Site is located in Precinct 4. 20. Request from GTE to construct a road bore and install 1,925 feet of parallel cable in the right-of-way of Wilson Pasture Road. Site is located in Precinct 2. 21. Request from Wickson Creek Special Utility District to construct a road bore in the right- of-way of Mancuso Road approximately 0.1 mile from its intersection with FM 2223 for a water line installation. To make arrangements, call (979) 361-4102. dgf% ..pAc!xL- 477- vwL.0j9 4 COMMISSIONERS' COURT REGULAR MEETING APRIL 18, 2000 • A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, April 18, 2000, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Jones gave the invocation and led the pledge of allegiance. There was no citizen input and/or concerns. The Court next considered Budget Amendment #99/00-21.1 through 21.4, which would reallocate funds for the Brazos Center, Emergency Management and the Task Force and transfer funds from contingency to Justice of the Peace, Precinct 2. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as is submitted by the County Treasurer for payment: 20005980 through 20006206 Vol 19 Page 47 3 3 x Commissioners' Court meeting April 18, 2000 2 On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. The next matter for consideration by the Court was the -approval of an Interlocal Agreement with Travis County for the ' provision of Medical Examiner services. Commissioner Jones moved to approve. Commissioner Cauley seconded the motion. Commissioner Thornton questioned section 3.03 that places responsibility for claims. He asked if the County wanted to be responsible for negligence. Commissioners Jones and Cauley withdrew their motion and second. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to table consideration. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to adopt a resolution j authorizing the County Judge to make application to the Office of the Governor, Criminal Justice Division, Texas Narcotics Control Program for a grant in the amount of $815,672.00 to operate to Brazos Valley Narcotics Task Force for the 2000- 2001 year and authorize the County Judge to accept such grant funds should they be tendered. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to authorize the County Judge to execute a Tax Resale Deed to the following individual: Syed Hyder - Lot 106, Benchley Oaks Subdivision, Brazos County, Texas. The Court proceeded to consider the following blanket Purchase Order: Quill Corporation District Attorney $1,500 On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the Blanket Purchase Order as submitted. Vol Page I i J Commissioners' Court meeting April 18, 2000 3 • • • r, , i The Court next considered payment of a requisition from I~ Certificate of Obligation Funds to Lindsay Communications for , the Minimum Security Jail expansion. This is for the purchase of a phone system. Lindsay Communications is the only local vendor who can provide equipment that is compatible with the system currently in place and the Minimum Security Jail. On motion by Commissioner Cauley , seconded by Commissioner Sims, the Court voted unanimously to approve payment of the requisition in the amount of $3,918.00. The next matter before the Court was a request from the Purchasing Department for permission for Ben Sanford of Ben Sanford and Associates to enter into contract negotiations with NTS Communications for long distance services for the County. On motion by Commissioner Sims, seconded by ` N Commissioner Cauley, the Court voted unanimously to approve the request from the Purchasing Department for permission for ; Ben Sanford of Ben Sanford and Associates to enter into contract negotiations with NTS Communications for long distance services for the County. The next matter for consideration was approval for the Purchasing Agent to advertise Bid 2000-040 Energy Conservation r Measure - Brazos Center - ACCU-2 Replacement and AHU-2 VSD Installation. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to authorize t the Purchasing Agent to advertise for bids for Energy Conservation Measures. The Court next considered a request to cancel Bid No. 2000-040 - Asphalt, Oil and Emulsion Products, Annual Contract and request to advertise Bid No. 2000-004R - Asphalt, Oil and Emulsion Products, Annual Contract. It has become necessary to cancel this bid due to the extreme increase in fuel costs. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to cancel Bid No. 2000-004 Asphalt, Oil and Emulsion Products and advertise for Bid No. 2000-004R - Asphalt, Oil and Emulsion Products. The Court next considered approval of requisitions from the Capital Expenditures Fund, Computer Replacement for the following purchases: a) Monitor and Hardware for Brazos Center $1,384.00. b) 2 computers, 2 monitors and 2 Allstar Systems memory upgrades for Emergency Management $3,240.00. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the requisitions to be paid from Capital Expenditures Fund, Computer Replacement. The next matter before the Court was the voiding of the Interlocal Agreement with the City of Snook and executing an Interlocal Agreement with the Snook Independent School District for participation in a public auction. