To make arrangements call (409) 361-4102. 1~ VO V----PAGF, L, COMMISSIONERS' COURT SPECIAL MEETING JANUARY 23, 1995 s A special meeting of the Commissioners' Court of Brazos Cotimty, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, January 23, 1995, with the following members of the Court present: Alvin Jones, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Sandie Walker, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The Court first opened and read aloud the bids for the county Depository for the 1995-1996 biennium. The bids were submitted from the following banks and each included an escrow deposit for $148,000.00: First American Bank signed by Charlie Zikes Victoria B&T signed by James R. Miller First National Bank signed by Wm. D. Barclay NationsBank signed by Joe L. Price The bids will be evaluated by the Auditor's office and the recommendation will be brought before the Court at a later date. . t /11' VO f ( 1 s G i • ~f t r E I 'I E r 4 r x~ f Oil Commissioners Court meeting January 23, 1995 The next matter for consideration was a request submitted by Susan Shinder, Administrative Law Judge of Waco, who requested the use of the Commissioners Courtroom. Robert Harris, representative of the State Office of Administrative Hearings, appeared before the Court and explained that the courtroom would be needed on the first and third weeks of the month on Tuesday, Wednesday and Thursday to hear adminis- trative hearings on drivers license revocations. Commissioner Norton asked about the use of the Brazos Center and was told that the Commissioners Courtroom was the preferred location with the Brazos Center designated as the alternative location should there be a conflict with the Commissioners Courtroom. On motion by commissioner Sims, seconded by Commissioner Walker, the Court voted unanimously to grant the request of the Administrative Law Judge, and approve the use of the Commissioners Courtroom on the first and third weeks of the month on Tuesday, Wednesday and Thursday to hear adminis- trative hearings on drivers license revocations and to designate a room at the Brazos Center should a conflict arise with the Commissioners Courtroom. The Court next considered an Order appointing Claude Davis to sit as Special Judge in County Court at Law II January 30, 1995 to allow Judge Ryan to take personal leave. Commissioner Sims asked if Court could be canceled for the day. He was informed that eighty-seven (87) cases had been set for that date. He was also informed that County Court at Law II has ten (10) working days budgeted for a visiting judge. Commissioner Sims moved to approve the order. The motion was seconded by Commissioner Walker. Commissioners Cauley, Sims and Walker voted "Aye"; Commissioner Norton voted "No". The motion carried to approve the Order naming Claude' Davis as Special Judge for County Court at Law II January 30, 1995. A full copy of the order is attached to and made a part of these minutes. F F i U t. • 1 • Commissioners Court meeting January 23, 1995 Norton, the Court voted unanimously to designate the third Monday of each month at 6:30 p.m. as the date and time for the monthly night meeting of the Commissioners Court. This will be reviewed after six (6) months time. Commissioner Norton suggested items of interest be-placed on the agenda of the night meetings. The Court next considered the appointment of the current County Judge to fill the vacant position of R. J. Holmgreen, the former County Judge, on the Bryan/College Station Metropolitan Planning Organization's (MPO) Steering Committee. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to appoint Al Jones to serve on the MPO Steering Committee. On motion by Commissioner Norton, seconded by Commissioner Cauley, the Court voted unanimously to receive; approve and order filed as submitted the Certification of the Juvenile Detention Facility and the Montgomery County Juvenile Detention Facility. The inspection and certification were carried out by the Juvenile Probation Board on January 6, 1995. A copy of each Certification is attached hereto. The next matter before the Court was approval of a Contractual Agreement between Brazos County and the Brazos County Rape Crisis Center, Inc. The Center will provide services to the victims of sexual assault, maintain files, respond to any inquiries, provide information needed for audits, provide quarterly financial statements, etc.. The cost to Brazos County will be $10,000.00 annually. The contract shall continue in force and effect for a term of twelve (12) months commencing on the 1st day of October, 1994 and terminating on the 30th day of September 1995. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to enter into contractual agreement with Brazos County Brazos County Rape Crisis Center, Inc.. A copy of the contractual agreement is attached hereto. The department currently has forty two (42) vehicles in inventory, is replacing seven (7) and requesting permission to retain three (3) of the seven (7) vehicles being replaced. The County Judge indicated that he did not believe in building the inventory past the current number of vehicles. The County Judge moved to deny the request of the Sheriff's Department to retain three (3) vehicles. Commissioner Sims seconded the motion. Commissioners Norton, Sims Walker and the County Judge voted "Aye"; Commissioner Cauley voted "No". The motion carried. The next matter for consideration was the procedures for use of departmental Visa credit cards. The Auditor stated that the credit cards should not be used to rent cars, that car rental should be done by the Commissioners Court. The Auditor was asked to change page 2, paragraph 4, to read "The fihal decision of appropriate or inappropriate use will be determined by the 'Commissioners Court"' and to contact the liability carrier for clearance on coverage of rental vehicles. On motion by Commissioner Norton, seconded by the County Judge, the Court voted unanimously to approve the credit card procedures with the change in verbiage and clarification on rental vehicles. The Court next considered adopting a Resolution authorizing the submission of a grant request to the Criminal Justice Division of the Governor's office for funding to Brazos County, Texas for a program known as the Narcotics Trafficking Task Force. Brazos County will be responsible for providing local matching funds in the amount of twenty-five percent of the money utilized in narcotics operations. On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to authorize the County Judge to make application on behalf of Brazos County to the Criminal Justice Division and accept on behalf of Brazos County such grant funds as may be tendered. The Court next considered appointments of members to the Board of Directors of the Brazos County Industrial Development Corporation, Brazos County Health Facilities Development Corporation and the Brazos County Housing Finance Corporation. On motion by Commissioner Sims, seconded by Commissioner Walker, the Court voted unanimously to appoint Alvin W. Jones, County Judge to the Board of Directors of the Brazos County industrial Development Corporation. