THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,

COMMISSIONERS' COURT
REGULAR MEETING
FEBRUARY 15, 2000
•
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, February 15, 2000, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2, Absent;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Sims gave the invocation and led the pledge
of allegiance.
Under citizen input and/or concerns, Demetrios Basdekas
is
asked the Court to request the County Auditor to prepare a
report on the financial ramifications to the County of the
DecisionOne bankruptcy.
The Court next considered Budget Amendment #99/00-13.1
through 13.5, which would set up project accounting for
District Clerk, County Attorney and County Auditor, split out
two projects under the same accounting code and reallocate
funds for the Sheriff's Office. On motion by Commissioner
Cauley, seconded by Commissioner Sims, the Court voted
unanimously to approve the budget amendment as submitted, a
copy of which is attached hereto.
The Court proceeded to consider the change of status of

employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to approve the
changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted
The Court next considered a request by Judge, County
Court at Law #1, for use of temporary part-time clerk funds
for overtime pay. In a memo to the Court, the Judge stated a
need to accomplish some special projects and tasks that have
been left unattended because of other daily matters. The
Court Reporter will only work five hours a week overtime to
accomplish the tasks. Commissioner Sims asked if overtime is
for the Court Reporter working after hours, if the Court
Reporter needed access to the District Clerks records, if
some of the work could not be done during working hours and if
this could not be reevaluated sooner than June or July. Judge
Michel responded yes to all the questions. On motion by
Commissioner Jones, seconded by Commissioner Cauley, the Court
voted unanimously to approve the request for use of temporary
part time clerk funds for overtime pay.
The next matter before the Court was to consider adoption
of an ORDER DIVIDING TEN (10) VOTING PRECINCTS, CREATION OF
TWENTY-ONE ADDITIONAL VOTING PRECINCTS AND CONSOLIDATION THE
TWENTY ONE ADDITIONAL VOTING PRECINCTS. The City of Bryan
approved ordinance #1018, Ordinance #1139, Ordinance #1140,
Ordinance #1146, and Ordinance #1175 annexing land that
required the division of the voting precincts into twenty-one
additional precincts to accommodate the City of Bryan Single
Member District lines and new city limit lines of the City of
Bryan. The new lines created by the annexation do not follow
the existing election precinct lines created by Brazos County.
The County Judge stated the lines of the newly created
election precincts had been drawn so as not to completely
disrupt the habits of the voting public. On motion by
Commissioner Sims, seconded by Commissioner Cauley, the Court
voted unanimously to adopt the ORDER DIVIDING 10 PRECINCTS,
CREATION OF TWENTY-ONE ADDITIONAL PRECINCTS AND CONSOLIDATION

OF THE TWENTY-ONE VOTING PRECINCTS. A copy,of the Order is
attached hereto.
The next matter before the Court was to consider adoption
of an ORDER FOR RELOCATING POLLING PLACE FOR ELECTION PRECINCT
61. The Court received notice that A&M Presbyterian Church
located at 301 Church Avenue, College Station, Texas was no
longer available for the conduction of elections. The Court is
desirous of consolidating the polling place for Election
Precinct 61 with the polling place for Election Precinct 21,
at the A&M Methodist Church, located at 417 University Drive,
College Station, Texas. On motion by Commissioner Jones,
seconded by Commissioner Sims, the Court voted unanimously to
adopt the Order relocating polling place for Election Precinct
61. A copy of the Order is attached hereto.

The next matter before the Court was approval of a
Contractual Agreement between Brazos County and Texas Voting
Systems, Inc. to provide election services for Early Vote for
the Republican and Democratic Primary and Run-Off Elections on
March 14 and April 11, 2000. The cost to Brazos County will
be $3,000.00. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to enter into
contractual agreement with Texas Voting Systems, Inc. A copy
of the contractual agreement is attached hereto.
The Court next considered a request by W. M. Klunkert,
Inc. for Revisions R-13,R-15, R-16 and R-17 to the contract
for the Detention Center Addition. These are as follows:
R-13 - Extend Return Air Duct to Chase 219, $77.31
R-15 - Early Turn on of Generator, $660.00
R-16 - Conduit for Detention Telephones, $4,454.32
R-17 - Pre-finished Kynbar at Canopy Panels, $350.00
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the request by

