SPECIAL MEETING
JANUARY 4, 1993
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, January 4, 1993, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;

Commissioner Sims gave the invocation and led the pledge
of allegiance.
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to set the rate for milage
reimbursement at $.275 per mile.
The Court proceeded to the selection of the Salary
Grievance Committee for 1993 in accordance with the law. The
following names were drawn from the list of persons who served
on the Grand Jury during the previous twelve months:

The Commissioners' Court proceeded to set the holidays to be
observed by Brazos County for 1993:
It was the consensus of the Court to approve January 18,
Martin Luther King's Birthday.
On motion by Commissioner Turner, seconded by
Commissioner Wilcox, the Court voted unanimously to
approve April 9, Good Friday.
On motion by Commissioner Sims, seconded by
Commissioner Norton, the Court voted unanimously to
approve May 31, Memorial Day.
It was the consensus of the Court to approve July
5, Independence Day.
It was the consensus of the Court to approve
September 6, Labor Day.
On motion by Commissioner Wilcox, seconded by
Commissioner Sims, the Court voted unanimously to
approve November 25 & 26, Thanksgiving.
It was the consensus of the Court to approve
December 23, 24 & 27, Christmas.
On motion by Commissioner Wilcox, seconded by
Commissioner Turner, the Court voted unanimously to
approve one (1) floating holiday.
On motion by the County Judge, seconded by

On motion duly made and seconded, the Court voted to ,
approve all above listed holidays that hadn't been approved

On motion by Commissioner Norton, seconded by
Commissioner Sims, the Court voted unanimously to authorize
CIC Agency, Inc., Insurance and Maintenance Risk Specialists,
to present aMaintenance Cost Reduction Proposal at no cost to
the County in an effort to show how an insurance policy can

reduce the cost of maintenance contracts on County equipment.
The Court next considered awarding the following bid:
Bid No. 93 -667 - Computer Hardware for Brazos County.
M. J. Deen, Head of Data Processing, made recommendations in
the following six (6) categories:

On motion by Commissioner Sims, 'seconded by Commissioner
Turner, the Court voted unanimously to accept the
recommendation of the head of Data Processing and award the
contracts to Micro Age for Compaq Prolinea 486/33 and external
tape backup and ComuAdd for all other items. A copy of the
bid tabulation is attached hereto.
The County Judge announced that he waived his right to
sign pay authorizations for the Road and Bridge Department.
On motion by the County Judge, seconded by Commissioner
Norton, the Court voted unanimously to approve the waiver.
The Court next considered two requests from GTE
Southwest. The first, to place buried cable in the right -of-
way of Tonkaway Lake Road in Precinct 3. The County Engineer
stated that all appeared to be in order and recommended
approval. on motion by Commissioner Sims, seconded by
Commissioner Turner, the Court voted unanimously to approve
the first request by GTE Southwest and authorized the
installation. A copy of the request is attached hereto. The
second request was to place buried cable in the right -of -way
of Steep Hollow Road beginning approximately 2.0 miles from
its intersection with FM 1179 for a distance of 1205 feet.

The site is located in Precinct 3. The County Engineer stated
that all appeared to be in order and recommended approval. On
motion by Commissioner Sims, seconded by Commissioner Wilcox,
the Court voted unanimously to approve the second request by
GTE Southwest and authorized the installation. A copy of the
request is attached hereto.
The Court next considered two requests from Aquila
Southwest Pipeline Corporation. The first to install two road
bores in the right -of -way of Elmo Weedon Road approximately
605.23 feet from its intersection with Hensarling Lane. The
site is located in Precinct 3. The County Engineer stated
that all appeared to be in order and recommended approval. On
motion by Commissioner Sims, seconded by Commissioner Turner,
the Court voted unanimously to approve the request of Aquila
Southwest Pipeline Corporation and authorized the
installation. A copy of the request is attached hereto. The
second request was to place two road bores in the right -of -way
of Hensarling Lane approximately 974.30 feet from ins
intersection with Elmo Weedon Road for the purpose of
installing natural gas lines. Company Check No. 016406 in the
amount of $2,000.00 accompanied both requests. The site is
also in Precinct 3. The County Engineer stated that all
appeared to be in order and recommended approval. On motion
by Commissioner Sims, seconded by Commissioner Wilcox, the
Court voted unanimously to approve the request of Aquila
Southwest Pipeline Corporation and authorized the
installation. A copy of the request is attached hereto.
The Court next considered two requests by Southwest Gas
Pipeline. The first, to place a road bore in the right -of -way
of Boxley Bend Road at its intersection with River Road for
the purpose of installing a 6 inch steel pipe line. Included
with the request is check # 3950 in the amount of $500.00.
The second, to place a road bore in the right -of -way of River
Road approximately 1.0 mile southeast of its intersection with
Lightsey Road for the purpose of installing a 6 inch steel

pipe line. Included with the request is check # 3848 in the
amount of $14,067.03. Both sites are in Precinct 1. The
County Engineer recommended the Court deny the two requests
due to the narrow right -of -way, high traffic volume and
proximity to residences in certain locations along the right -
of -way. On motion by Commissioner Norton, seconded by
Commissioner Sims, the Court voted unanimously to deny the two
requests by Southwestern Gas Pipeline and authorized the
return of the two checks. Commissioner Wilcox asked the
County Engineer to submit a cost estimate on reconstruction of
the road to withstand 80,000 pounds then give Southwestern Gas
Pipeline the option to pay for the reconstruction.
The Court proceeded to consider the change of status of
the following employees.

