COMMISSIONERS' COURT
SPECIAL MEETING
OCTOBER 3, 1994
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, October 3, 1994, with the following members of
the Court present:

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court first considered two (2) Budget Amendments.
Budget Amendment #93/94-34 would reallocate funds,budgeted for
the Constable Precinct 7, Precinct 7 Training Fund, Grants,
remove old grant from the general ledger records and transfer
funds from the Non Departmental Department to various
departments. Budget Amendment #94-95-01 would add a new grant
to the general ledger. On motion by Commissioner Wilcox,
seconded by Commissioner Turner, the Court voted unanimously
to approve the budget amendments as submitted and a copy of
each is attached hereto.
The next matter for consideration was the renewal of a
contract between the Retired Senior Volunteer Program.(RSVP)

and Brazos County. Brazos County will pay $2,500.00 to RSVP

Commissioners Court tweeting Octoer 3, 1994
and in exchange, RSVP will provide volunteers to help the
citizens of Brazos County. Term of the contract will be from
October 1, 1994 to September 30, 1995. On motion by
Commissioner Wilcox, seconded by Commissioner Norton, the
Court voted unanimously to approve the contract with the
Retired Senior Volunteer Program. A copy of which is
attached.
The next matter before the Court was establishing a date
for the Environmental Health Services Fees to begin. When the
Court approved the fees, no effective date was set.
Commissioner Sims recommended the fees go into effect November
1, 1994. Commissioner Wilcox pointed out that a sixty (60)
day notice would be preferable and that would be December
1,1994. On motion by Commissioner Wilcox, seconded by
Commissioner Norton, the Court voted unanimously to set
December 1, 1994 as the date the new Environmental Health
Services Fees go into effect.
The next matter before the Court was approval of a
Contractual Agreement between Brazos County and the Brazos
County Soil and Water Conservation District $450. The
District will provided soil and water conservation services to
the residents of Brazos County and to the County proper such
as erosion control, water management and rural development.
The cost to Brazos County will be $4,400.00 annually. The
term of the contract will be fiscal year 1995. On motion by
Commissioner Wilcox, seconded by Commissioner Turner, the
Court voted unanimously to enter into contractual agreement
with the Brazos County Soil and Water Conservation District
$450. A copy of the contractual agreement is attached hereto.
The Court next considered an order appointing James A.
Amis, Jr. to sit as Special Judge in County Court at Law I
from October 3 to October 7, 1994 to allow Judge Davis to
attend to a family emergency. On motion by Commissioner
Norton, seconded by Commissioner Sims, the Court voted
unanimously to approve the Order naming James A. Amis, Jr. as

Special Judge for County Court at Law I for the dates of
October 3 to Ocotber 7, 1994. A full copy of the order is
attached to and made a part of these minutes.
The Court next considered renewal of a lease agreement
between Brazos County and the Brazos Valley Art League for
rental of space within the Brazos Center located at 3232
Briarcrest Drive, in Bryan, Texas. Term of the lease is for
the period of one year commencing on October 1, 1994 and
ending on September 30, 1995. The Art League agrees to pay to
Brazos County the amount of fifty dollars ($50.00) per month.
On motion by Commissioner Turner, seconded by Commissioner
Norton, the Court voted unanimously to renew the lease
agreement between Brazos County and the Brazos Valley Art
League for the period stated above. A copy of the lease
agreement is attached.
The next matter before the Court was approval of a
Contractual Agreement between Brazos County and the Brazos
Maternal & Child Health Clinic, Inc.. The Clinic will provide
services to pregnant women who qualify for such items as
interviews, lab work, physical exams educational information
and medicine as needed. The cost to Brazos County will be
$60,000.00 annually. The term of the contract will commence
on October 1, 1994 and terminate on September 30, 1995. On
motion by Commissioner Norton, seconded by Commissioner
Turner, the Court voted unanimously to enter into contractual
agreement with the Brazos Maternal & Child health Clinic,
Inc.. A copy of the contractual agreement is attached hereto.
The next matter before the Court was approval of a
Contractual Agreement between Brazos County and Texas Voting
Systems, Inc.. Texas Voting Systems, Inc. will provide
supplies and services necessary to conduct the General
Election to. be held on November 8, 1994, in Brazos County,
Texas. The cost to Brazos County will be $19,620.00. On
motion by Commissioner Norton, seconded by Commissioner
Wilcox, the Court voted unanimously to enter into contractual

agreement with Texas Voting Systems, Inc. to conduct the
General Election to be held November 8, 1994. A copy of the
contractual agreement is attached hereto.
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to appoint the following

