•A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, March 7, 2000, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Jones gave the invocation and led the pledge
of allegiance.
There was no citizen input and/or concerns.
The Court next considered Budget Amendment #99/00-16.1,
which would reallocate funds for 85`" District Court. On
motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Jones, seconded by
Commissioner Thornton, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted.

The Court next considered entering into an Interlocal
Cooperation Contract with the Texas Department of Public
Safety (DPS) for participation in the "Failure to Appear
Program." This program provides for a political subdivision to
contract with the DPS to deny renewal of a driver license for
failure to appear on certain Class C violations. On motion
by Commissioner Cauley, seconded by Commissioner Sims, the
Court voted unanimously to enter into an Interlocal
Cooperation Contract with the Texas Department of Public
Safety. A copy is attached.
The Court next considered approval of the Pro Rata
Tobacco Settlement Distribution County Expenditure Statement.
The total amount spent by the County on health items was
$1,384,127. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to approve the
Pro Rata Tobacco Settlement Distribution County Expenditure
Statement. A copy is attached.
The Court next considered Change Order No. 5 to the
contract with R. M. Dudley for additions and renovations to
the Brazos County Courthouse. The change order makes the
following changes:
1. Install owner provided exterior light
fixtures at flagpole [$91.00]
2. Provide and install new door and
Hardware at existing frame
(Corridor 219/242) $484.96
3. Provide and install additional water

4. Provide and install new door hardware

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve Changer Order
No. 5 that would reduce the contract amount by $3,125.99. A
copy is attached.
On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to
authorize the County Judge to execute a Tax Resale Deed to the
following individual:
Eletha Steptoe Huffman and Kelvin Huffman - Lot 6,
Block 4, Candy Hill Addition, City of Bryan, Brazos
County, Texas.
The Court next considered exercising their option for
participating in the State Sales Tax Holiday in August, 2000.
On motion by the County Judge, seconded by Commissioner Jones,
the Court voted unanimously to participate in the State Sales
Tax Holiday in August, 2000.
The next matter before the Court was the sponsorship of
one sign at a cost of $200.00 concerning Child Abuse
Prevention Month. On motion by the County Judge, seconded by
Commissioner Cauley, the Court voted unanimously to sponsor a
sign, provided it is determined that it is legal for the
County to do so.
The Court next considered adopting a Resolution
authorizing the submission of a grant request to the Office of
the Attorney General by the District Attorney's Office for
participating in programs to aid in coordinating Victim
Services. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to adopt a
Resolution authorizing the submission of a grant request to
the Office of the Attorney General by the District Attorney's
Office for participating in programs to aid in coordinating
Victim Services. The motion also authorizes the County Judge
to accept on behalf of Brazos County such grant funds as maybe
tendered.

The Court next considered a request for County
participation in the rail relocation study at a cost of
$35,200.00. Total cost of the study is $1,131,000.00
Commissioner Jones asked many questions concerning the
information that is to be derived from the study. On motion
' by Commissioner Cauley, seconded by Commissioner Sims, the
Court voted unanimously to participate in the rail relocation
study and authorized the expenditure of $35,200.00.

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to establish the date and
time for a Public Hearing to set speed limits on Andert Road
in Precinct 3. The meeting will be held Tuesday, March 21,
2000 at 10:30 a.m.
The Court next considered approval of the Preliminary
Plat of Guillen Subdivision in Precinct 2. Richard Vance,
County Engineer, stated that he had reviewed the plat and
offered the following comments:
1) Show 10 feet public utility easement on both
sides of common lot lines between Lots 1 & 2
2) Show easement associated with overhead electric
line in southeast corner of Lot 2.
3) Remove extra "arrow heads" on west end of Lot 1.
On motion by Commissioner Thornton, seconded by Commissioner
Cauley, the Court voted unanimously to approved the
preliminary plat of the Guillen Subdivision subject to the
developer complying with the exceptions noted by the County
Engineer
The Court next considered the request from Wickson Creek
Special Utility District to construct a road bore for water
line installation in the right-of-way of Dilly Shaw Tap Road
where it intersects FM2776. The site is located in Precinct
2. The County Engineer stated that all appeared to be in
order and recommended approval.

