To make arrangements, call (409) 3614102. y i t REGULAR MEETING • 4 COMMISSIONERS' COURT NOVEMBER 23, 1999 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, November 23, 1999, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm. S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Jones gave the invocation and led the pledge of allegiance. The Court proceeded to consider the change of status of A employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 20001504 through 200017000 On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the Claims as submitted. 01 The next matter for consideration by the Court was rescinding the Order banning out door burning. As of Sunday, the drought index was at 653. Commissioner Jones moved to table consideration. The motion was seconded by Commissioner Cauley. The County Judge wanted to be allowed to release the burn ban should the County receive significant rail fall. Commissioners Jones and Cauley withdrew their motion and second. Then on motion by Commissioner Jones, seconded by Commissioner Cauley, to Court voted unanimously to appoint the AWFC`L► 9-.PACxr- 5 01 t . Commissioners Court meeting November 23, 1999 2 County Judge as agent of the Court to rescind the burn ban order should sufficient rain fall. The next matter for consideration was a funding request submitted by the Bryan-College Station Economic Development Corporation. This request in the amount of $20,000.00 is for the current phase of the community's information technology industry marketing effort. On motion by the County Judge, seconded by Commissioner Thornton, the Court voted unanimously to approve the funding request. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court proceeded to set the holidays to be observed by Brazos County for 2000: January 17, April 21, May 29, July 4, September 4, November 23 & 24 December 25 & 26 January 1, 2001 One (1) Floa Martin Luther King Birthday Good Friday Memorial Day Independence Day Labor Day Thanksgiving Christmas New Year ting Holiday The Court next considered a request for use of the 5 i .l t County's postage meter and mail service. Commissioner Sims, speaking as President of the County Judges and Commissioners Association of Texas, made the request. This is necessitated due to the number of mass mailings that will have to go out from his office. He proposed reimbursing the County at the rate of $.30 per piece of mail. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the request for use of the postage meter by the County Judges and Commissioners Association of Texas. The next matter before the Court was approval of a Contractual Agreement between Brazos County and the Brazos i Valley Council of Governments (BVCOG). The BVCOG will provide administrative services for the Indigent Health Care Program. 4 L The cost to Brazos County will be $60,000.00 annually. The term of the contract will be from October 1, 1999 through R September 30, 2000. A copy of the contractual agreement is attached hereto. The Court proceeded to consider the following blanket Purchase Orders: Nationwide Papers Jail $ 500 Ecolab Jail $ 700 Cain's Coffee Jail $ 500 Lilly Dairy Jail $2,800 Butterkrust Jail $1,300 Ben E. Keith Jail $2,000 US Foodservice Jail $1,000 Performance Jail $7,525 Alliant Food Jail $7,525 Sysco Food Jail $7,650 Scarmardo Produce Jail $3,000 On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the Blanket' Purchase Orders as submitted. The Court next considered approval of requisitions from the Capital Projects Fund for the following purchases: a) 3 Computer terminals and keyboards for the Tax Office $1,107.00 b) 3 Printers for the Tax Office $882.00 On motion by Commissioner Cauley, seconded by Commissioner Jones, the Court voted unanimously to approve Item "a" to be paid from Capital Projects Fund. On motion by the County Judge, seconded by Commissioner Cauley the Court voted unanimously to table consideration of the purchase of printers for the Tax Office. The Court next considered awarding Bid No. 2000-013R, Transportation of Deceased to Medical Examiner. John Hachmann, Purchasing Agent, recommended acceptance of the bid r submitted by Daniel & Son Funeral Home. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to Daniel & Son Funeral Home. A copy of the bid tabulation is attached. r 1. i Commissioners Court meeting November 23, 1999 4 The Court next considered the following requisition for purchases through sealed competitive bids for the Road and Bridge Department: aid Amount 1) No. 99-010 - Rental Equipment $1,000,000.00 Operator Primary - TexCon On motion by Commissioner Jones, seconded by Commissioner Sims, the Court voted unanimously to approve the above listed requisition for the Road and Bridge Department. The next matter for consideration was approval for the Purchasing Agent to advertise Bid 2000-022, Energy Conservation Measures (Courthouse Energy Management System Maintenance). On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the Purchasing Agent to advertise for bids for Energy Conservation Measures. