COMMISSIONERS' COURT
REGULAR MEETING
FEBRUARY 8, 2000
A regular meeting of the Commissioners' Court of Brazos
County; Texas was held in the Commissioners' Courtroom in
the Courthouse in Bryan, Brazos County, Texas, beginning at
9:00 a.m. on Tuesday, February 8, 2000, with the following
members of the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3, Absent;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The attached sheet contains the names of the citizens
and officials that were in attendance.
Commissioner Jones gave the invocation and led the
pledge of allegiance.
The County Judge introduced the following Commissioners
from Jasper County:

Commissioner Precinct3, James Smith
Commissioner Precinct4, Mike Rose
The Jasper County Commissioners presented-a Resolution from
the Jasper County Commissioners Court to each member of the
Brazos County Commissioners Court along with a Resolution to
District Attorney, Bill Turner, District Clerk, Marc Hamlin,
Sheriff Chris Kirk and City of Bryan Spokesman, Joe Brown.
This was done in gratitude for the courtesies extended to
the Jasper officials during the Brewer trial.
There was no citizen input and/or concerns.
The Court next considered Budget Amendment 499/00-12.1
through 12.3, which would correct budget amendment No.
99/00-10.1 for the Brazos valley Council of Governments;
•
reallocate funds for the Capital Improvement Fund and
increase revenue within the General Fund.

Commissioner Cauley questioned the reallocation of funds for
the Capital Improvement Fund asking if the implementation of
the computer program was indeed complete. Commissioner
Cauley moved to table consideration on budget amendment
12.2. The County Judge seconded the motion and it carried
unanimously. Then on motion by Commissioner Jones, seconded
by Commissioner Thornton, the Court voted unanimously to
approve the budget amendments 12.1 and 12.3 as submitted.
A copy is attached hereto.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to
approve the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
20003689 through 20003960
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted.
On motion by Commissioner Sims, seconded by
Commissioner Jones, the Court voted unanimously to authorize
the County Judge to execute a Tax Resale Deed to the
following individual:
Andrew L. Merchant - Lot 8, Block 2, George
McCulloch Subdivision, Brazos County, Texas
The Court next considered setting the date and time for
Public Hearings to consider the setting of speed limits on
the following roads:
a. Quail Run in Quail Run Subdivision located in
Precinct 1
b. Hicks Lane in Precinct 3

On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to set Tuesday,
February 22, 2000 at 10:30a.m. as the date and time for the
Public Hearing for Quail Run in Quail Run Subdivision in
Precinct 1. On motion by Commissioner Jones, seconded by
Commissioner Cauley, the Court voted unanimously to set
Tuesday, February 22, 2000 at 10:45a.m. as the date and time
for the Public Hearing for Hicks Lane in Precinct 3.
The next matter for consideration was a tax refund to
•
Corinthian Mortgage Corporation. Corinthian paid taxes on
parcel #R11743-99 owned by Richard Smith. Taxes should have
been paid on parcel R103515. On motion by Commissioner
Cauley, seconded by Commissioner Thornton, the Court voted
unanimously to refund $814.68 in county taxes for 1999 to
Corinthian Mortgage Corporation.
On motion by Commissioner Jones, seconded by
Commissioner Thornton, the Court voted unanimously to
appoint Tammy Tiner as a member of the Board of Trustees of
Mental Health Mental Retardation Authority of Brazos Valley
(MHMR.ABV). It is a two year appointment beginning March 1,
2000 through February 28, 2002.
The Court next considered a request by the Sheriff's
Office for a correction of the budgeted hours for seven
positions. During the budget process the positions were
budgeted for 2080 hours rather than 2223. On motion by
Commissioner Cauley, seconded by Commissioner Thornton, the
Court voted unanimously to correct the budgeted hours so
that all records will be correct for the next budget year.
The next matter for consideration was a request from
the District Clerk for the purchase of two computers with
•
monitors and printers.

On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the
purchase of the two computers with monitors from the
computer replacement fund.
The Court next considered a request from the County
Attorney for the purchase of a fax machine. On motion by
Commissioner Sims, seconded by Commissioner Cauley, the
Court voted unanimously to authorize the purchase of a fax
machine from the Capital Expenditure account.
The Court next considered approval of a requisition
from the Capital Expenditures account for the following
purchase:
a) Replacement computer for County Auditor
$995.00
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the
requisition to be paid from Capital Expenditures account.

The Court next considered awarding the following bids:
Bid No. 2000-028, Decking Timbers
John Hachmann, Purchasing Agent,
recommended acceptance of the bid
submitted by Lufkin Creosoting as
Primary and the bid submitted by Colfax
Creosoting as secondary. On motion by
Commissioner Cauley, seconded by
Commissioner Jones the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract as noted. A copy of the bid
tabulation is attached.
Bid No. 2000-029, Bridge Pilings Annual Contract
John Hachmann, Purchasing Agent,
recommended acceptance of the bid
submitted by Building Products Plus as
Primary and the bid submitted by Olsen
and Guerra as secondary. On notion by
Commissioner Jones, seconded by
Commissioner Cauley the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract as noted. A copy of the bid
tabulation is attached.

Bid No. 2000-031, Gasoline and Diesel Fuel Annual
Contract

John Hachmann, Purchasing Agent,
recommended acceptance of the bid
submitted by Brenco Marketing. On
motion by Commissioner Jones, seconded
by Commissioner Cauley the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract as noted. A copy of the bid
tabulation is attached.

