SEPTEMBER 12, 1994
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, September 12, 1994, with the following members

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court first considered Budget Amendment #93/94-30,

which would reallocate funds budgeted for the District
Attorney's office and the transfer of funds from Non
Departmental to various departments to correct errors and
balance funds. On motion by the County Judge, seconded by
' Commissioner Sims, the Court voted unanimously to approve the
i
budget amendment as submitted, a copy of which is attached
hereto.
The Court next heard from Robert Gresham, representative
of the Brazos Valley Development Council, who addressed the
r Court on a matter of oil recycling containers. Mr. Gresham
informed the Court that the BVDC had received authorization to

allocate funds for the purchase of oil recycling containers.

These containers, he said, cost approximately $1,500 each and
ti r could be used at the citizen collection stations located in

the county. He also named several companies who would pick up
the oil. He went on to say that certain requirements are
attached to the purchase of the containers such as site
registration, an annual report to the commission and the

completion of an application form by the user. On motion by
Commissioner Turner, seconded by Commissioner Norton, the
Court voted unanimously to make application to the BVDC for
funds to purchase one or more oil recycling containers.
The County Judge announced a Public Hearing for Monday,
September 19, 1994, at 10:30 a.m. in Commissioners Courtroom
to consider the closing of an unnamed, untraveled portion of
Old Turkey Creek Road in Precinct 4.
The Court next considered awarding the following bids:

second supplier. Commissioner Turner
seconded the motion. The County Engineer
request a third source. Commissioners
Norton and Turner withdrew their original
motion and second and then Commissioner
Norton moved to award the bid to Young
Contractors as the first supplier,
Colorado Materials as the second supplier
and Gifford Hill as the third supplier.

On motion by commissioner Sims, seconded
by Commissioner Wilcox, the court voted
unanimously to award the contract to

Asphalt and Koch Materials as second and
third suppliers.

on motion by Commissioner Norton,
seconded by Commissioner Turner, the
Court voted unanimously to award the
contract to Caldwell Culvert and to name
Wilson Culverts and Metal Culverts, Inc.
as second and third suppliers. A copy of
the bid tabulation is attached hereto.
On motion by Commissioner Wilcox, seconded by
Commissioner Norton, the Court voted unanimously to accept
Easement Grants from the following landowners for the
expansion of Dilly Shaw Tap Road in Precinct 2 and authorized
the County Judge to sign the acceptance:

the purpose of expanding and improving Zweifel Road in
Precinct 2.

The Court next considered the request by Wellborn Water
Supply Corporation to relocate a water line along the right-
of-way of Royder Road for road improvements. The location is
in Precinct 1. Estimated cost to Brazos County is $5,281.25.
The County Engineer stated that all appeared to bo in order
and recommended approval. On motion by Commissioner Norton,
seconded by Commissioner Wilcox, the Court voted unanimously
to approve the request of Wellborn Water Supply Corporation
and authorized the installation. A copy of the request is
attached hereto.
The Court next considered the closing of two (2) railroad
crossings in Precinct 1. The Commissioners Court met in a
Public Hearing on August 29, 1994 to consider the closings
which were made at the request of the Rail Road and Highway
Department. The first location is an unnamed crossing located
approximately 0.3 mile southeast of the South Dowling Road and
FM 2154 intersection. The second crossing is an unnamed

location 1.1 miles southeast of the White Switch Road and Old
Highway 6 intersection. On motion by Commissioner Turner,
seconded by Commissioner Wilcox, the Court voted unanimously

to close the two (2) unnamed crossings in Precinct 1.
The Court next considered posting speed limit signs on
various county roads in Precinct 1 and Precinct 3. The
Commissioners Court met in a Public Hearing on August 29, 1994
to consider the speed limits. In Precinct 3, on Bird Pond
Road from Rock Prairie Road to the main channel of Carter
Creek, a 40 mph speed limit was recommended; from SH 30 to the
main channel of Carter Creek a 35 mph speed limit was
recommended and in Precinct 1, the Nantucket Subdivision, a 35
mph speed limit throughout the subdivision was recommended.
On motion by Commissioner Sims, seconded by Commissioner
Turner, the Court voted unanimously to set in Precinct 3, a 40
mph speed limit on Bird Pond Road from Rock Prairie Road to
the main channel of Carter Creek, a 35 mph speed limit from SH
30 to the main channel of Carter Creek and in Precinct 1, a 35
mph speed limit throughout the Nantucket subdivision.
The next matter before the Court was consideration of
various regulatory signs in the Nantucket Subdivision in
Precinct 1 and the Timberwilde Subdivision in Precinct 3. The
Commissioners Court met in a Public Hearing on August 15 and
29, 1994 to consider the regulatory signs. It was
recommended that two (2) "Stop" signs be placed on Harper's
Ferry Road at the Nantucket Drive intersection (stopping
Harper's Ferry Road northbound and southbound at that
intersection) and place a 30 mph speed limit throughout the
Nantucket Subdivision, a "Caution Children at Play" signs on
Timberwilde Drive at the entrance to the subdivision. On
motion by Commissioner Sims, seconded by commissioner Norton,
the Court voted unanimously to place two (2) "Stop" signs on
Harper's Ferry Road at the Nantucket Drive intersection

