approximately 300 feet of the Hebert to Heame 12" pipeline to accommodate the new
Green's Prairie Road Extension project. Site is located in Precinct 3.

in Precinct 2.

REGULAR MEETING
MARCH 28, 2000

A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, March 28, 2000, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1, Absent;
Wm.S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Sims gave the invocation and led the pledge
of allegiance.
There was no citizen input and/or concerns.
The County Judge read aloud a Proclamation designating
•
the week of April 3 through 9, 2000 as "Public Health Week".
The Court commends the Brazos County Health Department
employees and volunteers for their outstanding dedication to
maintaining and improving the health of their fellow citizens.
On motion by the County Judge, seconded by Commissioner Sims,
the Court moved to proclaim the week of April 3 through 9,
2000 as "Public Health Week" throughout Brazos County. The
County Judge then presented the signed Proclamation to Ken
Bost, representing the local Health Department. Commissioner
Sims congratulated the entire staff.
The Court next considered Budget Amendment #99/00-18.1
through 18.2, which would reallocate funds for Road & Bridge
and the 361" District Court.

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the budget
amendment as submitted, a copy of which is attached hereto.
The Court proceeded to consider the change of status of

employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to approve the
• changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered approving Adoption of a Vehicle
Use Policy for the County Attorney's Office and the Brazos
County Events Facilities Department. On motion by
Commissioner Thornton, seconded by Commissioner Cauley, the
Court voted unanimously to adopt a Vehicle Use Policy for the
County Attorney's Office and the Brazos County Events
Facilities Department. A copy of each is attached.
The next matter for consideration was the establishment
of a speed limit on Andert Road. At a public hearing held
March 21, 2000, it was recommended to set the speed limit at
45 miles per hour along the entire length of the road. On
motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to set the speed limit at 45 miles
per hour along the entire length of the road.
The next matter for consideration by the Court was a
request submitted by the Director of the Computer and Network
Services seeking approval for out of state travel for Ernie
Laney. Mr. Laney would be traveling to Nashville,

Tennessee to attend a "Zortec Developer's Conference" during
the week of May 8 through the 10, 2000. On motion by
Commissioner Cauley, seconded by Commissioner Sims, the Court
voted unanimously to grant the request from the Director of
the Computer and Network Services Department and approved
payment of out of state travel expense for Mr. Ernie Laney.
The Court next considered authorizing Revision 20, Fence
Enhancements, to the contract with W. M. Klunkert Construction
Company for the Brazos County Detention Center Addition. R-20
will increase the contract amount by $65,385.00. On motion by
Commissioner Jones, seconded by Commissioner Cauley, the Court
voted unanimously to authorize Revision 20. Commissioner
Jones then asked where the funds would come from to pay for
this. The County Auditor replied that funds were available in
the C.O.fund.
The Court next considered authorizing the Special

Programs Manager to submit a grant application on behalf of
the Juvenile Services Department Boot Camp and the Texas
Agriculture Extension service Brazos County for funding of a
Juvenile Accountability Incentive Block Grant Program
administered by the Criminal Justice division of the
Governor's Office and designating the Special Programs Manager
of Juvenile Services Department as the authorized person to
execute documents in conjunction with the application. The
grant in is the amount of $37,162.00. On motion by
Commissioner Cauley, seconded by Commissioner Thornton, the
Court voted unanimously to authorizing the Special Programs
Manager to submit a grant application.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to execute a Tax Resale Deed to the following
individuals:

The Court next considered entering into an Interlocal
Agreement with Burleson County to jointly conduct a public
auction. This is authorized by the Interlocal Cooperation
act, V.T.C.A. Government Code Chapter 791. On motion by
Commissioner Sims, seconded by Commissioner Cauley, the Court
voted unanimously to enter into an Interlocal Agreement with
Burleson County to jointly conduct a public auction.
The Court proceeded to consider the following blanket
Purchase Orders:

