COMMISSIONERS' COURT
SPECIAL MEETING
FEBRUARY 22, 1993
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 8:30
a.m. on Monday, February 22, 1993, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Absent;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2, Absent;
Randy Sims, Commissioner of Precinct 3, Presiding;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The following citizens and officials were in attendance:

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court next considered Budget Amendment #92/93 -09,
which would transfer funds budgeted from the Non Departmental
Department to Data Processing for the purchase of computer
software. On motion by Commissioner Turner, seconded by
Commissioner Norton, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.
The Court next considered entering into Agreement with
the Brazos Valley Art League for the rental of space in the
Brazos Center. Term of the lease shall be beginning October
1, 1992 and ending September 30, 1993. The Brazos Valley Art
League agrees to pay the sum of $50.00 per month for the use
of such space. On motion by Commissioner Norton, seconded by
Commissioner Turner, the Court voted unanimously to enter into
agreement with the Brazos Valley Art League for the rental of
space in the Brazos Center. A copy of the agreement is

attached hereto.
The Court next considered an Order appointing James A.
Amis, Jr. to sit as Special Judge in County Court at Law I
from March 8, 1993 through March 11, 1993 to allow Judge Davis
take 16 hours of continuing education classes. On motion by
Commissioner Turner, seconded by Commissioner Sims, the Court
voted unanimously to approve the Order naming James A. Amis,
Jr. as Special Judge for County Court at Law I for the dates
of March 8, 1993 through March 11, 1993. A full copy of the
Order is attached to and made a part of these minutes.
The Court next considered a one time reconsolidation of
various voting precincts in Brazos County. This action was
taken to facilitate voting for positions on the city council,
school board, and a U. S. Senate race. The election will be
held Saturday, May 1, 1993. On motion by Commissioner Turner,
seconded by Commissioner Norton, the Court voted unanimously
to adopt the attached Order combining certain voting precincts
and polling places.
The next matter for consideration was approval to
advertise for bids on Furniture - Bid No. 93 -683. On motion
by Commissioner Sims, seconded by Commissioner Norton, the
Court voted unanimously to authorize the Purchasing Agent to
advertise for bids on furniture.
The Court received, approved and ordered filed as
submitted the Treasurer's report for January 1993. A copy of
which is attached to and made a part of these minutes.
The Court proceeded to consider the change of status of
the following employees.

On motion by Commissioner Turner, seconded by Commis-
sioner Norton, the Court voted unanimously to approve the
Claims as submitted.
Commissioner Sims restated the reasons for consolidating
the voting precincts for the convenience of Richard Rosas who
came in late. Mr. Rosas stated he understood it would be for
this election only and posed no objection.
There being no further business to come before the Court,
the meeting was adjourned.

On this the 22nd day of February 1993 at a special meeting of the
Commissioners' Court, the following members were present:
R. J. Holmgreen, County Judge, Presiding
Gary Norton, Commissioner, Precinct 1;

The following proceedings were held:
THAT WHEREAS, on February 22, 1993, the Court heard and
approved a budget amendment for the 1992 -1993 budget year for
Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which •could not be
reasonably included in the original budget adopted September 28,
1992, the following amendment(s) to the original are hereby
authorized, as described on the attached 1 page(s).

