On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to authorize the V0 AGE A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, December 12, 1994, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4, Absent; Mary Ann Ward, County Clerk. The Court tabled a request from David McCourt, Ray Crow and Phil Meuret to address t he Court. The County Judge stated that this needed to be done after the first of the year. The Court next considered approval of the minutes of 'the Commissioners' Court meetings held November 21, 1994, November 21, 1994 (10:30 a.m.) and November 28, 1994. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the minutes as submitted. There were no Budget Amendments to consider. f t~ f f r 's c .r F. I Commissioners Court meeting December 12, 1994 Purchasing Agent to advertise for bids for a Depository Contract for 1995-1997. The next matter for consideration was a tax refund to Manor East Mall, Inc.. In a Court settlement it was agreed that the appraised value for 1993 be lowered from $1,059,640.00 to $658,870.00 On motion by the County Judge, seconded by Commissioner Norton, the Court voted unanimously to refund $1,736.80 in county taxes for 1993 to Manor East Mall, Inc.. The Court next considered the purchase of copiers for various county offices. On motion by Commissioner Sims, seconded by Commissioner Wilcox, the Court voted unanimously to purchase copiers for various county offices on state contract. The Court next considered approval of a Commercial Charge Account with Sam's Club. Commissioner Norton read the policy statement that was submitted by the members of the ad hoc committee. The policy enumerated the procedures to be followed in order to make purchases on the commercial account. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to adopt the policy and related procedures for purchases made on the commercial account at Sam's. Purchases will be limited to $200.00 and a Purchase Order will be required. A copy is attached hereto. The next matter before the Court was approval of an Agreement between Brazos County and PCT/TELINK Inmate Telephone Service. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the agreement with PCT/TELINK with modifications :wade by the County's legal counsel. The next matter for consideration by the Court was a request submitted by the Data Processing Department requesting approval for out of state travel for John Branch. Mr. Branch would be traveling to Las Vegas, Nevada to attend an international conference March. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to grant the request from the head of Data Processing and approved payment of out of state travel expense for John Branch. The Court next considered renewal of a lease agreement between Brazos County and Walter Opersteny for rental of storage space for materials, building space for temporary parking of vehicles owned by Brazos County, Texas. Term of the lease is for the period of one year commencing on January 1, 1995 and ending on December 31, 1995. The County agrees to pay to Mr. Opersteny the amount of one thousand two hundred dollars ($1,200.00) annually for the area and water so utilized. On motion by Commissioner Wilcox, seconded by Commissioner Sims, the Court voted unanimously to renew the lease agreement between Brazos County and Mr. Walter Opersteny for the period stated above. A copy of the lease agreement is attached. The Court next considered the request from Ferguson Burleson County Gas Gathering System to a road bore in the right-of-way of Old Highway 6 approximately 0.6 mile north of its intersection with SH 6. The site is located in Precinct 1. Included with the request is company check #3097 in the amount of $500.00. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the request of Ferguson Burleson County Gas Gathering System and authorized the installation. A copy of the request is attached hereto. The site is located in Precinct 1. Included with the request is company check #019522 in the amount of $1,000.00. The County Engineer stated that all appeared to be in order and recommended approval. The first request is to install a water line in the right-of-way of Rustic Oaks Drive in the Rustic Oaks Subdivision. The site is located in Precinct 3. The second request is to install a water line in the right-of- way of Bird Pond Road approximately 460.0 feet from its intersection with Tonkaway Lake Road. The site is located in Precinct 3. The County Engineer stated that all appeared to - be in order and recommended approval. