COMMISSIONERS' COURT
REGULAR MEETING
NOVEMBER 9, 1999
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, November 9, 1999, with the following members
of the Court present:
Alvin W. Jones, County Judge, Absent;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3, Presiding;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Cauley gave the invocation and led the
pledge of allegiance.
The Court next considered authorizing the Auditor's
office to process recurring payment requests for the
following:
a) Family Practice Residency of the Brazos
Valley for indigent health care $55,000
b) Estate of Brazos A. Varisco, rental of
space for boot camp $12,000
c) Montgomery Kone for elevator maintenance
$7,403
On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to authorize the
Auditor's office to process all the previously noted recurring
payments.
The Court next considered Budget Amendment #99/00-5.1,
which would reallocate funds for Constable, Precinct S. On
motion by Commissioner Cauley, seconded by Commissioner Jones,
the Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioners Court meeting November 9, 1999

Commissioner Thornton, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
20001062 through 20001264
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered rescinding the Order
Prohibiting Outdoor Burning. The Assistant Emergency
Management Coordinator reported that the drought index was at
658 and that he could not recommend lifting the ban. On
motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to table consideration.
The next matter for the Court's consideration was a Flat
Rate Subscriber Agreement with Database Technologies, Inc.
(DBT) for the County Attorney's Office. DBT agrees to provide
the County Attorney's office with unlimited access to Auto
Track Plus or Auto Track XP at the rate of $100 per month for
the period of one year. On motion by Commissioner Thornton,
seconded by Commissioner Jones, the Court voted unanimously to
enter into Agreement with Database Technologies, Inc. A copy
of the Agreement is attached.
The Court next considered Change Order No. 4 from R. M.
Dudley Construction for the Courthouse Additions and
Renovations. The Change Order would make the following
changes:
1. Extend masonry screen wall and slope floor
drain in Holding Cell 314 add $880.00 to cost.
2. Provide removable mullions for doors 56 and 60
add $528.00 to cost.
3. Provide horizontal rail for lever trim on doors
56 and 60 add $624.00 to the cost.
4. Remove existing flagpole and provide two new
flagpoles, lighting and concrete walk add $8,983.00
to the cost.
j 5. Repair exising sidewalk adjacent to new
{ flagpole location add $703.64 to cost.

6. Add VCT to entry at toilet add $56.00 to the
cost.
7. Provide two new plastic clad wood doors at
Office 267 and Reception 247 in lieu of refinishing
existing doors add $400 to the cost.
8. Extend East wall or Corridor 219 to Deck add
$128.70 to the cost.
9. Provide additional exit light as directed by
Fire Marshall add $150.00 to the cost.
10. Provide and install new door/frame/hardware
between Room 112, and corridor 108 add $800.00 to
the cost.
11. Credit for door hardware for Door 43 on Change
Order No. 3 deducting $488.00 from the cost.
12. Credit for door stop on existing security door
in Room 314 on change order No. 3 deducting $62.46
from the cost.
This will result in an adjusted total for Change Order No.
Four in the amount of $12,875.95 and a $1,903.83 increase to
the project. On motion by Commissioner Jones, seconded by
Commissioner Cauley, the Court voted unanimously to approve
Change Order No. Four. A copy is attached.
The next matter for consideration was authorizing the
Assistant Coordinator for Emergency Management to work a 40
hour week until such time as an Emergency Management
Coordinator is selected. On motion by Commissioner Jones,
seconded by Commissioner Cauley, the Court voted unanimously
to authorize the temporary 40 hour work week for Assistant
Emergency Coordinator.
The Court proceeded to -consider the following blanket
Purchase Orders:
Tom's BBQ Jury Services $500
Sloppy Joe's Jury Services $500
On motion by Commissioner Thornton, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
'The Court next considered approval of requisitions from
the Capital Projects Fund for the following purchases:
a) Desktop Projector for Metropolitan
Planning Organization $4,649.00