On motion by Commissioner Cauley, seconded by Commissioner

The Court next considered approval of a requisition from
the Capital Expenditures for the following purchase:
a) Recondition pipe line due to road
construction on Greens Prairie Road
$40,000.00
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the requisition
to be paid from Capital Expenditures.
The Court next considered approval of requisition from
the Capital Expenditures-Computer Replacement for the
following purchase:
} a) Laptop computer for the 361" District
Court Judge, $2,594.00
On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the requisition
to be paid from Capital Expenditures-Computer Replacement.
The Court next considered the request from GTE to
construct a road bore and parallel cable installation in the
right-of-way of Cliff Road beginning approximately 0.2 mile
from its intersection with State Highway 21 and extending for
a distance of 1,973 feet. The site is located in Precinct 3.
The County Engineer stated that all appeared to be in order
and recommended approval. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the request of GTE and authorized the installation.
A copy of the request is attached hereto.
The Court next considered the request from GTE to
construct a parallel cable installation in the right-of-way of
Deer Park Drive starting at State Highway 6 South feeder road
and extending for a distance of 2,165 feet. The site is
located in Precinct 1. Commissioner Jones moved to approve the
request. Commissioner Thornton seconded the motion. After
some discussion and careful consideration Commissioners Jones
and Thornton withdrew their motion and second.

The County Engineer recommended denial because the proposed
cable placement was outside the 20 ft. utility easements that
run on both sides of the roadway. On motion by Commissioner
Jones, seconded by Commissioner Sims, the Court voted
unanimously to deny the request from GTE.
The Court next considered acceptance of Exxon-Mobil
Pipeline's cost estimate of $40,000.00 to inspect and
recondition approximately 300 feet of the Hebert to Hearn 12
inch pipeline to accommodate the new Greens Prairie Road
Extension project in Precinct 3. The county Auditor asked if
this was coming out of C.O. Funds. Commissioner Thornton
asked about taxes. The County Engineer stated that this was
merely an estimate of costs. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to accept Exxon-Mobil Pipeline's cost estimate to inspect and
recondition approximately 300 feet of the Hebert to Hearn 12
inch pipeline to accommodate the new Greens Prairie Road
Extension project.
The Court next considered approval of the Final Plat of
Fickey Road Estates in Precinct 2. Richard Vance, County
Engineer, stated that he had reviewed the plat and all
appeared to be in order. On motion by Commissioner Thornton,
seconded by Commissioner Jones, the Court voted unanimously to
approve the final plat of Fickey Road Estates as submitted.
The Court next considered approval of the Preliminary
Plat of Kurten Land Company in Precinct 2. Richard Vance,
County Engineer, stated that he had reviewed the plat and
that he recommended denial citing Article V, Paragraph C, Line
S on Page 14 of the Brazos County Subdivision and Development
Regulations which states:
"Arterial or main lateral streets, or set back
lines, are to be provided in locations where the
Commissioners Court and the County Engineer
consider them necessary.

Driveway entrances directly onto highways and
thoroughfares are discouraged by the County and the
Commissioners Court reserves the right to reject a
plat for final approval if the lots within such
subdivision provide for direct driveway entrance
onto and off of highways and thoroughfares."
The County Engineer went on to state that there were 32, 100
foot wide lots fronting FM 2038 and there is a high
probability that this proposed lot arrangement would generate
a severe safety hazard as all lot driveway entrances would be
located approximately 100 feet apart and each is accessing FM
2038. On motion by Commissioner Thornton, seconded by
Commissioner Sims, the Court voted unanimously to reject the
preliminary plat of the Kurten Land Company.
The Court acknowledged receipt of the Extension Service
reports for February 2000 and acknowledged receipt of reports
from the following County and Precinct Offices showing
revenues collected and remitted to the County Treasurer:

Under announcement of interest items and possible future
agenda topics Commissioner Sims made the following comment:
1. He was contacted by the Knox County Judge and
informed that wild hogs are now a nuisance and to
watch for hem along the roadways.