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the request of Wickson Creek Special Utility District and authorized the installation. A copy of the request is attached hereto. The Court acknowledged receipt of the Extension Service reports for November 1994 and acknowledged receipt of reports from County and Precinct Offices showing revenues collected and remitted to the County Treasurer. An excerpt from those reports is attached hereto. On motion by Commissioner Norton, seconded by Commis- sioner Sims, the Court voted unanimously to hold a Public Hearing on Tuesday, January 3, 1995 at 10:30 a.m. to consider changing the name of Steel Store Cut-Off Road to Sims Lane. That office will receive a new copier after the beginning of the year. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the Claims with the exception of claim number 28677. 'Randy ms Commi sioner, Precinct 3 y THE PURPOSE OF THIS POLICY AND RELATED PROCEDURES IS TO STANDARDIZE THE PROCEDURES THAT THE COUNTY FOLLOWS FOR PURCHASES MADE ON THE COMMERCIAL CHARGE ACCOUNT AT SAM'S WHOLESALE. 1. POLICIES A. GENERAL A purchase order is required for all purchases made at Sam's Wholesale. This will allow Brazos County to be invoiced for materials and supplies. A requisistion (request) approved in triplicate by the Department Head (or authorized employee), the County Auditor (or authorized employee) and the County Judge (or authorized representative) must be made prior to the purchase. B. PURCHASE ORDER NUMBERS All purchase order numbers will be issued through purchasing in the County Auditor's office only after the proper authorizations are obtained on the requisiton. C. USE OF BIDS FOR MATERIALS AND SUPPLIES i All existing purchasing policies and procedures are to be followed. Sam's Wholesale will provide telephone and/or written price quotations upon request. Price quotes are good for a maximum of 90 days. D. PERSONNEL AUTHORIZED TO MAKE PURCHASES Any employee of Brazos County holding a valid, authorized purchase order issued by Brazos County will be allowed to purchase and receive goods. E. AUTHORIZED LEVELS OF PURCHASING Commissioners Court has designated specific levels of discretionary spending available to the various departments through the budget process. Purchase Orders less than $200.00 requires one of the following signatures: County Judge, County Auditor, Purchasing Agent, or any Commissioner. INVOICING Sam's Wholesale will send all invoices directly to the Brazos County Auditor's Office. Billing cycle runs from the 18th through the 17th of the next month. Payment is due by the 6th day of the following month. Receipts obtained at the point of purchase shall be forwarded to the County Auditors's Office with the blue receiving copy of the purchase order within 48 hours of purchase. B. ROUTING: REQUISITION 1. Department making the request shall furnish the County Auditors Office with the white original requisition/payment authorization and the yellow copy with all relevant information i.e. vendor, date of request, description of materialstsupplies, prices, account to be debited, and authorized signature. 2. Requisitions shall be delivered directly to the Auditors office and approved for budgetary constraints. 3. After the requisition has been approved for budget availability by the Auditor's Office, signatory authorization will need to be obtained from the following: a. AL Community Supgryision & Corrections Department requisition/purchase authorizations should be delivered to the designated CSCD liaison judge. b. ALL Health Department requisition/payment authorizations should be delivered to the Health Department Board Member who has been designated as signatory for the current year. C. ALL Road & Bridee requisition/payment authorizations should be delivered to the Brazos County Commissioners Court member who has been designated as the Road & Bridge liaison for the current year. d.. ALL other requisition/payment authorizations should be delivered to the County Judge, who is the designated representative for the Commissioners Court. ADDITIONAL INFORMATION 1. Sam's will accept an approved faxed copy of the purchase order and will pull inventory and have it ready for pick-up at the dock area in the back of the store . 2. PTC/TELINK INMATE TELEPHONE SERVICE AGREEMENT THIS AGREEMENT is made and entered into this 21 at day of Dice-nW . 199 by and between PTC/TELINK a division of Peoples Telephone Company, with its principal office at 2300 Northwest 89th Place, Miami, Florida 33172 and BRAZOS COUNTY, TEXAS, acting by and through its duly elected Commissioners Court, with a mailing address of 300 East 26th Street, Bryan, Brazos County, Texas 77803 (hereinafter referred to as "Customer"). BACKGROUND PTC/TELINK is in the business of providing telephone services for inmates of criminal justice facilities and desires to act as the exclusive Company for (i) the installation and maintenance of a phone system at the Customer's facilities for that purpose; (ii) for the billing and collection of such calls from the Customer's location set forth in this Agreement; and (iii) for the distribution of revenues to Customer for the right to provide such services. Customer desires to retain PTC/TELINK to perform said services. THEREFORE, the parties agree to be legally bound as follows: 1. Representations of Customer. Customer hereby represents to PTC/TELINK that it owns or controls the facilities referred to in this Agreement and has the unrestricted right, power, and authority to enter into this Agreement with PTC/TELINK. 