On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the
requisitions to be paid from Capital Projects Fund
The Court next considered approval of a requisition and
Consulting Agreement with Ben Sanford & Associates for
telecommunications counsel and assistance for long distance
telephone service. Term of the Agreement is six months. The

fee is $90 per hour, plus expenses. This includes travel,
lodging, meals, long distance, postage and other miscellaneous
out of pocket items. Travel reimbursement will be $.35 per
mile. Service fees shall not exceed 34 hours ($3,060) and
expenses are estimated at less that $300. On motion by
Commissioner Cauley, seconded by Commissioner Thornton, the
Court voted unanimously to enter into agreement with Ben
Sanford & Associates and authorized the County Judge to
execute the Agreement on behalf of Brazos County. A copy of
the Agreement is attached.
The Court next considered the request from Wellborn
Special Utility District to construct 2 road bores for
parallel waterline installation in the right-of-way of North
Dowling Road. The site is located in Precinct 1. The County
Engineer stated that all appeared to be in order and
recommended approval. On motion by Commissioner Jones,
seconded by Commissioner Thornton, the Court voted unanimously
to approve the request of Wellborn Special Utility District
and authorized the installation. A copy of the request is
attached hereto.
On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to accept the
!i Treasurer's Quarter Ending 09-30-99 Investment Report.

Commissioners Court meeting November 9, 1999
Under announcement of interest items and possible future
agent topics, the following comments were made:
a) Sheriff Kirk announced that the 100,000
visitor to the jail had occurred on
November 1, 1999.
Commissioner Cauley made the following comments:
a) He announced that there would be
discussion held on the proposal for the
Software Group. The county has a
consultant looking over the bid and
negotiating with the vender.
b) There is continuing discussion on
document imaging and the storage of
documents for permanence.
c) There will be a workshop scheduled on the
23`d for a report by the consultant on the
software of the court system.
The County Clerk made the following comment:
a) She asked all to remember Jackie Brown in
their prayers because she had just lost
her brother.
Commissioner Sims made the following comment:
a) He announced that there would be a joint
meeting with the two cities on Wednesday
November 10`" at the Brazos Center.
b) State Senator Steve Ogden will be here on
Tuesday, November 16, 1999 to receive a
Resolution passed by the County Judge and
Commissioners in Midland.
The Treasurer made the following comment:
a) She announced that the County had earned
$1,731,484.55 in interst.
There was no citizen input and/or concerns.
There being no further business to come before the Court,
the meeting was adjourned.

TERMS AND CONDITIONS
TILE FOLLOWING TERMS AND CONDITIONS GOVERN THE USE OF ALL ONLINE SERVICES PROVIDED BY DATABASE TECHNOLOGIES, INC.
("DDT'). YOU MAY NOT USE SUCH SERVICES, OR THE INFORMATION AVAILABLE; FROM SUCH SERVICES, WITHOUT FIRST ACCEPTING THESE
TERMS AND CONDITIONS.

