REGULAR MEETING
FEBRUARY 8, 1993
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, February 8, 1993, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Absent;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2, Presiding;

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The first matter before the Court was the opening of the
Depository Bids. Cheryl Turney explained that there was no
bid submitted by First City Texas Bank because of the recent
sale of the bank. Bids were received from First American Bank
and NationsBank. Both bids contained a certificate of bid and
a certified check in the amount of $28,000.00. On motion by
Commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to have the Purchasing Agent and the Auditor
evaluate the bids and make a recommendation to the Court.
It was the consensus of the Court to table consideration
on combining various voting precincts for the May 1, 1993
election.
The Court next considered a request from Justice of the
Peace Precinct 4 Place 2, Carolyn Hensarling, to hire a full
Commissioners' Court meeting February 8, 1993
time clerk for her office. Judge Hensarling based her request
on the fact that the District Judges and County Court at Law
Judges have requested that the office of Justice of the Peace
Precinct 4 Place 2 hear all Indigence Hearings and appoint
attorneys. On motion by Commissioner Norton, seconded by
Commissioner Turner, the Court voted unanimously to approve
the request of Judge Hensarling with the stipulation that the
part time clerk position be eliminated.
On motion by Commissioner Wilcox, seconded by Commis-
sioner Turner, the Court voted unanimously to approve the
request of James Marrow, Constable Precinct 2, to appoint
Archie Clark and Robert Hickman as Reserve Deputy Constables
for Precinct 2.
The Court next considered entering into agreement with
the Texas Department of Criminal Justice, Pardons and Paroles
Division (TDCJ -PPD) for the placement of certain persons under
the jurisdiction of the TDCJ -PPD and in the custody of Brazos
County who have violated the terms and /or conditions of their
parole. On motion by Commissioner Norton, seconded by
Commissioner Sims, the Court voted unanimously to enter into
agreement with the Texas Department of Criminal Justice,
Pardons and Paroles Division (TDCJ -PPD) for the placement of
certain persons who have violated the terms and /or conditions
of their paroled and authorize the County Judge to execute the
Agreement on behalf of Brazos County. A copy of the Agreement
is attached hereto.
The Court next considered a request from Sheriff Bobby
Riggs to keep the 1989 GMC Van, Unit $66, as part of the
Sheriff's Department fleet for the purpose of utilizing it
within the Boot Camp Program to do community service. The
community service would include but not be limited to the
following:
1. Clearing vacant lots in Bryan /College
Station to prevent them from becoming a
haven for drug use. The areas will be
designated by the police departments.

2. Provide manpower for assistance to i
individuals with catastrophic incidents •
for removal of debris.
3. Assist the various governmental agencies
in their housing assistance programs.
On motion by Commissioner Wilcox, seconded by Commissioner i
Sims, the Court voted unanimously to approve the request of
the Sheriff with the stipulation that the county has adequate
liability coverage for this and that the rural areas of the

county be served first.

The Court next considered the request by Ferguson
Burleson County Gas Gathering System to place a road bore in
the right -of -way of Elmo Weedon Road approximately 5.75 miles `
southeast of its intersection with State Highway 30 for the
purpose of installing a 4 inch steel gas pipeline. Included
with the request is company check no. 3567 in the amount of
$500.00. The site is located in Precinct 3. The County
Engineer stated that all appeared to be in order and
recommended approval. On motion by Commissioner Sims,
seconded by Commissioner Norton, the Court voted unanimously ,
to approve the request of Ferguson Burleson County Gas

Gathering System and authorized the installation. A copy of
the request is attached hereto.
The Court next considered authorizing work outside of
county rights -of -way for the enhancement of county road
projects. The Road and Bridge Department submitted two i
requests. The first for permission to enter the private
property of R. E. Vrooman on Vista Lane to remove brush on
both sides of Vista Lane to allow adequate site distance at
the intersection with Pamela Lane. This is done for the
health, safety and welfare of the general public. The second
request was for permission to enter the private property of
Tim and Paula Thurmond on Hicks Lane to patch potholes and
ruts for the school bus turn around. This is done for the
health, safety and welfare of the general public. On motion
by Commissioner Sims, seconded by Commissioner Norton, the

Court voted unanimously to authorize the work.
The Court acknowledged receipt of the Extension Service
reports for January 1993 and acknowledged receipt of reports
from County and Precinct Offices showing revenues collected
and remitted to the County Treasurer. An excerpt from those
reports is attached hereto.
The Court proceeded to consider the change of status of

PRISONER CUSTODY AGREEMENT

This Prisoner Custody Agreement ( "AGREEMENT ") is entered into
as of February 8. 1993 by and between the Commissioners Court of
County ( "COUNTY ") and the Texas Department of
Criminal Justice, Par ons and Paroles Division.
RECITALS
WHEREAS, the Texas Department of Criminal Justice, Pardons and
Paroles Division ( "TDCJ -PPD ") has an agreement with a private organ-
ization to operate an intermediate sanction facility ( "FACILITY ") as
a correctional center for certain persons described herein who are
under the jurisdiction of TDCJ -PPD and in the custody of COUNTY
authorities, and who have violated the terms and /or conditions of
their parole;
WHEREAS, TDCJ -PPD and the COUNTY desire to enter into this
AGREEMENT to which the State of Texas will assume responsibility for
the physical custody and care of certain prisoners previously
incarcerated by COUNTY pursuant- to the COUNTY's authority to detain
prisoners in a detention facility operated by a private organization
under Local Government Code Section 351.101;
1. ASSUMPTION OF CUSTODY. In accordance with and subject to
the terms of this AGREEMENT, TDCJ -PPD shall assume physical custody,
care and control of certain Blue Warrant Prisoners (as hereinafter
defined) with constructive custody maintained by the COUNTY. Except
as otherwise set forth herein, TDCJ -PPD shall bear all expenses
associated with such physical custody, care and control of these
Blue Warrant Prisoners transferred to a FACILITY.
2. ELIGIBILITY REQUIREMENTS. Prisoners eligible for transfer
to the FACILITY shall be limited to technical parole violators in-
carcerated by COUNTY who are under the jurisdiction of TDCJ -PPD by
virtue of having had issued against them a Blue Warrant, which shall
remain in effect, and who (a) have violated their parole, (b) are in
reasonably good health, with no current and /or existing medical
problem that could cause hospitalization, and (c) have had a speci-
fied time of confinement authorized by TDCJ -PPD as a condition of
the continuance of their parole. Such persons are referred to here-
in as "BLUE WARRANT PRISONERS ". TDCJ -PPD or its designee shall be
authorized to refuse to accept for incarceration, or after incarcer-
ation shall be authorized to return to the physical custody of the
COUNTY at COUNTY's expense, any prisoner who does not meet the
eligibility requirements for incarceration at the FACILITY as set
forth in this paragraph 2.