the Court voted unanimously to reaffirm the action on the

The Court next considered the following Claims as

On motion by Commissioner Norton, seconded by Commis-
sioner Wilcox, the Court voted unanimously to approve the
Claims as submitted with the exception of claim number 56
which is paid from the Hot Check Fund and claim number 88
which was for membership in the Brazos County Bar Association.
At 9:33 a.m. the County Judge announced the meeting
closed to the public so that the Court could meet in closed

Commissioners' Court meeting January 4, 1993
executive session to discuss personnel as allowed under
Section (6252- 17(2)(g) Vernon's Texas Civil Statutes.
At 9:55 a.m. the County Judge announced the meeting open
to the public. on motion by the County Judge, seconded by
Commissioner Sims, the Court voted unanimously to approve the
request of the Sheriff to hire one (1) additional deputy at a
group 12 step 1 position. The Court asked the Sheriff if
there were any more changes in his staff, to please submit
them by January 11, 1993 because after that date there will be
no more shuffling of positions until the next budget year.
There being no further business to come before the Court,
the meeting was adjourned.

TO THE COMMISSIONER'S COURT OF BRAZOS COUNTY
ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE will construct a
communication line within the right -of -way of a County Road
in Brazos County, Texas as follows:
Beginning at the end of our cable on Tonkaway Lake
Road, a buried cable will be placed approximately
1600' to the East. This cable will be placed at a
minimum depth of 30 ", 3' off of the existing fence
line. Cable placement will then continue on pri-
vate property.
The location and description of this line and associated
appurtenances is more fully shown by four copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right -of -way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by GTE does
not constitute a waiver, surrender, abandonment or impairment
of any property rights, franchise, easement, license, authority,
permission, privilege or right now granted by law or may be
granted in the future and any provision or provisions so con-
strued shall be null and void.
Construction of this line will begin on or after December 1992.

Formal notice Is hereby given that (Applicant)Aquila Southwest Pipeline Corporation
proposes to place a (type) 2 natural Gas
pipeline within the right -of -way (road) Hensarling Lane _
in Brazos County, Texas as follows:
The location or description of the proposed Installation is more fully shown by
3 copies of the drawings attached to this notice.
1. The County Engineer must be notified prior to the beginning of construction in order that
they might be on hand to designate the actual location of the installation
2. That all damage to the roadways and right -of -ways will be repaired to their original condition
to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate or lower any such
line at no cost to Brazos County, should same become necessary due to widening or
lowering, or other alteration of the roadway or right -of -way.
4. That Brazos County Is In no way responsible for any damage that might occur to any
existing utility lines In the right -of -way.
5. That the line will be constructed and maintained on the County right -of -way in accordance
with governing laws.
6. That the line or lines will be constructed no less than forty -eight inches (48') lower than the
lowest part of the drainage or bar ditch and the drainage is to be considered at least two
feet (7) below the center of the roadway.
7. That all roads shall be bored and cased for such distance, from toe of slope to toe of slope
and In no case shall an open pit be allowed within four feet of the shoulder of the road.
8. That all sites will be barricaded during the construction period.
9. That the normal charge Is $500 00 per crossing and /or $40 00 per rod when paralleling the
roadway established by the Commissioners' Court on January 28, 1985.
10. Ditch line shall be compacted to 90% standard density ASTM -Test method No. D-698; test
shall be conducted by an independent Geotechnical testing firm; copies of all test results
shall be furnished to the office of the Brazos County Engineer.
11. Construction shall be in strict conformance to the latest Texas Manual on Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construction.
Construction of this line will begin on or after (date) December 28, 1992

2. That all damage to the roadways and right -of -ways will be repaired to their original condition
to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate or lower any such
line at no cost to Brazos County, should same become necessary due to widening or
lowering, or other alteration of the roadway or right -of -way.
4. That Brazos County Is In no way responsible for any damage that might occur to any
existing utility lines In the right -of -way.
5. That the line will be constructed and maintained on the County right -of -way in accordance
with governing laws.
6. That the line or lines will be constructed no less than forty -eight inches (48') lower than the
lowest part of the drainage or bar ditch and the drainage is to be considered at least two
feet (7) below the center of the roadway.
7. That all roads shall be bored and cased for such distance, from toe of slope to toe of slope
and In no case shall an open pit be allowed within four feet of the shoulder of the road.
8. That all sites will be barricaded during the construction period.
9. That the normal charge Is $500 00 per crossing and /or $40 00 per rod when paralleling the
roadway established by the Commissioners' Court on January 28, 1985.
10. Ditch line shall be compacted to 90% standard density ASTM -Test method No. D-698; test
shall be conducted by an independent Geotechnical testing firm; copies of all test results
shall be furnished to the office of the Brazos County Engineer.
11. Construction shall be in strict conformance to the latest Texas Manual on Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construction.
Construction of this line will begin on or after (date) December 28, 1992

Formal notice is hereby given that (Applicant) Aquila Southwest Pipeline Corporation
proposes to place a (type) 2 Natural Gas pipelines
pipeline within the right -of -way (road) Elmo Weedon Road _
in Brazos County, Texas as follows:
The location or description of the proposed installation is more fully shown by
3 copies of the drawings attached to this notice.
1. The County Engineer must be notified prior to the beginning of construction in order that
they might be on hand to designalo the actual locatlon of the Installation.