The Court next considered approval of a requisition
from the Capital Projects Expenditures for the following
purchase:
a) Two radios for the Sheriffs Office for
$2,366.14
On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the
requisition. The funds are to be transferred from Purchase
Autos to fixtures or equipment.
The next matter for consideration was approval for the
•
Purchasing Agent to advertise Bid 2000-036, Training for the
Narcotics Task Force. On motion by Commissioner Jones,
seconded by Commissioner Cauley, the Court voted unanimously
to authorize the Purchasing Agent to advertise for bids for
training.
The Court proceeded to consider the following blanket
Purchase Orders:
Labatt Foods Juvenile Services $8,500
Bryan ISD $3,400
On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered a request from the Grimes
County Road & Bridge Department for Brazos County to assist
in grading Long Trussel Road (approximately 0.3 mile) on the

Grimes County Side.

On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the request.
The Court next considered the request from GTE for
buried cable installation in the right-of-way of Smith Lane
beginning at its intersection with Raymond Stotzer Parkway
(FM 60) extending north for a distance of 707 feet. The
site is located in Precinct 4. The County Engineer stated
that all appeared to be in order and recommended approval.
On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the request
of GTE and authorized the installation. A copy of the
request is attached hereto.
Under announcement of interest items and possible
future agenda topics Commissioner Jones made the following
comment:
a) He received a lease from Justice of the
Peace Precinct 2 for property for
Precinct 1 Fire District. The County
will need to sublease from the Fire
District.
The County Judge made the following comments:
a) He asked Personnel to make a survey of
the salaries in the Brazos Valley since
1998.
b) The Director of Building Maintenance
reported a possible structural problem
at the Juvenile Services facility. It
begins at the west side of the building
and goes all the way down the length of
the building. Commissioner Jones will
look at the problem
c) There is a memo circulating that showing
state spending in Brazos County along
with money spent by the Brazos Valley
Council of Governments (BVCOG). Brazos
County is ranked 12`n in the state.
d) He received a letter concerning security
from a Mr. Crump of the State Jail
Commission.

e) The Auditor provided him with
information to be submitted to the state
for indigent health care to qualify for
tobacco money. We have $1,591,746.00
and that includes $805,676.00 for
• indigent health care.
There was no citizen input and/or concerns.
There being no further business to come before the
Court, the meeting was adjourned.

NO. 99/00 12.1 through 12.3
On this the 81 day of February 2000 at a regular meeting of the
Commissioners' Court, the following members were present:
Alvin W. Jones, County Judge, Presiding
Tony Jones, Commissioner, Precinct 1;
Wm. S. Thornton, Commissioner, Precinct 2;
Randy Sims, Commissioner, Precinct 3;
Carey Cauley, Commissioner, Precinct 4;
Mary Ann Ward, County Clerk.
The following proceedings were held:
THAT WHEREAS, on February 8, 2000 the Court heard and approved a
budget amendment for the 1999-2000 budget year for Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to meet
unusual and unforeseen conditions which could not be reasonably included
in the original budget adopted September 9, 1999 the following
amendment (s) to the original are hereby authorized, as described on the
attached page(s).
ADOPTED AND APPROVED this the 8`" day of February 2000.

This request is to cover the balance due to Multi-Information Systems Inc. which are under
contract for the Justice of the Peace Computerized Court system. The original purchase order for this
project was set u April 25, 1997 in the amount of $24,805.00 with payments made in the
amount of $17,181.50. For the fiscal year ending September 30, 1997, an encumbrance payable
was set up for the remainder of that purchase order in the amount of $7,623.50, which still remains
on the balance sheet. The original contract provides for a maximum cost not to exceed
$25,000.00 and a fee for migration of the existing data in the amount of $2,700.
CNS received an invoice January 28, 2000 for the remainder of this contract totaling $10,518.50.

ITEM: Request from GTE for buried cable installation in the right of way of Smith Lane
beginning at its intersection with Raymond Stotzer Parkway (FM 60) extending north for
a distance of 707 feet, Site is located in Precinct 4.
SOURCE OF FUNDS: N/A
REQUIREMENTS:
A) No work will be permitted between front slope and/or back slope.
B) The line shall be Installed 1) within 3-S' of and parallel to the right-of-way line and/or
2) In the case of a road bore, perpendicular to the right-of-way line.
C) If clearing of brush, trees and other obstruction Is necessary, it shall be the Applicants
responsibility to do so and to remove all cleared brush, trees, etc. from County right-
of way.
D) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698;
test shall be conducted by an Independent Geotechnical testing firm; copies of all test
results shall be furnished to the office of the Brazos County Engineer.
E) Construction shall be In strict conformance to the latest Texas Manual of Uniform
Traffic Control Devices for Streets and Highways. published by the Texas Department
of Transportation, and all other state and federal laws governing utility construction.

ATTENTION COUNTY JUDGE: AI Jones
Formal notice is hereby given that GTE SOUTHWEST INCORPORATED will
construct a communication line within the right-of-way of a County Road in
Brazos County, Texas as follows:
At the Intersection of Smith Lane and Raymond Stotzer Parkway
(Hwy 60) a buried cable will be placed 5 ft in the east R.O.W. of
Smith Lane extending north for a distance for 707 ft at a depth
not less than 30".
The location and description of this line and associated appurtenances is
more fully shown by two (2) copies of drawings attached to this notice. The line
will be constructed and maintained on the County Road right-of-way in
accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly
understood that the tender of this notice by the GTE Southwest Incorporated
does not constitute a waiver, surrender, abandonment or impairment of any
property'rights, franchise, easement, license, authority, permission, privilege or
right now granted by law or may be granted in the future and any provision or
provisions so construed shall be null and void.
Construction of this line will begin on of after January 24, 2000.
