REGULAR MEETING
NOVEMBER 16, 1999
A regular meeting of the Commissioners' Court of Brazos

County, Texas was held in the Commissioners' Courtroom in the
! Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, November 16, 1999, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Judge Jones gave the invocation and led the pledge of
allegiance.
The first matter before the Court was the presentation of
a Resolution by the County Judges and Commissioners
Association of Texas to Senator Steve Ogden. The County Judge
introduced Commissioner Randy Sims who is the President of the
Association. Commissioner Sims then introduced Jim Allison,
General Counsel of the Association, who made the presentation
to Senator Ogden.
The Court next heard a presentation by the Brazos Valley
Council of Governments' Environment Sub-Committee concerning
regional growth management planning efforts. They presented
the results of a study of open space.
The Court next considered authorizing the Auditor's
Office to process recurring payment requests for the
following:
a) Becky Segrest, for serving on Juvenile
Board $600
b) Brazos Animal Shelter, $63,000
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the Auditor's
Office to process the previously noted recurring payments.

The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
20001265 through 20001503
On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Claims as
submitted.
The next matter for consideration by the Court was
rescinding the Order Prohibiting Outdoor Burning. Assistant
Emergency Management Coordinator, Ed McKenzie stated that the
drought index was at 671 and that he recommended not lifting
the ban. On motion by the County Judge, seconded by
Commissioner Thornton, the Court voted unanimously to table

consideration.
The Court next considered declaring exemption from the
Health Insurance Portability and Accountability Act of 1996.
On motion by Commissioner Sims, seconded by Commissioner
Thornton, the Court voted unanimously to be exempt from the
following sections of the Health Insurance Portability and
Accountability Act for plan year January 1, 2000 and ending

December 31, 2000:
(1) the limitations on imposing pre-existing
conditions exclusions;
(2) the requirement to have special
enrollment periods for employees and
dependents in certain circumstances;
(3) the prohibition against discrimination on
the basis of health status;
(4) standards relating to benefits for
' mothers and newborns;

' (5) parity in the application of certain
i limits to mental health benefits.

The next matter for the Court's consideration was an
Amended Lease Agreement with the Harvey Community Center for
the citizens' collection site. This agreement is to renew and
extend the original lease dated September 21, 1992. Rent will
be $1,200 annually and payable in monthly installments of $100
a month. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the Amended Lease Agreement with the Harvey Community Center.
A copy of the lease agreement is attached.
The Court next considered allocation of votes for to
Brazos County Appraisal District. On motion by Commissioner
Sims, seconded by Commissioner Cauley, the Court voted
unanimously to cast its votes for the following:

The Court proceeded to consider the following blanket
Purchase Orders:

On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered approval of a requisition from
the Capital Projects Fund for the following purchase:
a) Network Hardware for Juvenile Services
$2,904.96
On motion by Commissioner Cauley, 'seconded by Commissioner
Sims, the Court voted unanimously to approve the requisition
to be paid from Capital Projects Fund.
The Court next considered re-awarding item 5.7 on Bid
#99-059, Janitorial Supplies. In a memo to the Court it was
explained that Item 5.7, 39" x 56" Mobil Stell-Sak trash liner
did not hold up to the required need of the Brazos Center.
The Purchasing Department requested that item 5.7 be awarded
to Ray Criswell. On motion by Commissioner Thornton, seconded

by Commissioner Sims, the Court voted unanimously to re-award
item 5.7 on bid 99-059 to Ray Criswell.
The Court next considered awarding the following bids for

On motion by Commissioner Cauley, seconded by Commissioner
Jones, the Court voted unanimously to accept the
recommendation of the Purchasing Agent and award the contracts
as noted. Copies of the bid tabulations are attached.
The next matter for consideration was approval for the
Purchasing Agent to advertise Bid 2000-021, Purchase of Motor
Graders for Road & Bridge Department. On motion by
Commissioner Jones, seconded by Commissioner Sims, the Court
voted unanimously to authorize the Purchasing Agent to
advertise for bids for Motor Graders.
The Court next considered a recommendation from the
Purchasing Department concerning a copier for the Juvenile
Services Department and a requisition for the lease of a
copier. In a memo to the Court,, the Purchasing Agent stated
that he could not recommend buying a Canon NP 6085 copier for
Juvenile Services but suggested leasing one on state contract.
It would cost $615 per month plus have a maintenance agreement
for the duration of the lease. On motion by Commissioner
Cauley, seconded by Commissioner Jones, the Court voted
unanimously to accept the recommendation of the Purchasing
Agent to rent the copier and approved the requisition for the
lease of the copier.
The next matter for consideration by the Court was
acceptance of an easement grant conveyed to Brazos County as
easement for the purpose of expanding and improving the
drainage area adjoining Blue Ridge Drive in Precinct 1. On
motion by Commissioner Jones, seconded by Commissioner Cauley,
the Court voted unanimously to authorize the County Judge to
accept the easement grant from Cheryl Kruse on the improvement
of the drainage area adjoining Blue Ridge Drive located in
Precinct 1 subject to the addition of the field notes to the
document.
The Court next considered acceptance of Aquila Gas
Pipelines cost estimate of $14,500.00 for relocation of an
existing gas pipeline to accommodate the Greens Prairie Road

Extension in Precinct 1. On motion by Commissioner Jones,
seconded by Commissioner Thornton, the Court voted unanimously
to accept Aquila Gas Pipeline's cost estimate of $14,500.00
for relocation of an existing gas pipeline to accommodate the
Greens Prairie Road Extension.