2. Services of PTC LINK. PTC/TELINK shall arrange for the installation, and maintenance of an automated collect calling telephone system (herein the "System")for the Customer's Maximum Security Jail, Minimum Security Jail and Juvenile Detention Facility (herein "Locations"), as set forth in Brazos County Request for Proposal No. 94-753 and PTC/TELINK Response to such Proposal dated August 18, 1994, both of which are incorporated herein by reference and attached as Exhibits "A" and "B", respectively. In order to effectuate the installation and maintenance of the System PTC/TELINK shall r . VOL 4= PAQE. -~Z. .r r i arrange for the necessary facilities from the local exchange company and inter-exchange carrier to terminate the inmate calls and shall install whatever equipment is necessary to screen and complete the inmate calls. PTC/TELINK shall also be responsible for the billing and collection of the completed calls and the distribution the proceeds from such calls in accordance with Paragraph 4 of this Agreement. All of the services described in this Paragraph 2 shall be at PTC/TELINK+s expense. 3. Service Agreement. (a) Installation. All work will be done in a safe, professional, workman-like manner by fully qualified and trained personnel. (b) LFgluipment The equipment, including standard and supplemental equipment, shall be completely assembled and adjusted and shall conform in durability, quality and workmanship to the standard in the industry. All equipment shall meet or exceed all federal and state of Texas safety, health, lighting and noise regulation in effect and applicable at.the time of manufacture. PTC/TELINK hereby warrants the equipment is fit for the purpose for which it is being installed and that it will perform and function in the manner set forth in PTC/TELINK's Response to Proposal 94-753. The number of telephones required pursuant to this Agreement are set forth in the Proposal 94-753 and any additional telephones required will be determined by the mutual consent and agreement of the parties hereto. PTC/TELINK shall provide all equipment required for the performance of this Agreement as set forth on Exhibit "C" attached hereto and made a part hereof for all purposes. Such equipment shall remain the property of PTC/TELINK and shall be installed at no cost to the County. All damage, destruction and risk of loss to such equipment during the term hereof shall be born by PTC/TELINK (c) Maintenance, PTC/TELINK will respond to a maintenance or repair request from the Customer within two (2) hours and will dispatch PTC/TELINK personnel for repair within twenty-four (24) hours for minor outages and within four (4) hours for major outages. A minor outage is defined as the inability to originate calls from less than twenty-five percent (25%) of the, phones at each Location served by PTC/TELINK. A major outage is defined as the inability to originate calls from more than twenty-five percent (25%) of the phones at each Location served by PTC/TELINK. (d) Training. Training: PTC/TELINK shall conduct ongoing training of Customees employees, to Customer's satisfaction in its sole judgment, in the proper maintenance, operation and the onsite • . PTC/TELINK shall install at its own cost and as soon thereafter as available any and all upgrades to the System. f 4. Distribution of Collected Proceeds by PTC LINK 4 PTC/TELINK agrees to provide for the Customer distribution of revenues actually billed and collected as follows: A. 42.5 percent of Flat rate collect calls gross revenue B. 42.5 percent of gross revenue on long distance collect calls Distribution will be made thirty (30) days following the end of the month in which the call giving rise to the revenue is generated. Distributions shall be in the form of a check which shall specify the period covered by the check and shall be accompanied by a hard copy of the Commission report as specified in Proposal 94-753 and PTC/TELINK's Response thereto. All distribution of revenue will be final and binding on the Customer unless written objection thereto is provided to PTC/'TELINK within sixty (60) days of Customer's receipt of distribution. 