STATE OF TEXAS
COUNTY OF BRAZOS
This agreement is made between BRAZOS COUNTY, TEXAS, hereinafter called Lessor, and BRAZOS
VALLEY ART LEAGUE, hereinafter called Lessee is as follows:
Lessor, the Owner of the Brazos Center, a multi -use building and the adjacent grounds has agreed and
does hereby agree, to lease and demise unto Lessee, a portion of the Brazos Center, hereinafter described,
upon the following terms and conditions.
1. Lessee shall be entitled to the space allocated to it by the Director of the Center
for a term beginning October 1, 1992 and ending September 30, 1993. The space
allocated to Lessee is described in Attachment 'A' hereto, which has been signed
by the Director of the Center.
2. A. In consideration therefore, Lessee agrees to pay the Lessor on the first day of
each calendar month during the term hereof, in advance, the sum of $50
representing the agreed monthly rental for use of such space as herein set forth.
B. In addition Lessee has permission to use Concourse and other space needed
which has been schedule with Brazos Center agreement for three art shows per
year. Two shows, the Juried Art Show as well as the Nature in Art Show are to
be the responsibility of Lessee. At least one other show, the youth art Show, has
permission to use similar space scheduled with Brazos Center agreement if Lessee
has agreed to serve as prime consultants.
3. Lessee agrees to arrange and hang work of local artists on a continual basis in
Showcase III. Artists ks chosen to be spotlighted are the sole responsibility of
Lessee. At least theartists per year will be featured.
4. Lessor shall furnish all utilities, including gas, water and electricity.
5. Lessee will pay the regular User fees for space used by it, other than space
allocated to it under this agreement.
6. Lessor does not provide and will not provide furnishings, custodial care, or
maintenance of the space allocated to Lessee under this agreement.
7. Lessee shall take good care of the space allocated to it, reasonable wear and tear
only excepted, and shall surrender the premises at the termination of this
agreement.
8. Lessee agrees that no improvements to or alterations to the space shall be made
without the consent of Lessor in writing.

9. Risk of loss of all property owned by Lessee shall remain with Lessee, it being
understood that Lessor will maintain no insurance on such property. Any insurance
desired by Lessee on Lessee's property shall be purchased by Lessee at Its
expense.
10. Lessor shall not be liable to Lessee or the Lessee's employees for any damage to
person or property caused by the negligent act of Lessor, Its agent, servants,or
employees or due to the act of any other tenant In the building, or due to any
defect or want of repair in any part of the building of which the allocated space
forms a part.
11. Lessee agrees to hold Lessor harmless from any and all claims, damages, expenses,
including attorney's fees, growing out of or arising from any negligent act on the
part of Lessee, its agent, servants or employees.
12. No sign shall be placed at, on, or about the premises by Lessee except with the
approval of the Center Director in writing.

Session at the term of the Court, at the Brazos County
Courthouse, in the City of Bryan, Texas, with the following members .

Among other proceedings had, the following proposed order was

WHEREAS, The Honorable Claude D. Davis, Judge of the County
Court at Law No. 1 of Brazos County, Texas, having made known to
the Commissioners Court of Brazos County, Texas, that on March 8,
9, 10, and 11, 1993, he will be absent from the bench due to the
requirement that judges take 16 hours of continuing education a
year.
WHEREAS, he has requested the appointment of James A. Amis,
Jr. to sit as Special Judge of the County Court at Law No. 1 of
Brazos County, Texas on the above mentioned date in all matters
that are, or may be, docketed on the Court's dockets for this day
in all matters that are, or may be, docketed on the Court's dockets
for this day, and to have and exercise all powers of a Special
Judge in relation to matters involved, it is, therefore,
ORDERED, ADJUDGED AND DECREED, Pursuant to authority of
Article 30.03, Section 2, Code of Criminal Procedure, that James A.
Amis, Jr., a former Judge of County Court at Law of Brazos County,
Texas, to sit and hear all matters that are, or may be, docketed on
any of the Court's dockets on the above - mentioned day and shall
have and exercise all powers of such Special Judge in relation to

ORDER COMBINING CERTAIN VOTING PRECINCTS AND POLLING PLACES
WHEREAS, the Commissioners Court of Brazos County, Texas
is charged by Section 42.001 of the Texas Election Code to divide
the county into convenient election precincts; and
WHEREAS, the Governor of Texas, by Proclamation dated
January 22, 1993, ordered a special election to be held in the
State of Texas on Saturday, the 1st day of May for the purpose of
electing a United States Senator to serve out the unexpired term of
the Honorable Lloyd Bentsen; and
WHEREAS, the cities of Bryan and College Station, will be
holding elections on Saturday, May 1, 1993 for the purpose of
electing Mayors, and City Council Members for each city; and
WHEREAS, the Bryan Independent School District and the
College Station Independent School District will be holding
elections on Saturday, May 1, 1993 for the purpose of electing
School Board Members; and
WHEREAS, the City of Bryan and Bryan Independent School
District will hold joint elections in certain election precincts in
their districts in Brazos County; and
WHEREAS, the City of College Station and the College
Station Independent School District will hold joint elections in
certain election precincts in their districts in Brazos County; and

