Consider and take action on payment of claims. 16. adjourn. 1 I 1 - t 0 COMMISSIONERS' COURT SPECIAL MEETING MARCH 29, 1993 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, March 29, 1993, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Andron City of Bryan Ed Ilschner City of Bryan Mike Conduff City of Bryan Lee Freeman City of Bryan Steve Beachy City of Bryan Paula Van Domelen Bluebonnet Girl Scout Council April Estrada Daisy Girl Scout Paula McCune Rape Crisis Center Commissioner Sims gave the invocation and led the pledge of allegiance. The first matter before the Court was the presentation of a plaque to Police Chief Charles Phelps upon his retirement from the Bryan Police Department. The County Judge praised i i i L P w c Commissioners' Court meeting March 29, 1993 Chief Phelps' accomplishments and told him his leadership would be missed. The County Judge read aloud a Proclamation designating Friday, April 2, 1993 as "Bluebonnet Girl Scout Council Women of Distinction Day ". The Court joins with the Bluebonnet Girl Scout Council, Inc. in honoring twenty -two women selected from throughout the Bluebonnet Council as outstanding role models for girls and women in their community. These role models illustrate to all girls and women the wide range of career options open to women today. The County Judge then presented the signed Proclamation to Ms Paula Van Domelen and Miss April Estrada, representatives of the Bluebonnet Council. The County Judge read aloud a Proclamation designating the month of April 1993 as "Sexual Assault Awareness Month ". The Court joins with the local Rape Crisis Center to promote sexual assault awareness and avoidance in the community and to promote public understanding of sexual violence and victims of sexual violence. The County Judge then presented the signed Proclamation to Ms Paula McCune, representing the local Rape Crisis Center. There were no budget amendments to consider. The next matter before the Court was a written request submitted by Constable Precinct 2, James Marrow. Constable Marrow stated that due to the increasing workload in his office he was requesting that he be allowed to appoint up to and including five (5) non -paid reserve deputies to assist in the responsibilities of his office. On motion by Commissioner Norton, seconded by Commissioner Wilcox, the Court voted unanimously to approve the request of Constable Marrow. The Court considered a second written request submitted by Constable Precinct 2, James Marrow in which he asked that Shawn S. Zweifel be authorized to serve as a non -paid reserve deputy for Precinct 2. On motion by Commissioner Norton, seconded by Commissioner Wilcox, the Court voted unanimously to approve the request of Constable Marrow and appoint Shawn Vol �I t' . i E E {F E t E� t �F •�1 e I • e Commissioners' Court meeting March 29, 1993 S. Zweifel as a non -paid reserve deputy for Precinct 2. The Court next considered adopting a Resolution authorizing application for a grant to support the Brazos County Victim Assistance Program that is administered by the District Attorney's office. Such grant to be in the total amount of $63,377.00; $28,816.00 to be funded by Federal Grant Funds, $34,561.00 to be a cash match by Brazos County. On motion by Commissioner Norton, seconded by Commissioner Turner, the Court voted unanimously to authorize the County Judge to make application on behalf of Brazos County to the Criminal Justice Division and accept on behalf of Brazos County such grant funds as may be tendered. A copy of the resolution is attached hereto. The next matter for consideration was approval to advertise for bids on Pager Purchases and Services - Bid No. 93 -684 and Cellular Phone Purchases and Service - Bid No. 93- 685. Cheryl Turney, Purchasing Agent stated that this is an attempt to standardize service. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to authorize the Purchasing Agent to advertise for bids on Pager and Cellular Phone Purchases and Services. The Court next considered two requests from Aquila Southwest Pipeline Corporation for two (2) road bores (spaced 8.0 feet apart) in the right -of -way of Bird Pond Road approximately 5,600.0 feet from its intersection with Rock Prairie Road to install two (2) natural gas lines. Included with the request is company check #016869 in the amount of $1,000. The site is in Precinct 1. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the request of Aquila Southwest Pipeline Corporation and authorized the installation. A copy of the request is attached hereto. 61 Commissioners' Court meeting March 29, 1993 The Court next considered the request from GTE Southwest to place a road bore in the right -of -way of Rustic Oaks Drive /Rustic Oaks Subdivision at its intersection with Shady Creek Drive for the purpose of installing a buried cable. The site is located in Precinct 3. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Sims, seconded by Commissioner Wilcox, the Court voted unanimously to approve the request of GTE Southwest and authorized the installation. A copy of the request is attached hereto. The Court next considered approval of the final plat of Evergreen Estates Subdivision. Holland Winder, County Engineer, stated that he had reviewed the plat and it appeared to be in order. On motion by Commissioner Wilcox, seconded by Commissioner Norton, the Court unanimously approved the final plat of the Evergreen Estates Subdivision subject to the receipt of a check in the amount of $4,000.00 to upgrade the road adjacent to the subdivision. The Court next considered authorizing work outside of county rights -of -ways for the enhancement of county road projects. The Road and Bridge Department submitted two (2) requests. The first for permission to enter the private property of John Habarta on KRC Lane to bury a dead horse. The second request was for permission to enter the private property of Randy Britten on Britten Road in order to clean out ditches. On motion by Commissioner Turner, seconded by Commissioner Sims, the Court voted unanimously to authorize the work. • a Commissioners' Court meeting March 29, 1993 The Court proceeded to consider the change of status of the following employees. The County Judge is authorized to make application on behalf of Brazos County to the Criminal Justice Division for grant funds to provide for the continuation of a Victim Assistance Program in Brazos County, Texas. • o- 4 2. Road: Bi rd Pond Road Precinct No.: Formal notice Is hereby given that (Applicant) Aquila Southwest Pipeline Corporation proposes to place a (type) 2 natural gas pipelines pipeline within the right -of -way (road) Bird Pond Road _ In Brazos County, Texas as follows: The location or description of the proposed installation is more fully shown by 3 copies of the drawings attached to this notice. 1. The County Engineer must be notified prior to the beginning of construction in order that they rnlaht he on hand to de agnate the actual location of the installation 2 That all damage to the roadways and right -of -ways will be repaired to their original condition to the satisfaction of the County Engineer. 3. That the normal charge Is 5500.00 per crossing and /or $40.00 per rod when paralleling the roadway established by the Commissioners' Court on January 28, 1985. 10. Ditch line shall be compacted to 90% standard density ASTM -Test method No. D -698; test shall be conducted by an independent Geotechnical testing firm; copies of all test results shall be furnished to the office of the Brazos County Engineer. 11. Construction shall be in strict conformance to the latest Texas Manual on Uniform Traflic Control Devices for Streets and Highways, published by the Texas Department of Transportation, and all other State and Federal laws governing utility construction.
