THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,

17. Request from Wickson Creek Special Utility District to construct a road bore in the right-
of-way of Grassbur Road approximately 0.25 mile from its intersection with Riley Road
for water line installation in the right-of-way of Cobb Road. Site is located in Precinct
3.
18. Request from GTE to construct two (2) road bores for parallel cable installation in the
right-of-way of Plagens Road beginning at its intersection with Democrat Road and
extending for a distance of 2,045 feet in a southerly direction. Site is located in Precinct
3.
19. The Preliminary Plat of Fickey Road Estates, 6.972 acres, Isaiah Curd League. Site is
located in Precinct 2.
20. The Amending Plat of Lots 6 and 7 to create Lot 61?, 3.726 acres, Whispering Ridge.
Site is located in Precinct 1.

A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, March 21, 2000, with the following members of
the Court present:
Alvin W. Jones, County Judge, Absent;
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3, Presiding;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
The Commissioner Thornton gave the invocation and led the
pledge of allegiance.
There was no citizen input and/or concerns.
The Court next considered Budget Amendment #99/00-17.1
through 17.5, which would reallocate funds for Constable,
Precinct 6 and Personnel; increase the budget for the
Metropolitan Planning Office; adjust the fund balance for the
Law Enforcement Officers Standards & Education Fund and
transfer funds to Grant Funds for merit increases. On motion
by Commissioner Cauley, seconded by Commissioner Jones, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. Commissioner Thornton moved to approve the request.
Commissioner Cauley seconded the motion. Commissioner
Thornton then asked to amend his motion saying that the change
of status for Kristen Stanfield should be from a Group 8, Step
3 to a Group 9 Step 2 rather than a Step 3. Commissioner
Cauley amended his second.

The Court voted unanimously to approve the changes as
modi f ied.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

20004644 and 20004645
On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Claims as
submitted.

The Court next considered a Third Party Administrator
Agreement between Brazos County and Employee Benefit Services
Brazos County. This is for the administration of the group
health plan for the Brazos County employees. On motion by
Commissioner Cauley, seconded by Commissioner Thornton, the
Court voted unanimously to delegate to Employee Benefit
Services full authority to perform various services with
respect to the group policy. A copy is attached.
The next matter for the Court was the appointment of a
member to the Brazos County Child Welfare Board. On motion by
Commissioner Jones, seconded by Commissioner Cauley, the Court
voted unanimously to appoint Ms. Ann Ganter to fill the open
position on the Child Welfare Board.
On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to
authorize the County Judge to execute Tax Resale Deeds to the
following individuals:
A. Michael Bradford and Kay Bradford - Lots 11 and
12, Block 2, McCullough Addition No. 2, City of
Bryan, Brazos County, Texas
B. Curtis Capps, Trustee - Lots 11 and 12, Block
9, Henderson's Addition, City of Bryan, Brazos
County, Texas
C. John E. Ayers and Tanya C. Ayers - Lot 5, Block
2, Washington Heights Addition, City, of Bryan,

The Court next considered a request from the Bryan
Independent School District Special Opportunity School for
transport of material by the Road & Bridge Department. On

The next matter for consideration was the adoption of a
vehicle use policy for all constables. On motion by
Commissioner Cauley, seconded by Commissioner Thornton, the
Court voted unanimously to adopt the policy as submitted. A
copy is attached.
' The Court next considered awarding the following bids:
Bid No. 2000-035, Second or additional Seal Coat
Projects for Precincts 1,2,3 & 4
John Hachmann, Purchasing Agent,
recommended acceptance of the bid
submitted by CLH Enterprises.
Bid No. 2000-037, Poly Jute, Annual Contract
John Hachmann, Purchasing Agent,
recommended acceptance of the bid
submitted by Contech Construction.

On motion by Commissioner Thornton, seconded by Commissioner
Cauley, the Court voted unanimously to accept the
recommendations of the Purchasing Agent and award the
contracts as noted. Copies of the bid tabulations are
attached.
The Court proceeded to consider the following blanket
Purchase Order:
Industrial Engine Constable Pct. 4 $ 500
On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Blanket
Purchase Order as submitted.
The Court next considered the renewal of Bid #99-037 and
requisition for Bridge Repair, Annual Contract. This is the
• renewal of a one year contract held by Fuqua Construction.

It will be effective until February 15, 2001. On motion by
Commissioner Sims, seconded by Commissioner Cauley, the Court
voted unanimously to approve the renewal of the contract and
the requisition for bridge repair.
The next matter for consideration was a Maintenance
Contract; and requisition for fax machines in the Sheriff's
Office. On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to approve
the maintenance contract and the requisition in the amount of
$155.00.