voting year at the following voting precincts and to approve

on motion by Commissioner Wilcox, seconded by
Commissioner Norton, the Court voted unanimously to adopt an
order relocating polling place locations for election precinct
12, election precinct 15 and election precinct 32 and to
forward the submission to the Assistant Attorney General, in
the Department of Justice in Washington D.C. requesting
preclearance of the order. A copy of the order is attached
hereto.
The Court next considered three requests from Aquila
Southwest Pipeline Corporation to place six (6) road bores in
the right-of-way of Old Highway 6 to install two (2) natural
gas pipe lines. The sites are located in Precinct 1.
Included with the requests are company checks $019209 in the
amount of $1,000.00, /019225 in the amount of $1,000 and
$019234 in the amount of $1,000.00. The County Engineer
stated that all appeared to be in order and recommended
approval. on motion by Commissioner Norton, seconded by
Commissioner Turner, the Court voted unanimously to approve
the requests of Aquila Southwest Pipeline Corporation and
authorized the installations. A copy of each request is
attached hereto.
The Court next considered the request by C. J.
Porterfield Utility Company to place a 4.0 inch sanitary sewer
line along the right-of-way of Higgs Drive to provide service
to a county resident. The location is in Precinct 4. The
County Engineer stated that all appeared to be in order and
recommended approval. On motion by Commissioner Turner,
seconded by Commissioner Norton, the Court voted unanimously
to approve the request of the C. J. Porterfield Utility
Company and authorized the installation. A copy of the
request is attached hereto.

Brazos County, Texas and the Retired Senior Volunteer Program, under the
sponsorship of the Brazos County Community Council and hereinafter referred to
as RSVP for the covenants and consideration herein expressed, mutually agree to
the following terms and conditionst

Brazos County, Texas agrees to pay the total sum of 500.00
to RSVP in a single payment on or before March 31, 1995. A All payments will be
payable to the Retired Senior Volunteer Program and mailed to their current
addresse 305 S. Main Suite 1001 Bryan, Texas 77803.
II.
RSVP agrees to provide the service of its program to the citizens of Brazos
County. There is not established any definite program of assignments; but, the
number of volunteers and assignments can be changed throughout the term of this
contract by agreement of all parties. RSVP does agree to address the mutual goals
of RSVP and Brazos County, Texas by assisting with senior volunteer recruitment
for:
A. The Brazos County Health Department.
B. The County Extension Aging committee.
C. The Brazos County Adult Probation Department.
D. The Brazos County Juvenile Probation Department.
E. The Civic Defense program. '
F. The Brazos County Tax Office-voter registration drive.
0. The District Attorney's Office Victim Assistance Program.
H. The County Commodity Distribution program.
1. The County Extension office.
J. Clerical support for county offices and programs.
The terms of this contract will be October It 1994 to September 30, 1995.
III.
Volunteer placements will be made as appropriate at volunteer workstations
throughout the community. All workstations will have a signed Memorandum of
Understanding on file with RSVP.
IV.
Any invention of literacy or artistic production arising out of an assignment
shall be the exclusive property of the volunteer Station and the Volunteer shall
have the right to produce additional copies and distribute to the general public.
Volunteer Station may consent to other uses by the Volunteer.
V.
Volunteers shall comply with all the rules and standards exercised by the
employees in the department to which she or he is assigned.

VI.
The County Judge or his delegate shall have the authority to represent Brazos
County and make whatever further agreements necessary to administer and
effectuate the terms and conditions set forth herein.
VII.
The Volunteers will not receive any pay from a Volunteer Station for their
services, they will not be considered an employee and this service will be ,
considered as voluntary contribution to the betterment of the community and the
public purpose of Brazos County.
VIII.
Since the Volunteer is not a party to this agreement, the Volunteer Station may .
require Volunteers who accept service to sign other instruments setting forth
other terms and conditions between the Volunteer Station to amend or rescind this
contract by mutual agreement.