The County
Judge made the following comments:
a)
He received a letter for State Senator
Steve Ogden asking for local bills to
introduce in the legislature.
b)
He received a letter from Mickey West
asking that the County assign an employee
to be the liaison on the E-County
Project.
c)
He received a letter from Janice Giner in
reference to a car accident in front of
Mustang Tractor.
d)
He received a fax from the Economic
Development Corporation saying that the
restructuring of DecisionOne had begun.
e) He received the financial report from the
County Auditor and that it was filled
with great information.
f) The loss in sales tax through purchases
on the Internet totals $6 million per
year.
Under citizen input and/or concerns, Frank Thrumond
i
informed the Court that the TIF for the Traditions Golf Course
was on the Bryan City Council agenda for this evening's
meeting. This will be the final reading of the TIF zone, and
appointment of a Board of Directors. Since the County has not
i yet agreed to the TIF, he asked if this is not premature.
The County Judge stated that he had been approached by
the Purchasing Agent in reference to sending out an RFP for
and outside auditor. The County Auditor said that the county
has a contractual liability. Commissioner Thornton asked the
Auditor if he was questioning the extension. The County Judge

said that he would ask legal counsel about this matter.
At 9:50 a.m. the County Judge announced the meeting
closed to the public so that the Court could meet in Executive
Session to consult with an attorney concerning contemplated
litigation as allowed under Section 551.071 of the Texas
Government Code. The County Judge announced the meeting open
is
to the public at 10:30 a.m.

He then read aloud a resolution instructing the County
Attorney to institute a law suit against Bea Smolka. On
motion by the County Judge, seconded by Commissioner Jones,
the Court voted unanimously to adopt the resolution.
There being no further business to come before the Court,
the meeting was adjourned.

On this the 28" day of March 2000 at a regular meeting of the
Commissiooners' Court, the following members were present:

COUNTY ATTORNEY VEHICLE POLICY
I. PURPOSE
The purpose of this policy is to state the official regulations regarding the daily operation
and maintenance of County owned vehicles operated by the County Attorney's Office.
I
II. DEFINITIONS
County Vehicle: Any motor vehicle owned by Brazos County.
Assigned Vehicle: A County Attorney's Office vehicle that is assigned to a particular
member of the Investigation Division for exclusive or semi-exclusive use over an extended
period of time.
Grant Program: A Federal or State funded program awarded to the County Attorney's
Office utilizing Investigation Division personnel, equipment, and vehicles as matching
funds or in the furtherance of the grant objectives.
III. POLICY
The safety of the public and County Attorney's Office personnel is of paramount
importance where the operation of vehicles is concerned. Accordingly, it is the policy that
all vehicles shall be driven within the limits of State law and regulations of this office. The
goal is to achieve the mission of the office, while setting the example for the rest of the
motoring public.
IV. ASSIGNED VEHICLE OPERATION REGULATIONS
A. Vehicle Assignments- Investigators that are assigned vehicles will be permitted to take
said vehicle home due to the nature of investigator duties, i e. subpoena service, warrant
service, out of county warrant service, witness protection, grant programs, surveillance,
and immediate recall to service in emergency situations.
1. Investigators assigned vehicles will be responsible for the security of said
vehicle and the contents thereof
2. Investigators assigned vehicles are responsible for insuring the vehicles are
properly maintained, inspected on time, have current registration, and have all
preventive maintenance performed as needed. As has been repeatedly shown in
law enforcement vehicle assigned car programs, this should reduce the overall
maintenance costs per vehicle.

3. The temporary daily use of assigned vehicles is the responsibility of the
assigned investigator. Permanent assignments will only be made by the County
Attorney or Chief Investigator.
B'. Taxable Benefit
I . Internal Revenue Code 3.2-2 states "If the employee uses a company car mainly
for the employer's business, infrequent and brief side trips for personal reasons
are considered de minimis fringe benefits whose value is excluded from income.
Also, if a company owned vehicle is unlikely to be used for personal travel
because of its special design, use of the vehicle by an employee is excluded
from income."
2 As stated above, the assigned vehicle is for the convenience of this Agency and
its missions, not for the investigator assigned to the vehicle. Assigned vehicles
are not to be used for personal use when off-duty.
C. Liability
1. Investigators assigned vehicles will operate that vehicle and any other County
Attorney's Office vehicle with the due regard for the safety of all persons,
pedestrians, other drivers, and property
2. Investigators will operate County Attorney's Office vehicles in accordance with
all State laws governing the operation and movement of vehicles and all policies
contained in this policy manual
3 Investigators are required to comply with the County's regulations regarding
the attendance of the Driver Safety Course.