The Court next considered the request from GTE to

The Court next considered the request from GTE to

The Court next considered approval of the Amending Plat
of Lots 6 and 7 to Create Lot 6R, 3.726 Acres, Whispering
Ridge in Precinct 1. Richard Vance, County Engineer, stated
that he had reviewed the plat and all appeared to be in order.
On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Amending
Plat of Lots 6 and 7 to Create Lot 6R, 3.726 Acres, Whispering
Ridge as submitted.
The Court next considered approval of the Preliminary
Plat of Prairie Acres Subdivision in Precinct 2. Richard
Vance, County Engineer, stated that he had reviewed the plat
and offered the following comment:
1) Designate "Preliminary Plat" in title block.

On motion by Commissioner Thornton, seconded by Commissioner
Cauley, the Court voted unanimously to approve the preliminary
plat of Prairie Acres Subdivision subject to the developer
complying with the exception noted by the County Engineer.
The Court next considered approval of the Final,Plat of
Wixon Oaks Subdivision in Precinct 3. Richard Vance, County
Engineer, stated that he had reviewed the plat and all
appeared to be in order. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the final plat of Wixon Oaks Subdivision as
submitted.
The Court next considered approval of the Preliminary
Plat of Green Branch Ridge, Phase One - Five in Precinct 3.
Richard Vance, County Engineer, stated that he had reviewed
the plat and all appeared to be in order. On motion by
Commissioner Sims, seconded by Commissioner Cauley, the Court
voted unanimously to approve the Preliminary Plat of Green
Branch Ridge, Phase One - Five as submitted.
The Court next considered approval of the Preliminary
Plat of Saddle Ridge Subdivision in Precinct 3. Richard
Vance, County Engineer, stated that he had reviewed the plat
and all appeared to be in order. On motion by Commissioner
Sims, seconded by Commissioner Cauley, the Court votes
unanimously to approve the Preliminary Plat of Saddle Ridge
Subdivision as submitted.
The County Auditor presented the Comprehensive Annual
Financial Report for the year ended September 30, 1999.
Under announcement of interest items and possible future
agenda topics the following comments were made:
Commissioner Jones stated that he will not be
prepared to present information on the Traditions
Golf Course.
Commissioner Sims asked for a one month extension

Susan Gandy reminded the Court of the Public
Hearing scheduled for 10:30 a.m. today and the
joint meeting at 7:00 p.m. at the Brazos Center on
Thursday with the School Boards and the Juvenile
Board.

On this the 21" day of March 2000 at a regular meeting of the
Commissioners' Court, the following members were present:

The administrator shall hold all funds received by it in a fiduciary capacity and shall immediately remit such funds to the
person entitled thereto.
This notice is effective from the date below until the policyholder notifies Sun Life in writing of the termination of the
above relationship. Termination of the policy alone will not end the agency relationship.

BRAZOS COUNTY CONSTABLE'S OFFICE
POLICY REGULATING COUNTY OWNED VEHICLES
Pursuant to action taken by the Brazos County Commissioner's Court on Tuesday, January I Ph,
2000, regarding the BRAZOS COUNTY POLICY REGULATING USE OF COUNTY
VEHICLES; the following are the policies adopted by the Brazos County Constable's offices
pending approval of Brazos County Commissioner's Court.
TAKE-HOME VEHICLE PROGRAM
For the purposes of these policies, a vehicle is any motor vehicle which is under the direction and
control of this Office and is not owned by an employee. Participation in the Take-Home Vehicle
Program requires the employee to abide by applicable State of Texas and Federal laws, and the
guidelinets of these policies and other Office procedures. Vehicles are issued at the discretion of
the Constable or Chief Deputy.
POLICY
Constable's Offices issued vehicles are considered a law enforcement tool. Personal use or gain
is not in keeping with this policy and is prohibited. It is recognized and accepted that normal
wear will occur during the working use of the vehicle. It is recognized that operation of vehicles
in the law enforcement setting raises the possibility of accident, theft, criminal mischief, etc. This
policy does not hold the deputy responsible for matters beyond his or her control.
ELIGIBILITY
I. Officer must have a valid Texas Driver's License.
2. Officer must be a T.C.L.E.O.S.E. licensed peace officer, commissioned by a Brazos County
Constable and a paid employee of Brazos County.
3. Officer must complete and sign the "Take Home Vehicle" authorization form. This form is
used to acknowledge that the participating officer has read and agrees to abide by these
policies. Also on this form the Officer will designate his/her place of residence or where the
vehicle is to be parked.
4. Officer must to be dressed appropriately, carry their authorized service or off-duty weapon •
and monitor their radio in order to respond to in-progress calls and /or emergency call-outs
authorized by the Constable or Chief Deputy.
5. Officer must comply with Internal Revenue Code Regulations. To comply, each Officer
must file an annual EMPLOYEE FRINGE BENEFIT CERTIFICATION FORM with the
Brazos County Auditor's office.
PASSENGERS
Persons riding as passengers in vehicles are limited to Office personnel, other County
employees, and other authorized riders. Peace Officers from other jurisdictions may ride without
signing a waiver. They do not wear their official uniforms unless conducting official business.
Authorized civilian rider's participating in the "ride along program" must complete a wavier of
liability form prior to beginning the ride. These riders are issued as "Civilian Rider"
identification tag to be worn in plain sight during the length of the ride. Rider tags are available
from the Chief Deputy, and deputies with riders are responsible for the issuance and recovery of
the tags.