On motion by Commissioner Thornton, seconded by Commissioner
Sims, the Court voted unanimously to approve the. request from

the plat and all appeared to be in order. On motion by
Commissioner Cauley, seconded by Commissioner Sims, the Court
voted unanimously to approved the final plat of Bush Lane
Acres, Block One, Lots 1 through 12 as submitted.
The next matter for consideration was approval for the
Purchasing Agent to advertise Bid 2000-038 Purchase of Water
Truck for Road & Bridge. On motion by Commissioner Sims,
seconded by Commissioner Jones, the Court voted unanimously to
authorize the Purchasing Agent to advertise for bids for a
water truck.
The Court proceeded to consider the following blanket

On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered awarding the following bid:

Bid No. 2000-034, Two Lane Roadway Bridge
John Hachmann, Purchasing Agent,
recommended acceptance of the bid
submitted by BLS Construction. On motion
by Commissioner Thornton, seconded by
Commissioner Sims, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to BLS Construction and approve
the requisition for payment. A copy of
the bid tabulation is attached.
The Court next considered approval of requisitions from
the Capital Expenditures, Minor Furniture for the following
purchases:
a) Chairs for Sheriff's Office,$2,458.32
b) Desk, hutch and assembly for County Court
at Law #1, $349.00

On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the

The Court next considered approval of requisitions from

The Court next heard a presentation by Lynn Stuart,
representing the Economic Development Corporation, who brought
the Court up to date on the DecisionOne bankruptcy. He
explained that this is a Pre-packaged bankruptcy in which the
creditors agree to it in advance. As of March 21, 2000, the
company will be a newly organized corporation and continue
doing business as usual. He said that the Economic
Development Corporation feels very positive about the whole
thing. Demetrios Basdekas, local resident, said he had some
very serious concerns about the bankruptcy. He stated that
when the tax abatement first came up, he was very concerned
about giving incentives to a company that was losing money.
He added that the Economic Development Corporation had not
done its homework on this company. He went on to state that
smart money does not bet on DecisionOne and that should this
reorganization 'fail, the executives of the Economic
Development Corporation be held accountable for their
mistakes.
The Court next heard a presentation by Bryan City Council
Member, Kenny Mallard, concerning the proposed City of Bryan
Tax Increment Financing Zone #10 (TIF). This is for the
Traditions Golf Course and Country Club at University Ranch
which is a $26,850,000 project to be built on the west side of
Bryan. Included in the project are a golf course, country
club, hotel, conference center and residential units. The
City of Bryan contributed the property for the golf course, is
assisting with a loan of $1,000,000 to build the clubhouse,
assisting with the clearing and mass grading of the property
and providing drainage and irrigation. Frank Thurmond
presented the Court with a handout relating to the
presentation by the City of Bryan. In the handout, he stated
that he was not only opposed to subsidizing the golf course
but the entire project.

He said that if the project goes forward he would ask the
County to support the TIF. Beth Price, stated that she
supported Mr. Thurmond's remarks. She went on to say that
the City of Bryan did not seek bids on the project and that a
25 year project can not be good business practice. Also, the
City proposes to provide 1 million gallons of water per day
at no cost to the golf course for one year plus 500,000
gallons a day free for infinity. Demetrios Basdekas passed on
making comments. Kenny Mallard, City of Bryan Council Member
rebutted Frank Thurmond's figures. Commissioner Cauley stated
that he supports this project and it's location because it
will benefit the citizens on the west side of town.
The Court next heard a discussion concerning the
architect's estimate for construction costs for the Justice of
the Peace/Constable offices. Commissioner Tony Jones
explained how the Architect's fees were on a fee basis rather
than a percentage of the contract. The Architect will submit
figures for Architectural fees.
Under Announcement of interest items and possible future
agenda topics, the County Judge made the following comments:
a) The County Judge will not be at the
Commissioners Court meeting for March 21,
2000. He asked that the vote on the TIF
be on the March 28, 2000 agenda.
b) He spoke on the GASB accounting
procedures.
There was no citizen input and/or concerns.
There being no further business to come before the Court,
the meeting was adjourned.

