REGULAR MEETING
JANUARY 18, 2000

A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in
the Courthouse in Bryan, Brazos County, Texas, beginning at
9:00 a.m. on Tuesday, January 18, 2000, with the following
members of the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The attached sheet contains the names of the citizens
and officials that were in attendance.
Commissioner Sims gave the invocation and led the
pledge of allegiance.
There was no citizen input and/or concerns.
The Court next heard a presentation by Margaret Sutton,
Donny Stone and Diane Grady regarding the 2000 Census.
The Court next considered Budget Amendment #99/00-10.1,
which would transfer fundr for the Brazos Valley Council of
Governments. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is
attached hereto.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the changes as submitted.

The Court next considered authorizing the Auditor's
office to process a recurring payment request for the
following:
a) Brazos County Emergency Communications
District $17,448
On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to authorize the Auditor's
office to process the previously noted recurring payment.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
20003031 through 20003274
On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Claims
as submitted.
The next matter before the Court was approval of a
Contractual Agreement between Brazos County and Houston
Cellular for cellular phone service to be used in
conjunction with the Sale to Minor Sting Grant and•the Sale
to Intoxicated Persons Grant administered by the County
Attorney's office. The phone service includes 340 minutes
per month for $35.00. No additional funding is needed as
the expense will come out of the existing cellular phone
budget. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to enter
into contractual agreement with Houston Cellular. A copy of
the contractual agreement is attached hereto.
The next matter for consideration was authorizing the
Architect to design and obtain specific cost projections for
enhancements to the Sandy Point Detention Center perimeter
security. On motion by the County Judge, seconded by
Commissioner Jones, the Court voted unanimously to table
consideration to allow Commissioner Jones time to meet with
the Architect and the Sheriff and then bring the Court a

recommendation.
The Court next considered adopting a Vehicle Use Policy
for the Sheriff's Office. The Court discussed this at
length. Questions were raised over use after hours, IRS
requirements and department head accountability in
enforcement. Commissioner Thornton moved to approve the
Policy. Commissioner Jones seconded the motion.
Commissioners Jones, Thornton and Cauley voted "Aye".
Commissioner Sims voted "No". The County Judge abstained.
The motion carried. A copy of the policy is attached.
The Court next considered authorizing the Purchasing
Agent to advertise for RFP for imaging of archived county
records. Commissioner Cauley explained that the purpose of
this request was to try to reduce the cost below
$600,000.00. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to authorize
the Purchasing Agent to advertise for RFP for imaging.
The Court proceeded to consider the following Blanket
Purchase Orders:
Brazos Office Sup. County Attorney $1,200
Pharmerica Jail $1,000
Lowe's Brazos Center $1,000
Lowe's Brazos Center $ 500
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered awarding the following bid:
Bid No. 2000-022, Courthouse Energy Management System
John Hachmann, Purchasing Agent, recommended
acceptance of the bid submitted by Tempset
Controls. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted
unanimously to accept the recommendation of the
Purchasing Agent and award the contract to Tempset
Controls.

The next matter before the Court was consideration of a
one year extension of the contract with Swico Auctions. In
a memo to the Court, the Purchasing Agent asked for the
extension based on Swico's excellent service in the past.
on motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court vote& unanimously to extend the contract
with Swico Auctions for one year. A copy of the contract is
attached.
The Court next considered approval of a requisition
from Grant Funds for the County Attorney's office:

a) Body worn video system $3,945.00
On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the
requisitions to be paid from Grant Funds for the purchase of
video equipment for the County Attorney's office.
The Court next considered approval of a requisition
from the Capital Expenditure Fund for the following
purchase:
a) Radio Equipment for the Sheriff's office
$3,549.80
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the
requisitions to be paid from Capital Expenditures Fund
The Court next considered rejection of RFP 2000-016,
Long Distance Service. In a letter from Ben Sanford,
Telecommunications Consultant, he stated that there was only
one RFP-compliant long distance proposal received and it was
only marginally better than what the County currently had.
On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to reject RFP 2000-016
and to reissue the RFP.