3. MAXIMUM PRISONERS. COUNTY may initially transfer BLUE
WARRANT PRISONERS for incarceration at the FACILITY, beginning on
the date specified by notice which shall be given by the TDCJ -PPD to
COUNTY at least seven (7) days in advance with the maximum number of
prisoners to be designated by TDCJ -PPD subject to increase or
decrease upon two (2) days notice to COUNTY.
4. JAIL STANDARDS. The FACILITY shall be operated and main-
tained in accordance with minimum jail standards of Texas Commission
on Jail Standards ( "COMMISSION "), including such variances from Jail
Standards as may be approved by the COMMISSION. If the COMMISSION,
at any time, determines that the FACILITY does riot meet Jail Stan-
dards, either party may terminate this AGREEMENT without penalty, at
which time all BLUE WARRANT PRISONERS shall be returned to the
physical custody of COUNTY.
5. TRANSPORTATION. The COUNTY shall provide transportation
from the county fail to the TRANSPORTATION SITE as designated by
TDCJ -PPD. Upon COUNTY's request, the TDCJ -PPD's designee shall
provide, at the TDCJ -PPD's or its designee's expensd, transportation
of all eligible BLUE WARRANT PRISONERS from a transportation site to
the FACILITY and back to the TRANSPORTATION SITE.
6. RELEASE OF PRISONERS. BLUE WARRANT PRISONERS who are to
be released from the FACILITY will be returned to the physical cus-
tody of the COUNTY at the TRANSPORTATION SITE for release or
transfer to the Institutional Division of the Texas Department of
Criminal Justice by the COUNTY that incarcerated the prisoner.
7. TERM. This AGREEMENT is effective as of the date first
above written and shall continue until August 31, 1993, at which
time it may be extended for additional one year periods upon the
mutual agreement of TDCJ -PPD and COUNTY. Either party may cancel
this AGREEMENT upon seven (7) days written notice to the other
party, at which time TDCJ -PPD will return to the physical custody of
the COUNTY each of its BLUE WARRANT PRISONERS.
8. NOTICE. All notices required to be given hereunder shall
be effective upon receipt by the party to which notice is given.

aware that the TDCJ -PPD has contracted with the private organization

at the FACILITY, and hereby consents to TDCJ -PPD's assignment to the
private organization of all of its obligations hereunder with
respect to the physical custody, care and control of COUNTY BLUE
WARRANT PRISONERS.
10. TERMINATION AND RETURN OF PRISONERS. In the event that
(a) TDCJ -PPD's contract- with the private organization for the care
and physical custody of prisoners at the FACILITY is terminated for
any reason, or (b) TDCJ -PPD is for any reason prevented from using
the FACILITY to house BLUE WARRANT PRISONERS, then this AGREEMENT
shall terminate immediately and TDCJ -PPD or its designee shall
return the BLUE WARRANT PRISONERS to the physical custody of the
COUNTY at the TRANSPORTATION SITE, and COUNTY shall accept into its
custody any BLUE WARRANT PRISONERS incarcerated at the FACILITY who
were previously incarcerated by COUNTY.

in Brazos County, Texas as follows:
The location or description of the proposed Installation is more fully shown by

1. The County Engineer must be notified prior to the beginning of construction In order that
they might be on hand to designate the actual location of the Installation.
2 That all damage to the roadways and right -of -ways will be repaired to their original condition
to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate or lower any such
line at no cost to Brazos County, should same become necessary due to widening or
lowering, or other alteration of the roadway or right -of -way.
4. That Brazos County Is In no way responsible for any damage that might occur to any
existing utility lines In the right -of -way.
5. That the line will be constructed and maintained on the County right -of -way In accordance
with governing laws.
6. That the line or lines will be constructed no less than forty -eight Inches (48 ") lower than the
lowest part of the drainage or bar ditch and the drainage Is to be considered at least two
feet (2) below the center of the roadway.
7. That all roads shall be bored and cased for such distance, from toe of slope to toe of slope
and In no case shall an open pit be allowed within four feet of the shoulder of the road.
8. That all sites will be barricaded during the construction period.
9. That the normal charge Is $500.00 per crossing and /or $40.00 per rod when paralleling the
roadway established by the Commissioners' Court on January 28, 1985.
10. Ditch line shall be compacted to 90% standard density ASTM -Test method No. D -698; test
shall be conducted by an Independent Geotechnlcal testing firm; copies of all test results
shall be furnished to the offlce of the Brazos County Engineer.
11. Construction shall be In strict conformance to the latest Texas Manual on Uniform Trafflc
Control Devices for Streets and dlghways, published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construction.
Construction of this line will begin on or after (date) 2-11- % 3