INTERLOCAL COOPERATION CONTRACT
STATE OF TEXAS §

1. Parties
This Interlocal Cooperation Contract ("Contract") is made and entered into between the Texas
Department of Public Safety ("TDPS"), a political subdivision of the State of Texas, and the County
of Brazos ("County"), a local political subdivision of the State of Texas.
11. Ovcrview
The purpose of this Contract is to implement the provisions of Texas Transportation Code Chapter
706 (Denial of Renewal of License for Failure to Appear). The TDPS has authority to contract with
a private vendor ("Vendor") pursuant to §706.008 of that Chapter. The statute is intended to ensure
that persons cited for traffic violations or certain Class C misdemeanors comply with a promise to
appear in court as required by law.
Information concerning individuals who have failed to appear will be generated by local political
subdivisions of this state. The Vendor will provide the necessary goods and services to establish an
automated system ("FTA System") whereby information regarding violators subject to the provisions
of Texas Transportation Code Chapter 706 may be accurately stored and accessed by the TDPS.
Utilizing the FTA System as a source of information, the TDPS will deny renewal of a driver license
to a person who is the subject of an FTA System entry.
• Each local political subdivision contracting with the TDPS will pay monies to the Vendor based on
a fee certain established by this Contract. The TDPS will make no direct or indirect payments to the
Vendor. The Vendor will ensure that accurate information is available to the TDPS, political
subdivisions, and to persons seeking to clear their licenses at all reasonable times.
III. Definitions
"Complaint" means notice of an offense as defined in Article 27.14(d) or Article 45.01, Code of
Criminal Procedure.
"Department" or "TDPS" means the Texas Department of Public Safety.

"Failure to Appear Program" or "FTA Program" refers to the implementation efforts of all parties,
including those system components provided by the TDPS, local political subdivisions and the
Vendor, including the FTA System.
"Failure to Appear System" or "FTA System" refers to the goods and services sought to be acquired
by the TDPS, including all hardware, software, consulting services, telephone support services and
related support services supplied by the Vendor.
"FTA Software" refers to computer software developed or maintained now or in the future by the
Vendor to support the FTA System.
"Originating Court" refers to the court in which a traffic law complaint or other applicable violation
has been filed for which a person has failed to appear and which has filed an appropriate report with
the TDPS.
"State" refers to the State of Texas.
"Local political subdivision" refers to a city or county of the State of Texas.
Unless otherwise defined, terms used herein shall have the meaning assigned by Texas
Transportation Code Chapter 706 or other relevant statute. Terms not defined in this Contract or by
other relevant statutes shall be given their ordinary meanings.
IV. Governing Law
This Contract is entered into pursuant to Texas Government Code Chapter 791 and is subject to the
laws and jurisdiction of the State of Texas and the United States and shall be construed and
interpreted accordingly.
V. Venue
The parties agree that venue for any suit arising from the interpretation or enforcement of this
Contract shall lie in Travis County, Texas.
VI. Application and Scope of Contract
This Contract applies to each denial of license renewal for failure to appear reported to the TDPS
or the Vendor by the local political subdivision pursuant to the authority of Texas Transportation
Code Chapter 706. FTA Reports may be submitted based on citations issued for traffic law

violations that occurred on or after September 1, 1995. FTA Reports for applicable non-traffic
violations must be based on citations issued after September 1, 1999.

