000, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. The County Judge gave the invocation and led the pledge of allegiance. There was no citizen input and/or concerns. The Court next considered Budget Amendment #99/00-30.1 through 30.4, which would reallocate funds for Juvenile Services, TJPC Challenge Grant and District Clerk; and set up budget for TYC Parole Support. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. Commissioner Thornton moved to approve the changes as submitted. Commissioner Sims seconded the motion. Commissioners Jones, Thornton, Sims and the County Judge voted "Aye". Commissioner Cauley abstained. The Court next considered the following Claims, as submitted by,the County Treasurer for payment: 20008105 through 20008302 Vol ao Page IM I f E I 4 Commissioners' Court meeting June 20, 2000 2 On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the Claims as submitted. The Court next considered acceptance of a Petition for the Incorporation of the Town of Kurten, Texas. The County Judge reviewed the Petition and stated that it contained . sixty-one (61) signatures. On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to accept the Petition for the Incorporation of the Town of Kurten, Texas. The next item for consideration was the Adoption of the Election Order for the Incorporation of the Town of Kurten, Texas. On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to adopt an Order calling a special election for the Incorporation of the Town of Kurten on August 12, 2000, creation of a temporary polling place at the District 2 Volunteer Fire Station at 894 FM 2038 and to appoint Mary Ann Ward, the County Clerk, as the presiding officer at the incorporation election. The Court next considered adjusting the mileage rate reimbursement. Commissioner Sims addressed the $.28 per mile rate and suggested the rate be increased to $.30 per mile. ' Commissioner Thornton stated that it should be increased to $.325 as allowed by the IRS. On motion by Commissioner Sims, r seconded by Commissioner Jones, the Court voted unanimously to set the mileage reimbursement rate at $.30 per mile effective as of this date. The next matter for consideration was contributing to the Bryan/College Station Community Health Center. Commissioner Sims stated that the Court should look into assisting with dental services sometime at a later date. Commissioner Thornton expressed a desire to do something for.the group now. Commissioner Cauley indicated that time was of the essence and that the Court needed to act now. Commissioner Sims moved to deny the request for funding. The County Judge seconded the motion. Commissioners Jones, Thornton, Sims and the County Judge voted "Aye". Commissioner Cauley voted "No". The Court next considered authorizing the issuance of a requisition to Multi-Information Systems, Inc. for services performed in the design and implementation of the software system for the Justices of the Peace. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to authorize the issuance of a requisition in the amount of $10,800.00 to expedite improvements tot he software system for the Justices of the Peace. The Court next considered Interagency Agreements with the City of Bryan and the City of College Station for the filing of a joint grant application with the Texas Criminal Justice Division for funding for the Brazos Valley Narcotics Task Force. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to enter into Interagency Agreements with the City of Bryan and the City of College Station. A copy of each Agreement is attached. The next matter for consideration was approval for the Purchasing Agent to advertise Bid 2000-047, Landscape Maintenance Service. On motion by Commissioner Thornton, seconded by Commissioner Jones, the Court voted unanimously to authorize the Purchasing Agent to advertise for bids for Landscape Maintenance Service. Vol as page E r Commissioners' Court meeting June 20, 2000 4 The Court proceeded to consider the following blanket Purchase Order: Wilton Office Sup District Clerk $3,000 On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the Blanket Purchase Order as submitted. The next matter for consideration by the Court was a request for a laptop computer and associated cables and portable color printer for the District Attorney's Office. This would be for the use of the "on call" attorney for Child 'r f i f r f~ R k f SI Protective Services. On motion by Commissioner Cauley, seconded by Commissioner Jones, the Court voted unanimously to grant the request from the District Attorney and approve the requisition in the amount of $2,703.00. The Court next considered a requisition for a laser jet printer for the District Clerk's Office. On motion by Commissioner Cauley, seconded by Commissioner Jones, the Court voted unanimously to grant the request from the District Clerk and approve the requisition in the amount of $1,582.00. The next matter for consideration was Addendum "A" to the contract with Evercom Systems, Inc. for Inmate Telephone Service. This is a one year extension to the original contract until February 3, 2002. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve Addendum "A" to the with Evercom Systems, Inc. A copy is attached hereto. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare cf the general public. The Road and Bridge Department requested permission to enter the private property of J. C. Thompson, Jr. on I&GN Road to obtain fill material for use in driveway installations. The site is in Precinct 1. The Court next considered approval of the Re-Plat of Lots 7 & 8 Willow Run, Phase One in Precinct 1. Richard Vance, County Engineer, stated that he had reviewed the plat and offered the following comment: 1) Change 1110' Utility Easement" to 1116, Utility Easement" along Headwater Lane. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the Re-Plat of Lots 7 & 8 Willow Run, Phase One subject to the developer complying with the exception noted by the County Engineer. The Court next considered approval of the Re-Plat of Lots 3 through 8, Block 1, Deerfield Estates in Precinct 3. Richard Vance, County Engineer, stated that he had reviewed the plat and offered the following comment: 1) Minimum building line along State Highway 30 is 50 feet. