A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, November 9, 1992, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court next .:onsidered Budget Amendment #91/92-37,
•
which would reallocate funds budgeted for the Sheriff's
Department, The Coun+:y Attorney, Constable Precinct 4 and
Constable Precinct 7. On motion by Commissioner Sims,
seconded by Commissioner Wilcox, the Court voted unanimously
to approve the budget amendment as submitted, a copy of which
is attached hereto.
The next item on the agenda was to canvas the results of
the General Election hold November 3, 1992 to vote on
national, state and lccal offices. The County Judge read the
final results as tabulated by the electronic counting
equipment. The totals are as follows:

On motion by the County Judge, seconded by Commissioner Sims,
the Court voted unanimously to accept as true the county-wide
totals and ordered tho results be certified to the Secretary
of State and recorded in the Official Election Records of
• Brazos County.
Commissioner Sims gave an overview of refuse collection
for Brazos County. He asked the members of the Court to give
consideration to some of the following suggestions:

He then asked the Court for recommendations on the construc-
tion of citizen collection stations throughout the county.
On motion by Commissioner Turner, seconded by
Commissioner Wilcox, the Court voted unanimously to reappoint
the following persons as Fire Commissioners of Rural Fire
Prevention District #4 for two (2) year terms.

The Court next considered payment of the High Speed Rail
Committee assessment of $1,100.00. Commissioner Sims gave a
report of the High Speed Rail Committee. He stated that the
meetings had been informative and would like to continue to
attend. It was the consensus of the Court to table considera-
tion of payment of the assessment until a later date.
The Court next considered the request by GTE Southwest to
place buried cable and a road bore along and across the right-
way of Democrat Road: location $1 beginning at its
intersection with SH 21 for a distance of 0.6 miles; location
N2 is 1.1 miles northeast of Plagens Road. This is being done
to provide service to a county resident. The site is located
in Precinct 3. The County Engineer stated that all appeared
to be in order and recommended approval. On motion by
Commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to approve the request of GTE Southwest and
authorized the installation. A copy of the request is
attached hereto.
The Court next considered two requests by Aquila
Southwest Pipeline Corporation. The first, to place a road
bore in the right-of-way of Weedon Loop approximately 3.15

miles from its intersection with Hardy Weedon Road for the

purpose of installing a natural gas pipe line. The second to
place a road bore in the right-of-way of Weedon Loop
approximately 3.14 miles from its intersection with Hardy
Weedon Road for the purpose of installing a natural gas pipe
line. The requests are accompanied by company check 11016226
in the amount of $1,000.00. This is $500 for each request.
The sites are located in Precinct 3. The County Engineer
stated that all appeared to be in order and recommended
approval. On motion by Commissioner Wilcox, seconded by
Commissioner Sims, the Court voted unanimously to approve the
requests of Aquila Southwest Pipeline Corporation and
authorized the installations. A copy of each request is
attached hereto.
The Court next considered authorizing work outside of
•
county rights-of-way for the enhancement of county road
projects. The Road and Bridge Department submitted four
requests. The first is for permission to enter the private
property of J. O. Siegert on Smetana Road to dispose of excess
material removed from road right-of-way. The second to enter
the private property of Bill Scarpinato on Sims Lane Cut-off
to clean a ditch to allow for proper drainage flow. The third
to enter the Gifford-Hill Plant property on Sims Lane Cut-off
to construct an outlet channel. The fourth to enter the Young
Brothers Construction, Inc. property on Silver Hill Road to
construct a ramp to sot a water pump in the creek for County
use. On motion by Ccmmissioner Turner, seconded by Commis-
sioner Wilcox, the Court voted unanimously to authorize the
work.

The Court acknowledged receipt of the Extension Service
reports for October 1592 and reports from County and Precinct
offices showing revem.es collected and remitted to the County
Treasurer. An excerpt from those reports is attached hereto.

THAT WHEREAS, on November 9, 1992, the Court heard and
approved a budget amendment for the 1991-1992 budget year for
Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 3,
1991, the following amendment(s) to the original are hereby

scheduled for October 1992. If you have any questions con-

TO THE COMMISSIONER'S COURT OF Brazos COUNTY
ATTENTION COUNTY ENGINEER
Formal notice is hereby given that GTE SOUTHWEST INCORPORATED will construct a communication line
within the right-of-way of a County Road in Brazos County,
Texas as follows:
Location M1: Beginning point is the intersection of Democrat Road
and Highway 21. Buried cable will be placed East along
and 3' inside the North right-of-vay boundary for an
approximate distance of 3210'.
Location #2: Beginning point is on Democrat Road, 1.1 miles North-
east-QS!Pngeri Road. Democrat Road will be bored and
a -buried drop placed under the road. The drop will
~~/?af~~s then turn Southwest and be placed 3' inside the right-
of-way before turning onto property owned by Ruffs 1
ord.
The location and description of this line and associated appurtenances is more fully shown
by four copies of drawings attached to this notice. The line will be constructed and maintained
on the County Road right-of-way in accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly understood that tender of this notice
by the GTE Southwest Incorporated does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may
be granted in the future and any provision or provisions so construed shall be null and void.
Construction of this line will begin on or after October 26 19 92

proposes to place a (type) natural gas
pipeline within the right-of-way (road) Wcr(lon Lcx)p
In Brazos County, Texas as follows:
The location or description of the proposed installation Is more fully shown by
3 coples of the drawings attached to this notice.
1. The County Engineer must be notified prior to the beginning of construction In order that
they might be on hand to designate the actual location of the Installation.
2. That all damage to the roadways and right-of-ways will be repaired to their original condition
to the satisfaction of the :ounty Engineer.
3. That Brazos County rese ves the right to require Applicant to relocate or lower any such
line at no cost to Brazos County, should same become necessary due to widening or
lowering, or other alterati m of the roadway or right-of-way.
4. That Brazos County Is Ir no way responsible for any damage that might occur to any
existing utility lines In the right-of-way.
5. That the line will be const acted and maintained on the County right-of-way In accordance
with governing laws.

8. That the line or lines will t a constructed no less than forty-olght Inches (48') lower than the
lowest part of the dralnal; a or bar ditch and the drainage Is to be considered at least two
feet (2) below the center of the roadway.
7. That all roads shall be bor )d and cased for such distance, from toe of slope to toe of slope
and In no case shall an o )en pit be allowed within four feet of the shoulder of the road.
8. That all sites will be barricaded during the construction period.
9. That the normal charge is 1500 00 per crossing and/or $40 00 per rod when paralleling the
roadway established by 111 .9 Commissioners' Court on January 28, 1985.
10. Ditch line shall be compacted to 90% standard density ASTM-Test method No. D-698; test

In Brazos County, Texas as follows: The location or description of the proposed Installation Is more fully shown by
3 coples of the drawings attached to this notice.
1. The County Engineer must be notified prior to the beginning of construction In order that
they might be on hand to desigr>.ite the actual locatlon of the Installation.
2. That all damage to the roadways and right-ol-ways will be repaired to their original condition
to the satlslaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate or lower any such
line at no cost to Brazos County, should same become necessary due to widening or
lowering, or other alteration of the roadway or right-ol•way.
4. That Brazos County Is In no way responsible for any damage that might occur to any
existing utility lines In the right-ol-way.
6. That the line will be consh ucted and maintained on the County right-ol-way In accordance
with governing laws.
