' SPECIAL MEETING
DECEMBER 21, 1992
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, December 21, 1992, with the following members
of the Court present: '
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.

The Court next considered approval of the minutes of the
f Commissioners' Court meetings held October 6, 1992. On motion
by Commissioner Sims, seconded by Commissioner Norton, the
Court voted unanimously to approve the minutes as submitted.
The Court next considered Budget Amendment 192/93-05,
which would reallocate funds budgeted for the Minimum Security
Jail, increase the budgets of the office of Justice of the
Peace Precinct 2, County Clerk and Adult Probation and
transfer funds from the Non-Departmental department to pay for
expenses incurred in the 91/92 budget year. On motion by
Commissioner Norton, seconded by Commissioner Wilcox, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.

Commissioners' Court meeting December 21, 1992
The Court next considered a request from District
• Attorney to buy into the county retirement system. Citing a
memorandum from the Texas County and District Retirement
System, in which it states that with the passing of House Bill
1985, Prosecuting Attorneys may now become members of the
county system to the extent of supplemental compensation paid
by the County. On motion by Commissioner Norton, seconded by
Commissioner Sims, the Court voted unanimously to adopt an
order to include Prosecuting Attorneys in Texas County and
District Retirement System to Extent of Supplemental
Compensation Paid by County participate to the extent as
provided which amends Sections 842.106, 842.201 and 843.402 of
the government Code and to include in the Texas County and
District Retirement System each person regularly engaged in
the performance of the duties of prosecuting attorney who
receives supplemental compensation from County funds of said
County. A copy of the order is attached hereto.
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to approve Change Order
No. 1 submitted by Coyote Construction for the interior
modifications to the Brazos Center and to remit payment in the
amount of $2,436.00. A copy of the change Order is attached
hereto.
The next mattes before the Court was reconsideration
of the abandoning snd vacating Short Road in Precinct 1.
Citing Article 6702.1 Section 2.002(e) in which it states tho
Commissioners Court acting either upon the request of one or
parties, Commissiorer Norton stated he had received letters
• from the two property owners on Short Road requesting this
w
action. On motion by Commissioner Norton, seconded by
Commissioner Wilco:t, the Court voted unanimously to abandon_
and vacate Short Road in Precinct 1 and to record the Order in
the Real Property records in the County Clerk's office
The Court next considered authorizing work outside of
county rights-of-ways for the enhancement of county road
Commissioners' Court meeting December 21, 1992
projects. The Road and Bridge Department requested permission
to enter the private property of Tracy Peters located off
Weedon Road to clear out an existing drainage channel for a
distance of 601. The Road and Bridge Department also
requested permission to enter the private property of Stanley
E. Stoltz located off old Highway 105 to install two (2)
cattle guards, two (2) culverts and construct a new road
through a pasture. This is necessary due to damages caused by
floods in 1991. The County Judge moved to approve both
requests. Commissioner Norton seconded the motion.
Commissioners Norton, Turner and Wilcox voted "Aye".
Commissioner Sims voted "No". The motion carried and the

court authorized the work.
The next matter for consideration was approval to
advertise for bids on a diesel truck for the Brazos valley
i.
Narcotics trafficking Task Force and Pug Mill Cement Limestone
Stabilizer Base for the Road and Bridge Department. On motion
by Commissioner Sims, seconded by Commissioner Norton, the
Court voted unanimously to authorize the Purchasing Agent to
advertise for bids on the diesel truck and the lime stabilizer
base.
The Court next considered awarding the following bids:
Bid No. 93-662 - Annual Insect Control
Consideration was tabled until the next meeting
Bid No. 93-666 - Two (2) Purge Units Retrofit for
Centrifugal Chillers
Natkin Service Company
Unit Price Total Price
$5,750.00 $11,500.00
Cheryl Turney, Purchasing Agent,
recommended acceptance of the only bid
submitted by Natkin Service Company. On
motion by the County Judge, seconded by
Commissioner Norton, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Natkin Service Company.
The Court received, approved and ordered filed as
submitted the Treasurer's report for November 1992. A copy of

Commissioner Sins asked about clothing being purchased
for the Sheriff's Department. He mention there were some odd
sized, asked who they were for and if they could be sent back.
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to approve the Claims as
submitted.
The County Judge announced that agenda items for the next
Commissioners' Court meeting need to be in the Judge's office
by Tuesday noon.
There being no f irther business to come before the Court,
the meeting was adjoiLrned.