W. M. Klunkert, Inc. for the revisions.
The next matter for consideration was a request by the
Sheriff's Offices for the reclassification of a Detention
Officer - Jail position. They propose to change the position

from a Class 1511 Position 2, Detention Officer - Jail to a
Class 1513 Position 4, Detention Officer - Work Crew. On
motion by Commissioner Cauley, seconded by Commissioner Sims,
the Court voted unanimously to approve the reclassification.
The next matter for consideration was authorizing the
Auditor's Office to make juror donations payable to the Child
Welfare Board of Brazos County. The District Clerk pointed
out that Senate Bill 136 adds to the current list of program
options a County Child Welfare Program that would be the
recipient of juror donations. He felt no action was necessary
by the Court. On motion by the County Judge, seconded by
Commissioner Sims, the Court voted unanimously to authorize
the funds donated by jurors and held in escrow be transferred
to the Brazos County Child Welfare Board to be used at their
discretion and that all future donations be transferred to the
Child Welfare Board.
The next matter for consideration was approval for the
Purchasing Agent to advertise Bid 2000-037, PolyJute Annual
Contract. On motion by Commissioner Jones, seconded by
Commissioner Cauley, the Court voted unanimously to authorize
the Purchasing Agent to advertise for bids for PolyJute for
Road & Bridge.
The Court next considered the following requisition for
purchases through sealed competitive bids for the Road and
Bridge Department:

On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to table consideration
until a later date.
The Court next considered the award of Bid 2000-026 and

approval of a requisition for a chip spreader for the Road &
i Bridge Department. John Hachmann, Purchasing Agent,
recommended acceptance of the bid submitted by Hi-Way
Equipment with the stipulation that it comply with the

specifications. On motion by Commissioner Jones, seconded by
Commissioner Cauley, the Court voted unanimously to accept the
recommendation of the Purchasing Agent and award the contract
to Hi-Way Equipment with the compliance stipulation. The
Court also approved the requisition for payment. A copy of
the bid tabulation is attached.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Calvin Barkley and
Charles Todd, both on Dick Elliott Road to clear and
straighten an existing channel. Mr. Barkley's property is on
the west side of Dick Elliot Road while Mr. Todd's is on the
east side. On motion by Commissioner Sims, seconded by
Commissioner Jones, the Court voted unanimously to authorize
the work.
The Court next considered authorizing work outside of
• county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Jimmy Weedon on
Elmo Weedon Road in Precinct 3 to reconstruct a water gap on
Brushy Creek. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to authorize
the work.
The Court next considered approval of the Re-Plat of Lot
43, Block 1, Harvey Hillsides, 5.001 acres in Precinct 3.
Richard Vance, County Engineer, stated that he had reviewed
the plat and recommended approval. On motion by Commissioner
Sims, seconded by Commissioner Cauley, the Court voted
unanimously to approved the Re-Plat of Lot 43, Block 1, Harvey
Hillsides, 5.001 acres as submitted.
• The Court next considered approval of the minutes of the
Commissioners' Court meetings held in September, 1999 on the
following dates: 7, 14, 21, 28; Public Hearing on September 8
and Special meeting held on September 9. On motion by

Commissioner Sims, seconded by Commissioner Cauley, the Court
voted unanimously to approve the minutes as submitted.
Under announcement of interest items and possible future
agent topics, the County Judge made the following comments:
a) He received a letter from Judge Guy
Herman who holds the mental hearings in
Austin. Travis County has not billed for
hearings in catchment area for some time.
The Judge does not believe that Brazos
County is involved in this issue.
b) He is writing a letter to the City of
Bryan concerning a formal presentation on
Tax Increment Financing District #10 that
the City of Bryan is proposing. The
presentation will be February 29, 2000.
c) He received a survey from the GAO. He
will ask the Auditor to assist with its
completion.
d) He received a letter from Sam Seale
concerning a publication by the Texas
Municipal League and issues for the local
candidates in the up coming election.
There was no citizen input and/or concerns.
At 9:50 a.m. the County Judge announced the meeting
closed to the public so that the Court could meet in Closed
Executive Session to discuss security devices as allowed under
Section 551.076 of the Texas Government Code.
At 10:50 a.m. the County Judge announced the meeting open
to the public.
The County Judge moved to put the decision of the fence
enhancement estimates on the agenda for the meeting of
February 22, 2000. Commissioner Jones seconded the motion.
Sheriff Kirk and Wayne Dicky, the Jail Administrator indicated
they were prepared for the Court to make the decision today so
the contractor would know how to proceed and not hold up the
project. Commissioner Sims moved to approve all items on the
attached proposal except for item 6 which is a ten feet high
second perimeter fence with razor wire. The motion was
seconded by the County Judge. Mr. Dicky stated that a great
deal of thought had been put into the proposal on both
financial and security responsibility. Commissioner Cauley
stated he would feel more secure and thinks that citizens