Brazos County Soil and Mater Conservation District M 450, hereinafter
called the District, and Brazos County Commissioners Court,
hereinafter called the County, does hereby enter into a contractual
agreement for the District to provide soil and water conservation
services to the residents of Brazos County and to the County proper.
Those services will include, but not be limited to, erosion control,
water management, and rural development. This will be carried out by
planning and application through informal agreements with land users,
or, as required by Federal or State law. An information and
recognition program will be used to inform the public. Technical
assistance is utilized through a Memo of Understanding between the
District and the USDA- Soil Conservation Service.
Erosion control will keep the land productive for its various uses for
many generations. Sediment resulting from erosion clogs our local
streams reducing water carrying capacity and resulting in local
flooding. Excessive siltation ruins our local wetlands, and;
therefore, reduces a dwindling wildlife habitat. Silt from erosion
carries many pollutants directly into our local streams and rivers.
Conservation practices consists of erosion control structures, erosion
control ponds, gully shaping, diversions, vegetating old fields,
proper management of grazing resources.
Water management includes recommendations for proper irrigation, flood
control, and water quality. Irrigated crops account for 75% of all
water used. Proper irrigation saves that resource for tomorrows uses
including domestic consumption. Proper irrigation helps to keep
{ agriculture pollutants from entering underground water supplies.
Conservation practices include total evaluation of irrigation systems
and application procedures, precision land levelling, underground
pipelines. Water management includes floodplain management.
The District's role in Rural development in Brazos County is in
providing fire protection utilizing dry hydrants. Insurance rates
outside the city limits can be lowered a great deal, as well as
provide a reliable source of water to fight rural fires. Farm ponds
provide the water and we plan the dry hydrant system. The District is
evaluating the use of artificial wetlands to replace the septic tank
filter fields. The prospects are very promising, but, much work
j remains to be done before this technology can be implemented. Water
r quality in rural Brazos County will be greatly inhanced it this method
k can be used.

of the District in 1942. Many conservation problems affect not only
the individual landowner but the County itself.
The District contracts to Brazos County to provide the above services

T. A. In consideration therefore, Lessee agrees to pay the Lessor on the first day of
each calendar month during the term hereof, in advance, the sum of $50
representing the agreed monthly rental for use of such space as herein set forth.
B. In addition Lessee has permission to use Concourse and other space needed
which has been scheduled with the Brazos Center for three art shows per year.
Two shows, the Juried Art Show as well as the Nature in Art Show are to be the
responsibility of Lessee. At least one other show, the Youth Art Show, has
permission to use similar space scheduled with Brazos Center agreement if Lessee
has agreed to serve as prime consultants.
3. Lessee agrees to arrange and hang work of local artists on a continual basis In
Showcase 111. Artists works chosen to be spotlighted are the sole responsibility of
Lessee. At least six artists per year will be featured.
4. Lessor shall furnish all utilities, including gas, water and electricity.
5. Lessee will pay the regular User fees for space used by it, other than space
allocated to it under this agreement.
8. Lessor does not provide and will not provide furnishings, custodial care, or
maintenance of the space allocated to Lessee under this agreement.
7. Lessee shall take good care of the space allocated to k, reasonable wear and tear
only excepted, and shall surrender the premises at the termination of this
agreement.
8. Lessee agrees that no improvements to or alterations to the apace shall be made
without the consent of Lessor in writing.

8. Risk of loss of all property owned by Losses shall remain with Lessee, it being
understood that Lessor will maintain no Insurance on such property. Any insurance
desired by Lessee on Lessee's property shall be purchased by Lessee at its
expense.
10. Lessor shall not be liable to Lessee or the Lessee's employees for any damage to
person or property caused by the negligent act of Lessor. Its agent, servants,or
employees or due to the act of any other tenant In the building, or due to any
defect or want of repair In any part of the building of which the allocated space
forms a part.
11. Lessee agrees to hold Lessor harmless from any and all claims, damages, expenses,
including attorney's fees, growing out of or arising from any negligent act on the
part of Lessee, its agent, servants or employees.
12. No sign shall be placed at, on, or about the premises by Lessee except with the
approval of the Center Director in writing.

THIS CONTRACT IS ENTERED INTO BY AND BETWEEN BRAZOS COUNTY,
TEXAS, acting by and through its duty elected County Commissioners (hereinafter "County"), and
the BRAZOS MATERNAL. & CHILD HEALTH CLINIC, INC. (hereinafter "Provider"), located
in 1720 Barak Lane, Bryan, Texas 77802,
RECITALS:
WHEREAS, the medical care of the County's poor and indigent has become a growing
problem; and
WHEREAS, the County recognizes that good medical care of pregnant women results in ,
healthier babies and less costly medical expenses incurred for the child in the future by the parents
and the Community; and
WHEREAS, the Court is interested in promoting such care through the Provider,
NOW THEREFORE the parties above stated agree to the following terms and conditions
to provide such indigent health care.
TERM
This contract shall continue in force and effect for a term of twelve (12) months
commencing on the 1 st day of October, 1994 and terminating 30th day of September, 1995.
CANCELLATION
This contract may be canceled by any of the patties hereto upon sixty (60) days written
notice as provided herein.
SERVICES TO BE PERFORMED BY PROVIDER
Provider shall provide the following services through trained, salaried staff to pregnant
women who qualify for such services pursuant to the guidelines currently implemented for making
such determination: interviews, lab work, physical exams, educational information and medicine as
needed (herein "Services").
USE OF COUNTY FUNDS
Funds to be furnished to Provider as stated herein below shall be used to pay the partial
salary of the Director of Provider and the entire salary of the Billing Clerk as described in
Enclosure (1) attached hereto and made a part hereof for all purposes. The County and Provider
acknowledge that the Countys purpose in providing finxIs hereunder is to provide medical
assistance to qualified applicants and that the funding of salaries for the trained personnel of
Provider is designed,to accomplish that goal.