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to appoint, Alvin W. Jones, County Judge, Sandie Walker, Commissioner Precinct 2 and Carey Cauley Commissioner Precinct 4 to the Board of Directors of the Brazos County Health Facilities Development Corporation. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to appoint Alvin W. Jones, County Judge, Sandie Walker, Commissioner Precinct 2 and Carey Cauley Commissioner Precinct 4 to the Board of Directors of the Brazos County Housing Finance Corporation. The Court next considered three (3) Exemptions from , Competitive Bidding Requirements of Local Government Code, Section 262.024(a)(7)(C). The first is for the purchase of electric power, natural gas, water or other utility services from Lone Star Gas. The second is for the purchase of electric power, natural gas, water or other utility services from Bryan Utilities. The third is for the purchase of electric power, natural gas, water or other utility services from General Telephone Company. The Commissioners' Court determined that these are single source suppliers. On motion by Commissioner Norton, seconded by Commissioner Walker, the Court voted unanimously to approve the Exemptions of Competitive Bidding Requirements and approved all such payments to the designated vendors for purchases necessary during the 1994-1995 fiscal year. The site is located in Precinct 4. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the request of Fairview Smetana and authorized the installation. A copy of the request is attached hereto. The Court next considered two requests from Wickson Creek Special Utility District. The first to place a road bore in the right-of-way of Fourwinds Drive East and the second to place two (2) road bores in the right-of-way of Crosswinds Drive/East Brazos Industrial Park to provide service at two locations on Crosswinds Drive. The sites are located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Walker, seconded by Commissioner Norton, the Court voted unanimously to approve both requests of Wickson Creek Special Utility District and authorized the installation. A copy of each request is attached hereto. The Court next considered the request from GTE Southwest for a buried cable installation in the right-of-way of J Stousland Road beginning at its intersection with Clay Pit Road for a distance of approximately 1166.0 feet. The site is located in Precinct 1. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Norton, seconded by Commissioner Walker, the Court voted unanimously to approve the request of GTE Southwest and authorized the installation. The Court next considered the request from the Road and Bridge Department to make application to the City of Bryan to install a service meter and a security light at the Citizen's Collection Site located off Silver Hill Road. The Court next considered three (3) request for authorization to work outside of county rights-of-way for the health, safety and welfare of the general public. The first request was for permission to enter the private property of Clarence Cobb located off Long Trussel Road to remove dead and/or leaning trees along the northeast side of the roadway. The site is located in Precinct 3. On motion by Commissioner Sims, seconded by Commissioner Walker, the Court voted unanimously to authorize the work. The second request was for permission to enter the private property of Frank Kalinec located off SH 21 West to provide County trucks and equipment access to the proposed Juvenile Detention Center site located in Precinct 4. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to authorize the work. The third request was for permission to enter the private property of Raymond Olson located off I&GN Road to remove excess material in the driveway. The site is located in Precinct 1. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the Claims as submitted. The next matter before the Court was.Citizen input and Concerns. The County Judge stated that there were a number of items to share with the Court: Budget - the court would start early to put a schedule together and notify the departments of guidelines for submitting requests. Workshop meetings - with department heads or their representatives. ` Smoking Policies for the County - reconsider. Budget - visit with department head on current budget. Courthouse security - consider recommendations. Eisenhower Leadership Committee - Free assistance from Political Science Department at A&M for determining process for long range planning. Radio, Frequency - Chief Freeman offered the County use of the City's radio frequency until the County can get its radio frequencies re-established. Historical Commission - meeting to be held January 23, 1995 at 7:00 p.m. in the Commissioners Courtroom. Commissioner Sims recommended that one or both of the new commissioners join the Board. There being no further business to come before the Court, the meeting was adjourned. We hereby find that: 1. Children in detention are not detained in or committed to a compartment of a jail in which adults are detained or committed; 2. Children in detention are not permitted contact with adults who are detained or committed to jail; 3. The detention facility meets the requirements of Article 5115, Revised Civil Statutes of Texas, 1925, as amended, defining "safe and suitable jails"; • 4. The detention facility meets the "Standards for Juvenile Detention Facilities" as required by k Section 75.041, Texas Human Resources Code, and as adopted by the Texas Juvenile Probation commission, effective the 11th day of November, 1986. THEREFORE, the Montgomery County Detention Center (serving as a backup to Brazos County) is hereby certified as a suitable facility for children until the next annual inspection due one year from this date. SERVICES TO BE PERFORMED BY PROVIDER The Provider will provide services to victims of sexual assault and their families. These services will include: a 24-hour hotline and 24-hour escort service; one-on-one counseling; group counseling; community awareness programs; Speakers Bureau; training and supervision of volunteers; training for law enforcement agency personnel, the medical community, clergy, staff of the District Attorney's office and psychologists. Maintaining this Contract. 