THE COMMISSIONERS' COURT WILL MEET IN SPECIAL SESSION ON DECEMBER 5,

SPECIAL MEETING
DECEMBER 5, 1994
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, December 5, 1994, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct'1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3s
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The following citizens and officials were in attendance:

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The first item for consideration was a Commercial charge
Account with Sam's Club. The County Judge appointed
Commissioners Norton and Sims, the County Auditor and the
Purchasing Agent as an ad hoc committee to consider the
information and make a recommendation to the Court.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held November 1, 1994, November
7, 1994 and November 14, 1994. On motion by Commissioner
Sims, seconded by Commissioner Wilcox, the Court voted
unanimously to approve the minutes as submitted.
The Court next considered Budget Amendment #94/95-08,
which would reallocate funds budgeted for the Sheriff's office
and the 272nd District Court. On motion by Commissioner
Wilcox, seconded by Commissioner Sims, the Court voted

unanimously to approve the budget amendment as submitted, a
copy of which is attached hereto.
The Court next considered approval of the City-County
Public Health Agreement for fiscal year October 1, 1994
through September 30, 1995. This agreement is entered into by
the City of Bryan, City of College Station and Brazos County
to administer the Brazos County Health Department. The
purpose of the Health Department is administering and
enforcing all federal and state health laws and city health
ordinances in the respective jurisdictions of each of the
participating governmental entities. Brazos County agrees to
pay $129,141.00 and give $238,170.00 in-kind services. This
represents 28% of the total budget. On motion by the County
Judge, seconded by Commissioner Sims, the Court voted
unanimously to enter into agreement with the Cities of Bryan
and College Station for the administration of the Brazos
County Health Department. The Court also authorized the
County Judge to execute the Agreement on behalf of Brazos
County. A copy of the Agreement is attached hereto.
On motion by the County Judge, seconded by Commissioner
Turner, the Court voted unanimously to approve a Petition for
Extension of Records Control Schedule Filing Deadline,
submitted pursuant to §203.041 (c), Local Government Code, to
extend the deadline from January 1, 1995 to January 1, 1996.
This will be transmitted to the Texas State Library, State and
Local Records Division, prior to December 16, 1994.
The next matter for consideration was approval to
advertise for bids for furniture and uniform rentals. On
motion by Commissioner Turner, seconded by Commissioner Sims,
the Court voted unanimously to authorize the Purchasing Agent
to advertise for bids for furniture. On motion by
Commissioner Norton, seconded by Commissioner Sims, the Court
voted unanimously to authorize the Purchasing Agent to
advertise for bids for uniforms.
The Court next considered entering into contract with

Garrett Engineering to survey property for the Minimum
Security Jail and Juvenile Justice Center. Garrett
Engineering did the original survey on the property prior to
the construction of the minimum security jail. On motion by
Commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to enter into contract with Garrett
Engineering to survey the property for the Minimum Security
Jail and the Juvenile Justice Center and that the contract
amount not to exceed $1,300.00.
The next matter before the Court was consideration of
authorization of a payment to the City of College station for
completion of the Graham Road reconstruction. Commissioner
Norton briefed the Court about the section of Graham Road that
had yet to be reconstructed. The County was in the midst of
reconstructing the road when the City of College Station
annexed it and asked the County to delay any improvements
because the city was considering putting in curbs and gutters.
Since the funds were already set aside for the work,
Commissioner Norton asked that the money be transferred to the
City of College Station in order to complete the
reconstruction without further delay. The County Judge stated
that he wanted the funds to be restricted to Graham Road.
Commissioner Norton told the Judge that the City of College
Station in their letter of acceptance, stated that the funds
"would be for the City to utilize for improvements to Graham
Road." On motion by Commissibner Norton, seconded by
Commissioner Sims, the Court voted unanimously to authorize
the payment of $71,380.00 to the City of College Station for
improvements to Graham Road.
The Court next considered acceptance of a Warranty Deed
for the purchase of a 0.1477 acre tract of land located in
Precinct 4. On motion by Commissioner Turner, seconded by
Commissioner Norton, the Court voted unanimously to authorize
the County Judge to accept on behalf of Brazos County the
Warranty Deed from, James M. Allen for the purchase of a 0.1477