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Billy Payne on Ferrill Creek Road to clear and remove an old fence line, reshape gully and construct a new fence for erosion control. On motion by Commissioner Thornton, seconded by Commissioner Jones, the Court voted unanimously to authorize the work. The court next considered approval of the minutes of the Commissioners' Court meetings held in July and August, 1999 on the following dates: July 5,13,20,27; August 3,10,17,24; Public Hearings held August 10 and 26; workshop held on August 10; Special meeting held August 12 and Training Session held July 21, 1999. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the minutes as submitted. The County Judge read aloud a Proclamation designating the month of December as "Brazos Valley TROUP Month". On motion by Commissioner Sims, seconded by Commissioner Cauley the Court moved to proclaim the month of December 1999 as "Brazos Valley TROUP Month" throughout Brazos County. The Court acknowledged receipt of the Extension Service reports for October 1999 and acknowledged receipt of reports from the following County and Precinct Offices showing ' revenues collected and remitted to the County Treasurer: County Clerk District Clerk Justice of the Peace Precinct 2 Justice of the Peace Precinct 3 Justice of the Peace Precinct 4 Justice of the Peace Precinct 5 Justice of the Peace Precinct 6 Constable Precinct 4 Constable Precinct 5 Constable Precinct 6 Brazos County Events Facilities County Attorney Road & Bridge Tax Assessor/Collector A copy of the Officials' reports can be viewed in the County Auditor's office. Under announcement of interest items and possible future ` agent topics, the County Judge made the following comments: a) There will be a meeting of the Historical Commission in Austin on December 4, 1999. They will consider designating the LaSalle Hotel and City Hall as historical buildings. b) The DPS will be manning a full time operation center from December 28, 1999 through January 1, 2000 to combat any Y2K problems should they occur. The Judge will be the contact person for Brazos County. c) The CUC is conduction a survey and asking the County to participate. Commissioner Sims has sent his in already. The other members of the Court need to do the same. The County Treasurer had the following question: a) What happens to merit money when an employee leaves. The County Judge } replied that funds do not stay with the position but revert back to the merit pay line item in the department. ~'BLL.~.A1Cx~~~3 b Commissioners Court meeting November 23, 1999 6 The County Judge continued with his announcements: t k r E i d) There was a question on a lump sum withdrawal from the retirement fund. He said that he would wait for a response from TCDRS before putting this item on the agenda. e) He received a draft copy of the 25 year long range plan from the MPO. f) He brought the Court up to date on a study being conducted on Highway 6 South and what the TxDot can do to make the road safer. Commissioner Sims made the following comment: a) He asked about renaming roads in the county. He then asked Commissioner Jones if he was ready for a Public Hearing to be scheduled. The County Judge replied that he was concerned that changing the names of roads could cause problems with the census. The Sheriff made the following comment: a) The contractor on the Minimum Security Jail expansion peeled back some flashing while working on the building. Rain came in and flooded the jail causing the relocation of prisoners. There was no citizen input and/or concerns. Novgmber 23-1992 County Judge or Commissioners Signature: , :i vot, • F INDIGENT HEALTH CARE CONTRACT This Contract is Sub'ect to Arbitration Under the Texas General Arbitration Act This Contract is entered into by and between BRAZOS COUNTY acting by and through its duly elected Board ( hereinafter "County") and the BRAZOS VALLEY COUNCIL OF GOVERNMENTS (hereinafter "BVCOG"). The purpose of the Contract is to outline the responsibilities of each of the parties in the operation of the Indigent Health Care and Treatment Act, created by House Bill 1398 during the Special Session of the 76"' Texas State Legislature. . The parties mutually agree as follows: In compliance with the Indigent Health Care and Treatment Act and the Texas Constitution, the County agrees to provide the financial resources for the mandatory, Inpatient, Outpatient, Physician, Prescription, X-Ray, Laboratory, Rural Health Clinic and Family Planning Services to Eligible household members who meet the requirements of the Act, the Texas Department of Health (TDH) Handbook, and the BVCOG. RATES FOR REIMBURSEMENT W%F ~~AGW- I~ 3 t z~. J 4 i z A r d The County agrees to join other counties in the region and provide a pro-rata share of funds for the Administration of the County Indigent Health Care (CIHC) Program by BVCOG for the State Dept. of Health, Region 7. The amount payable by BRAZOS COUNTY to BVCOG is $60,000.00 through September 30. 