Vol. r' � I I I I 1 i it I r i I h I 01 COMMISSIONERS' COURT REGULAR MEETING JANUARY 11, 1993 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, January 11, 1993, with the following members of the Court present: R. J. Holmgreen, County Judge, Absent; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2 Presiding; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The following citizens and officials were in attendance: Ruth McLeod Executive Assistant Carol Palmer Admin. Asst. to County Judge Bea Green Secretary to Commissioners Rosalie Todaro Auditor's Office A. H. Winder County Engineer Sandie Walker Treasurer Rita Watkins Sheriff Larry Catlin Attorney James H. Biehn Retired Engineer Commissioner Sims gave the invocation and led the pledge of allegiance. The Court next considered Budget Amendments #92/93 -06 and #92/93 -07. Amendment #92/93 -06 would transfer funds budgeted for the Non Departmental Department to The Sheriff's Office, Community Support and the 272nd District Court. On motion by Commissioner Sims, seconded by Commissioner Turner, the Court voted unanimously to approve the budget amendment as submitted. A copy of which is attached hereto. Amendment #92/93 -07 would increase the budget of the Sheriff's Department for the purchase of a video camera. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the budget amendment as I submitted. A copy of which is attached hereto. The next matter for consideration was an application made by Josephine Gillar to redeposit into the Texas County and District Retirement System the amount previously withdrawn at the termination of prior employment. Submitted with the Commissioners' Court meeting January 11, 1993 application is a check in the amount of Five Thousand Eight i Hundred Twenty One Dollars and Sixty Nine Cents ($5,821.69) which includes a five percent (5%) per annum withdrawal charge from the date of withdrawal to the date of redeposit. On motion by Commissioner Wilcox, seconded by Commissioner Sims, the Court voted unanimously to forward the application of Josephine Gillar to the Texas County and District Retirement System along with her check for Five Thousand Eight Hundred Twenty One Dollars and Sixty Nine Cents ($5,821.69). Pct. 5 On motion by Commissioner Norton, seconded by Commissioner Wilcox, the Court voted unanimously to post "No Through Traffic over 30,000 lbs." signs on Graham Road from Highway 6 to FM 2154. This was done in a effort to stop further deterioration of the road surface. The Court acknowledged receipt of the Extension Service reports for December 1992 and acknowledged receipt of reports from County and Precinct Offices showing revenues collected and remitted to the County Treasurer. An excerpt from those reports is attached hereto. a • 01 401 i A. -... , Commissioners' Court meeting January 11, 1993 The Court next recognized Larry Catlin, attorney and private citizen of Brazos County. Mr. Catlin stated that he spends approximately 60% to 70% of his time in the Courthouse. In that time he has heard numerous requests from clients and County employees that the Courthouse have "No Smoking Areas" designated, or be made a smoke free area. He cited a EPA report that states that second hand smoke is a carcinogen and that it increases the chances of pneumonia, bronchitis and respiratory problems. He continued by saying that larger counties have a ban on smoking in the Courthouses. Commis- sioner Sims asked if the Courthouse were to be declared smoke free what recourse the County would have if the public vio- lated the law. Mr. Catlin responded that information pre- sented shows no need to enforce, that the public cooperates. He then speculated that the Bryan Police Department would enforce the rule if necessary. Commissioner Norton said that he too had been approached by numerous employees complaining about smokers and he suggested that the Court consider making the building smoke free, allowing smoking in private offices and in the jail. Commissioner Sims requested action be taken at the Commissioners' Court meeting of January 19, 1993 and asked that the matter be placed on the agenda.