THAT WHEREAS, on December 5, 1994, the Court heard and
approved a budget amendment for the 1994-1995 budget year for

WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which, could- not be
reasonably included in the original budget adopted September 8,
1994 the following amendment(s) to the original are hereby

CITY-COUNTY PUBLIC HEALTH AGREEMENT
WHEREAS, the City of Bryan, the City of College Station and Brazos County, have created an
administrative agency named the Brazos County Health Department for the public purpose and objective of
administering and enforcing all federal and state health laws and city health ordinances in the respective
jurisdictions of each of the participating governmental entities; and
WHEREAS, Article 4413(32c), V.A.T.C.S., authorizes intergovern mental contracting at the local level
including contracts between counties and cities; and
WHEREAS, the City of Bryan, the City of College Station and Brazos County, subject to the limitations
set forth herein, intend to share in the cost on a percentage basis with the County to collect and disburse the
funds;
NOW, THEREFORE, THE UNDERSIGNED MUTUALLYAGREE AS FOLLOWS:

That the matters set forth in the preamble are true and correct and are made a part of this agreement.
2.
In consideration of the benefits to be received by the City of Bryan, the City of College Station, and Brazos
County, by reason of the joint venture, the parties herein agree to pay, and Brazos County agrees to collect
and disburse funds for the operation of the Brazos County Health Department, Fiscal Year October 1, 1994
- September 30, 1995, on the following pro rata basis:

T'his contract is for a period of one year and all payments shall be made from current revenues of each of
the parties. Payments shall be made by the City of College Station and the City of Bryan to Brazos County
at the Brazos County Courthouse prior to the tenth day of each month with each monthly share representing
one-twelfth (1/12) of the respective total share of the cities. If credit is due any of the parties, Brazos County
shall make the necessary reimbursement no later than the end of the first (1st) quarter of the next fiscal contract
year. Reimbursement due to overpayment shall be made in the amount overpaid by the entity. All
unencumbered funds at the close of the contract year shall be deposited into the Public Health Account (sec
Section S) to be designated for use for Public Health Services mutually beneficial to each party, or shall be used
to reduce local budget contributions in the following fiscal year. No appropriation of the money in this
Agreement shall be made unless unanimously approved by the City of Bryan, the City of College Station and
Brazos County.
4.
The chairman of the governing board shall have the authority to make expenditures as budgeted. Authority
for non-budgeted items shall come only from the approval of the governing board (known as the Brazos County
Board of Health).
5.
The Brazos County Health Department shall maintain records of all income (service fees collected) and
disbursements of the Public Health Account. Such records shall be brought before the governing board each
quarter for approval. No appropriation of money in this account shall be made unless unanimously approved
by the governing board.
6.
The Brazos County Health Department shall maintain records of usage of the facilities and services by the
citizens of each city and citizens of the county who live outside the two cities. Such records shall be used to
determine the percentage of costs to be charged to the participating entities for the following contract year.
7.
The Brazos County Health Department will be under the supervision of the governing board consisting of
one representative from each of the three participating governmental entities.
8.
This contract can be renewed on an annual basis by resolution.
9.
The Director of the Brazos County Health Department shall submit financial and activity reports for both
Health Department and Public Health Accounts upon request by members of the governing board; but in no
event shall such financial and activity reports be submitted less frequently than quarterly. The Director shall
submit the annual financial and activity report no later than the close of the first quarter of the next fiscal year.

10.
Brazos County agrees to procure and maintain public liability insurance in the amount of not less that
$1,000,000.00, insuring against risks and claims wising out of the operation of the Health Department (except
for professional liability claims against medical doctors, who shall provide their own professional liability
insurance). The cost of liability insurance shall be included in the annual budget of the Brazos County Health
Department.
IN WITNESS WHEREOF, the parties hereto have caused this agreement to be executed as the 1st day of
October, 1994