THAT WHEREAS, on December 21, 1992, the Court heard and
approved a budget amendment for the 1992-1993 budget year for
Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 28,
1992, the following amendment(s) to the original are hereby
authorized, as described on the attached 1 page(s).

County, Texas was convened In Special
session at a Special Term of said Court, with the following members present, to wit:
R. J. Holmgreen , County Judge
Gary Norton , Commissioner, Precinct #1
Walter Wilcox , Commissioner, Precinct #2
Randy Sims , Commissioner, Precinct #3
Milton Turner , Commissioner, Precinct #4
Nary Ann Ward , County Clerk;
and at such session, among other proceedings, the following order was passed:
'Whereas. by virtue of an order of the Commissloners Court of Brazos
County.
Texas adopted on the 21 st day of December , 19 92 , said County became a participating subdivision In
the Texas County and District Retirement System; and,
Whereas, prosecuting attorneys who receive supplemental compensation from County funds in addition
to the compensation received by them from the State of Texas were not eligible to participate in both the Employees
Retirement System of Texas and in the Texas County and District Retirement System, and,
•
Whereas, by recent amendments to Sections 842.106, 842.201 and 843.402 of the Government Code,
the County has now been authorized on the tE rms therein stated to provide for inclusion of such prosecuting attorneys
In the Texas County and District Retirement ; ystern to the extent of the compensation paid each such person by the
County, notwithstanding membership In the Employees Retirement System of Texas: and,
Whereas, the Commissioners G curt of Brazos
County has determined that it Is to
the public interest that such officials be so Incl ided in the Texas County and District Retirement System; It Is therefore,
ORDERED BY THE COMMISSIONERS COURT OF Brazos COUNTY, TEXAS:
'1. Pursuant to the provisions of Section 842.201 of Texas Government Code, Title 8, Subtitle F, Revised
Civil Statutes, Brazos Count y hereby elects to Include In the Texas County and District Retirement
System effective the 1st day of Januar, 19 93 (the effective date of this order) each person regularly
engaged in the performance of the duties of pr 3secuting attorney, as defined In Section 842 106 (and who Is a member
of the Employees Retirement System of Texas - who, in addition to the compensation received from the State of Texas.
Is paid supplemental compensation from Cot my funds of said County; and all such persons shall be considered to
the extent of the compensation paid to such pt rson by the Countyy, to be earnp:oyecs of said County within the meaning
of said Act, and as such eligible for member hip In the Texas County and District Retirement System.
'2.(a) Every person who Is. on the effective date of this order as above specified, whin the class designated

by this order to be included in the Texas Co M and District Retirement System, shall become a member of said
System, as an employee of Brazos -County, unless such person, within thirty (30) days from the effective
date of this order, shall execute and file with th t Director of said System a written waiver of membership, In such form
as the Board of Trustees of said System may p escribe. Any person who files a waiver of membership as hereinabove
provided, may subsequently apply for membership In said System as of the first day of any month thereafter and,
If such person would then be eligible for membership in the System as a beginning employee of said County, may
thereupon become a member of the System at that date but without credit for any service antedating the date of
membership.