The Court next considered the following requisitions
for purchases through sealed competitive bids for the Road
and Bridge Department:

On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the above
listed requisitions for the Road and Bridge Department.
The Court next considered authorization for the County
Judge to execute departmental contracts with Houston
Cellular. On motion by Commissioner Jones, seconded by
Commissioner Sims, the Court voted unanimously to authorize
the County Judge to execute departmental contracts with
Houston Cellular.
The Court next considered acceptance of Union Pacific
Resource's cost estimate of $6,000.00 to lower a cased salt
water pipeline to accommodate the Green's Prairie Road
Extension project in Precinct 1. On motion by Commissioner
Jones, seconded by Commissioner Sims, the Court voted
unanimously to accept Union Pacific Resource's cost estimate
of $6,000.00 to lower a salt water pipeline on Greens
Prairie Road.
The Court next considered approval of the Amending
Plat of Woodlake Subdivision, Section One, Lots 42 & 43 in
Precinct 1.

Richard Vance, County Engineer, stated that he had
reviewed the plat and recommended acceptance as submitted.
on motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approved the
Amending Plat of Woodlake Subdivision, Section One, Lots 42
& 43 as submitted.
The Court next heard a presentation by Shelbourne
,
Veselka, representative of McCreary, Veselka, Bragg & Allen
P.C. on delinquent tax collection.
There were no announcements made by the County Judge.
Under citizen input and/or concerns, the following

comments were made:
a) Judge Rick Davis stated that he would
have no input on the selection of his
replacement and that he would abide by
the decision of the Court.
b) Justice of the Peace, Precinct 4, C.
Patrick Meece addressed imaging of old
records.
0 Justice of the Peace, Precinct 6, George
Boyett stated that he had a serious
storage problem. He went on to ask
Commissioner Cauley if he had any idea
as to when the imaging would filter down
to the JP offices. Commissioner Cauley
responded it would be as soon as
possible.
At 10:55 a.m. the County Judge announced the meeting
closed to the public so that the Court could meet in
Executive Session to consider the appointment of a public
officer as allowed under Section 551.074 Texas Government
Code.
At 11:34 a.m. the County Judge opened the meeting to
the public and announced that the meeting would stand in
recess until 8:00 a.m. on Wednesday, January 19, 2000.
The Court reconvened on Wednesday, January 19, 2000 at

The County Judge announced the meeting closed to the public
so that the Court could meet in Executive Session to
continue consideration of the appointment of a public
officer as allowed under Section 551.074 Texas Government
Code.
At 8:13 a.m. the County Judge opened the meeting to the
public. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to appoint
Glynis Gore as Judge of County Court at Law II effective
January 31, 2000.
There being no further business to come before the
Court, the meeting was adjourned.

Commissioners' Court, the following members were present:

THAT WHEREAS, on January 18, 2000 the Court heard and approved a
budget amendment for the 1999-2000 budget year for Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to meet
unusual and unforeseen conditions which could not be reasonably included
in the original budget adopted September 9, 1999 the following

