THE COMMISSIONERS' COURT WILL MEET IN SPECIAL SESSION ON TUESDAY,
NOVEMBER 10, 1992, AT 10:00 A.M. IN THE COMMISSIONERS' COURTROOM
OF THE BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115,
BRYAN, TEXAS.
1. Consider and take action on the creation of a wetlands at the
Brazos Center.

COMMISSIONERS' COURT
SPECIAL MEETING
NOVEMBER 10, 1992
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Tuesday, November 10, 1992, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The following citizens and officials were in attendance:

The Court met to consider adopting a resolution setting
aside a certain tract of land adjacent to the Brazos Center
for the creation of a wetlands. The County Judge turned the
meeting over to Dan Wilkerson, representative of the City of
Bryan, who explained that this is a creation of wetlands to
replace the area being closed by the Walmart Corporation due
to a recent land purchase. He went on to say that the County
was not creating something that was not already in existence
currently. He further stated that the City of Bryan would be
responsible for the control of mosquito infestation. This
action is necessary to obtain a United States Army Corps of
Engineer's 404 permit for development.
The County Judge informed the Court that this is a joint
venture between private business and the County and that
Brazos County was not obligated to maintain this area.
Commissioner Sims requested that a copy of the plan for the
creation of a wetlands area be submitted to the Corp of
Engineers and that a signed copy be returned to the Court. On

motion by Commissioner Sims, seconded by Commissioner Norton,
the Court voted unanimously to adopt A Resolution Setting
Aside a Certain 2.71 Acre Tract of Land Adjacent to the Brazos
Center in Brazos County for dedication as wetlands and that it
be immediately effective upon its passage and adoption.
Commissioner Norton seconded the motion and it carried
unanimously.
There being no further business to come before the Court,
the meeting was adjourned.

have been examined and approved in open Court

A RESOLUTION SETTING ASIDE A CERTAIN 2.71 ACRE TRACT OF LAND
ADJACENT TO THE BRAZOS CENTER IN BRAZOS COUNTY FOR DEDICATION AS
WETLANDS AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Brazos County owns approximately fifty acres of land,
more or less, in Bryan, Brazos County upon which the Brazos Center
building itself is situated along with other grounds and parking
area; and,
WHEREAS, Brazos County desires to cooperate and participate
in the Federal Conservation of Wetlands program; and,
WHEREAS, a certain tract of land on the Brazos Center lands
is ideally suited for Wetlands dedication; NOW THEREFORE,
BE IT RESOLVED BY THE BRAZOS COUNTY COMMISSIONERS COURT THAT:
Section 1. That certain 2.71 acre tract of land adjacent to
the Brazos Center and more fully described in Exhibit A attached
hereto and incorporated herein by this reference for all purposes,
is hereby dedicated as a Wetlands area as that is defined by the
Federal government.
Section 2. It is understood that Brazos County shall not be
required to contribute any further funding to the creation of this
Wetlands area.
Section 3. This Res)lution shall be immediately effective
upon its passage and adoptLon.
PASSED AND ADOPTED THIS ;&L? DAY OF NOVEMBER, 1992 BY AFFIRMATIVE
VOTE OF THE BRAZOS COUNTY -COMMISSIONERS COURT.

Field notes of a 2.71 acre tract or parcel of land, lying and being situated
In the Richard Carter Survey, Abstract No. S. Brazos County, Texas, and being
part of the 6.3 acre tract described in the deed from Bart Wheeler's Beverage
Stores, Inc., to Brazos County, Texas, recorded in Volume 324, Page 684, of
the Deed Records of Brazos County, Texas, and being more particularly
described as follows:
COMMENCING at the 1/2' Iron rod found at a 6- creosote post marking
the north corner of the boforomentioned 6.3 acre tract. In the southeast right-
of-way lino of Briarcrest Drive (F.M. No. 11791 same being In a curve concave
to the northwest, having a radius of 1492.15 feet, said iron rod also being the
north corner of a 50.0 acre tract described In the deed to Brazos County,
Texas, recorded In Volume 324, Page 684, of the Deed Records of Brazos
County, Texas;
THENCE S 330 34' 04' E along the common line between the
boforementlonod 6.3 acre tract and a Bert Wheeler's, Inc. 5.89 acre tract
(remainder of 1580.68 acres, Volume 291, Page 764), for a distance of
349.95 foot to the PLACE OF BEGINNING of this description In Carter's Creek;
THENCE S 330 34'04* E continue along the common line between the
beforementioned 6.3 acre tract and the Bert Wheeler's Inc., 5.89 acre tract, at
a distance of 50.00 feet pass a 1/2' Iron rod set, continue on, for a total
distance of 760.00 feet to a 1/2' iron rod set;
THENCE S 560 25' 58- W 75.00 feet to a 1/2' Iron rod set;
THENCE N 330 34' 04' W 320.00 feet to a 1/2' Iron rod set;
THENCE N 630 34' 04' W 250.00 feet to a 1/2' iron rod set.
THENCE N 330 34'04' W at a distance of 360.00 feet, pass a 1/2'
Iron rod set, continue on, for a total distance -if 420.00 feet;
