VOLE PAGE /Z7 • • COMMISSIONERS' COURT REGULAR MEETING DECEMBER L4, 1992 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, December 14, 1992, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding= Gary Norton, Commissioner of Precinct is Walter Wilcox, Commissioner of Precinct 2= Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 41 Mary Ann Ward, County Clerk. Asst. to County Judge Auditor's Office Auditor's Office Road & Bridge Deputy Treasurer Sheriff KBTX-TV KBTX-TV Brazos County Resident Herwald Pest Control Attorney Attorney Telink, Inc. Commissioner Sims gave the invocation and led the pledge of allegiance. The Court next considered approval of the minutes of the Commissioners' Court' meetings held September 22, 1992, September 25, 1992, September 28, 1992 (9:00 a.m.) September 28, 1992 (1:30 p.m.) and October 5, 1992. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the minutes as submitted. The Court next considered Budget Amendment #92/93-04, which would reallocate funds budgeted for the Elections Department. on motion by Commissioner Turner, seconded by Commissioner Sims, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered the renewal of contracts for the Sheriff's Department. The consideration of the first 11- ~ I Commissioners' Court meeting December 14, 1992 • contract with the City of Bryan to hold prisoners was tabled until such time as the Sheriff received a copy of it from the City of Bryan. The second contract, is with Telink which provides a phone system in the jail. The Sheriff informed the Court that revenue from calls made by inmates amounted to approximately $43,000.00 last year. He went on to say that negotiation with Telink generated an increase in the amount of percentage paid to the County on local and long distance calls. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to renew the contract with Telink to provide a phone system for the inmates in the County Jail. The Court next considered awarding the following bids: Bid No. 93-663 - Annual Maintenance Contract for 3levators Montgomery Dover Elevators Elevators Monthly Charge $495.00 $615.00 Initial Safety Inspection N/C 582.00 Labor per Hour 62.90 72.75 Cheryl Turney, Purchasing Agent, recom- mended accep:ance of the low bid submit- ted by Montgomery Elevators. On motion by Commissioner Sims, seconded by Commis- sioner Wilccx, the Court voted unani- mously to accept the recommendation of the Purchasi zg Agent and award the con- tract to Mon,:gomery Elevators. On motion by Commissioner Sims, seconded by Commissioner Turner, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to Dealers Electric and Magnetek. Consideration of the abandoning and vacating of Short Road in Precinct 1 was tabled until letters are received from the residents. The Court next considered two requests by GTE Southwest. The first to place a road bore within the right-of-way of Barron Road Cut-Off in Precinct 1. The second, to place a 2" road bore in the right-of-way of Stewart's Meadow Road at its intersection with old Jones Road in order to install a buried cable that will run for a distance of 2175' along the right- of-way of old Jones Road. The site is located in Precinct 4. Tho County Engineer stated that all appeared to bo in order and recommended approval of both requests. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the two requests of GTE Southwest and authorized the installations. A copy of each request is attached hereto. Consideration of the request submitted by Natural Gas Pipeline Partners to install a gas line in the county right- of-way of Sims Lane in Precinct 4 was tabled until further information arrives from the company. The Court next considered approval of the preliminary plat of Evergreen Estates Subdivision in Precinct 2. Holland Winder, County Engineer, stated that he had reviewed the plat and it appeared to be in order. On motion by Commissioner t I i~ • ,0 Commissioners' Court meeting December 14, 1992 Sims, seconded by Commissioner Wilcox, the Court unanimously approved the preliminary plat of the Evergreen Estates Sub- division with the stipulation that it show the original width of the road and a set back line of 25 feet be shown on the plat. The Court next considered authorizing work outside of county rights-of-ways for the enhancement of county road projects. The Road and Bridge Department requests permission to enter the private property of Willie C. Locke, Jr. on Rabbit Lane to mount a directional traffic sign on the gate entrance to the pasture for the health, safety and welfare of the general public. On motion by Commissioner Wilcox, seconded by Commissioner Sims, the Court voted unanimously to authorize the work. The Court acknowledged receipt of the Extension Service reports for November 1992 and receipt of reports from county and Precinct Offices showing revenues collected and remitted to the County Treasurer. Buried cable will be placed beneath Stewart Meadow Road by making a 2" bore and continue Southwest along and within 3' of the Northern right- of-way boundary for an approximate distance of 2175'. The location and description of this line and associated appurtenances is more fully shown by four copies of drawings attached to this notice. The line will be constructed and maintained on the County Road right-of-way in accordance with governing laws. Notwithstanding any other provision contained herein, it is expressly understood that tender of this notice by GTE does not constitute a waiver, surrender, abandonment or impairment of any property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may be granted in the future and any provision or provisions so con- strued shall be null and void.
