for long distance service.
17. Request from Wellborn Special Utility District for water line installation in the right-of-
way of Koppe Bridge Road. Site is located in Precinct 1.
18. Request from Road & Bridge Department for permission to enter Tracy Peters' property
located off Elmo Weedon Road to clear approximately 0.3 mile of fenceline and open
drainage ditch to drain water from roadway. Site is located in Precinct 3.
19. Request from Road & Bridge Department for permission to enter Melanie Moore Kolby's
property located off White Switch Road to construct a N" bottom drainage ditch from
the curve to Bid Creek to drain water from the roadway. Site is located in Precinct 1.
20. Request from GTE to install approximately 2,700 feet of 50 pair cable along the east
right-of-way of Weedon Loop. Site is located in Precinct 3.
21. Approval of the March 2000 ,Treasurer's Report and the Quarter Ending 03-31-2000
Treasurer's Report.
22. Approval of minutes of the following Commissioners Court meetings:
a. Regular meetings conducted on December 7, 1999; December 14, 1999 and
December 21, 1999.
b. A Special Meeting conducted on December 17, 1999.
23. Payment of Claims.

A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, May 2, 2000, with the following members of
the Court present:
Alvin W. Jones, County Judge, Absent;
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3, Presiding;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Sims gave the invocation and led the pledge
of allegiance.
Under citizen's input and/or concerns, Frank Thurmond
presented the Court with the Pebble Creek Development
Company's Statement and Questions concerning the proposed
Traditions Golf Course Development.
Commissioner Sims read aloud a Proclamation designating
May 4, 2000 as "National Day of Prayer". The Court joins with
the National Government to encourage all to join together in
prayer to recognize our blessings, acknowledge our wrongs, and
to ask for Divine guidance to better our future. On motion by
Commissioner Jones, seconded by Commissioner Cauley the Court
voted to proclaim May 4, 2000 as "National Day of Prayer"
throughout Brazos County. Commissioner Sims then presented
the signed Proclamation to Ms. Sue Sorenson, who announced
that the observance would be held at Wolf Pen Creek.

The Court next considered Budget Amendment #99/00--23.1
through 23.2, which would reallocate funds for the 85"'
District Court and transfer funds from Contingency to Justice
of the Peace, Precinct 2. On motion by Commissioner Cauley,
seconded by Commissioner Thornton, the Court voted unanimously
to approve the budget amendment as submitted, a copy of which
is attached hereto.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to approve
the changes as submitted.
The next item for consideration was an Interlocal
agreement with Travis County for Medical Examiner Services.
On motion by Commissioner Thornton, seconded by Commissioner
Jones, the Court voted unanimously to table consideration.
The Court then considered the cancellation of contract
for Express Scripts prescription services. On motion by
Commissioner Cauley, seconded by Commissioner Thornton, the
Court voted unanimously to cancel the contract for Express
Scripts prescription services.
Next for the Court's consideration was approval of an
Agreement with Script Care, LTD. for a managed prescription
drug program for the county employees. on motion by
Commissioner Cauley, seconded by Commissioner Jones, the Court
voted unanimously to enter into Agreement with Script Care,
LTD. for managed prescription drug program for the county
employees. A copy of the Agreement is attached.
The Court next considered the appointment of a member of
I the Brazos County Child Welfare Board. On motion by
Commissioner Jones, seconded by Commissioner Cauley, the Court
voted unanimously to appoint Ms. Mary Lou di Zerega to fill an
open position on the board.

The next matter for consideration was the authorization
for the County Judge to travel to Washington, D. C. with the
Bryan-College Station Economic Development Corporation May 2-
4, 2000. This will be at no cost to the County. On motion by
Commissioner Sims, seconded by Commissioner Thornton, the
Court voted unanimously to authorize the County Judge to
travel to Washington, D. C. with the Bryan-College Station
Economic Development Corporation May 2-4, 2000.
The Court next considered and amendment to the
State/Local Purchase Agreement #A3J81 with Hewlett-Packard
Company for maintenance. On motion by Commissioner Jones,
seconded by Commissioner Cauley, the Court voted unanimously
to authorize the amendment to the State/Local Purchase
Agreement #A3J81 with Hewlett-Packard Company for maintenance.
A copy is attached.
The next matter before the Court was adoption of a
vehicle use policy for the Maintenance Department. On motion
by Commissioner Thornton, seconded by Commissioner Cauley, the
Court voted unanimously to table consideration of the policy.
The Court next considered approval of a requisition from
the Capital Expenditures-Computer Hardware for the following
purchase:
a) Laptop Computer for 85`" District Court,
$2,376.00.
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the
requisitions to be paid from Capital Expenditures-Computer
Replacement.
The Court next considered approval of a requisition from
the ,
Capital Expenditures-Copier Replacement for the following
purchase:
a) Copier for Brazos Center, $2,970.37.