1. SOFTWARE LICENSE; LICENSE TO USE SERVICES AND INFORMATION; RESTRICTIONS ON USE. For so long as Subscriber subscribes to dw
applicable DDT Services and fully complies with the terms of the Subscriber Agreement, DDT shall make available to Subscriber. Dom time to time, certain software
and modifications and updates to such software (collectively. the "Software") in connection with the Services. In order to access the Information. DBT hereby garus
Subscriber a limited, revocable, nonexclusive, non&arufcmble license to use the Software, and to access and use the Services and the Information, for Internal
research and Investigative purposes only, and not for resale, for the uses specified by Subscriber in the Subscriber Qualification Process. Subscriber may make one
copy of the Software for backup or archival purposes, provided that Subscriber duplicates on such backup copy the copyright notice and other identifying informatioo
on the Software. Subscriber must notify DBT in writing if it wishes to make any additional copies of the Software so that DBT may properly track such Software.
Subscriber may download a portion of the Information to a storage device for the purpose of printing Reports. Subscriber shall not sell, copy, reproduce or transfer the
Information in bulk or resell the Reports. Subscriber shall not provide access to the Services to any other party. In using the Services and the Information, Subscriber
shall comply with all applicable federal and state Is" and regulations, including, without limitation, any reporting or use requirements under the FCRA to the extant
applicable. If Subscriber breaches these provisions, DBT may terminate Subscriber's access to the Services and Information and seek an injunction and any other
available relief against Subscriber. DDT reserves the right to restrict Subscriber's access to certain portions of the Services and Information.
2. DST INTELLECTUAL PROPERTY; RIGHT AND TITLE. The Software and copyright to the printed information supplied by DBT and the reports
provided to Subscriber by DDT containing search results of the Information (the "Reports") are and shall remain the intellectual property of DDT and its third party
suppliers. Subscriber may print a copy of the documentation from the Software only for its own use for the sole purpose of operating the Software. Subscriber
acknowledges that the Software, the Services, the Information and the Reports are proprietary to DBT and contain copyrighted material, trade secrets and proprietary
information owned by or licensed to DBT. Subscriber shall not deenmpile, reverse engineer, discs•.cmble or otherwise reduce the Software to human readable form.
Subscriber may not modify, rent, lease, loan, or distribute copies of the Software. Subscriber may not create derivative software based upon any trade secret or
proprietary information of DBT. Subscriber acknowledges that the license set forth herein is not a sale of DBT intellectual property and that DBT and its suppliers
continue to own all right, title and interest in and to the Software. Services, Information and the copyright to the Reports, including but not limited to all rights under
applicable intellectual property laws. Subscriber shall use the Services. Information and the Reports consistent with such right, title and interest of DBT. Subscriber

4. USER IDENTIFICATION; INQUIRY LOG. Subscriber shall maintain the confidentiality of its assigned user identification numbers for the Services and
shall be responsible for all charges incurred under such numbers. Each of Subscriber's authorized users shall be assigned a unique user identification name or number
("ID"). The name of each user associated with each ID shall be provided to DBT. Subscriber shall insure that no ID assigned to Subscriber's account is used by more
than one Individual and that users do not otherwise share IDs. Unless Subscriber is a duly constituted law enforcement or government agency. DBT reserves the right
to maintain and, for any legitimate reason, review logs containing any inquiry details and other activities performed by Subscriber.
S. INTELLECTUAL PROPERTY INDEMNITY DBT shall Indemnify, defend and hold Subscriber harmless from and against any and all claims, losses, costs,
damages and expenses (including attorney's fees) (collectively "Losses") to the extent arising out of any claim by any third party that the Software violates such
party's copyright, trademark or other U S. intellectual property rights.
6. INDEMNITY. Except to the extent (i) provided in Section 5 above or (ii) arising out of the gross negligence or willful misconduct of DBT. Subscriber shall
indemnify, defend, and hold DBT harmless from and against any Losses resulting from claims by third parties arising out of Subscriber's use of the Services or the
Information.
7. LIMITATION OF LIABILITY. Subscriber acknowledges that DDT relics on others, including the compilers and reporters of public records. In providing the
Services and the Information. THE SERVICES AND TIIE INFORMATION ARE PROVIDED 'AS IS' AND 'AS AVAILABLE'. WITHOUT WARRANTY,
EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR
PURPOSE. Neither DBT nor any third party source of any Information shall be liable to Subscriber (or to any person or entity claiming through Subscriber) for any
damages arising from or caused in whole or In part from (i) errors or omissions in the Services or the Information, (h) any interruption in the Services'. (iii) DBT's or
any third party source's negligent acts or omissions in procuring, compiling, interpreting, reporting or delivering the Information, or (iv) otherwise in providing the
Services. Notwithstanding this paragraph, in the event that DBT or any third party source shall be found liable for any damages for any reason relating to Subscriber's
use of the Services or the Information, the appropriate measure of such damages shall be the cost paid by Subscriber for the Services and the Information specifically
rebating to such loss.
0. NO CONSEQUENTIAL DAMAGES IN NO EVENT SHALL DDT OR ANY THIRD PARTY SUPPLIER TO DDT DE LIABLE FOR ANY INDIRECT,
SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, EVEN IF DDT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. EXCUSABLE DELAY. The availability of Services and Information Is subject to interruption and delay ("Excusable Delay' due to causes beyond DDT's
reasonable control. DDT shall not be liable to Subscriber for any Excusable Delay.
10. ADVERTISING. Neither party shalt use, in any advertising, sales promotion, publicity or other public or media communications, any trade name. trademark.