WHEREAS, these entities have consolidated certain county
election precincts for the convenience of the voters; and
WHEREAS, these consolidated election precincts are not
the same as the consolidated election precincts for Brazos County;
and
WHEREAS, for the ease and convenience of the voter Brazos
County is desirous of conducting the Special Election for the
office of United State Senator at the same polling places as the
joint elections of the City of Bryan and Bryan Independent School
District and the joint elections of the City of College Station and
the College Station Independent School District; and
WHEREAS, it will be necessary for Brazos County to change
the consolidation of certain election precincts for this one
particular election to enable the Special Election for the Election
of United States Senator to be conducted at the same polling places
as the combined City of Bryan, Bryan Independent School District
and City of College Station, College Station Independent School
District elections;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS COURT
OF BRAZOS COUNTY, TEXAS, THAT:
(1) Pursuant to Section 42.008 of the Texas Election
Code certain election precincts be combined to wit:
(a) Election precincts 2, and 82 be consolidated
and will vote at the Wellborn Community Center
located at 4119 Greens Prairie West, College
Station;
(b) Election precincts 7, 44, 46, 51 and 81 be.
consolidated and will vote at the Reliance
Community Center located on FM 1179, 6 miles east
of FM 1179 and FM 158 in rural Brazos County;

(c) Election precincts 15, 53, 54, and 55 be
consolidated and will vote at Fannin Elementary
School located at 1200 Baker Street, Bryan;
(d) Election precincts 16 and 52 be consolidated
and will vote at the Courthouse Annex, 202 East
27th Street, Washington Street entrance, Bryan;
(e) Election precincts 17, 47, 48, and 49 be
consolidated and will vote at the Brazos County
Health Department, 201 North Texas Avenue, Bryan;
(f) Election precincts 19, 42, 45, 60 and 66 be
consolidated and will vote at the Arena Hall
located at 2904 Tabor Road, Bryan;
(g) Election precincts 20, 21 and 61 be
consolidated and will vote at the Memorial Student
Center on the Texas A &M Campus, College Station;
(h) Election precincts 22, 37, 50 and 56 be
consolidated and will vote at the Army Reserve
Center located at 511 Carson Street, Bryan;
(i) Election precincts 25, 38 and 43 be
consolidated and will vote at the George Williams
Tabernacle located at 105 Waco Street, Bryan;
(j) Election precincts 27, 75 and 76 be
consolidated and will vote at the Bright Light
Freewill Baptist Church located at 11234 State
Highway 30, College Station;
(k) Election precincts 28, 59, and 83 be
consolidated and will vote at Holly Cross Lutheran
Church, 1200 Fox Fire Drive, College Station;
(1) Election precincts 29, 62, 64, and 69 be
consolidated and will vote at Saint Marks Baptist
Church located one mile west of College Station on
State Highway 60 in rural Brazos County;
(m) Election precincts 30, 77, 78 and 79 be
consolidated and will vote at Navarro Elementary
School located at 4520 Northwood Street, Bryan;
(n) Election precincts 33 and 35 be consolidated
and will vote at the Lincoln Center located at 1000
Eleanor, College Station;
(o) Election precincts 36, 57 and 70 to be
consolidated and will vote at Fellowship Freewill
Baptist Church located at 1228 West Villa Maria
Road, Bryan;

(p) Election precincts 40, 58, 71, and 73 be
consolidated and will vote at Aldersgate Methodist
Church located 6501 State Highway 6 By -pass,
College Station;
(2) THAT all other election precincts will vote at the
location designated at the time the new election precincts were
formulated by order dated December 16, 1991; and
(3) THAT submission be made to the Assistant Attorney
General, Civil Rights Division, Voting Section, Department of
Justice, Washington D. C. requesting the preclearance of this Order
pursuant to Section 5 of the Federal Voting Rights Act.
ADOPTED this 22nd day of February, 1993 by a
vote of 3 AYES and 0 NAYS. Two members of the Commissioners Court