5. Term. (a) Subject to the provisions of (b) and (c) below, the term of this Agreement shall be for a period of one (1) year and shall renew automatically for two (2) additional one (1) year periods unless either parry terminates this Agreement as herein specified. (b) PTC/TELINK shall be entitled to cancel this Agreement on thirty i (30) days written notice to the Customer in the event that a significant I number of calls prove to be unbillable or if the Customer's management of the facility makes this Agreement economically unprofitable for PTC/TELINK Upon such notice, Customer shall have thirty (30) days to cure those reasons for termination within its control. (c) The Customer may cancel this Contract for consistently unsatisfactory service, as determined in the Customer's sole discretion and/or upon failure to remit distributions of proceeds as provided in Paragraph 4 above, upon thirty (30) days written notice to PTC/TELINK setting forth the Customer's complaints. PTC/TELINK shall have thirty (30) days to cure such objection. The Customer shall be obligated- to give PTC/TELINK only two-30 day cure periods during the term of this Contract after which time the Customer may terminate this Agreement upon thirty (30) days written notice. ~ VO AC E_5 r I s • 1 • I I • • 1 \ 1 .I ~ 1 6. Indemnification. BOTH PARTIES AGREE TO CONDUCT THEIR ACTIVITIES SO AS NOT TO ENDANGER ANY PERSON OR PROPERTY, AND EACH PARTY SHALL HOLD THE OTHER, AND ITS OFFICERS, AGENTS AND EMPLOYEES HARMLESS FROM ANY AND ALL CLAIMS FOR LOSS, INJURY OR DAMAGE TO PERSONS OR PROPERTY CAUSED BY ITS GROSS NEGLIGENCE OR WILLFUL MISCONDUCT AND ARISING IN CONNECTION WITH THE TELEPHONES PERMITTED TO BE INSTALLED HEREUNDER. 7. Access. The Customer agrees to provide PTC/TELINK reasonable access to the premises and the telephone facilities as required by PTC/TELINK to perform the services outlined in this agreement. 8. Notices. Any and all notices given hereunder shall be deemed properly given if in writing and either hand delivered or sent by registered or certified United States mail, postage prepaid, return receipt requested, to a party at its address set forth above or at such other address as a party may hereafter specify by written notice to the other. 9. Assignment. This Agreement may be assigned by PTC/TELINK to any Parent or Affiliate of PTC/TELINK upon written consent of the Customer. 10. Successors., This Agreement shall be binding upon and inure to the benefit of the parties hereto and their permitted successors and assigns. 11. Governing Law. This Agreement shall be governed by and interpreted in accordance with the laws of the State of Texas. Jurisdiction-and venue for any matter arising out of the Agreement shall be Brazos County, Texas. 12. Entire Agreement. This Agreement, Brazos County, Texas Proposal No. 94-753 and PTC/PTC/TEL1NK's response to Proposal 94-753 represents the entire agreement between the parties and supersedes any and all representation or agreement, both oral or written, not therein reflected. 13. Priority of Agreements. If any conflicts or inconsistencies shall.arise among the terms of this Agreement, Proposal 94-753 and PTC/TELINK's response to such Proposal, the terms of this Agreement shall control, then the terms of Proposal 94-753 and then the Response. SCOPE Proposals are solicited from qualified vendors on an Automated Telephone System for the County Maximum Security Jail, Minimum Security Jail and Juvenile Detention Facility. The term of contract shall be three years, commencing on the date of award and renewable annually for the following two years. B. TERMS AND CONDITIONS The following instructions apply to all proposals and become a part of terms and conditions of any proposal submitted to the Brazos County Auditor, unless otherwise specified elsewhere in this request for proposal. All vendors are required to be informed of these Terms and Conditions, and those on the reverse side of this page and will be held responsible for having done so: 1. CONTRACT - An agreement between the County and a Supplier to furnish supplies and/or services over a designated period of time during which repeated purchases are made of the commodity specified. d. CONTRACTOR - The successful Vendor(s) of this request for proposal. e. COUNTY - Same as Brazos County. f. SUB-CONTRACTOR - Any contractor hired by the Contractor or Supplier to furnish materials and services specified in this proposal request. g. SUPPLIER - Same as Contractor. 2. Upon acceptance and approval by the Commissioners' Court, this proposal effects a working contract between Brazos County and the successful vendor for the period designated. Proposals must be received by the Auditor's Office prior to the time and date specified. The mere fact that the proposal was dispatched will not be considered; the vendor must insure that the proposal is actually delivered. 