1. These regulations apply to ALL County Attorney's Office employees that may have
occasion to operate a county owned vehicle
2. Office vehicles shall be operated according to applicable traffic laws and department
regulations
3. Office vehicles shall be operated only by members authorized to do so and have
completed the required Driver Safety Course as set forth in County regulations.
4. Any member operating a vehicle shall have in his/her possession a valid Texas Driver
License of Class C or higher.

S. No one other than office personnel, and/or grant personnel, and/or repair personnel are
authorized to operate office vehicles.
6. Any member using an office vehicle is required to check the vehicle prior to operation
to insure it is safe to drive. This is to include the headlights, turn signals, brakes and
brake lights, windshield wipers, horn, steering, tire pressure and any other feature
which would affect the safe operation of the vehicle.

7: When a vehicle is determined to be unsafe, or in need of repair it will be immediately be
reported to the assigned investigator for that vehicle. In the event that investigator is
unavailable, then to the Chief Investigator.
8. Safety belts shall be worn at all times by the driver and any and all passengers when the
vehicle is in motion
9. Persons operating a department vehicle shall turn and/or back only after careful
observation of the surroundings and the movement can be made safely.
10. Vehicles shall not be left unattended unlocked, with the keys in the ignition, and/or the
engine running Vehicles will be secured when not in use.
11. The operation of any department vehicle shall be done so with due regard for
conditions affecting safe operation, i e weather, road surface, traffic congestion.
12. At no time will any vehicle operated by this office be defined as an "authorized
emergency vehicle"
13. All police two-way radio usage will be in accordance with current, applicable FCC
regulations and current, applicable regulations of the Sheriffs Office, as we share their
frequency.
14. During daytime subpoena service or arrests it will not be necessary to check out with
the dispatcher. However, it is recommended that dispatch be contacted during the
nighttime hours and is left to officer's discretion

BRAZOS COUNTY EVENTS FACILITIES DEPARTMENT
VEHICLE USE POLICY
EFFECTIVE NEW DATE/LAST REVISION: MARCH 30, 2000
Policy/Description:
• This policy establishes guidelines for the use and assignment of all county vehicles by
employees of the department. The objectives of the policy are to provide cost effective
transportation to employees for carrying out the functions of the department, to maintain
the vehicle fleet in good working order and to provide 24 hour capability to respond to
emergency situations.
Procedures:
1. TYPES OF TRANSPORTATION SERVICES: The department may provide an
employee with means of transportation to perform his or her job duties. Such
means include mileage reimbursement, use of county vehicle and public
transportation. Provisions of transportation by the county shall not be used as a
condition of employment with the county.
2. USE OF COUNTY VEHICLE: County vehicles and equipment are property of the
county and may be used by department employees only in the course of their job
duties unless otherwise provided for in this policy. Any employee who uses a
county vehicle must have a valid Texas driver's license and must have signed a
"Drivers License Check" form (See Attachment "A"). Authorized drivers are
covered by the county's casualty and liability insurance policy. The driver is
responsible for the safe operation of the vehicle and for obeying State and local
traffic regulations. Employees who drive county vehicles or use their own
personal vehicle to routinely conduct official county business shall notify their
supervisor at the beginning of the business day of any suspension or cancellat:on
of their vehicle operator's license. Employees shall not drive county vehicle under
the influence of illegal drugs or alcohol or while under the influence of lawfully
prescribed or over the counter substances, if these substances impair the
employee's ability to drive. The driver is responsible for payment of all fines,
penalties and court costs associated with violations of traffic regulations.
3. VEHICLE ASSIGNMENT: All BCEF vehicles are assigned to the Landscape
Maintenance Division. The Landscape Manager is responsible for the care
maintenance, security, and day to day assignment of all vehicles. Use by other
divisions in the department is common; however, the Landscape Maintenance
'
Division has priority.