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the Re-Plat of Lots 3 through 8, Block 1, Deerfield Estates subject to the developer complying with the exceptions noted by the County Engineer. Under announcement of interest items and possible future agenda topics the County Judge made the following comments: a) He received a request for five vehicles that have been turned in. CNS asked for a pickup truck. b) He asked the status on the retention pond at MSJ. Commissioner Jones is providing plans to the city. Sheila Walker, Director of the Brazos Center made the following comment: a) She informed the Court that the Federal Land Management Agency would be at the Brazos Center with wild horses for adoption. CLM OR c JU'1 i Y cn 4MMSE Petition and Application to Incorporaf tE~ S The Town of Kurten, Texas 6 PUTY TO THE HONORABLE Alvin Jones, County Judge, Brazos County: WHEREAS, the undersigned constitute fifty or more qualified voters who are residents of the community commonly known as "Kurten"; WHEREAS, each of the undersigned proposes that the community be incorporated under the laws of the State of Texas as a municipality; WHEREAS, the community contains less than two square miles of surface area; WHEREAS, the community contains more than 201 inhabitants and less than 9,999 inhabitants; WHEREAS, the community is a collection of inhabited houses in close proximity for which there is a compact center of population around which an unincorporated town has developed; WHEREAS, the community area is capable of receiving reasonable municipal services; WHEREAS, the community is located entirely in Brazos County, Texas; WHEREAS, the proposed name of the municipality will be the "Town of Kurten"; WHEREAS, this Petition and Application is accompanied by a plat of the proposed municipality containing only the territory to be used strictly for municipal purposes (see "Exhibit K'); WHEREAS, this Petition and Application is made pursuant to and in compliance with the laws of the State of Texas, particularly Article M, Section 4 of the Texas Constitution, Chapters 5 and 7 of the Texas Local Government Code, and Chapter 277 of the Texas Election Code. i i Petition to Incorporate Part A Town of Kurten ' 17 Pa I of 2 Circulator's Initials Cr-~vj-%J 154 r.r.1 •:___...i:.l::.... _ ...u,.,.~..... - ~ ~i• , ;..~~~w.:-.+caa_.~,.,. u4~ud.+ti'v.. ...~c:er _ ,:~u....e.~. _...__e._.._ __t:.. _ _ NOW THEREFORE, the undersigned respectfully submit this application and petition to the Honorable Alvin Jones, County Judge of Brazos County, Texas, and request that he: (1) Accept and consider this Petition and Application to Incorporate the Town of Kurten, Texas; (2) Find that this Petition and Application contains the signatures of at least fifty qualified voters who are residents of the community commonly known as "Kurten"-, (3) Find that the territory described above contains less than two square miles of surface area, (4) Find that the territory described above contains at least 201 but less than 9,999 inhabitants, (5) Order and convene a public hearing on the application and petition before the County Commissioners Court if deemed advisable and/or required by law-, (6) Order a special election on the issue of incorporation to be held at a designated place in the community and on a specified date, that being the next uniform election date, (7) Appoint an officer, pursuant to Chapter 7 of the Texas Local Government Code, to preside at an incorporation election at which each qualified voter who resides within . the boundaries of the proposed municipality may vote on the issue of incorporation-, (8) Post notice of the election at three public places in the community for at least ten days preceding the date ofthe election and publish the notice as otherwise required by law-, (9) Take such other action as required by law for the calling and holding of an incorporation election; (10) Declare and enter into the records of the County of Brazos the results of the election, and (11) Take such other action as deemed necessary and advisable in his judgment to give full effect to the intent and requirements of the laws of the State of Texas. The aggregated billing data Is compared against the real-time balances for accurate.validation. STC also uses direct billing agreements to bill and collect phone charges. Under these agreements, STC sends. call detail records directly to the Local Exchange Carriers (LECs); the recipients of the inmate collect calls receive the collect call changes as part of their regular telephone bill. The LEC relationships allow us to share billing database Information, which greatly enhances our ability to process valid and billable calls. Our representatives work with Inmate-called parties to unblock their numbers following credit resolutlon. This reduces the Incidence of fraud, and quickly resolves call blocking Issues. Voice Prompts are expandable and can be customized to match special facility needs. The CAM system has no limitations on the number of blocks It will allow. Prior to Installation, blocks are automatically placed on all 800, 900 and 976 numbers, as well as other sensitive exchanges such as 411, 555, 911, credit card calls, etc. The blocks are placed by the end-user directly, by authorized facility personnel through the on-site management workstation. The facility may add, delete and review the file at the workstation. CAM can be blocked In ranges of numbers (entire area code or exchange), site specific numbers, specific destination number or block calls to a predetermined number of unaccepted calls to the same termination number. Multiple range blocking Includes disallowed telephone numbers, Le., banks, hospitals, hotels, government offices, etc. d. The system must have the ability to limit and/or shut off completely, some or all, equipment from being operational at any time. Response: STC acknowledges and will comply. STC will Install cut-off switches on each Individual telephone, as well as a master cut-off switch to all telephones within the facility. The CAM System operates on an automatic and manual switching basis. The telephones can be controlled on an Individual basis or simultaneously. The System can also be pre-programmed -to automatically control the availability of the telephones. -The Facility may control the telephone usage via manual cut-off switches located In an area that Is not accessible to unauthorized Individuals or through the on-site management workstatiom e. VIL REVENUElCOrvOUSSION Brazos County shall set call lengths to 18 minutes, local collect calls shall be at a flat rate of S2410, and long distance surcharge rates shall be set at S.50. Brazos County reserves the right to adjust these rates during the term of this contract. These rates shall be used for tabulation purposes.