4. The County reserves the right to accept or reject in part or in whole, any proposal submitted, and to waive any technicalities for the best interest of the County. 5. Brazos County reserves the right to reject any proposal that does not fully respond to each specified item. 6. Brazos County shall not be responsible for any verbal communication between any employee of the County and any potential vendor. Only written specifications and written price quotations will be considered. 7. Vendor must include Employer Identification Number or Social Security Number for the proposal to be valid. 8. Should there be a change in ownership or management, the contract shall be canceled unless a mutual agreement is reached with the new owner or manager to continue the contract with itf present provisions and prices. This contract is nontransferable by either party. 9. The County may cancel this contract at any time for any reason of consistently unsatisfactory service provided a thirty day written notice is given. 10. The unit(s) shall be completely , assembled, adjusted, and all equipment including standard and supplemental equipment be installed and the unit made ready for continuous operation. All such equipment shall be provided by the successful vendor at no expense to the County. 4. All parts not specifically mentioned which are necessary for the unit to be complete and ready for operation or which are normally furnished as standard equipment shall be furnished by the successful vendor. All parts shall conform in strength, quality, and workmanship to the accepted standards of the industry. 5. The unit(s) provided shall meet or exceed all Federal and State of Texas safety, health, lighting, and noise regulations and standard in effect and applicable to equipment furnished at the time of manufacture. 6. Proposals shall be opened so as to avoid disclosure of contents to competing offerors and kept secret during the process of negotiation. All proposals that have been submitted shall be open for public inspection after the contract is awarded, except for trade secrets and confidential information contained in the proposals and identified as such. The number of phones required by Brazos County shall meet or exceed the current statistics. Brazos County is in the process of building an off-site 50 bed Juvenile Detention Facility. This facility'shall be completed within the next three years and will require special programming requirements that allow juveniles access only to certain phone numbers. Please specify how this will be best accomplished. 4. The successful vendor, at its expense, will arrange and be responsible for coordinating with the present servicing vendor, Jail Administrator, Building and Maintenance personnel, and local and long distance carriers on the transfer of services. Specify the amount of time necessary to transfer services including any down time that may be required. 5. The automated telephone system by Brazos County will be used by incarcerated inmates for non-cash collect calls only. Brazos County desires to have the following minimum features: a. Equipment shall be able to fully procest calls in at least both English and Spanish languages. C. The system must be programmable to block specific numbers so that calls cannot be made to them twenty-four (24) hours a day, seven (7) days a week. Also all 900 and 800 numbers must be able to be blocked. d. The system must have the ability to limit and/or shut off completely, some or all, equipment from being operational at any time. e. The system must allow free calls to the local Crime Stoppers phone number. f. The system proposed must not allow any incoming calls. Also, the system must not allow any credit card and/or third party billing calls. g. The system must have the ability to limit the call duration, specified by Brazos County, to any length of time. h. System must allow unlimited call blocking, before or during an established call. Brazos county must be able to shut off individual, group or all phones either manually or automatically. z.; 6. Specify how the proposed system prevents fraudulent calls. At a minimum, it should refuse or disallow chain dialling, switch-hook manipulation, multiple calls, or 3-way calling (accepted by called party, calling party must hang up and obtain dial tone before establishing another connection). 7. Specify positive acceptance features proposed. The automated telephone system must provide a guaranteed positive acceptance by the called party before the call will be connected. All calls connected will be by voice recognition with a "Yes" or "Si" response. 