4. TAKE HOME POLICY: Only the department head has the authority to give an
employee authorization to take a county vehicle home. This authorization will only
be granted to an employee who is performing stand by duty and is subject to
being called out on county business overnight or on weekends.
County employees authorized to take home county vehicles may use them
minimally, for personal errands while en route from home to work. De minimus
use may include personal errands but may not include stops which may impinge
the reputation of the county and the department. Take home vehicles may not
utilized for off duty employment or on weekends for personal use.
5. USE OF COUNTY VEHICLES FOR BREAKS: County vehicles may be used to
travel to and from work sites for designated meal breaks if the break occurs while
in route to or from or while at a work location.
6. VEHICLE MAINTENANCE: Users of county vehicles are responsible for
maintaining sufficient fluid levels in the vehicles, including gas, oil, brake fluid,
water and tire air pressure. These items should be checked each time the vehicle
is filled with gas. No one should return a vehicle with less that a half (1/2) tank of
gasoline.
7. PASSENGERS: Persons not employed by Brazos County are permitted to ride in
county vehicles as passengers if necessary to conduct county business or provide
courtesy rides in cases of road side emergencies. Non-county employees are
covered by the county's casualty and liability insurance policy under these
circumstances. At no time will a person not employed by Brazos County be
authorized to operate a county vehicle.
8. TRANSPORTATION OF EMPLOYEES IN TRUCK BED: Transporting
employees in a truck bed to a job site is prohibited. Once at the work site,
transporting not more than two (2) employees seated in the floor of the bed is
permitted for short distance at low speed, provided that there is no equipment
also in the bed of the truck.
9. SAFETY: All departments employees who drive county vehicles or their own
personal vehicles to conduct county business are expected to drive safely and
observe all vehicle traffic laws to prevent vehicle accidents. County employees
who drive county vehicles will be rated based on a point system comparing their
motor vehicle record (MVP) and the Risk Assessment Table, shown below. Any
employee who has accumulated 8 or more assessment points over the past two
years from the date of the Driver's License Check is considered to be high risk
driver and will not be permitted to drive county vehicles.

INTERLOCAL AGREEMENT
THE STATE OF TEXAS
COUNTY OF BRAZOS
THIS CONTRACT AND AGREEMENT, made and entered into this 28th day
of arch 2000, by and between the County of Brazos and Burleson County , each
participating government acting by and through its respective executive office hereunto
duly authorized by resolution of the governing body.
WITNESSETH:
WHEREAS, the respective participating governments are authorized by the
Interlocal Cooperation Act, V.T.C.A. Government Code Chapter 791, to enter into joint
contracts and agreements for the performance of governmental functions and services
including administrative functions normally associated with the operation of government
such as purchasing of necessary materials and supplies, and the sale of goods and
equipment in a public auction;
WHEREAS, it is the desire of the aforesaid participating governments to comply
with and further the policies and purposes of the Interlocal Cooperation Act;
WHERF,AS, the participating governments cannot normally obtain the best
possible purchase price for materials and supplies acting individually and without
cooperation; and
WHEREAS, it is deemed in the best interest of all participating governments that
said governments do enter into a mutually satisfactory agreement for the sale of goods
and equipment in a public auction for the year 2000;
NOW, THEREFORE, the parties hereto, in consideration of the mutual covenants
and conditions contained herein, promise and agree as to each of the other parties and as
to all of the parties as follows:
1. Burleson County shall be responsible for all such administrative duties as may
be necessary to lawfully facilitate processing and sale of goods or equipment
in a public auction.

C) If clearing of brush, trees and other obstruction is necessary, It shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees, etc. from County right-
of way.
D) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698;
test shall be conducted by an Independent Geotechnlcal testing firm; copies of all test
results shall be furnished to the office of the Brazos County Engineer.
E) Construction shall be In strict conformance to the latest Texas Manual of Uniform
Traffic Control Devices for Streets and Highways, published by the Texas Department
of Transportation, and all other state and federal laws governing utility construction.

Formal notice is hereby given that GTE SOUTHWEST INCORPORATED will
construct a communication line within the right-of-way of a County Road in
Brazos County, Texas as follows:
Beginning .2 miles off Hwy. 21 and the intersection of Cliff Road, GTE
proposes to place 50 pair cable in the southwest R.O.W. Buried line
along and parallel to and 5' inside R.O.W. at a distance of 1973 ft.

The location and description of this line and associated appurtenances is
more fully shown by two (2) copies of drawings attached to this notice. The line
will be constructed and maintained on the County Road right-of-way in
accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly
understood that the tender of this notice by the GTE Southwest Incorporated
does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or
right now granted by law or may be granted in the future and any provision or
provisions so construed shall be null and void.