11. PVRCIIASE ORDER. If Subscriber's purchase order is used in conjunction with this Agreement, the terms and conditions set forth in this Agreement are
made a part of and govem in the event of any conflict with the terns of such purchase order.

XP at the rate of 5100 per month, for a period of one year, subject to the conditions set forth in Paragraph 3

SPECIAL CONDITIONS:
The flat rate would not apply to copies of "Premium Reports" which consist of (1) National and Florida
criminal records and motor vehicle accident reports (MVRs), and (2) Experian Business Reports. The Premium
Report options can be turned off to prevent access from the menu if you desire. If you require Premium
Reports they will be billed in addition to the flat rate price.

CONSULTING AGREEMENT
THIS AGREEMENT dated the 256 day of October 1999, by and between Ben Sanford & Associates,
Inc., hereinafter referred to as CONSULTANT, and Brazos County, Texas, hereinafter referred to as
CLIENT.

WHEREAS, CLIENT is desirous of obtaining advice, counsel and assistance in the definition and
solution of certain telecommunication problems it has now, or anticipates in the future, encountering; and
WHEREAS, CONSULTANT possesses the experience, expertise, familiarity with the industry and
capacity to fulfill said need of CLIENT, and is willing to assist CLIENT as herein described for the fee
set forth;
NOW THEREFORE, for and in consideration of these premises, the mutual promises and covenants

This report is made in accordance with provisions of Gov.Code 2256, The Public Funds Investment Act,
which requires quarterly reporting of investment transactions to the Commissioners' Court.
The Brazos County Investment portfolio earned a weighted average yield of 5.258% for the quarter
ending 09-30-99. The weighted average maturity of the invested funds was 56 days for the total
portfolio. This average included the one-day to two-day availability of the funds that were invested with
TexPool. At quarter end, Brazos County had an investment cost of $25,796,830.98 that carried a book
value of $25,977,326.80. Total interest deposited for the quarter was $125,389.14 bringing the year-end
investment interest income to a total of $1,471,703.15.

As noted in the Quarter Ending 06-30-1999 Investment Report and in a July memorandum to the
members of the Commissioners Court, the Investment Advisory Committee has strongly recommended
extending investment maturities to establish a ladder of 2-year maturity dates occurring at 6-month
intervals. To initiate this ladder, Brazos County purchased a $3,165,000.00 Federal Home Loan
Mortgage Corporation Discount Note that will mature in June of 2000. We will continue this strategy as
investments mature and as tax monies for 2000 are collected in December, January and February. The
Investment Advisory Committee had discussed the possibility of revising the Brazos County Investment
Policy to allow for the investment of certain funds, such as the Tobacco Settlement monies, beyond the
2-year maximum to gain an increase in yield. At the July 6, 1999, meeting of Commissioners Court, the
County Health Endowment Funds was established with the Tobacco Settlement funds, and the Court
voted to maintain the 2-year maximum maturity for the investment of these funds. All funds are invested
utilizing strategies designed to provide for the safety of principal first and the suitability of each individual
fund while earning the best possible interest rate available.