On motion by Commissioner Thornton, seconded by Commissioner
Jones, the Court voted unanimously to approve the requisitions
to be paid from Capital Expenditures-Copier Replacement
The next matter for consideration was the
Switched/Dedicated Service Enrollment Form and Agreement with
NTS Communications for long distance telephone service. On
motion by Commissioner Thornton, seconded by Commissioner
Jones, the Court voted unanimously to table consideration to
allow the Court time to review a last minute change.
The Court next considered the request from Wellborn
Special Utility District for water line installation in the
right-of-way of Koppe Bridge Road. The site is located in
Precinct 1. The County Engineer stated that all appeared to
be in order and recommended approval. On motion by
Commissioner Jones, seconded by Commissioner Cauley, the Court
voted unanimously to approve the request of Wellborn Special
Utility District and authorized the installation. A copy of
the request is attached hereto.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Tracy Peters on
Elmo Weedon Road in Precinct 3 to clear approximately 0.3 mile
of fence line and open the drainage ditch to drain water from
the roadway. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to authorize
the work.

The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Melaine Moore
Kolby on White Switch Road in Precinct 1 to construct a "V^
bottom drainage ditch from the curve, across private property
to Bid Creek to drain water from the Roadway. The site will
be maintained as necessary to ensure adequate drainage. On
motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to authorize the work.
The Court next considered the request from GTE to install
approximately 2,700 feet of 50 pair cable along the east
right-of-way of Weedon Loop in Precinct 3. The County

recommended approval. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously

On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to receive,
approve and order filed as submitted the Treasurer's report
for March 2000. A copy of which is attached to and made a
part of these minutes.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held December, 1999 on the
following dates: 7, 14 & 21 and a Special Meeting held on
December 21. On motion by Commissioner Jones, seconded by
Commissioner Thornton, the Court voted unanimously to approve
the minutes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Claims as
submitted.
Under announcement of interest items and possible future I
agenda topics Commissioner Cauley made the following comment: .
a) There will soon be a public workshop on
computer software for the County.
There was no citizen input and/or concerns.
There being no further business to come before the Court,

On this the 2nd day of May 2000 at a regular meeting of the
Commissioners' Court, the following members were present:

The following proceedings were held:
THAT WHEREAS, on May 2, 2000 the Court heard and approved a
budget amendment for the 1999-2000 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September ,9,
1999 the following amendment(s) to the original are hereby
authorized, as described on the attached page(s).

requested by Judge Ellis for a TV/VCR which he had located at WalMart for $179.88. Also,
for a stand from a contract vendor in the amount of $129.96. 310.00 was approved)
Now, a request for an additional $100.00 from contingency funds for a 19" TV/VCR
instead of the 13" unit originally priced. Please refer to the Telephone Quotation Sheet

A MANAGED PRESCRIPTION DRUG PROGRAM AGREEMENT
MANAGED BY SCRIPT CARE, LTD FOR
BRAZOSCOVNn
THIS AGREEMENT made by and between Script Care. Ltd., a third party administrator (`SCI') and Brazos County ('Subscriber")
WHEREAS. Subsctiber desires to provide a prescription drug benefit program ('the Program") for certain of its duly qualified and enrolled employees and dependents
("Participants") and
WHEREAS SCI desires to provide contract administration and management of the Program for Subscriber through the network of Script Care Pharmacy Provider
1"Participating Pharmacy')
NOW. THEREFORE, in consideration of the premises and the mutual covenants and undertakings herein contained, the parties agree as follows
1 DEFINITION OF TERMS
"Participant" means any individual for whom Subscriber requests prescription benefit coverage Participants will be specified by Subscriber in the then
current Eligibility File Maintenance Data incorporated by reference in Schedule C of this Agreement.
"Eligibility File Maintenance Data" means that form of data supplied by Subscriber so as to identify Participants as well as other eligibility information
necessary to administer the Program and process prescription drug claims also refereneed in Schedule C of this Agreement
-Maintenance Drug- means any Legend Drug that is prescribed for the purpose of treating or preventing a chronic illness
'Covered Prescription Benefits" means those categories of drugs and/or items identified as being covered under the Program to Schedule A of this
Agreement
"Legend Drug" means any medicinal substance which bears the legend 'Caution. Federal law prohibits dispensing without a prescription' and. for the
purposes of this Agreement, shall include State Restricted Drigs (any non-federal Legend Drug which, according to state law, may not be dispensed without
a prc=puon) and compounded prescriptions containing at least one Legend Drug as herein described in a therapeutic amount.
-Authorized Physician" shall mean any licensed doctor of medicine, doctor of osteopathy, doctor of podiatry, or doctor of dentistry
'Copayment" means that amount of money that the Participant must pay for each presrnption filled or refilled under the terms of the Program as specified
in Schedule A of this Agreement
"AWP" is the average wholesale price as determined by Medispan
-FFP" is the federal financial participation limits for certain therapeutically equivalent multiple source drugs as defined in the HCFA Medicaid Manual
' Usual & Customary (U&C) is the lowest price a pharmacy would charge if the customer were paying cash, including senior citizen discounts and frequent
shopper discounts
2 DRUG COVERAGE AND EXCLUSIONS
Coverage for Participants will be provided pursuant to Schedule A Of this Agreement.
Exclusions
Medications for which the cost is recoverable under any workers compensation or occupational disease law or any state or governmental agency, or
medication furnished by any other drug or medical service where no charge is made to the ParticipanL The Program will also exclude coverage for
Participants who have other pnmary group medical coverage
Any Legend Drug for which the intended use has not been approved by the Food and Drug Administration and is therefore termed'Invcstigatwnal "
Any experimental drug even though a charge is made to the Participant.
Any charge for the administration of any Legend Drug.
Legend Drugs which are to be taken or administered to the Participant, in part or in whole, while Participant is a patient in a licensed hospital, rest home.
sanitanum. extended care facility, convalescent hospital. nursing ham, or similar institution which requires special una-dose type packaging of Legend
Drugs for its patients
Drug charges exceeding the cost for the same drug in conventional packaging
3 QUANTITIES DISPENSED
The quantity dispensed for each covered prescription or refill of a covered prescnptm will be the quantity prescribed, up to the limits set forth in Schedule
A of this Agreement