would feel more secure if the second fence were installed.
Commissioner Sims called for the question. Commissioner Sims
and the County Judge voted "Aye". Commissioners Jones and
Cauley voted "No" whereupon the Judge announced the.motion
failed. After considerable discussion on security and
financial concerns, Commissioner Jones moved to approve all
items on the proposal but item number 6, the fence enhancement
proposal and put item #6 on the agenda of the Commissioners
Court meeting of February 22, 2000. Commissioner Cauley
seconded the motion. Commissioners Jones, Sims and Cauley
voted "Aye". The County Judge abstained.
There being no further business to come before the Court,
the meeting was adjourned.

THAT WHEREAS, on February 15, 2000 the Court heard and approved a
budget amendment for the 1999-2000 budget year for Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to meet
unusual and unforeseen conditions which could not be reasonably included
in the original budget adopted September 9, 1999 the following
amendment (s) to the original are hereby authorized, as described on the
attached page(s).

WHEREAS, the City of Bryan approved Ordinance # 1018 annexing 50.74 acres of land located in Voting Precinct 26B,
Ordinance # 1139 annexing 552.14 acres of land located in Voting Precinct 77, Ordinance # 1140 annexing 37.303 acres of land
located in Voting Precinct 63B, Ordinance # 1146 annexing 43.34 acres of land located in Voting Precinct 26B and Voting Precinct
51B, Ordinance # 1175 annexing 6,368 acres of land located in Voting Precinct 51 B, Voting Precinct 26B, Voting Precinct 27,
Voting Precinct 63B, Voting Precinct 7, Voting Precinct 46, Voting Precinct 81, Voting Precinct 45B, Voting Precinct 30B, Voting
Precinct 77, Voting Precinct 3B and Voting Precinct 29B; and
WHEREAS, the new boundary lines of the City of Bryan and the boundary lines of the Single Member Districts of the City
of Bryan do not follow the existing election precinct lines created by Brazos County; and
WHEREAS, Section 42.005 (ax6) of the Texas Election Code states "A county election precinct, including a consolidated
precinct, may not contain territory from more than one of each of the following types of territorial units: a ward in a city with a
population of 10,000 or more"; and
WHEREAS, Section 42.005 (c) states "In this section. "ward" means a territorial unit of a city, regardless of its designation
under other law, from which a member of the city's governing body is elected by only the voters residing in the territorial unit.";
and
WHEREAS, the Commissioner's Court is desirous of complying with the City of Bryan Single Member District lines, city
limit lines, and the Texas Election Code; and
WHEREAS, compliance with the Texas Election Code requires the division of ten (10) voting precincts and the creation
of twenty-one (21) additional voting precincts; and
WHEREAS, Section 42.008 (1) of the Texas Election Code provides for consolidating election precincts; and
WHEREAS, the newly created election precincts can be consolidated for the convenience of the voter to allow the voter
in the newly created election precincts to vote at their usual polling place;
NOW THEREFORE BE IT RESOLVED BY THE COMMLSSIONERS COURT OF BRAZOS COUNTY, TEXAS,
that
Pursuant to Section 42.005 (ax6) of the Texas Election Code that various election precincts be divided to follow the City

of conducting elections; and
WHEREAS, the polling place for Election Precinct 61 is located at the A&M Presbyterian Church located
at 301 Church Avenue, College Station, Texas; and
WHEREAS, the Commissioner's Court has been notified by the A&M Presbyterian Church that the
church located at 301 Church Avenue, College Station, Texas, will no longer be available for the conduction of
elections; and
WHEREAS, it is the desire of the Commissioner's Court to consolidate the polling place for Election
Precinct 61 with the polling place for Election Precinct 21, located at the A&M Methodist Church, located at 417
University Drive, College Station, Texas; and
WHEREAS, the polling place for Election Precinct 21 is located one block south and one block east of the
A&M Presbyterian Church; and
WHEREAS, Election Precinct 61 and Election Precinct 21 share the same Congressional, Legislative,
Commissioner and Justice of the Peace lines;
NOW, THEREFORE BE IT RESOLVED BY THE COMMISSIONERS COURT OF BRAZOS COUNTY,

Pursuant to section 43:031(d) of the Texas Election Code that the location of the polling place be
relocated in Brazos County to wit:

(a) REPUBLICAN - Deliver and pick up 220 voting devices for the first primary

(b) DEMOCRAT - Deliver and pick up 90 voting devices for the first primary