RESPONSMMXrIES OF PROVIDER
Provider will be responsible for providing the following Services pursuamt to this Contract:
1. All necessary application forms to potentially eligible individuals.
2. Obtaining and compiling information on each applicant for Providers
Services with regard to residency and financial qualifications.
3. Maintaining this ContracL
4. Providing of the Provider's Servicm
5. Maintaining data files on clients and the Services provided thereto.
6. Respond to all and any inquiries by the County regarding the Clinic and its
Services.
7. Assist the County with information needed for audit purposes.
8. Provide the County with quarterly financial statements.
9. Provide the. County with any and an certified audits of Provider and the
management letter prepared in connection therewith.

10. Provide financial statements evidencing how County funds are spent. Such
statements to be submitted to County one week prior to the funding dates
set forth herein above.
11. Provide the Court with statistics evidencing the number of Brazos County
residents using the Provider's Services and the percentage Brazos County
residents comprise of the total population using Provider's Services.
RESPONSIBILITY OF COUNTY
The County shall be responsible for the following duties and requirements:
1. Provide County funds for the payment of the consideration stated herein.
2. Conduct a review of the Provider's performance in providing the Services to
be provided hereunder in order to assess County's continued participation in
the funding of the Provider.

RECORD RETENTION
The Provider shall be responsible for record keeping on all Services provided to those
individuals using its services and all financial records of the Clinic. The Provider agrees to
maintain and make available for inspection by the County upon request consistent with personal
privacy and subject to the limitation of state law, any and all records the County determines, in its
sole discretion, to be necessary for the Court to justify its continued participation in supporting the
Provider with funding. Such records shall be retained for at least four (4) years from the date the
service was provided. These records shall be made available for inspection and audit by the
County, if it so desires.

DISCRUMNATION
The Provider shall not discriminate against any employee or applicant for employment
because of race, color, religion, sex, or national origin. The Provider shall take affirmative action
to ensure that applicants who are employed are treated during employment, without regard to their
race, color, religion, sex, or national origin Such action shall include, but not be limited to, the
following: employment, upgrading, demotion, or transfer, recruitment or recruitment advertising;
layoff or termination; rated of pay or other forms of compensation; and selection for training,
including apprenticeship. The Provider agrees to post in conspicuous places, available to
employees and applicants for employment, notim setting forth the provisions of this
nondiscrimination clause

INDEMNITY
The County and Provider state that to the best of their knowledge, no officer, agent or
• employee of the County who exercises any function or responsibility in connection with the
carrying out of this Contract or the Services to which it relates has personal interest direct or
indirect, in this Contract.
COUNTY INVOLVEMENT

The parties hereto agree to indemnify one another for and hold one another harmless from
and against all suits, claims, demands, liabilities or actions resulting or alleged to result from the
breach, violation or non-performance of the Services stated herein and for any damage to any
person resulting from any act or omission or negligence on the part of each party hereto.
INSURANCE
The parties hereto agree that the Provider shall be an independent contractor and not any
employee or agent of the County and that each shall maintain at its own expense, adequate liability
insurance to insure against damages and liabilities which may arise due to the duties and
obligations contracted for herein.
GOVERNING LAW
This Agreement shall be executed in and shall be governed by the laws of the State of
Taxes.

All notices required to be given hereunder shall be deemed to be duly given by deliveing
such notice or by mailing it, registered mail to the other party at the following addresses:

FURTHER ASSURANCES
Each party hereto agrees to perform any further acts and to execute and deliver any further
documents which may be necessary to carry out the provisions of this Agreement.
SEVERABILITY
In the event that any of the provisions or portions thereof, of this Agreement, are held to .
be unenforceable or invalid by any court of competent jurisdiction, the validity and enforceability
of the remaining provisions or portions thereof shall not be affected thereby.
ENTIRE AGREEMENT
This Agreement contains the entire understanding between the parties hereto concerning .
the subject matter contained herein. There are no representations, agreements, arrangements, or
understandings, oral or written, between or among the parties hereto, relating to the subject matter
of the Agreements, which are not fully expressed herein.
ASSIGNABILITY
Provider shall have the right to assign this Contract and any of its rights hereunder to a
wholly owned subsidiary or to a corporation with which it may be merged without prior written
consent of the County; otherwise, this Contract is not assignable by the Provider without the prior
written consent of the County.