4. REFILL
A covered prescription may be refilled up to one yew fitim the tune it was issued by the Authorized Physician if the Authorized Physician so authorizes and

S. PARTICIPANT COVERAGE
Coverage for Participants will be only as specified by the Subscriber to the then currant Eligibility File Maintenance Data, hereby irmeorporat, by reference
in this Agreement
6. SCI agrees to
A. Pro vide Subscriber with a current list of all Participating Pharmacies eligible to provide prescription services to Participants of the Program and
topibrin Subscriber in writing of all additions and/or deleuons to this list
b Allow Participants of the Program to obtain and charge Covered Prescription Benefits at any Participating Pharmacy after paying the appticable
Copsyment if any is required by the Program
c Collect the full amount of Copayment, if any, born Participants for each new or refilled prescription at the time of the purchase.
d Bill Subscriber on or about the first and the fifteenth of each month for Covered Prescription Benefits provided by all Participating Pharmacies
according to the pricing formula sec forth in Schedule A of this Agreement and for all applicable administrative fees Such invoices shall
provide a detailed summary of the number of claims, the amount due for said claims, the administrative fees due, and such other rnformauon
which Subscriber reasonably requests
e Send all materials related to the administration of a plan, ie, the oontraas, employee handouts, provider lists, ID cards and reports to the
appropriate party via regular US Mad Any charges incurred for special delivery will be billed to the subscriber
7 SUBSCRIBER agrees to
a. Provide SCI, or its agent, with complete Eligibility File Maintenance Data, incorporated into this Agreement by reference, luting those
Participants that the Subscriber wishes to enroll in the program. Subscriber shall be totally responsible for the correctness, completeness and
accuracy of all dam submitted to SCI or its agent, eoncemmg the Eligibility File Maintenance Data and any updates thereof If any such data
submitted to SCI, or its agent is incorrect, incomplete, not in good condition, or not submitted on time. Subscriber shall be responsible for any
charges that may result from the use of said information in the verification of eligibility and the providing of services by Participating
Pharmacies
b Inforn SCI, or its agent, using the appropriate data fours, of all changes in the stance of Participai.ts (i e. additions, terminations, etc ) no less
often than once a month
c Pay in full, upon receipt of billing, all invoices submitted to Subscriber by SCI for charges made by Participants, including those invoices made
for related administrative fees All invoices shall be paid in United States dollars, within ten (10) working days of the receipt of each invoice
Subscriber shall pay a late payment charge of the lesser of (1) the maximum legally permitted rate, or (2) one percent (1%) per month on the

Nothing contained in this Agreement shall be construed to require the Participating Pharmacy to tender any pharmaceutical service and/or dispense any

AMENDMENT AND MODIFICATION
This Agreement shall not be amended or modified in any manner whatsoever except by a written instrument signed by the parties haeto.

schedules and exhibits are incorporated herein by reference and are made part of this Agreement.