The Court next considered approval of the Final Plat of
Lots 1R and 2R being a re-subdivision of Lots 1 and 2,
Spencer's Cove Subdivision in Precinct 1. Richard Vance,
County Engineer, stated that he had reviewed the plat and
recommended acceptance. On motion by Commissioner Jones,
seconded by Commissioner Cauley, the Court voted unanimously
to approved the final plat of Lots 1R and 2R in Spencer' s Cove
Subdivision in Precinct 1.
Under announcement of interest items and possible future
agent topics, the County Judge made the following comments:
a) He announced that use of a narcotics dog
use by Constables will be on the agenda
for the next meeting.
b) He received a copy of a survey from the
CUC that needs to be completed.
c) He has a request from Sgt. Walker from
the DPS. The DPS is establishing a time
period of 12-28 to 1-23 when they will
have people on duty 24 hours a day to
deal with any y2k problems that might
arise.
Sheila Walker, Director of the Brazos Center, made the
following comment:
a) Thanked the Maintenance Department for
their assistance in getting computers set
up for the ten day DecisionOne training
session.
b) Informed the Court that the Christmas
decorations from Mumford School will be
installed on Tuesday at 10:30 a.m. and
asked the members of the Court to be
present.
Sheriff Chris Kirk made the following announcement:
F c) The jail population continues to grow
with the daily average now at 402
inmates. He said that something must be
done to be in compliance with jail
standards. He stated that he had asked
for a variance from the Jail Commission
until June when the new jail is
completed.

There was no citizen input and/or concerns.
At 10:04 a.m. the County Judge announced the meeting
closed to the public so that the Court could meet in Executive
Session to discuss the acquisition of real property as allowed
under Section 551.072f the Texas Government Code.
At 11:03 a.m. the County Judge opened the meeting to the
public and announced that no action would be taken on the
Executive Session.
There being no further business to come before the Court,
the meeting was adjourned.

Dear Mr. Holstein:
Brazos County maintains a group health plan for its employees, the Brazos County Employee
Benefits Plan. The entire plan is self-funded. No part of the Plan is funded through insurance.
The plan year for the Brazos County Employee Benefits Plan runs from January 1, 2000 to
December 31, 2000.
Effective January 1, 2000, the substantive provisions of the Health Insurance Portability and
Accountability Act of 1996 (HIPAA) would apply to this plan, absent our annual election for
exemption from these provisions. The plan is not subject to a collective bargaining agreement.
For the plan year beginning January 1, 2000 and ending December 31, 2000, and pursuant to
HCFA Reg. Section 146.180, the Brazos County Employee Benefits Plan hereby elects
exemption form the following provisions of HIPAA:
1) the limitations on imposing pre-existing conditions exclusions;
2) the requirement to have special enrollment periods for employee and dependents in
certain circumstances;
3) the prohibition against discrimination of the basis of health status;
4) standards relating to benefits for mothers and newborns; and
5) parity in the application of certain limits to mental health benefits.

who declared that the Brazos County Employee Benefits Plan, previously established, is hereby amended
as follows:
ARTICLE XX, HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT (H1PAA)
COMPLIANCE is hereby restated to read as follows:

"HIPAA" shall mean the Health Insurance Portability and Accountability Act of 1996, as presently enacted
and as it may be amended from time to time, together with its related rules and regulations. References to
any section of HIPAA shall include any successor provisions.

AGREEMENT of Lease, made this the day of n~ercmeet
Aetebw, 1999, by and between THE
HARVEY COMMUNITY CENTER, acting by and through its duly elected Board of Trustees,
' (called "LANDLORD") and BRAZOS COUNTY, TEXAS, acting by and through its duly elected
Commissioners Court (called TENANT").
This agreement is to renew and extend the original Lease dated September 21, 1992. It is
agreed and understood that this lease may be terminated by either party by the giving to either party
written notice of intentions to do so, in which event the tern of this lease shall end.
Rent shall accrue during the term from and after the commencement of this Lease and shall
be payable by TENANT to LANDLORD at Bryan, Brazos County, Texas at a rate of ONE
THOUSAND TWO HUNDRED DOLLARS ($1,200.00) annually. The rent shall be due and
payable either in equal monthly installments of $100.00 payable in advance on or before the first day
of each calendar month or in full in one payment on the first day of the Tenant's fiscal year, at the
Tenant's option.
The terms, agreements, covenants and conditions contained in the original Lease are biding
upon and shall insure the benefit of the parties hereto and their respective successors and assigns.
IN WITNESS WHEREOF, the parties hereto have caused these presents to be duly executed
as of the day and year first above written.