POLICY REGULATING COUNTY OWNED VEHICLES
i Pursuant to action taken by the Brazos County Commissioner's Court on Tuesday, January 11`, 2000
regarding the BRAZOS COUNTY POLICY REGULATING USE OF COUNTY VEHICLES; the
following are the policies adopted by the Brazos County Sheriff's Office and approved by the
Commissioner's Court on Tuesday, January 18", 2000.
TAKE-HOME VEHICLE PROGRAM
For the purposes of these policies, a vehicle is any motor vehicle which is under the direction and
control of this Office and is not owned by an employee. Participation in the Take-Home Vehicle
Program requires the employee to abide by applicable State of Texas and Federal law and the guidelines
of these policies and other Office procedures. Vehicles are issued at the discretion of the Sheriff or
Chief Deputy.
POLICY
Sheriffs Office issued vehicles are considered a law enforcement tool. Personal use or gain is not in
keeping with this policy and is prohibited. It is recognized and accepted that normal wear will occur
during the working use of the vehicle. It is recognized that operation of vehicles in the law enforcement
setting raises the possibility of accident, theft, criminal mischief etc. This policy does not hold the
deputy responsible for matters beyond his or her control.
ELIGIBILITY
1. Officer must have a valid Texas driver's license.
2. Officer must be a T.C.L.E.O.S.E. licensed peace officer, commissioned by the Brazos County
Sheriff, and a full-time employee of Brazos County.
3. Officer must complete and sign the "Take Home Vehicle" authorization form. This form is used to
acknowledge that the participating officer has read and agrees to abide by these policies. Also on this
form the Officer will designate his/her place of residence or where the vehicle is to be parked
when not in use. All vehicles must remain within the boundaries of Brazos County when not in use.
When an Officer changes his/her place of residence or changes assigned vehicles, a new form is to be
completed.
4. Officer must to be dressed appropriately, carry their authorized service or off-duty weapon and
monitor their radio in order to respond to in-progress calls and/or emergency call-outs authorized by
the Sheriff or Chief Deputy.
5. Officer must comply with Internal Revenue Code Regulations. To comply, each Officer must file an
annual EMPLOYEE FRINGE BENEFIT CERTIFICATION FORM with the Brazos County
Auditor's office.
PASSENGERS
Persons riding as passengers in vehicles are limited to Office personnel, other County employees, and
other authorized riders. Peace Officers from other jurisdictions may ride without signing a waiver. They
do not wear their official uniform unless conducting official business for their agency.
Authorized civilian riders participating in the "ride along program" must complete a wavier of liability
form prior to beginning the ride. These riders are issued a "Civilian Rider" identification tag to be worn
in plain sight during the length of the ride. Rider tags are available from the Chief Deputy and deputies
with riders are responsible for the issuance and recovery of the tags.

USE OF COUNTY OWNED VEHICLES
1. OFFICE USE - Use of the vehicle is limited to commuting to and from work, normal on-duty
utilization, and Office related events. De minimis use of the vehicle may include personal errands
while on duty or commuting, provided they do not take priority over calls for service and do not
diminish the image of the Office.

II. OFF-DUTY USE - All employees of the Sheriffs Office must receive approval for any off-duty
employment from the Sheriff, Chief Deputy, or their designee. Participating deputies must be
eligible for off-duty employment and comply with Sheriffs Office extra duty assignment procedures.
Deputies may use the county owned vehicles under the following circumstances:
A. As transportation to approved off-duty jobs, which includes;
1. To or From the an extra-duty job;
2. For the transport of arrested persons to the Brazos County Jail for booking; and
3. Any other use of the vehicle for the extra-duty employer is to be billed according
to the procedures established by the Brazos County Auditor.
NOTE: Deputies are considered on the payroll of the County throughout the
transportation and booking process and subsequently off the extra-duty job payroll.
B. As transportation to and from County or Office approved functions and/or business.
(When in doubt if the use is authorized, employees should request clarification through their
immediate supervisor).
C. Any other use authorized by the Sheriff, Chief Deputy or their designee.
CARE AND MAINTENANCE
1. When not in use, all vehicles shall be provided reasonable security to safeguard the vehicle and its
contents.
2. Deputies are responsible for maintaining the entire vehicle in a clean condition and will ensure the
vehicle receives preventative maintenance as scheduled.
3. Any damage sustained to the issued vehicle shall be immediately reported to a Sheriffs Office
supervisor, with a written report submitted to the Sheriff or Chief Deputy by the next working day.
4. After review of an incident report involving damage to the vehicle, the Sheriff or his designee, will
make a determination as to responsibility. Should it be determined that the damage was caused by
neglect or misuse of the vehicle by the deputy, the Sheriff or his designee, may require the deputy to
reimburse Brazos County for expenses incurred as a result of neglect of misuse. Reimbursement may
include any and all expenses, including vehicle replacement.
PROHIBITED ACTIVITIES
The following activities, although not totally inclusive, are prohibited:
1. Employees experiencing any type of impairment or condition that may adversely affect their safe
performance of duty shall not operate a vehicle and will notify their supervisor in writing;
2. Employees will not drive vehicles to establishments which are primarily engaged in the sale and/or
on-premise consumption of alcoholic beverages, to a business of questionable nature, or to other
establishments specifically prohibited by the Sheriff unless within the scope of their official business;
3. Employee shall not drive their vehicle improperly, unlawfully, or in a reckless manner, and
4. Employee may not take a county vehicle outside the boundary of Brazos County for anything other