8. Specify how maintenance and emergency situations will be handled. Personnel must be on-call twenty-four (24) hours a day, seven (7) days a week. The successful vendor shall have certified and trained service personnel to respond to any maintenance call. Subcontracting service calls is not acceptable to Brazos County. Specify response time for emergency and non-emergency situations. 9. The successful vendor shall provide training for Brazos county personnel on the use and operations of all equipment. Daily, the call records are backed up within the system and downloaded by our call retrieval group. Once down loaded, an additional backup copy of the record is made and stored in a 30 day rolling file. This backup/retrieval process Insures that call records are not overwritten or destroyed. At the end of the month, a customized Jail Summary Report Is prepared on disk or paper printout of all activity for the month and Is forwarded to the facility with the commission analysis. Various reports are available listing all calls placed during the month by date, by station, and by frequency of call (Jail Summary Report). Since these reports are prepared by PTC Correctional staff members, no administrative burden Is placed on the Jail personnel. Other reports are available to track and audit the system operation. Call blocking of all 800, and 900 series of numbers is hardcoded Into the software and prevents access to any of these numbers. Numbers can also be blocked individually or in groups of ranges. The capacity of this feature is unlimited and we have locations at present with more than 50,000 Individual numbers blocked In addition to ranges covering some 100,000 numbers. PTC Correctional blocks on a 10 digit basis which covers both local and long distance numbers. The Inmate is advised that he has dialed a "RESTRICTED" number and requested to hang up. Re-order tone Is then applied and the call Is disconnected from the system. Each inmate telephone may be programmed for "PIN" or NON='PIN" operation. This allows the County to utilize the "PIN" operation In short or long term areas while allowing all calls In overnight , work release or trustee areas. The host processor has no limit or restrictions on the distribution of "PIN" or NON "PIN" Inmate telephone operations at the facility. A single Inmate's "PIN" or any number of Inmates "PINS" may be turned "off" for a specified period of time at the on-site administrative terminal or from an . authorized remote terminal. This feature is frequently used for punitive reasons and allows the facility to deny telephone privileges to one or more Inmates without affecting other Inmates sharing the same inmate telephones. The length of time of time for "PIN" DENIAL Is input and automatically policed, enforced, and released by the host processor. VO AGE, i The host processor Is capable of setting a maximum time limit for any type of N call and/or all calls related to an Individual "PIN" and/or all "PINS". A maximum I time limit for local calls may be set for 15 minutes while long distance calls are set for 10 minutes. Many restrictions may be tagged to any "PIN" or telephone J number associated with a "PIN". Examples of restrictions are: 1. Time of Day and/or days or week that number may be called 2. Maximum duration of call for that number and/or "PIN" 3. Maximum number of calls to that number or from that "PIN" per day weeklmonth, etc. 4. The successful vendor, at its expense, will arrange and be responsible for coordinating with the present servicing vendor, Jail Administrator, Building and Maintenance personnel, and local and long distance carriers on the transfer of services. Specify the amount of time necessary to transfer services including any down time that may be required. PTC RESPONSE: Brazos County will not experience down time for the transfer of services if Peoples Telephone Company, Inc. Is selected to continue providing Inmate telephone service. 5. The automated telephone system by Brazos County will be used by incarcerated Inmates for non-cash collect calls only.. Brazos county desires to have the following r minimum features: a. Equipment shall be non-operator personnel assisted. PTC RESPONSE: PTC Correctional will continue to provide Brazos County with a complete turn-key Inmate telephone system. PTC automated Inmate telephone service allows collect only local and collect only long distance calls. The system Is totally automated and does not utilize a live operator. 