Brazos County and Leonard E. Morehead, Sr. for the purchase of
dirt for Grassbur Road in Precinct 3. Leonard E. Morehead,
Sr. agrees to sell to the Brazos County Road and Bridge
Department approximately 8,000 cubic yards of dirt at the
price of fifty cents ($.50) per cubic yard and to furnish
water as needed. If unable to furnish water, the price per
cubic yard of dirt will be forty five cents (;.45) per pubic
yard. In return the Road and Bridge Department will dig a
pond. On motion by Commissioner Sims, seconded by Commis-
sioner Norton, the Court voted unanimously to enter into
contract with Leonard E. Morehead, Sr. to purchase
approximately 8,000 cubic yards of dirt. A copy of the
agreement is attached hereto.
The Court next considered a request from GTE Southwest,
Inc. to place a road bore in the right-of-way of Barnes Road
to install a buried cable to provide service to the Mumford
Road Citizen's Collection Station site in Precinct 4. The
County Engineer stated all appeared to be in order. On motion
by Commissioner Turner, seconded by Commissioner Norton, the
Court voted unanimously to approve the request from GTE
j Southwest, Inc. and authorized the installation. A copy of

the request is attached hereto.
f The next matter for consideration was the acceptance of

the roads and drainage structures of Silver Hill Estates
located on the northeast side of Higgs Drive in Precinct 4 and

road and drainage structures of the C. J. Porterfield
subdivision also located in Precinct 4. On motion by
Commissioner Turner, seconded by Commissioner Sims, the Court
voted unanimously to accept the road and drainage structures
of Silver Hill Estates on the northeast side of Higgs Drive
(Lake Drive and Tia Maria Road) but to deny acceptance of the
} roads and drainage structures of the C. J. Porterfield

Subdivision which are not currently maintained by the county
because they do not meet Brazos County specifications.

The Court acknowledged receipt of the Extension Service
reports for August 1994 and acknowledged receipt of reports
from County and Precinct Offices showing revenues collected
and remitted to the County Treasurer. An excerpt from those
reports is attached hereto.
The Court proceeded to consider the change of status of

SOURCE OF FUNDS:
1. PRESENTATION: (a) No work will be POMItted between front slope and/or the back •
slope.
(b) The line shall be installed within 3.6 of and parallel to the right-
of -way line.
(c) If clearing of brush, trees and other obstruction Is necessary.
it shall be the Applicant's responsibility to do so and to remove all
cleared brush, trees etc. from County right-of-way.
(d) Ditch line shall be compacted to 90% standard density
ASTM•Test method No. D-698; test shall be conducted by an
Independent Geotechnical testing firm; copies of all test results
shall be furnished to the office of the Brazos County Engineer.
(e) Construction shall be In strict conformance to the latest Texas ,
Manual on Uniform Traffic Control Devices for Streets and
Highway , published by the Texas Department of Transportation,
and all other State and Federal laws governing utility construction.

ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE will construct a
communication line within the right-of-way of a County Road
in Brazos County, Texas as follows:
From intersection of OSR and Mumford Road South on
Mumford Road at Barnes Road will bore under Barnes
Road from GTE receptacle marked L-346 P.4, will
follow power lead to south four (4) spans to aerial
crossing at new garbage station.
The location and description of this line and associated
appurtenances is more fully shown by two copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right-of-way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by GTE does
not constitute a waiver, surrender, abandonment or impairment
of any property rights, franchise, easement, license, authority,
permission, privilege or right now granted by law or may be
granted in the future and any provision or provisions so con-
strued shall be null and void.
Construction of this line will begin on August 30, 1994.