VII. Required Warning on Citation for Traffic Law Violations
A peace officer authorized to issue citations within the jurisdiction of the local political subdivision
shall issue a written warning to each person to whom the officer issues a citation for a traffic law
violation. This warning shall be provided in addition to any other warnings required by law. The
warning must state in substance that if the person fails to appear in court for the prosecution of the
offense, the person may be denied renewal of the person's driver license. The written warning may
be printed on the citation or on a separate instrument.
VIII. FTA Report
If the person fails to appear without good cause, the local political subdivision may provide a report
to the TDPS containing the following information:
(1)the jurisdiction in which the alleged offense occurred;
(2)the name of the local political subdivision submitting the report;
(3)the name, date of birth and Texas driver license number of the person
who failed to appear;
(4)the date of the alleged violation;
(5)a brief description of the alleged violation;
(G)a statement that the person failed to appear as required by law;
(7)the date that the person failed to appear; and
(8)any other information required by the TDPS.
•
There is no requirement that a criminal warrant be issued in response to the person's failure to
appear. The local political subdivision must make reasonable efforts to ensure that all FTA Reports
are accurate, complete and non-duplicative.
IX. Clearance Reports
The originating court that files the FTA Report has a continuing obligation to review the report and
promptly file appropriate additional information or reports with the TDPS. The clearance report
shall identify the person, state whether or not a fee was required, advise the TDPS to lift the denial
of renewal and state the grounds for the action. All clearance reports must be filed with the TDPS
within one business day of the time and date that the originating court receives appropriate payment
or other information that satisfies the citizen's obligation to appear in that court.

To the extent that a local political subdivision utilizes the FTA Program by submitting a violation
report, there is a corresponding obligation to collect the statutorily required $30.00 administrative
fee, absent special circumstances. If the person establishes good cause for failing to appear or is
acquitted of the underlying offense for which the original FTA Report was filed, the court shall not
require payment of the $30.00 administrative fee. The originating court shall promptly file a
clearance report advising the TDPS to lift the denial of renewal and identifying the grounds for the
action.
The local political subdivision must promptly file a clearance report with the TDPS upon payment
of the administrative fee and:
(1)the entry of a judgement against the person;
(2)the perfection of an appeal of the case for which the warrant of arrest
was issued;
(3)the posting of a bond or the giving of other security to reinstate the charges
for which the wan-ant was issued; or
(4)the payment of fines owed on an outstanding court order to pay a fine.
X. Compliance with Law
The local political subdivision understands and agrees that it will comply with all local, state and
federal laws in the performance of this Contract, including administrative rules adopted by the
TDPS.
XI. Accounting Procedures
An officer collecting fees pursuant to Texas Transportation Code §706.006 shall keep separate
records of the funds and shall deposit the funds in the appropriate municipal or county treasury. The
custodian of the municipal or county treasury may deposit such fees in an interest-bearing account
and retain the interest earned thereon for the local political subdivision. The custodian shall keep
accurate and complete records of funds received and disbursed in accordance with this Contract and
the governing statutes.
The custodian shall remit $20.00 of each fee collected pursuant to Texas Transportation Code
§706.006 to the Comptroller on or before the last day of the month following the close of the
calendar quarter and retain $10.00 of each fee for payment to the Vendor and credit to the general
revenue of the municipal *or county treasury.

The TDPS has contracted with Omni Base Services, Inc. ("Vendor"), a corporation organized and
incorporated under the laws of the State of Texas, with its principal place of business in Houston,
Texas, to assist with the implementation of the FTA Program.

The local political subdivision must pay the Vendor a fee of $6.00 per person for each offense which
has been reported to the Vendor and for which the local political subdivision has subsequently
collected fees and court costs from the person. In the event that the originating court finds that good
cause existed for the person's failure to appear or if the person has been acquitted of the underlying
charge, then no payment will be made to the Vendor or required of the local political subdivision.
In the event that court costs and fees are not received by the local political subdivision (e.g. if the
person serves jail time in lieu of payment of court costs or fees or if the person dies), then no
payment will be made to the Vendor or required of the local political subdivision. Provided that if
the person pays court costs and fees, but does not pay a fine assessed by the court, then payment to
the Vendor is required.

If the person makes partial payment of court costs and fees assessed by the court, then the local
political subdivision will make partial payment to the Vendor in an amount equal to the percentage
of court costs and fees paid by the person. If the person makes additional payments thereafter, the
local political subdivision shall pay the Vendor accordingly.
The parties agree that payment shall be made by the local political subdivision to the Vendor on the
last day of the month following the close of the calendar quarter in which the payment was received
by the local political subdivision.
XIII. Litigation
In the event that the local political subdivision is aware of litigation in which this Contract or Texas
Transportation Code Chapter 706 is subject to constitutional, statutory, or common-law challenge,
or is struck down by judicial decision, the local political subdivision shall notify the TDPS
immediately.