ADVERTISING AND PROMOTIONAL CONTROL
SCI reserves the right to control the use of the words "Script Care' and all service marks presently existing or hereafter established in connection with the
Program Subscriber agrees that it will not use such words. symbols, trademarks or service marks in advertising or promotional materials or otherwise, and
that it will not advertise or publicly display such words. symbols, trademarks or service marks without the prior written consent of SCI, and will cease any
and all usage immediately upon termination of this Agreement
GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas All disputes ansing out of this Agreement shall be
resolved in Jefferson County. Texas.
FORCE MAJEURE
Neither party shall be liable for failure W perform its obligation under this Agreement if prevented from doing so by a cause or causes beyond its
commercially reasonable control. including, but not limited to. acts of God at nature, fires, stomps, floods. earthquakes, riots, strikes, wars, of restraints of
government.
ENTIRE AGREEMENT
This Agreemcm including any schedules, exhibits. or amiaidmaiu, shall consuuuee the crime understanding between the parties hereto and shall supersede
any and all prior or contemporaneous representations. statements, understandings, oegoustsons. or agreanerus either oral or written between the parties.
WAIVER
No delay or failure of SCI or Subscriber in exercising any right hereiuider and no parual or single exercise thereof shaft be deemed of itself to constitute a
waiver of such rights or any other right hereunder.

24. TERM AND TERMINATION
The tam of this Agreement dull be one (1) yea. commencing Jim 1. 2000, and ending on the first anniversary of such date provided however. that this
Agreement shall terminate on five (5) days prior written notice from either party if the other party is in default under any of the tams and provisions of this
Agreement or under the terms and provisions of any other agreement entered into by the parties in connection with the Program and has baled to cure
default within ten (10) days following written notice of such default. The terms of this Agreement shall be automatically renewed for successive additional
one year terms unless written nouce to the contrary is given by either party to the other not less than suety (60) days prior to the end of the current one year
tam If this Agreement has any effect whatsoever on the level of reimbursement that the Participating Pharmacies received from any applicable state
Medicaid program, this Agreement may be immediately terminated by SCI Notwithstanding the preceding, this Agreement may be terminated at any time
by either party without cause upon sixty (60) days written notice
25 POWER AND AUTHORITY
Each of the individuals who has executed this Agreement on behalf of one of the parties hereto warrants that he at she has the power and authority to
execute this agreement on behalf of such party and to bind such party to the terns and provisions of this Agreement
26 RIGHT TO AUDITS
Subscriber shall have the right to perform an audit at any tune on the charges submitted to Subscriber by SCI for services provided under the tams of this
Agreement. All toss for such audits will be entirely the responsibility of Subscriber and will be due and payable upon completion of such audits
27 CONFIDENTIALITY OF INFORMATION
Pursuant to this Agreement. SCI-shall take all reasonable precautions to prevent disclosure or misuse of information conceming Participants for a purpose
unrelated to the administration of the Program SCI shall disclose such information only

B) The line shall be installed 1) within 3.6 of and parallel to the right-of-way line and/or 2) in the
case of a road bore, perpendicular to the right-of-way line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right-of-way.
D) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test
shall be conducted by an independent Geotechnical testing firm; copies of all test results shall
be fumished to the office of the Brazos County Engineer.
E) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of Transportation,
and all other State and Federal laws governing utility construction.

ITEM: R!2auest from GTE to install approximately 2.700 ft. of 50 pair cable along the
east rig of way of Weedon Loop. Cable will be 4 ft. in the right of wax at a minimum
depth of 30". Site is located in Precinct 3. \
SOURCE OF FUNDS: _N/A
1. PRESENTATION:
A) No work will be permitted between front slope and/or back slope.
B) The line shall be installed 1) within 3-5' of and parallel to the right-of-way line and/or 2) in the
case of a road bore, perpendicular to the right-of-way line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right-of-way.
D) Duch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test
shall be conducted by an independent Geotechnical testing firm; copies of all test results shall
be fumished to the office of the Brazos County Engineer.
E) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of Transportation,
and all other State and Federal laws governing utility construction.

To The Commissioner's Court of Brazos County
ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE SOUTHWEST INCORPORATED will
construct a communication line within the right-of-way of a County Road in
Brazos County, Texas as follows:
We will be placing approximately 2700 ft. of 50 pair buried cable
along the east R.O.W. of Weedon Loop. The cable will be 4 ft.
in the R.O.W. at a minimum depth of 30" between 9732 Weedon
Loop and 9505 Weedon Loop.
The location and description of this line and associated appurtenances is
more fully shown by two (2) copies of drawings attached to this notice. The line
will be constructed and maintained on the County Road right-of-way in
accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly
understood that the tender of this notice by the GTE Southwest Incorporated
does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or
right now granted by law or may be granted in the future and any provision or
provisions so construed shall be null and void.
Construction of this line will begin on of after April 2000.
