MARCH 15, 1993, AT 9:00 A.M. IN THE COMMISSIONERS' COURTROOM OF

MARCH 15, 1993

A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, March 15, 1993, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court first considered Budget Amendment #92/93 -11,
which would transfer funds budgeted for the Non - Departmental
Department to Data Processing, the Brazos Center, and
Environmental Protection. On motion by Commissioner Norton,
seconded by Commissioner Turner, the Court voted unanimously
to approve the budget amendment as submitted, a copy of which
is attached hereto.
The County Judge stated that it would not be necessary to
appoint a Special Judge for County Court at Law No. 1.
The Court next considered entering into an interim lease
agreement between Brazos County and Junior League of
Bryan /College Station for rental of office space in the Brazos

Center. This lease is in existence until May 31, 1993 at
which time an annual lease agreement shall apply. All terms
of a previous agreement signed August 4, 1994 shall apply for �.
the above stated time period except for an adjustment in
monthly rental fees from $225 to $425. The adjusted fee will
occur when occupancy of the new office space is taken. On
motion by Commissioner Wilcox, seconded by Commissioner Sims,
the Court voted unanimously to enter into an interim lease
agreement between Brazos County and Junior League of
Bryan /College Station. A copy of the lease agreement is -
attached.
The Court next considered adopting a Resolution
authorizing application for a grant to cover the costs of
implementing a computerized on -line update to the Departement
of Public Safety database. This will enable counties to meet
their obligations under the term "criminal justice information
system" (CJIS) as passed by the sixth called session of the
71st legislature and inserted in the list of definitions in
article 60.01, Code of Criminal Procedure to include both the
computerized criminal history system and the corrections
tracking system. On motion by Commissioner Norton, seconded
by Commissioner Sims, the Court voted unanimously to authorize
the County Judge to make application on behalf of Brazos
County to the Criminal Justice Division and accept on behalf
of Brazos County such grant funds as may be tendered. A copy
of the resolution is attached hereto.
On motion by Commissioner Wilcox, seconded by Commis-
sioner Sims, the Court voted unanimously to adopt a resolution
stating that the Commissioners' Court of Brazos County is
against having fourth degree felonies. If the legislation is
adopted, the fiscal and physical responsibility of housing
fourth degree felons should remain with the State of Texas.
A copy of the resolution will be forwarded to the Governor,
the Lieutenant Governor, Speaker of the Texas House of
Representatives, the State Senator, and the State

Representative.
The next matter for consideration was an application made
by William R. Turner, District Attorney, to buy into the Texas
County and District Retirement System for the number of years
he worked for the County but was not eligible to participate.
Mr. Turner is asking for service credit from November 9, 1983
to September of 1991. Submitted with the application is a
check in the amount of Four Thousand Four Hundred Fifteen
Dollars and Fifty Five Cents ($4,415.55). On motion by
Commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to forward the application of William R.
Turner to the Texas County and District Retirement System
along with his check for Four Thousand Four Hundred Fifteen
Dollars and Fifty Five Cents ($4,415.55).
The Court next considered awarding the following bid:
RFP No. 93 -674 - Computerized Optical Imaging System
Cheryl Turney, Purchasing Agent, recom-
mended acceptance of the bid submitted by
Government Records for the purchase of
the equipment. On motion by Commissioner
Norton, seconded by Commissioner Turner,
the Court voted unanimously to accept the
recommendation of the Purchasing Agent
and award the contract to Government
Records for the purchase of the equip-
ment. The other bidders were Lanier and
QIV Systems. A copy of the bid
tabulation is attached hereto.
The Court next considered awarding the following bids:

Cheryl Turney, Purchasing Agent,
recommended acceptance of the bid
submitted by Wickersham Ford of Orange,
Texas. On motion by Commissioner Sims,
seconded by Commissioner Norton, the
Court voted unanimously to accept the
recommendation of the Purchasing Agent
and award the contract to Wickersham
Ford.

Commissioner Sims, the Court voted unanimously to accept the
recommendation of the Purchasing Agent to reject all bids and
to advertise again for bids.
The Court next considered the request by Brushy Water
Supply Corporation for a road bore in the right -of -way of
Valley View Drive to install a water line. The site is in
Precinct 1. The County Engineer stated that all appeared to
be in order and recommended approval. On motion by
Commissioner Norton, seconded by Commissioner Sims, the Court
voted unanimously to approve the request of Brushy Water
Supply Corporation and authorized the installation. A copy of
the request is attached hereto.
It was the consensus of the Court to table consideration
of the final plat of the Evergreen Estates Subdivision until
the next meeting.
The Court next considered the request by Wickson Creek
Special Utility District to place a road bore in the right -of-
way of Dick Elliott Road for the installation of a 1 inch PVC
water line. The site is in Precinct 2. The County Engineer
stated that all appeared to be in order and recommended

approval. On motion by Commissioner Wilcox, seconded by
Commissioner Sims, the Court voted unanimously to approve the

request of Wickson Creek Special Utility District and
authorized the installation. A copy of the request is
attached hereto.
The Court next considered the request by GTE Southwest to
place a buried cable in the right -of -way of Sara Lane
beginning at the College Station city limits extending for
distance of 600 feet in a southeasterly direction. The site
is located in Precinct 3. The County Engineer stated that all
appeared to be in order and recommended approval. On motion
by Commissioner Sims, seconded by Commissioner Norton, the
Court voted unanimously to approve the request of GTE
Southwest and authorized the installation. A copy of the
request is attached hereto.
The Court next considered the request by Fairview Smetana
Water Supply Corporation to place a road bore in the right -of -