XIV• Contract Modification
No modifications, amendments or supplements to, or waivers of, any provision of this Contract shall
be valid unless made in writing and executed in the same manner as this Contract. The parties agree
that no oral statements of any person shall be taken to modify the terms of this Contract.
XV• Effective Date of Contract
This contract shall be in effect from and after the date that the final signature is set forth below. It
is the intent of the parties that this Contract shall automatically renew on a yearly basis. However,
either party may terminate this Contract by notifying the other in writing thirty (30) days prior to the
expiration date that it intends not to renew the Contract. After termination, the local political
subdivision has a continuing obligation to report dispositions and collect fees for all violators in the
FTA System at the time of termination.

tendered.

Dear Sir:
Formal notice is hereby given that the United Telephone Company of Texas.
Inc. proposes to install buried communications cable upon and along the
right-of-way of county roads in Brazos County, Texas, as follows:
IMPROVED ROADS (paved) - The contractor will plow cable in backslope with
8' of right-of-way line. Pipe will be bored under all paved county roads
extending from ditch line to ditch line with a minimum cover of 30
IMPROVED ROADS (graven - The contractor will plow cable in the backslope
of the road, one track of the plow tractor on the backslope the other may
come to the shoulder of the road neither whole tractor or plow will be on
the road surface.
UNIMPROVED ROADS (dirt) - Same as improved, unless because of ditches.
trees and other terrain features, it is more practical to plow in the center
of the road. In these cases, the cable will be plowed in the center of the road.
Not applicable in County.
BRUSH DISPOSAL - Any brush, trees, etc., that are cut will be burned or
disposed of and not left in the ditch. Rocks brought up by tractor or
plow will be disposed of.
DEPTH OF CABLE - All cables will be placed at a minimum depth of 30'
except where crossing dams or ditches, at which locations the depth of
cables will be at a minimum of 36'.
The following are requirements which are made on the contractor:
1. The plowing equipment shall be subject to the approval of the
Engineer and the Public Authorities having jursidiction over highway
and road rights-of-way.
2. The equipment and construction methods used by the contractor shall
be such as to cause minimum displacement of the soil. The slot made
in the soil by the cable plow shall be closed immediately by driving
a vehicle track or wheel over the slot or by other suitable means.
3. Damage to banks, ditches, driveways, and roads caused by the equipment
shall be immedeiately repaired to the satisfaction of the Engineer and
Public Authorities having jursidiction over highway and road right-of-
way where involved.
4. Trenches shall be promptly back-filled with earth, and mechanically
tamped at six (6) inch lifts so that the earth is restored to original
grade to assure no hazard to vehicular, animal or pedestrian traffic.
No trenches shall be left open overnight.
5. The usual 10%fees withheld from contractor until repairs are made
satisfactory with Engineer and Public Authorities having jurisdiction

of right-of-way involved.
Brazos County will not be held liable at any future
date for accidental damages to the buried cable plant by road working
equipment such as maintainers, hole diggers, etc In the event of
such damages the Telephone Comapany will be notified immediately.
The County Commissioners Court may require the owners to relocate this
line. for valid reasons under the law, by giving thirty (30) days
written nonce.
a. Where communication facilities are located on county
road ROW the Telephone Company will relocate said
'facilities at no expense to the County.
b. Where communication facilities are located on private
property the county will reimburse the Telephone Company
for the relocation of said facilities.
At any place where a communications line crosses over a county road, it
shall be constructed and maintained at least eighteen (18) feet above
the surface of the traffic lane.
Please notify forty-eight (48)
hours prior to starting construction of the line, in order that a
representative may be present.
The locations of the proposed lines are more fully shown by the copies
attached to this nonce.
Construction of this line will begin on or after the 24th day of
February , 1999.