'r b. Equipment shall be able to fully process calls in at least both English and Spanish languages. r t PTC RESPONSE: The proposed ACCS 2000 Inmate calling system Is multi-lingual. Multiple languages are available. The system is currently providing English and Spanish. ' -High speed, low compression voice' digitation Is resident In each ACCS i 2000 system. The system must be programmable to block specific numbers so that calls cannot be made to them twenty-four (24) hours a day, seven (7) days a week. Also all 900 and 800 numbers must be able to be blocked. PTC RESPONSE: Call blocking of all 800, and 900 series of numbers is hardcoded into the software and prevents access to any of these numbers. Numbers can also be blocked individually or in groups of ranges. The capacity of this feature is unlimited and we have locations at present with more than 50,000 Individual numbers blocked In addition to ranges covering some 100,000 numbers. PTC Correctional blocks on a 10 digit basis which will cover both local and long distance numbers. The Inmate is advised that he has dialed a "RESTRICTED" number and requested to hang up. Re-order tone Is then applied and the call-is disconnected from the system. • .-yam, d. The system must have the ability to limit and/or shut off completely, some or all, equipment from being operational at any time. Hours of operation by Individual telephone, groups of telephones or by facility will be as directed by the correctional staff. Manual: Telephone service can be shutdown manually. The ACCS 2000 system has a manual override which Is operated through a manual cut-off switch to cut-off calls by Individual telephone, groups of telephones or facility wide. Location of Cut-Off Switches: Manual cut-off switcheS will be located in the desired locations at each facility and will meet all requirements of Brazos County. e. The system must allow free calls to the local Crime Stoppers phone number. PTC RESPONSE: Read and Agreed. Brazos County will continue to be provided with the ability to allow free calls to designated numbers. VO AGE / r 7. 1• f. The system proposed must not allow any incoming calls. Also, the system must o allow any wit card and/or third party billing calls. eTC RESPONSE: Only outgoing calls are permitted to be placed through the existing ACCS 2000. Incoming calls are prevented. r~ g. The system must have the ability to limit the call duration, specified by Brazos County, to any length of time. PTC RESPONSE: The length of all calls placed throughout the system t can be controlled automatically by setting the individual call time limit 6 parameter. This parameter Is variable between S and 120 minutes as desired by the facility. Changes to this limit may be done remotely, anytime, from our centralized service center. Presently, thirty seconds before the time limit expires, a tone is Injected on the line so that both the called and calling parties are aware that the conversation will shortly terminate automatically. If a tone notification is not acceptable, arrangements can be made to supply a voice announcement. h. System must allow unlimited call blocking, before or during an established call. At a minimum, it should refuse or disallow chain dialing, switch-hook manipulation, multiple calls, or 3-way calling (accepted by called party, calling party must hang up and obtain dial tone before establishing another connection). PTC RESPONSE: Peoples Telephone Company, Inc.'s proprietary system design of positive acceptance ensures that there will never be a charge for unanswered or unaccepted calls. In addition, to prevent chain dialing or access to unauthorized locations, the ACCS 2000 will immediately disconnect a call If any attempt to dial extra digits before or during a call is made. The ACCS 2000 has a voice overlay that can be played randomly;y throughout the call notifying the called party that the call is from an inmate. The proposed ACCS 2000 will be programmed to detect access to three-way calls at the called location although, no system can guarantee the elimation of all three-way calling attempts. However, although some companies may claim to prevent 3-way call attempts, these methods have never been proven to be 100% effective for the following reasons: There are two methods in use today to detect three-way calling. One method Is for the computer to "listen" for the audible noise or "click" generated when the switch hook Is depressed. The second method detects an Interruption In current flow known as a "Level 4 Loop Drop". While the ACCS 2000 will deny access and terminate three-way calling, NO method Is 100% guaranteed for the following reasons. The audible noise generated by the operation of the switch hook Is the same noise generated for other network noises which can fluctuate considerably. Other similar network noises are those generated for call waiting, call hold, transfer through a PBX, or line static, line interference, or background noise. There are devices which have been used by inmate in correctional institutions to bypass these methodologies. These