VOL/-PAGE. /1_f • m r COMMISSIONERS' COURT SPECIAL MEETING • NOVEMBER 30, 1992 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, November 30, 1992, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The following citizens and officials were in attendance: • Ruth McLeod Carol Palmer Bea Green Rosalie Todaro Cheryl Turney A. H. Asst. to County Judge Secretary to Commissioners Auditor's Office Auditor's Office County Engineer County Treasurer Bryan/College Station Eagle KBTX-TV KBTX-TV Commissioner Sim:: gave the invocation and led the pledge of allegiance. The Court first considered Budget Amendment #92/93-03, which would take fu:ids budgeted for the Non-Departmental Department and transf!r them to the Brazos Center. On motion by Commissioner Sims• seconded by Commissioner Norton, the Court voted unanimoussly to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered an order appointing James A. Amis, Jr. to sit as Special Judge in County Court at Law II on December 31, 1992 to allow Judge Ryan to take personal leave r~ u time. On motion by Commissioner Norton, seconaea Dy Commissioner Turner, the Court voted unanimously to approve the order naming James A. Amis, Jr. as Special Judge for County Court at Law II on December 31, 1992. A full copy of the Order is attached to and made a part of these minutes. ' vV Y L .C.. 4..~ Commissioners' Court meeting November 30, 1993 V •.ti.. The Court next considered the request by Aquila Southwest Pipeline Corporation to place two (2) road bores in the right- of-way of Schehin Road approximately 642.7 feet from Parker Lane for the purpose of installing a 6 inch low pressure and a 4 inch high pressure natural gas pipe line. Included with the request is company check 11016306 in the amount of $1,000.00. The site is located in Precinct 1. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Norton, seconded by Commissioner Wilcox, the Court voted unanimously to approve the request of Aquila Southwest Pipeline Corporation and authorized the installation. A copy of the request is attached hereto. The Court next considered the request by Wellborn Water Supply Corporation to install a 2 inch water line in the right-of-way of Batts Ferry Road to set a new meter for Southwestern Pipeline Company. The site is located in Precinct 1. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Norton, seconded by Commissioner Wilcox, the Court voted unanimously to approve the request of Wellborn Water Supply Corporation and authorized the installation. A copy of the request is attached hereto. The Court next considered two requests by GTE Southwest. The first to place buried cable in the right-of-way of Batts Ferry Road from the existing cable for a distance of 94.0 feet towards the Southwestern Pipeline Company. The site is in Precinct 1. The second, to place two (2) road bores in the right-of-way of (1) Dowling Road and (2) Saddle Lane; beginning at the intersection of Dowling Road and Quail Run Drive in a southeasterly direction for a distance of 1730.0 feet. The sites are in Precinct 1. The County Engineer stated that all' appeared to be in order and recommended approval of both requests. On motion by Commissioner Turner, seconded by Commissioner Sims, the Court voted unanimously to 9 i u Commissioners' Court meeting November 30, 1993 approve the requests of GTE Southwest and authorized the installations. A copy of each request is attached hereto. • The next matter for consideration was the vacating and re-subdivision plat of lots 26 and 43 Lake Millican Estates in Precinct 1. The County Engineer stated that all appeared to be in order and recommended approval of the request. Commissioner Wilcox stated that the current right-of-way did not meet the 60 feet right-of-way requirement of the Subdivision Regulations. Commissioner Norton directed the County Engineer to request an additional 5 feet of right-of- way along the road. Commissioner Sims asked if all the property owners had been notified and signed the approval. Commissioner Norton stated that he did not feel it necessary to contact the property owners for the additional 5 feet of right-of-way. On motion by Commissioner Norton, seconded by Commissioner Turner, the Court voted unanimously to approve • the vacating and re-subdividing of Lake Millican Estates Lots 26 and 43 with a variance to the 60 foot right-of-way requirement of the Subdivision Regulations. Cask Force Claims-123335-thru-123347- On line che(:ks - 92853-92854-92856 Commissioners' Court meeting November 30, 1993 Commissioner Sims questioned a claim for the payment of National Court Reporter dues for the Court Reporter of the 361st District Court. He next questioned a claim for the payment of dues to the Central Texas Justice of the Peace Association for both Wesley Hall and his clerk. Commissioner Sims recommended paying one membership only. Commissioner Sims next asked about payment to TRW for credit information. He was told that it could be paid for with Hot Check funds. On motion by the County Judge, seconded by Commissioner Norton, the Court voted unanimously to approve the Claims as submitted. There being no further business to come before the Court, the meeting was adjourned. This cable will be placed at a minimum depth of 30", 1' off the existing cable. The location and description of this line and associated appurtenances is more fully shown by four copies of drawings attached to this notice. It will be necessary to bore under Saddle Lane and Aggieland Country School's private drive to place the above mentioned cable within the designated right-of-way of Quail Run. The location and description of this line and associated appurtenances is more fully shown by four copies of drawings attached to this notice. The line will be constructed and maintained on the County Road right-of-way in accordance with governing laws. Notwithstanding any other provision contained herein, it is expressly understood that tender of this notice by GTE does not constitute a waiver, surrender, abandonment or impairment of any property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may be granted in the future and any provision or provisions so con- strued shall be null and void.