USE OF COUNTY OWNED VEHICLES
1. OFFICE USE- Use of the vehicle is limited to commuting to and from work. Normal on-
duty utilization, and Office related events. De minimis use of the vehicle may include
personal errands while on duty or commuting, provided they do not take priority over
calls for service and do not diminish the image of the Office.
II. OFF-DUTY USE- All employees of the Constable's office must receive approval for any
off-duty employment from the Constable, Chief Deputy, or their designee. Participating
deputies must be eligible for off-duty employment and comply with Constable's Office
extra duty assignment procedures. Deputies may use the county owned vehicles under
the following circumstances,
A. As transportation to approved off-duty job which includes;
1. To or From the an extra -duty job;
2. For the transport of arrested persons to the Brazos County Jail for booking; and
3. Any other use of the vehicle for the extra-duty employer is to be billed according
to the procedures established by the Brazos County Auditor.
NOTE: Deputies are considered on the payroll of the County throughout the
transportation and booking process and subsequently off the extra-duty job
payroll.
B. As transportation to and from County or Office approved functions and/or business.
(When in doubt if the use is authorized, employees should request clarification
through their immediate supervisor).
C. Any other use authorized by the Constable, Chief Deputy, or their designee.
CARE AND MAINTENANCE
1. When not in use, all vehicles shall be provided reasonable secunty to safeguard the vehicle
and its contents
2. Deputies are responsible for maintaining the entire vehicle in a clean condition and will
ensure the vehicle receives preventative maintenance as scheduled.
3. Any damage sustained to the issued vehicle shall be immediately reported to a Constable's
Office
Supervisor, with a wntten report submitted to the Constable or Chief Deputy by the next
working day
4. After review of an incident report involving damage to vehicle, the Constable or this
designee, will make determination as to responsibility. Should it be determined that the
damage was caused by neglect or misuse of the vehicle by the deputy, the Constable or his
designee, may require the deputy to reimburse Brazos County for expenses incurred as a
result of neglect or misuse. Reimbursement may include any and all expenses, including
vehicle replacement.
PROHIBITED ACTIVITIES
The following activities, although not totally inclusive, are prohibited-
1. Employees experiencing any type of impairment or condition that may adversely affect their
safe performance of duty shall not operate a vehicle and will notify their supervisor in
wnting;
2. Employees will not drive vehicles to establishments which are primarily engaged in the sale
and/or on -premises consumption of alcoholic beverages, to a business of questionable
nature, or to other establishments specifically prohibited by the Constable unless within the

4. Employees may not take county vehicles outside the boundary of Brazos County for anything
other than Brazos Countv business.

Formal notice is hereby given that GTE SOUTHWEST INCORPORATED will
construct a communication line within the right-of-way of a County Road in
Brazos County, Texas as follows:
Beginning at a point approximately 80' northeast of the junction of N.
Dowling Road and Walnut Road, on the northerly side of Dowling Road,
GTE will place a 4x8x4 ground level handhole with x-conn cabinet
mounted on top. Buried cable will be extended southwest to an
existing pole line, and also a road bore will be made across N.
Dowling Road to Walnut Road. The new construction on N. Dowling
replaces existing facilities in the area.
The location and description of this line and associated appurtenances is
more fully shown by two (2) copies of drawings attached to this notice. The line
will be constructed and maintained on the County Road right-of-way in
accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly
understood that the tender of this notice by the GTE Southwest Incorporated
does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or
right now granted by law or may be granted in the future and any provision or
provisions so construed shall be null and void.

The location or description of-the proposed Installation is more fully shown by 3

I understand and agree that:
1. The County Engineer must by notified 72 hours prior to the beginning of
construction in order that he or his designated Inspector may inspect the
actual installation.
2 That all damage to the roadways and rights-of-way will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate or
lower any such line at no cost to Brazos County, should same become
necessary due to widening or lowering, or other alteration of the

ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE SOUTHWEST INCORPORATED will
construct a communication line within the right-of-way of a County Road in
Burleson County, Texas as follows:
Beginning at the intersection of Democrat Road and Plagens Road
GTE proposes to place a 25 pair cable within 3 ft. of R.O.W. We
will place approximately 2045 ft. of cable in a southeasterly direction.

The location and description of this line and associated appurtenances is
more fully shown by two (2) copies of drawings attached to this notice. The line
will be constructed and maintained on the County Road right-of-way in
accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly
understood that the tender of this notice by the GTE Southwest Incorporated
does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or
right now granted by law or may be granted in the future and any provision or
provisions so construed shall be null and void.

Construction of this line will begin on of after March 1, 2000.