INTERIM LEASE AGREEMENT
This agreement, hereinafter called Interim Lease Agreement, is
between BRAZOS COUNTY, TEXAS, and JUNIOR LEAGUE OF BRYAN /COLLEGE
STATION. It is in existence until May 31, 1993 at which time an
annual lease agreement shall apply.
All terms of the lease agreement dated August 4, 1992 signed
by Sue Ellen Davis, Lessee and R. J. Holmgreen, Lessor dated August
10, 1992 shall apply for the above stated time period except for an
adjustment in monthly rental fees from $225 to $425. The adjusted
fee will occur when occupancy of the new office space is taken. The
new fee will be prorated based upon the actual number of days of
occupancy in the first month occupied. Thereafter, rental fees
will by the whole month.
IN TESTIMONY WHEREOF, the parties of this agreement have
hereunto set their hand in duplicate, the day and year written
below.

A RESOLUTION BY THE COMMISSIONERS' COURT OF BRAZOS COUNTY,
TEXAS AUTHORIZING THE SUBMISSION OF A GRANT REQUEST TO THE
GOVERNOR'S CRIMINAL JUSTICE DIVISION FOR FUNDING TO BRAZOS
COUNTY, TEXAS FOR A PROGRAM KNOWN AS THE "CRIMINAL HISTORY
ELECTRONIC REPORTING UNDER CHAPTER 60 GRANT ".
WHEREAS, THE COMMISSIONERS' COURT OF BRAZOS COUNTY, TEXAS, have the moral
obligation to the citizens and taxpayers of the Brazos County to ensure that the
criminal justice system operates in the most efficient and coordinated manner possible;
and
WHEREAS, the Commissioners' Court feels that the implementation of the Criminal
History Electronic Reporting under Chapter 60 Grant will materially enhance the
administration of justice in Brazos County, Texas; and,
WHEREAS, the opportunity exists to fund vital parts of this program through the
Office of the Governor of the State of Texas, Criminal Justice Division;
NOW, THEREFORE BE IT RESOLVED, by the Commissioners' Court of Brazos County,
Texas at its meeting on the 15th day of March, 1993 that:
1. The County Judge of Brazos County, acting on behalf of Brazos County be
authorized to make application to the Criminal Justice Division, Office of
the Governor, for grant funds resulting from the Criminal History
Electonic Reporting under Chapter 60 Grant.
2. The County Judge be authorized to accept such grant funds should they be
tendered; and
3. This resolution becomes effective upon its adoption.

The Legislature has allowed District Attorneys to buy into
the County retirement system for the number of years they worked
for the County but were ineligible. This program is identical
to the program afforded the District Judges and likewise requires
the approval of the Commissioners' Court. I am asking for
permission to buy my service from November 9, 1983 to September of 1991.
The total I would pay to the retirement system is $4,415.55 as
indicated by sly salary calculated by the treasurer's office. I
have attached that calculation for your information.

Please be advised that we have received Commissioners Court Order authorizing
participation in this System of Brazos County's Prosecuting Attorneys effective
January 1, 1993.
We are enclosing forms TCDRS -65 (County's Report of Months of Service and
Supplemental Compensation of Each District Official) which should be completed
and submitted to our office within ninety (90) days of the effective date of your
Order if William Reagan Turner desires to receive credit in this System for previous
service. Amounts submitted for the purchase of previous credit must be submitted
in a lump sum and cannot be treated as a reduction of compensation subject to
federal income tax (this treatment can only be accorded regular monthly
contributions required of a member after December 1985 and does not extend to
voluntary purchases of credited service). The required remittance (as calculated on
the enclosed form TCDRS -65) from Mr. Turner and the County, as well as a form
TCDRS -2 (Personal Data Form) should be submitted with the form TCDRS -65.
Also enclosed are forms TCDRS -E (Waiver of Membership) which need to be
completed and submitted to our office if any other Prosecuting Attorney you may
have elects not to participate in the Retirement System.
Prosecuting Attorneys who take office'in the future are to become members of the
System immediately upon the date they take office.
Please let us know if you have any questions in this regard.

SUBJECT: Recommendation for RFP No. 93 -674
Mary Ann Ward, M.J. Deen, and I evaluated and considered the three bids received for
the County Clerk's Computerized Optical Imaging System. After seeing a demonstration
from each of these vendors, we determined that Government Records would best suit our
current needs. We have contacted a number of County Clerk references throughout
Texas that highly recommend Government Records, therefore it appears they offer the
least risk to Brazos County.
The tabulation attached outlines Brazos County's options for Purchase, Lease /Purchase,
and Lease only. Leasing the equipment would be the most costly over a five year
analysis and is not recommended. We do recommend that Brazos County purchase this
equipment outright. The equipment furnished under this bid is of the latest technology
and should serve Brazos County well over the next five years.
This tabulation also reflects final figures after negotiations with Government Records.
They have provided our first year warranty free of charge with the purchase of their
equipment and have reduced their equipment paces by $1,333.00 (approximately 3%).