include, for example, two line phones where no audible noise can be detected when the switch hook is depressed and bridging devices, readily available at electronic supply stores, which connect two telephone lines together with the same effect as two line phones. With customer premises equipment, such as the PTC Correctional ACCS, the sensitivity of the system Is site adjustable. If the sensitivity of the system Is adjusted too high, not only will three-way calls be terminated, but so will legitimate calls placed through the system, driving up costs to inmate's families. In addition, Inmate calls to attorneys will be terminated when the call goes through a PBX and the secretary places the call on hold, and transfers it to the attorney. An inmate's call to his/her family will be terminated if, during the course of their conversation, a call waiting signal notifies the called party that a call is waiting. VO AGE.. J Aft. ' V If the sensitivity of the system Is adjusted too low, no throo-ray calls or call forwarded calls will be detected and, therefore, none will be terminated. i The goal of the system is to adjust the sensitivity to the point where call detail reports Indicate that attempts at three-way calling or call forwarding are being detected and terminated. Ai For these reasons, blocking capabilities of three-way calls Is not an effective tool for eliminating telephone fraud, illegal Inmate behavior or harassment. These methodologies, however, coupled with other features such as, voice overlay, recording and monitoring of inmate calls, on-line call validation, use of an ' automated operator, on-tine monitoring of calls and call detail reports will 'I effectively eliminate inmate telephone fraud. V 7. Specify positive acceptance features proposed. The automated telephone system must provide a guaranteed positive acceptance by the called party before the call will be connected. All calls connected will be by voice recognition with a "Yes" or "Si" response. n PTC RESPONSE. PTC Correctional's Collect Calling System (ACCS), processes, all calls without the Intervention of any Operators. This type of call processing was developed to provide the maximum protection against fraud, ease of telephone use, and minimum maintenance requirements. Many automated } systems do not require a positive response from the called party to accept the call, but the ACCS requires that a "2" be pushed on tone type phones, or through a special "voice recognition" circuit, the word "YES" be stated at the appropriate time for the call to be completed. If the correct ACCEPT response is not recognized by the system, the call is terminated. If the called party does not x wish to accept the call, all he/she has to do Is push the digit "8" or hang up the receiver. Disconnection Is Immediate and the call is terminated. This type of automation, using voice recognition, virtually eliminates the chance for Incorrect billing and fraud. 8. Specify how maintenance and emergency situations will be handled. Personnel must be on-call twenty-four (24) hours a day, seven (7) days a week. The successful vendor shall have certified and trained service personnel to respond to any maintenance call. Subcontracting service calls is not acceptable to Brazos County. Specify response time for emergency and non-emergency situations. • PTC RESPONSE: PTC personnel will continue to be on-call twenty-four (24) 8 hours a day, seven (7) days a week. (name of road) in Brazos County, Texas as follows: The location or description of the proposed installation is more fully shown by 3 copies of the drawings attached to this notice. I understand and agree that: 1. The County Engineer must be notified 72 hours prior to the beginning of construction in order that he or his designated inspector may inspect the actual installation. 2. That all damage to the roadways and rights-of-way will be repaired to their original condition to the satisfaction of the County Engineer. 3. That Brazos County reserves the right to require Applicant to relocate or lower any such line at no cost to Brazos County, should same become necessary due to widening or lowering, or other alteration of the roadway or right-or-way. 4. That Brazos County will in no way be responsible for any damage which might occur to any existing utility lines in the right-of- way. 5. That the line will be constructed and maintained on the county right-of-way in accordance with governing laws. 6. That the line or lines will be constructed no less than twenty- four inches (2411) lower than the lowest part of the drainage or bar ditch and the drainage is to be considered at least two feet (21) below the center of the roadway. 7. That all sites will be barricaded during the construction period.