2. Providing of the Provider's Services. 3. Maintaining data files on clients and the Services provided thereto. 4. Respond to all and any inquiries by the County regarding the Center and its Services. 5. Assist the County with information needed for audit purposes. 6. Provide the County with quarterly financial statements. 7. Provide the County with any and all certified audits of Provider and the management letter prepared in connection therewith. S. Provide the Court with statistics evidencing the number of Brazos County residents using the Provider's Services and the percentage Brazos County residents comprise of the total population using the Provider's Services. RESPONSIBILITY OF COUNTY The County shall be responsible for the following duties and requirements: 1. Provide county funds for the payment of the consideration stated herein. 2. L . . RECORD RETENTION i The Provider shall be responsible for record keeping on all Services provided to those individuals using its services and all financial records of the Center. The Provider agrees to maintain and make available for inspection by the County upon request consistent with personal privacy and subject to the limitation of state law, any and all records the County determines, in its sole discretion, to be necessary for the Court to justify its continued participation in supporting the Provider with funding. Such records shall be retained for at least four (4) years from the date the service was provided. These records shall be made available for inspection and audit by the County, if it so desires. DISCRIMINATION 'b- o . r~ The Provider shall not discriminate against any employee or applicant for employment because of race, color, religion, sex, or national origin. The Provider shall take affirmative action to ensure that applicants who are employed are treated during employment, without regard to their race, color, religion, sex, or national origin. Such action shall include, but not limited to, the following: employment, upgrading, demotion, or transfer; recruitment or recruitment advertising; layoff or terminations rated of pay or other forms of compensation; and selection for training, including apprenticeship. The Provider agrees to post in conspicuous places, available to employees and applicants for employment, notices setting forth the provisions of this nondiscrimination clause. INDEMNITY The parties hereto agree to indemnify one another for and hold one another harmless from and against all suits, claims, demands, liabilities or actions resulting or alleged to result form the breach, violation or non-performance of the services stated herein and for any damage to any person resulting form any action or omission or negligence on the part of each party hereto. The proposed cable will be buried to a minimum depth of 30". f The location and description of this line and associated appurtenances is more fully shown by two copies of drawings attached to this notice. The line will be constructed and maintained on the County Road right-of-way in accordance with ' governing laws. Notwithstanding any other provision contained herein, it is expressly understood that tender of this notice by GTE does not constitute a waiver, surrender, abandonment or impairment of any property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may be granted in the future and any provision or provisions so con- strued shall be null and void. It is understood that this agreement shall stay in force for a period of not less than two years, and thereafter. unless cancelled by either party by giving the other written notice of at least 30 days prior to the effective date of termination of this service. 2. A duly authorized representative of the City shall be permitted to enter Customer's premises at all reasonable times in order to make necessary repairs and bulb replacements. 3. The City will maintain lights free of charge to Customer where equipment is defective or foils due to normal wear and tear. The Customer will be responsible for payment for all components damaged by vandalism. The Customer will be responsible for notifying the City when a light fails, and the City will repair some within 72 hours if not unreasonable to do so. 4. The City agrees to install lights for which the customer agrees to pay the monthly rate as prescribed by ordinance. This amount to be billed to the Customer's Acc't No. 5. This agreement is binding until the applicant gives proper notice to discontinue service. The applicant also agrees that if at any time there is a failure to pay when due, any charge for service or repairs, Bryan Utilities may discontinue service to any or all meters in the name of the applicant until arrears are paid, plus an additional service charge for turning utilities back on. The city shall have a right of offset against other accounts in the name of the applicant. The City of Bryan is not responsible for loss resulting from interrupted service. The applicant also acknowledges that meters are the property of Bryan Utilities, and that they may be turned on or off only by authorized city employees. Apply for service, by completing an application at the Utility Billing Office at 205 E. 26th. This application is necessary prior to obtaining an electrical permit and initiates a pending order. All fees and deposits must be ► paid prior to issuing of permits (or calls for inspections). PERMIT A. An electrical permit must be taken before starting ,work and is obtained from the Rural Inspector, Jerry Tighe (Tie), at the City Inspections office in the Municipal Building on { Texas and 29th Street (361-3612) after the completion of the F investigation. 3. The person holding the electrical permit will notify the Electrical Inspector when ready for an inspection. Two inspections are required: (a) rough-in (before the wiring is covered) (b) final inspection (after all electrical wiring and facilities are installed) 1 An "acceptance tag" will be posted if the work is accepted by the inspector. A "red tag" will be posted if the work is not acceptable, and the permit holder must pay a reinspection fee at the Rural Inspector's office before reinspection. 4.
