THE COMMISSIONERS' COURT WILL MEET IN REGULAR SESSION ON MONDAY,
NOVEMBER 14, 1994 AT 9:00 A.M. IN THE COMMISSIONERS' COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.

A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, November 14, 1994, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Absent;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3, Presiding;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The following citizens and officials were in attendance:

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court next considered Budget Amendment #94/95-06,
which would reallocate funds budgeted for Risk Management and
the Treasurer and transfer funds from Commissioners Court to
the Justice of the Peace Precinct 2. On motion by
Commissioner Wilcox, seconded by Commissioner Turner, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
The next item on the agenda was to canvas the results of
the General Election held November 8, 1994. On motion by
Commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to accept as true the county-wide totals as
arrived at by the automated tabulating equipment and ordered
the results be certified to the Secretary of State and
recorded in the Official Election Records of Brazos County.

Commissioner Turner, the Court voted unanimously to appoint
Judge Holmgreen to another two (2) year term on the Board of
Directors of the Brazos County Emergency Communications
District and to appoint Randy Sims to serve out the last year
of the unexpired term of Milton Turner who is resigning as of
November 14, 1994.
The Court next considered approval of the Final Plat of
Westminster Subdivision, Phase II, located in Precinct 1.
Richard Vance, County Engineer, stated that he had reviewed
the plat and it appeared to be in order and recommended
approval. Commissioner Wilcox asked the width of the roadway
on Barron Cutoff. Mr. Vance replied that no houses fronted
Barron Cutoff. Commissioner Wilcox implied that a variance
would be needed because the subdivision was adjacent to a
public right-of-way. Commissioner Norton said the area would
be incorporated by the City of College Station very soon.
Commissioner Norton moved to accept the Final Plat of
Westminster Subdivision, Phase II, grant a variance to the
Subdivision Regulations and to stipulate on the plat that
there will be no driveway access to Barron Cut-off Road from
any lot in this Subdivision. Commissioner Sims seconded the
motion. Commissioners Norton, Sims and Turner voted "Aye" and
Commissioner Wilcox voted "No". The motion carried.
The Court next considered approval of the Replat of Tabor
Ranchettes in Precinct 2. The purpose of this replat is three
fold, first to effect the division of lot 5-10.00 acres into
lot 5A being 3.50 acres & lot 5B being 6.5 acres; second to
correctly label with bearings and distances the two line
segments which form the southwest line of the subdivision, and
to assure that the parts equal the total; and third, to
correct dimensions errors on lots 6, 7 & 8. Richard Vance,

County Engineer, stated that he had reviewed the plat and it
appeared to be in order. On motion by Commissioner Wilcox,
seconded by Commissioner Sims, the Court unanimously approved
the final plat of the Tabor Ranchettes.

The Court next considered approval of the Preliminary

Plat of Boyce Subdivision, Block 1. Richard Vance, County
Engineer, stated that it was a twenty (20) acre subdivision
with no public roads in or adjacent to the site. He went on
to say that he had reviewed the plat and it appeared to be in
order. Commissioner Wilcox felt that roads should meet
Subdivision regulations. Commissioner Sims moved to accept
the Preliminary Plat. Commissioner Norton seconded the
motion. Commissioners Norton, Sims and Turner voted "Aye".
Commissioner Wilcox voted "No". The motion carried to approve
the preliminary plat of the Boyce Subdivision, Block 1.
The Court next considered authorizing work outside of
county rights-of-ways for the enhancement of county road
projects. The Road and Bridge Department requested permission
to enter the private property of David R. Price located off
Weedon Loop to clear brush to construct a drainage channel.
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to authorize the work.
The Court next considered the request by GTE Southwest to
place a road bore in the right-of-way of Steel Store Road
beginning at its intersection with Fazzino Road for a distance
of 2,500 feet in order to install cable. The site is in
Precinct 4. The County Engineer stated that all appeared to
be in order and recommended approval. On motion by
Commissioner Turner, seconded by Commissioner Norton, the
Court voted unanimously to approve the request of GTE
Southwest and authorized the installation. A copy of the
request is attached hereto.
The Court acknowledged receipt of the Extension Service
reports for October 1994 and acknowledged receipt of reports
from County and Precinct Offices showing revenues collected
and remitted to the County Treasurer. An excerpt from those
reports is attached hereto.

On this the 14th day of November 1994 at a special meeting of the
Commissioners' Court, the following members were present:
R. J. Holmgreen, County Judge, Presiding
Gary Norton, Commissioner, Precinct 1;
Walter Wilcox, Commissioner, Precinct 2;
Randy Sims, Commissioner, Precinct 3;
Milton Turner, Commissioner, Precinct 4;
Mary Ann Ward, County Clerk.
The following proceedings were held:
THAT WHEREAS, on November 14, 1994, the Court heard and
approved a budget amendment for the 1994-1995 budget year for
Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 8,
1994 the following amendment(s) to the original are hereby
authorized, as described on the attached 1 page(s).

location of our proposed buried cable line on County roads in
Brazos County at Steele Store, Texas.

COMPANY LINE INSTALLATION
October 27, 1994
TO THE COMMISSIONER'S COURT OF BRAZOS COUNTY
ATTENTION COUNTY JUDGE: Dick Holmgreen
Formal notice is hereby given that GTE will construct a
communication line within the right-of-way of a County Road
in Brazos County, Texas as follows:

We will bore/push under Steele Store Road, at the
intersection of Fazzino Road and Steele Store Road
then we will place a buried line along, parallel to
and 5' inside the Bast ROW of Steele Store Road a
f
distance of 2500' in a Southerly direction to Sims
Lane.
The location and description of this line and associated
appurtenances is more fully shown by two copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right-of-way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by GTE does
not constitute a waiver, surrender, abandonment or impairment
of any property rights, franchise, easement, license, authority,
permission, privilege or right now granted by law or may be
granted in the future and any provision or provisions so con-
strued shall be null and void.
Construction of this line will begin in November, 1994.