2000. Payment will be made to the BVCOG, quarterly. RESPONSIBILITIES OF BVCOG For and in consideration of the funding provided by the County, the BVCOG will be responsible for providing the following services pursuant to this Contract: 1. Providing all necessary application forms to potentially Eligible Individuals. 2. Provide intake services in the County at least once a month. 3. Assist applicants in completing all necessary forms. 4. Determine the Eligibility of each applicant with regard to residency and qualifications defined in the Act, including but not limited to Sections 1.01 and 1.04. In this capacity the BVCOG shall also be responsible for mailing all necessary forms and following all procedures defined in the handbook with regard to notifications and appeals on the issue of household eligibility. k,r• t- `i f i i i ~i i i l C I B 2 - CIHC Contract Brazos County 5. Maintain this Contract and assist the parties hereto In the operation of the Program. 6. Maintain data files on Clients. 7. Provide information to all parties as needed. 8. Respond to all and any inquires regarding the Program. 9. Assist the County with information needed for Audit purposes. 10. Monitor the Program on a periodic basis to review overall Program management and operation 11. Assist the County with all of its responsibilities under the Act and the Constitution. 12. Perform all other duties and functions necessary to fulfill the requirements as outlined in the Act and TDH Handbook. 13. Review the Eligibility of each household every six (6) months. 14. Prepare and distribute to the Provider no less than once every six (6) months a computer list of Eligible Residents. 15. Determine Eligibility not later than the fourteenth (14) day after receiving a completed application from an applicant including all necessary documentation and verifications. 16. Receive all Bills submitted by the Provider for payment of Services and review the same to verify that the Services and the patient qualify in all respects. 17. Send all Bills for payment to the County for payment. RESPONSIBILITIES FOR THE COUNTY The County shall be responsible for the following duties and requirements: 1. Provide County funds for the payment of mandated services. 2. Provide County funds for the Administration of the Program to the BVCOG on a quarterly basis. 3. Develop a system for the payment of Indigent Health Care Services bills or incorporate this billing into the County's established system for paying like bills. 4. Provide an audit of the Program as required by State law. 5. Accept ultimate responsibility for payment of services, which may be determined through an audit to have been an Ineligible expense. 6. Provide for and assist with the procurement of and payment for legal services as necessary. 7. Provide for and assist with the procurement of and payment for additional audit services. i 4 f h .r f. • . *I Page 3 - CIHC Contract Brazos County TERM This Contract shall continue in force and effect for a term of one (1) year commencing on the First day of October, 1999 and shall terminate on the Thirtieth day of September, 2000. CONCELLATION This Contract will be canceled automatically should the County become remiss in their reimbursements to the BVCOG for administrative services. This Contract may be canceled by either of the parties hereto upon Sixty (60) days written notice as provided herein. INDEMNTY Any monetary loss suffered by the County from Ineligible Clients, mistake, fraud or other conditions cannot be recovered from the BVCOG. AMENDMENT This Contract shall be automatically amended by the amendments made to the Act by the State Legislature, in all other respects, this Contract may only be amended by the written consent of all the parties hereto. GOVERNING LAW This Contract shall be executed in and shall be governed by the laws of the State of Texas. FURTHER ASSURANCES Each party hereto agrees to perform any further acts and to execute and deliver any further documents, which may be necessary to cant' out the provisions of this Contract. WIDL -15,.PA13p- 52.-L Page 4 - CINC Contract Brazos County SEVERABILITY In the event that any of the provisions or portions of this Contract are held to be unforceable or invalid by any court of competent jurisdiction, the validity and enforceability of the remaining provisions or portions hereof shall not be affected thereby. ENTIRE CONTRACT This Contract contains the entire understanding between the parties hereto concerning the subject matter contained herein. There are no representations, agreements, arrangements or understanding, oral or written, between or among the parties hereto, relating to the subject matter of the Contract, which are not fully expressed herein.