'(b) Every person who subsequent to the efiectlvedateof this order becomes forthe fim Unman employee
of said County by reason of an employment described hereinabove, shall becorne a member of Texas County and
District Retirement System at the date of such employment.
'3. Any person who becomes a member of Texas County and District Retirement System pursuant to
this order shall not be allowed credit for service rendered prior to the effective date of this order, unless within ninety
(90) days after the date the person becomes a member of Texas County and District Retirement System:
'(a) For each and all months that such person performed services as an employee of said County between
the effective date of this County's participation in Texas County and District Retirement System and the effective date
of the person's membership in said System, such person shall pay over and deposit with said System a sum equal
to the deposits which a member of the System drawing the same compensation from the County during the same
period was required to make to said System; and
'(b) Brazos County within the ninety (90) day period from the effective date of the
person's membership shall contribute to the System an amount equal to, and for the purpose of matching, the deposits
made by the member pursuant to paragraph 3(a), above.
'In the event the deposits mentioned In paragraphs 3(a) and 3(b) are made within the time specified, the
sum so deposited by the member shall be credited to the member's individual account in the Employees Saving Fund
of the System, and such member shall be allowed current service credit for each month of service from which his
said deposits derive; and the matching deposits made by the County shall be deposited to its account In the Subdivision
Accumulation Fund of the System.
'4. Any person who becomes a member of the System pursuant to paragraphs 1 and 2 of this order,
and who shall make and cause to be made the deposits specified In paragraphs 3(a) and 3(b) above, shall be entitled
to receive, and Is hereby allowed, credit for 'prior service' rendered to this County prior to its participation In said
System, and upon certification of his prior service in the manner provided by law and the Rules and Regulations of
said System, shall be allowed an Allocated Prior Service Credit determined In the same manner and on the same
percentage of Maximum Prior Service Credit as was used in determining the Allocated Prior Service Credit of those
employees of the Ceunt, who became members of said System on th3 date of this County's participation therein.
'Each such employee who claims 'prior service' credit for service performed before the effective date
of participation prescribed above shall promptly file with the County Treasurer, a detailed written
statement (on such forms as are prescribed by or under the direction of the Board of Trustees of the System) of all
such prior service. The County Treasurer I Is hereby authorized and directed toverityeach
such statement of prior service claimed, and upon being satisfied that the same is correct, to certify to the Board of
Trustees of the System on behalf of this County: (a) length of 'prior service' for which credit is allowed by this County
to the employee-member (stated In terms of months of such service), and (b) the *average prior service compensation'
of the employee-member, to be computed and reported as directed by the Board of Trustees of the System.
'S. Member contributions of each person who becomes a member d Texas County and District Retirement
System by virtue of this order shall be made to the System for each payroll period from and after the effective date
of this order, at the rate of contribution prescribed for all employees of this County, upon all compensation (not
exceeding the maximum compensation for the period applicable to other employees of the County) which said person
receives out of County funds; and the Cdunty Treasurer 2 shall collect such member deposits,
and shall transmit the same to the System, as provided In Sections 845.402 and 845.403 of Texas Government Code,
Title 8. Subtitle F. Revised Clvd Statutes, as amended.'

ORDER
CAN THIS the 14th day of December, 1992, came to be heard a

petition from interested Brazos County residents to abandon and
vacate Short Road in the Timbercrest Subdivision; and the court
having heard testimony and finding that the abandonment would not
deprive abutting landowners of ingress or egress from their
property, or would cause a depreciation in value to such abutting
property; and it being determined such petition should be granted;
It is therefore ORDERED that said request be approved and that the
said Short Road be and is hereby abandoned, closed and vacated.
IT IS FURTHER ORDERED, pursuant to Article 6702-1 Vernon's
Texas Civil Statutes, that title to the property comprising Short
Road shall vest, to the center line of said road, in those persons
owning record title to the ;roperty abutting said road on the date
of this order.

Commissioner Norton:
This letter Is to request that Short Road be abandoned and vacated as a county road.
My property is at the back of the cul-de-sac, and I understand that this means that the
county will no longer maintain the road and that it will be maintained by Barry
Wilkerson. I request that the road be closed and the property under it be deeded to the
property owners that abut it in proportion to the frontage owned.

Re: Short Road closing
Commissioner Norton:
This letter is to request that Short Road be abandoned and vacated as a county road. I
am the only person who lives on th-3 road, and own more than 95% of the land on both
sides. Mr. Bill Patton owns about 4 acres at the back of the cul-de-sac, and has about
25' of frontage on Short Road. He has agreed to the closing and will write you a letter
agreeing to the same. Carl McNealey owns 3.16 acres along the beginning of Short
Road and has about 60' of frontage. He has also agreed to the closing and will send
you a letter. I have maintained th s road since I moved here 9 years ago and shall
continue to do so. I plan to curb the road and gravel it. The county has made three
passes up the road in the 9 years. It is a narrow road and is not easily graded by large
graders. This closing will be advar tageous to the county in that it will save tax dollars
for upkeep. I request that the road be closed and the property under it either be
deeded to me or to the property ow iers that abut it in proportion to the frontage owned.