TEXAS VOTING SYSTEMS, INC. will provide the following services:
(a) Assemble six hundred fifty (650) voting devices, and check each unit.
(b) Check each unit for proper ballot pages, label each unit by precinct, and
stack units by precinct for delivery by the Brazos County.
(c) Deliver the voting equipment to the five Early Voting locations and pick up
the equipment at the close of the early voting period.
(d) Provide complete ballot layout and design.
(e) Conduct one (1) class for election judges and clerks of election procedure.
(f) Conduct one (1) class for all central counting personnel if required.
(g) Assist with Absentee Voting as required.
(h) Prepare all supplies for use in the individual precincts.
(1) Assist In the preparation of the computer test deck and holding of the Official
Test of the vote count computer.

The COUNTY OF BRAZOS, State of Texas, will be responsible for, and hereby
assumes the following duties and obligations in regard to the GENERAL ELECTION
to be held on November 8, 1994.
(a) Payment of all Election Judges, Alternate Judges, and Clerks of Election,
to Include the central counting station.
(b) Furnish Texas Voting Systems, Inc. a complete list of all candidates and issues
for all races to be conducted in the above mentioned election.
(c) All reports, expense accounts, canvass of the election, conduct of the elec-
tion at the Individual polling places, and any other statutory requirements
as required by the Texas Election Code and/or the Federal Voting Rights
Act and not specifically covered above.
4.
The consideration to be paid by the COUNTY OF BRAZOS, to TEXAS VOTING
SYSTEMS, INC. for the services and supplies to be rendered by said corporation
in the GENERAL ELECTION to be held on November 8, 1994 is nineteen thousand

Terrace, Bryan, Texas; and
WHEREAS, the Bryan Independent School District has asked
the Commissioners Court to locate a different place in which to
conduct elections due to the over crowded condition of Sul Ross
Elementary School; and
WHEREAS, the polling place for Election Precinct 15 was
located in the Army National Guard Building, 1700 East 25th Street,
Bryan pending the reconstruction of Fannin Elementary School ; and
WHEREAS, the construction of the Fannin Elementary School
has been completed; and

WHEREAS, the Commissioner Court has been notified by the

Formal notice Is hereby given that (Applicant) Aquila southwest Pipeline Corporation
proposes to place a (type)2 natural gas
pipeline within the right-of-way (road) old Hwy 6
In Brazos County, Texas as follows:
The location or description of the proposed installation Is more fully shown by
copies of the drawings attached to this notice.
1. The County Engineer must be notified prior to the beginning of construction In ordor that ,
they might be on hand to designate the actual location of the Installation.
2. That all damage to the roadways and right-of-ways will be repaired to their original condition
i to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate or lower any such
line at no cost to Brazos County, should same become necessary due to widening or
lowering, or other alteration of the roadway or right-of-way.
4. That Brazos County Is In no way responsible for any damage that might occur to any
existing utility lines In the right-of-way.
5. That the line will be constructed and maintained on the County right-of-way in accordance
with governing laws.
8: That the line or lines will be constructed no less than forty-eight Inches (481 lower than the
lowest part of the drainage or bar ditch and the drainage Is to be considered at least two
feet (2) below the center of the roadway.
7. That all roads shall be bored and cased for such distance, from too of slope to toe of slope
and In no case shall an open pit be allowed within lour feet of the shoulder of the road.
8. That all sites will be barricaded during the construction period.
9. That the normal charge Is $500.00 per crossing and/or $40.00 per rod when paralleling the
roadway established by the Commissioners' Court on January 28, 1985.
10. Ditch line shall be compacted to 90% standard density ASTM-Test method No. D-898; test
shall be conducted by an Independent Geotechnical testing firm; copies of all lest results
shall be furnished to the office of the Brazos County Engineer.
11. Construction shall be In strict confcrmance to the latest Texas Manual on Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construction.
Construction of this line will begin on or after (date) September 26, 1994

of construction in order that he or his designated inspector may
inspect the actual installation.
2. That all damage to the roadways and rights-of-way will be repaired
to their original condition to the satisfaction of the County
Engineer.
3. That Brazos County reserves the right to require Applicant to
relocate or lower any such line at no cost to Brazos County, should
same become necessary due to widening or lowering, or other
alteration of the roadway or right-of-way.