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to void the Interlocal Agreement with the City of Snook and execute an Interlocal Agreement with the Snook Independent School District for participation in a public auction. The Court next considered approval of the Final Plat of Prairie Acres in Precinct 2. Richard Vance, County Engineer, stated that he had reviewed the plat and offered the following comment: 1) There is an existing water line in the 18.12 feet of extra right-of-way dedication which is also a private easement; arrangements have been made with Wickson Creek S.U.D. to relocate the existing water line to the new utility easement at the developers expense. The Court next considered the request from ITC DetlaCom Communications to construct a road bore and parallel cable installation in the right of way of Mumford road beginning approximately 4,800 feet southeast of FM 2818 extending for a distance of 10,560 feet. Brazos County's jurisdiction begins 4,800 feet southeast of FM 2818. The site is located in Precinct 4. The County Engineer stated that all appeared to be in order and recommended approval with the stipulation that ITC DeltaCom Communications must contact the City of Bryan for information regarding their right-of-way. On motion by Commissioner Cauley, seconded by Commissioner Sims, the. Court voted unanimously to approve the request from ITC DeltaCom Communications and authorized the installation with the stipulation that the requirement be met. A copy of the request is attached hereto. The Court next heard a presentation of the Delinquent Tax Collection Attorney's quarterly report. Under announcement of interest items and possible future agenda topics the County Judge made the following comments: a) He received a letter from the State Comptrollers Office saying that all requests for tobacco settlement monies were in. Brazos County claimed 1.6 million dollars. Disbursement of funds will be about 9% for each request. The new forms are being designed by by M.J. Deen and himself. c) He hopes to report on a possible location for the Expo Center by next week. Under citizen input and/or concerns, Frank Thurmond presented the Court with a petition from twelve developers and seven home builders concerning the City of Bryan golf course project. He asked the County to not participate in the TIF. F 1 E I s r• r INTERLOCAL AGREEMENT THE STATE OF TEXAS COUNTY OF BRAZOS THIS CONTRACT AND AGREEMENT, made and entered into this 18th day of Aoril , 2000, by and between the County of Brazos and Snook Independent School District , each participating government acting by and through its respective executive office hereunto duly authorized by resolution of the governing body. WITNESSETH: WHEREAS, the respective participating governments are authorized by the Interlocal Cooperation Act, V.T.C.A. Government Code Chapter 791, to enter into joint contracts and agreements for the performance of governmental functions and services including administrative functions normally associated with the operation-of government such as purchasing of necessary materials and supplies, and the sale of goods and equipment in a public auction; WHEREAS, it is the desire of the aforesaid participating governments to comply with and further the policies and purposes of the Interlocal Cooperation Act; WHEREAS, the participating governments cannot normally obtain the best possible purchase price for materials and supplies acting individually and without cooperation; and WHEREAS, it is deemed in the best interest of all participating governments that said governments do enter into a mutually satisfactory agreement for the sale of goods and equipment in a public auction for the year 2000; NOW, THEREFORE, the parties hereto, in consideration of the mutual covenants and conditions contained herein, promise and agree as to each of the other parties and as to all of the parties as follows: 1. Snook Independent School District shall be responsible for all such administrative duties as may be necessary to lawfully facilitate processing and sale of goods or equipment in a public auction. PRESENTATION: A) No work will be permitted between front slope and/or back slope. • B) The line shall be installed 1) within 3-5' of and parallel to the right-of-way line and/or 2) in the case of a road bore, perpendicular to the right-of-way line. C) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's responsibility to do so and to remove all cleared brush, trees etc. from county right-of-way. D) Duch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test shall be conducted by an independent Geotechnical testing firm; copies of all test results shall be furnished to the office of the Brazos County Engineer. The line will be constructed and maintained on the County Road right-of-way in accordance with governing laws. Notwithstanding any other provision contained herein, it is expressly understood that the tender of this notice by the GTE Southwest Incorporated does not constitute a waiver, surrender, abandonment or impairment of any property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may be granted in the future and any provision or provisions so construed shall be null and void.
